Chairman Fisher opened citizen input.
Barbara Allen spoke to the board. She expressed concern about marijuana in Eagle County. She felt it was
obvious that the drug Czars were calling the shots and in control of the interpretation. She felt it would either be
families or pot. She visited schools and churches and the Vail Valley Foundation. They all felt they couldn't say
anything because it was too political. The county did not want this to become a pot capital of Colorado and the
schools were interested in what was going on. Ski areas and developers were worried about families. Vail
probably won't receive any of the tax funds as they were considered a wealthy county in the school funding
calculation. She spoke about the traffic. She showed a map of Edwards, five miles by two miles in size. She
checked on traffic with Colorado Department of Transportation. There were already 20,002,000 vehicle trips and
with 2%more due to marijuana businesses there would be 400,000 trips added. She provided several support
documents about the destructive elements of Marijuana.
Commissioner Ryan stated that the board would have discussions about social clubs in late December.
Jeff Layman the Eagle Vail Community Manager spoke. He spoke about their community grant
application. They finished a year-long planning process for their 6 parks. The park and pavilion were regional
amenities and attracted people from all over the county and the state. The grant process identified community gaps,
strengths and alignment with board priorities. Eagle County had developed a jewel of a park in Edwards. Eagle
Vail wanted to build on that vision by creating new and different experiences in its parks. They had many strong
ideas of how to enhance the outdoor areas. He added that Eagle Vail was one of the first metro districts in the state
and the county. On behalf of the users of the park they are asking for financial help.

majority of the money raised goes to the school and in the past they have given$10,000 each year.
Mr. Stephens stated that they have provided trophy cases and new glass and frames for historic class
pictures.
Commissioner Chandler—Henry commended them for their work as an Eagle Valley Alumni.
Mr. Stephens indicated that tickets were still available.Town of Eagle and Town of Gypsum offices had
tickets for sale.
Ms. Darrough stated that Citadel Security would manage the drinking age and potential over-drinking.

DESCRIPTION:
The applicant has applied for the transfer of a Hotel and Restaurant liquor license and is requesting a
Temporary permit to allow them to operate during the period in which the application to transfer ownership of the
license is pending. The applicant has submitted all of the required documents and associated fees for the transfer.

STAFF FINDINGS:
1. The premises where the alcoholic beverages will be sold have been previously licensed by the State and
Local Licensing Authority,and were valid as of the date of receiving the application.
2. The applicant has applied on forms provided by the Department of Revenue and includes the name and
address of the applicant,the names and addresses of the president,vice-president, secretary and
managing officer,the applicant's financial interest in the proposed transfer, and the premises for which
the Temporary Permit is sought.
3. A statement that all accounts for alcohol beverages sold to the applicant are paid has been filed.
4. The application for the Temporary Permit has been filed no later than thirty(30)days after the filing of
the application for the transfer of ownership and the appropriate fees have been paid.
DISCUSSION:
Ms. Scriver explained the request. The owner already has three businesses in the same Edwards Corner;
Eat,Drink and Cut. The owner was moving into the space previously occupied by the Lost Cajun restaurant.
Ms.Forrester explained that she held several liquor licenses in the state in addition to those in Eagle
County. She has never had a violation and was a certified TIPS trainer. The concept was street tacos with table
service, and organic and local products would be the focus. They believed this quick and casual idea would be
attractive to families and millennium generations.
Chairman Fisher applauded Ms. Forrester's history in the area and for doing such a quality job.
Commissioner Ryan moved that the Local Liquor Licensing Authority approve the issuance of a
Temporary Permit to Tacolicious, Inc. d/b/a Tacolicious which will be valid until such time as the application to
transfer ownership of the license is granted or denied or for one hundred twenty(120)days,whichever occurs first;
except that, if the application to transfer the license has not been granted or denied within the one-hundred-twenty
day period and the transferee demonstrates good cause,the local licensing authority may extend the validity of said
permit for an additional period not to exceed sixty(60)days.
Commissioner Chandler Henry seconded the motion. The vote was declared unanimous.

21. Resolution 2013-115 Adopting a Fifth Supplementary Budget and
Appropriation of Unanticipated Revenues for Fiscal Year 2013, and
Authorizing the Transfer of Budgeted and Appropriated Monies between
Various Spending Agencies

Mr. Lewis explained the request. He added that nothing could be spent in county dollars unless previously
approved by commissioners. The county continued to hold the line on expenses and this request consisted of

unanticipated expenses or new grants to be spent in other areas. Even with the supplemental the county was still
ahead of revenue less expense projections for the year. He explained the funds that would be impacted.
He spoke about the donation to Animal Services in the amount of around$2000.00. There are some E-
recording funds to be spent on related equipment to support E-recording. The remaining balance was comprised of
the purchase of several printers in the amount of$24,000 and there had been much work in appeals processes. The
attorney and the assessor worked hard on these appeals and some of the fees were for fees to support these efforts.
There was an additional$3000 in ballot costs,recruiting needs in the amount of$5000 and some funds for fire-
fighting services provided. In the Social Services funds they have received additional funds from the state. He
detailed the way in which these funds were proposed to be used. Roaring Fork Transportation would benefit due to
an increase in unanticipated sales tax collection. They would receive an additional$40,000 and$3000 for trails.
The Airport Fund was related to fuel for resale and sign making equipment. The 800 Megahertz fund would like to
purchase the tower from the airport. They have the money and were simply asking for the appropriation. The
Housing Fund and Operations fund also had requests. The Open Space Fund was asking for appropriations for
fencing and repairs around previously purchased properties. The Capital Improvement fund was asking for
approximately$23,950. This included 3,950 for the compliance report done on the maintenance center and 20,000
as contingency for the Clerk and Recorder remodel project. The Justice Center was asking for funds to satisfy
certain compliance requirements. Landfill fund was asking for money for the scale house.
Ken Whitehead spoke about the Scale House. They discovered that there was extensive mold in the old
Scale House and was on schedule to be replaced in the near future. They looked at all options and building a
permanent Scale House was the best solution, improving customer service and safety.
Mr. Lewis stated that the Fleet Fund was asking for money for funding for additional repairs. The
Insurance Reserve Fund needed additional funds for Worker's Compensation and Casualty.There was a request to
boost the budget amount for the Health Insurance Fund. They anticipate the amount requested may actually be
more than needed.
Chairman Fisher spoke about Health Insurance and wondered about the previous trend of cost reductions.
She felt that having reserves was important because these expenses could fluctuate at any time.
Lisa Ponder spoke to the board. They want to be proactive and careful to be sure that budgeted expenses
were not exceeded. As of November the budget was still tenable and the expenses were still less than budgeted.
She felt the approach was quite conservative but prudent. Large claims were particularly high this year and were
things that the wellness program won't prevent. The wellness program was reducing things like Obesity arid
Diabetes.
Commissioner Chandler—Henry thanked the directors for their diligence in sticking to the budget and
holding expenses.
Commissioner Ryan moved to approve the resolution adopting a fifth supplementary budget and
appropriation of unanticipated revenues for fiscal year 2013, and authorizing the transfer of budgeted and
appropriated monies between various spending agencies.
Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous.

Mr. Whitehead spoke about the remodel contract from Evans Chaffee construction. He explained the hard
costs and requested contingency funds. As such he asked for approval of the contract.
Teak Simonton stated that the remodel would accomplish many things; it would create additional office
space and provide for a buffer between the front office functions and the back office functions.
Commissioner Ryan moved to approve the fixed bid construction agreement between Eagle County and
Evans Chaffee Construction Group,Inc. for the Eagle County Clerk&Recorder's Office Remodel.

22. Resolution 2013-116 Regarding the Matter of the Adoption of the Budget and
the Making of Appropriations for the County of Eagle, State of Colorado, for
Fiscal Year 2014

Mr. Montag stated that as they prepared the budget they focused on the strategic priorities. Some
of the challenges were loss of revenue. He spoke about the leveling out of property values,but the fact that
increases would not be seen until 2016. Other fees were rebounding,but slowly. Interest income had
decreased over the past 4—6 years. It was hoped that these rates would increase going forward. Sales
taxes had increased and some of these funds were realized by the county. There was a financial advisory
board that was used to provide information and validation. Inflation would cause increases in expenses.
He thanked the Elected Officials and Directors for holding the line and being responsible. The county
budget was healthy and in good shape.
Mr. Lewis provided some 2014 assumptions. They initially forecasted a greater reduction in
property values, in an amount of around 4.7%.
Chairman Fisher asked for clarification on property values. The changes would come
incrementally over time.
Mr. Lewis felt there could be a 6%increase in several years in property values. Sales tax has
increased 7% in the past year and 4%is budgeted for 2014 increase. Licenses,Permits and Fees were
decreasing by$150,000 due to Treasurer's fees not being collected on certain property taxes. Opportunities
for investment are limited. There had been some staff increases. Expenses had increased by 6.6%,
excluding community block grants. In 2009 there was close to$40 million in revenue and expenditures
were$42 million. These expense numbers had decreased by about 7.3%. He presented information about
fund balances and the expected$14 million for 2014 and 2015.
Mr.Hyatt spoke about all funds. He explained the increases. In all cases in which spending
exceeded revenue it was due to capital funds in use.
Mr. Lewis added that the detailed budget presentation was on the website.
Chairman Fisher thanked the elected officials and department heads. She spoke about the"Open
Record"program allowing transparency into all county expenditures.
Commissioner Chandler Henry suggested that people look at the many partnerships in play within
the budget and the county tried to make good use of taxpayer funds.
Commissioner Ryan moved to approve the resolution regarding the matter of the adoption of the
budget and the making of appropriations for the county of Eagle, State of Colorado, for fiscal year 2014.
Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous.
23. Resolution 2013-117 Adopting the 2014 Fiscal Budget Mill Levy

Mr. Lewis suggested that the mill levy in the amount of$2,572,373,380 as confirmed by Mark
Chapin, County Assessor. They proposed that the mill levy remain unchanged at 4.924,Road and Bridge
1.720, Social Services .240, Capital Improvement .061, Open Space fund 1.5,Insurance Reserve Fund
.054, combined was 8.499 mills for fiscal year 2014.
Commissioner Chandler Henry moved to approve the resolution adopting the 2014 fiscal budget
mill levy as presented.

25. 2014 Eagle County Air Terminal Corporation Budget
Heather Matthews explained the budget. She spoke about the rental revenue from the airlines which were
up a bit from 2013. Rental car revenue was expected to be reduced from 2013,but was still a healthy number. The
ground transportation revenues are expected to be slightly higher. Concession revenue was expected to be slightly
reduced due to the calculation of their profits. Passenger trips had been reduced, so these profit shares had been
reduced.
Gregg Phillips stated that the philosophy of the airport for revenues was to be conservative. If 2014 was
similar to 2013 revenues should be stronger than budgeted. He spoke about overall expenses.
Ms. Matthews spoke about total revenue and the fact that they were budgeted to be slightly decreased.
There was the addition of a Moody's rating fee.
Mr. Lewis spoke about Moody's rating which was important to keep compound interest rates low. The
county currently had an A minus rating which was as good as anywhere in the state.
Bryan Treu stated that ECAT didn't have an A minus rating,but their rating was as good as any other
airport in the state.
Ms. Matthews spoke about the upgraded landscaping projects that were completed last year. Costs had
been reduced by almost$40,000 in the maintenance of the landscaping. Utility expense had been increased slightly
even though changes have been made to improve efficiency with utilities. Non-cash expenses such as depreciation
would be increasing. Overall,the expenses are$3.276 million,a decrease from 2013 and net ordinary income
would be$1.35 million. Overall income for the year was projected to be$1.16 million dollars and would cover all
needs and keeps the debt service ratio at the required level.
Mr. Lewis spoke about how hard the airport administration had worked to make sure all of this worked. He
supported the budget approach and final numbers.
Mr.Phillips spoke about the benefits of being able to accumulate funds for future capital improvements at
the airport.
Mr. Treu stated that the corporation was created to fund and constructs the terminal in order to issue bonds.
It was simply a funding mechanism for the airport.
Ms. Chandler—Henry added her thanks and appreciated the investment in the airport by the county and
airlines.
Chairman Fisher wished great success to the airport staff and winter travelers visiting the County.

DISCUSSION:
Ben Gerdes provided some background. The first hearing was held on October 1, 3013 and a site visit on
October 21, 2013. The applicant was seeking a dual access, emergency vehicle turnaround and a variance from
minor road improvement standards. He presented the standards and explained that the necessary finding was the
balance of the hardships to the applicant of not granting the variance against the adverse impact on health, safety,
and welfare of persons affected,and the adverse impact on the lands affected.
Ms. Ayres-Oliver explained what the board had the ability to weigh in on the development or the quality of
the access road because of the language of the Land Use Regulations. In terms of the adverse impact, it was a
limited review. The boards review was limited to adverse impacts related to the variance request. The applicant
had a right to construct a paved access road to the property now as long as they met the driveway standards.
Dominic Mauriello summarized the proposed variances. This was the first step in many for the applicant.
The applicant had taken measures within the development itself that were tied back to the variance to prove that
they'd made a single access a safe access. The request would provide the property owner with safe year around
access to their property. They tried to mirror the county road standards as much as possible. The county staff and
Fire District believed the proposed single roadway was safe with a mitigation plan proposed. Compared to the
other developments in the area,this was a low density project. The existing road bed was dirt. In terms of road
design it would follow the existing roadbed as much as possible and would be paved. The road connected to
several Forest Service roads along the way and would allow for public use and enjoyment of adjacent hiking trails.
The road would provide fire truck turnarounds and parking in logical locations. The road would limit negative
affects to wildlife. Based on a proposed roadway and plan for 19 home sites,the road was required to be paved by
the Eagle County Land Use Regulations and would provide for safe two-way traffic and safe reliable access. The
new road would have some impacts to recreation but the road would continue to allow for mountain bike and
pedestrian access. If there were to be horses present they would be housed in a single equine facility that would be
professionally managed with a strict focus on fire safety and evacuation. He spoke about the hardships effecting
the applicant and changes in the requirements dealing with dual access. The variance was needed and not granting
the variance would create greater environmental impact and would be depriving the owner of reasonable access and
use of their property.The applicant proposed 9 conditions of approval that addressed fire,density, open space,
public access,landscaping,horses, livestock,pets,wildlife, and fencing.

Chairman Fisher opened public comment.
Gail McFarland with the Eagle River Fire Protection District spoke. She and Chief Bauer discussed the
situation and they preferred a dual access road.
Commissioner Ryan asked Ms. McFarland if she believed the road was safe.
Ms. McFarland was unable to say it was safe as she had not had a chance to re-review the proposed land
use development for the property.
Mr.Mauriello spoke about a letter from Chief Bauer agreeing with Eric Lovgren's findings. He believed
that the mitigation plan was one Chief Bauer could stand behind.
Commissioner Ryan spoke about a letter submitted by Eric Lovgren which indicated that there was still a
risk having a lack of dual access. She wondered if the residents and/or guests would be at a greater risk than the
residents of Cordillera or other developments. She asked if the road would be wide enough for an emergency
vehicle and other car to pass safely.
Ms.McFarland believed that having a shelter in place was one step ahead of certain other developments
within the district.
Chris White with Anchor Point Group spoke. He understood why the Fire Chief would prefer a dual
access. They attempted from day one was to develop an alternative method of compliance which was equivalent or
would exceed the standard. The applicant was not going with a minimal approach;they wanted the development to
be a sustainable and safe community.
Commissioner Ryan asked about fuel reductions in certain areas of the road.
Mr.White stated that they would mitigate the fuels if the Forest Service allowed or provide areas where
one could stop adjacent to those areas.
Commissioner Chandler-Henry shared the concerns about fire safety and fuel reductions. She asked about
the wildlife mitigation plan and whether removing fuel for wildfire would adversely affect wildlife. She asked if
there was a winter closer in place currently.
Ms.Ayres-Oliver stated that the board could consider wildlife impacts but it had to relate to the variances.
Rick Thompson with Western Ecosystems spoke. He had not looked at the impacts of considered fuel
reduction.
Commissioner Ryan wondered if the trips per day were significant enough to produce more animal/vehicle
collisions.
Mr. Gerdes could not say.
Mr. Thompson stated that he did not have the specific numbers on hand. The Mountain Star subdivision
was a much larger development on similar acreage than what was proposed. The documented road kills were
minimal.
Chairman Fisher opened public comment.
Kim West,resident of 1120 Beard Creek Road spoke. She expressed concern with the engineering of the
existing Beard Creek Road and the increased usage. She believed that there would be a huge impact to wildlife.
Chairman Fisher closed public comment.
Commissioner Chandler-Henry understood that the board was not deciding on the 19 homes and accessory
dwelling units. She believed a single access road would have less of an impact to recreation and wildlife. She did
not see any legitimacy to the argument that the owner was prevented from using his property. Fire was a concern
and she was only 90%comfortable with the safety of the road if there were to be a wildfire. The Forest Service
was really the entity that would be reviewing the big picture. With the constraints there were to consider, she was
leaning towards a motion of approval.
Commissioner Ryan appreciated the summery giving by Commissioner Chandler-Henry. She believed a
paved road would have impacts to wildlife. The fire mitigation plan was extensive.
Commissioner Chandler-Henry stated that she would support a tabling to get more clarification on the fire
aspects.
Chairman Fisher stated that she understood the position of the property owner but did not feel a comfort
level. She would deny the request at this time unless the other board members recommended a tabling to get
additional information.

Ms. Ayres-Oliver believed it was important for the board to focus on the balancing of the hardships.
Considering future homeowners or the community at large should not factor into the decision.
Chairman Fisher stated that at this point in time the applicant had access to their property and there was no
obligation to the applicant.
Ms. Ayres-Oliver stated that the applicant was asking for variances to the road improvement standards and
asking the board to make a determination on those. The board had an obligation to make a decision based on the
application presented today. The board did not have the opportunity to focus on consistency with the
Comprehensive Plan, compatibility with surrounding land uses or the development of the parcels.
Commissioner Ryan requested a 10 minutes recess to review her notes.
Mr. Gerdes spoke about an email received from Eric Lovgren regarding the application. The email
indicated that he generally concurred with the Anchor Point Group. The mitigation efforts that they designed met
or exceeded what a dual access on its own might provide.
Ms. Ayres-Oliver stated that Mr. Lovgen indicated in the email that he was good with the provisions laid
out in the Anchor Point plan as conditions of approval in lieu of dual access.
Ms. McFarland clarified that as a Fire District they would always prefer dual access but Anchor Point had
provided something they could work with.
Commissioner Ryan read the comments made by Chief Bauer and Eric Lovgren and came to the same
conclusion that there were no absolutes. She believed that the proposal was proactive. She was comfortable with
the standards 1 and 3. She asked about the emergency turnouts and fire suppression.
Mr.Mauriello indicated that they would be comfortable with a condition to meet any concerns.
Commissioner Chandler-Henry had no additional questions.
Chairman Fisher stated that she was still challenged but would entertain a motion to approve, deny or table
the file.
Mr. Gerdes stated that staff recommended 7 conditions:
1. Except as otherwise modified by this Variance approval, all material representations made by the Applicant
in this application and in public meeting shall be adhered to and considered conditions of approval.
2. The applicant shall incorporate the road improvement and construction recommendations provided by the
Eagle County Wildfire Mitigation referral response dated September 9, 2013
3. The applicant shall provide a debris and mudslide analysis as part of a drainage study at the time of
Grading Permit application to size all culverts and/or bridges designed for the access road.
4. The Applicant will be responsible for all applicable permitting necessary to develop the proposed lots
including,but not limited to,building permits, grading permits, etc.
5. At the time of Grading Permit application the Applicant shall have approval from the USFS of the
necessary easements for construction of the access road alternative presented in this Variance application
prior to Grading Permit application.
6. Road design shall incorporate minimum spiral curve lengths where possible and consider use of simple
tangent curves at locations with little tangent deflection.
7. Road Design shall include alternate switchback design(Alpine Engineering, 2010)that provides the
necessary stopping sight distance between curves.
There was also a possibility that there could be restriction's placed on the applicant by the Forest Service.The
applicant would have to come back for a grading permit. The approval was specific to the design presented today.
Commissioner Chandler-Henry stated that she respected and valued the board resolution 2009-115
regarding strict adherence to the Land Use Standards as it was a critical issue.
Commissioner Chandler-Henry moved to approve the request for a variance to the requirement of dual
access with 7 conditions as presented by staff.

In 2010-2011,the Applicant applied for a Special Use Permit and Finding of No Significant Impact(FONSI)to
recognize a pre-existing single-family residence,constructed in 1973,to remain as a legal use in the Commercial
General Zone District. The home was constructed prior to zoning being applied to the subject property in 1974;the
residence has been non-conforming in terms of zoning ever since.
During the 2010—2011 Special Use and FONSI process, some extraneous uses of the property were identified by
adjacent property owners and a staff site visit. As a condition of the Applicant's requests during the 2010-2011
Special Use Permit and FONSI,the uses of the property were required to be brought into conformance with the
provisions of the Commercial General Zone District and other regulatory requirements.The Applicant is requesting
the following uses be allowed:
Seasonal plant sales,
• Christmas tree sales,
• Taxi storage,
• One plumbing truck,
• One towing truck, and
• Year-round used car sales.
Per the Eagle County Land Use Regulations, each of these uses in the Commercial General Zone District requires a
Special Use Permit approval. Also, since a majority of these uses occur within the 75 foot stream setback,the
Board of County Commissioners has the ability to amend stream setbacks through the Special Use Permit process.

III. CHRONOLOGY/BACKGROUND:
1973: Existing residence constructed .
1974: Eagle County adopted and implemented zoning for all unincorporated lands.
1987: Subject property platted for first time.
1998: Subject property part of an amended final plat.
2000: Subject property defined in its current configuration via amended final plat.
2010: Property owner discovers that the existing single-family residence has been considered legal non-
conforming by Eagle County since 1974;thereby making it impossible to refinance the residence

1) A land use regulation amendment to eliminate the 33%cap on residential development in
the Commercial-Limited and Commercial-General zone districts, subject to Special Use Permit

2) A Special Use Permit to recognize the existing single-family residence located in the
Commercial-General zone district as an allowed use.
3) A Finding of No Significant Impact for a stream setback variance request to vary the
setback to 50 feet where 75 feet is required by the land use regulations. The existing residential
structure is situated 50 feet from the high-water mark of the Eagle River and outside of the 100
year floodplain.
Land Use Regulation Amendment and Special Use
The Board of County Commissioners approved the proposed land use regulation amendment and
the companion Special Use Permit to allow 50%of the existing residential structure to be utilized
as a residence and the other 50%to be utilized for professional office space.
Finding of No Significant Impact
The Finding of No Significant Impact(FONSI) application was originally tabled to and
subsequently approved on August 23rd, 2011,to allow a stream setback variance of 50 feet subject
to the following conditions:
1. Except as otherwise modified by this development permit, all material representations made
by the Applicant in this application and in public meeting shall be adhered to and considered
conditions of approval.
2. In the event that the existing structure is damaged by less than fifty(50)percent of its actual
value(as determined by the most recent County Tax Assessor's role), it may be repaired and
reconstructed and used as before the time of damage,provided such repair and reconstruction
is substantially completed within twelve(12)months of the date of damage.
3. The replacement structure may encompass up to the same habitable floor area as the existing
structure.Per the Eagle County Assessor's Office,the existing structure is 3,685.30 square
feet, excluding the garage;
4. The replacement structure may be constructed up to the 50 foot stream setback as approved by
this Finding of No Significant Impact.
5. Less than or equal to 50%of the replacement structure's footprint may be constructed
between the 75 foot stream setback and the 50 foot stream setback as measured from the high
water mark.
6. In no event shall the total amount of the replacement structure's footprint constructed between
the 50 foot and 75 foot stream setback exceed the total square footage by which the existing
structure's footprint encroaches into the 75 foot stream setback.
7. This Finding of No Significant Impact approval for a stream setback variance is applicable
only to the existing structure. It is understood that any future commercial or mixed-use
development of the subject property will necessitate the appropriate land use approvals.
IV. REFERRAL RESPONSES:
Eagle County Engineering Department: In the attached response dated,January 28,2013,Eagle County
Engineering reviewed the information presented during the re-referral and has no comments on the
additional information provided. The November 26, 2012 comments still apply and are provided below:

Eagle County Engineering has reviewed the information provided by the Applicant on February 21, 2012
with the understanding that the Eagle County Land Use Regulations now allow the BoCC to approve a
variance to the 75-foot stream setback that is not limited to a 50-foot stream setback.
The Applicant is requesting a variable stream setback as defined by Exhibit A of the submitted information
with a minimum setback of 10-feet. This setback would not impact the defined floodplain(see attached).
During the summer of 2012 the Applicant constructed a berm adjacent to the river. This berm should
provide some protection in preventing plowing of the parking lot into the river. In addition,the berm
provides some visual relief from the property owners across the river.
The berm was seeded and protected with erosion mat. However,the Applicant will need to continue to
work to minimize weed growth until the native vegetation is established.
ECO Trails: As part of the 2010-2011 Special Use Permit and FONSI process, ECO Trails requested a 15
foot wide trail easement to accommodate the future route of the Eagle Valley Core Trail through Edwards,
connecting to the Eagle River Preserve. The final trail design will accommodate and not block the access
driveway to the residential property. This easement has not been provided yet,therefore it is a condition of
approval on this file as well.
Eagle County Department of Environmental Health: Adam Palmer reviewed the special use application
for plant sales/storage,taxi storage,used vehicle sales and Christmas tree sales on the subject property. As
part of Eagle County's commitment to preserving the health of the natural environment and protecting air
and water quality,there is particular sensitivity to uses near live rivers and streams, including surrounding
riparian areas. While some of these areas have already been altered or impacted from past uses,there exists
an opportunity to not only reduce impacts from future uses,but mitigate previous impacts as well through
implementation of best management practices along the Eagle River. To this end,Adam had the following
comments:
• "A detailed plan showing the retention and treatment from vehicles being washed/maintained on
the property is recommended in order to protect the adjacent riparian area and water quality of the
Eagle River. In addition,the Sustainable Community Index recommends best management
practices such as bioswales and other natural retention features to reduce suspended solids and
other pollutants for projects within 200 feet of a live stream.
• Please provide a comprehensive list of soils,amendments, fertilizers,pesticides,herbicides and
storage plan for such materials which will be used on the property, as well as spill prevention
control and countermeasures plan. Storage and use of such materials is discouraged in or near
riparian areas.
• While a FONSI was granted in 2011 to recognize the existing residence on the property,
Environmental Health advocates for the protection of Eagle County's riparian areas through strict
application of the stream setback provision which requires that a 75-ft. strip of land on either side
of the high water mark remain in its natural state. Where previous impacts have altered the natural
state in these areas,it is recommended that they be reclaimed and revegetated with native plant
species accordingly.
• A landscape design which provides effective visual screening for the taxi and boat storage is
recommended.
• Please provide proposed comprehensive signage and lighting plan for all of the proposed uses,
either seasonal or ongoing."
The Applicant has provided a written response to these comments.Please see the attached correspondence
dated,February 20,2013.

Edwards Metropolitan District: "The Edwards Metropolitan District reviewed the Fritz Schmidt Special
Use Permit to allow temporary use on the existing parking lot within the 75 foot streamside setback and the
Special Use Permit to allow temporary uses on a seasonal basis.While the District respects Mr. Schmidt's
historical use of his property and recognizes that his site has severe constraints due to the shape and size of
the property,the District would like to express its concern about the manner in which some of Mr.
Schmidt's property is being used particularly where its use is located in close proximity to the Eagle River.
The Edwards Metropolitan District would like to express concern about parked vehicles which are located
in close proximity to the Eagle River.The Board is concerned about how those vehicles may be impacting
the environment of the Eagle River.The Edwards Metropolitan District Board of Directors looks to Mr.
Ray Merry to continue to oversee and enforce County regulations concerning present and future
environmental impacts to the Eagle River."
Colorado Parks and Wildlife: No comments were received back from this referral agency.

the Schmidt property and thinks a Special Use permit is going overboard.

is grandfathered in, due diligence before buying is the responsibility of the buyers,any changes made by
residents in the Old Edwards Estates are the responsibility of that resident,living in the center of
Edwards comes with positives and negatives in regard to the activities of the commercial properties.
3) Tim O'Donnell

In the attached letter dated February 2, 2012,Mr. O'Donnell states he has no complaints with the current
level of use. As long as he(Mr. Schmidt)reasonably respects the interests of adjacent property owners
before making any changes to the use of this property.

In the attached email dated March 26, 2013,Mr. Cooper is concerned about the hodgepodge nature of
the uses,noise and light pollution,and the aesthetics of locating vehicles along the Eagle River corridor.
V. PLANNING COMMISION:
On May 1, 2013,the Planning Commission voted 3 to 1 to deny the project.
At the April 3,2013,hearing,the Planning Commission and Eagle County agencies made the following comments:
• Environmental Health would prefer to see further restoration of the Eagle River Corridor and have the
opportunity to evaluate the feasibility of restoring the 10 foot setback area.

• A Planning Commissioner asked if the dry well and swale were already in place?
o Applicant response: Yes,the dry well and swale are in place.
• A Planning Commissioner asked is the gravel area going to be used for taxi storage or will the
miscellaneous items be brought back, such as boats and trailers?
o Applicant response: No, the boat and trailers will not be brought back. The gravel area will be for
the taxis,The Plant Lady and Christmas tree sales.
• A Planning Commissioner questioned if the lighting for Christmas tree sales is operating. There are
complaints from neighbors concerning the noise of the generator. Can an electrical hookup be installed
outside?There should be a condition that an electrical hookup be installed.
o Applicant response: The lighting will still be there and we can arrange for an electrical hookup.
• A Planning Commissioner made the statement that the dry well is point source pollution and wants a
condition that the dry well be tested on a regular basis.
• Martha Miller from Colorado Department of Transportation (CDOT) made the comment that she is
concerned about water quality and that the parking lot wasn't there 15 years ago. She questioned if there is
an access permit for the site?
o Engineering Department response: The access permit is very general and it could be updated, but
they do have an access permit.
• Martha Miller also stated that the pavement on the east side of the applicant's property and the property has
been changed without permission from CDOT. Ms. Miller was concerned that the total parking count
included the pavement on CDOT's property.
o Applicant response: The parking on CDOT's property has not been counted in the parking totals.
CDOT has every right to take back use of the property.
o A Planning Commissioner asked if CDOT could take the property back?
o CDOT Response: We will wait until the Edwards Access Road expansion.
• A Planning Commissioner stated that the applicant has done some things on the property that has improved
the property. The Eco Trail could be better located. There is better placement for all these uses. This could
have been a great application but by approving this, we are eliminating our ability to make this a better
project.
• A Planning Commissioner stated that the impaired status of the Eagle River cannot be overstated. A dry
well is a direct connection to the Eagle River and is not a protection mechanism from runoff on the site. If
the commercial use of the land was better we wouldn't need to be farming the property out to these
different uses in the parking lot and adjacent to the river which further impacts the river corridor. We can
no longer say that a special use permit can be withdrawn within a couple of years because the impact from
the special use, especially in an area adjacent to the river corridor,has already taken place.
• A Planning Commissioner stated that in the Eagle-Vail Commercial Area Plan, we are trying to clean up
impacts to the Eagle River corridor through mitigation measures during redevelopment. The point being
that 614 miles downstream we are looking at a special use permit to allow just what we are trying to clean
up in Eagle-Vail. We should be consistent in what we're trying to accomplish. This project is an example
of poor planning.
• A Planning Commissioner stated that the whole plan needs a major redo and the Planning Commission
needs a site visit.
• The applicant would not agree to redo the project and would not reschedule the project until June to
accommodate a site visit.
• The applicant requested a vote on the project,but there was no longer a quorum.
• The project therefore was tabled to April 17th for a vote.
At the May 1, 2013,hearing,the Planning Commission and Eagle County agencies made the following comments:
• A Planning Commissioner stated that there are too many proposed uses and issues associated with those
uses on the property. He went on to say the existing design has maximized the commercial opportunities at
the expense of the environmental impacts. All the uses would adversely affect the public's health, safety,
and welfare and the proposed uses do not comply with the Eagle County Comprehensive Plan or the Eagle
River Watershed Plan. The final comment was that the trail alignment should be determined prior to the
project being approved.

• A Planning Commissioner stated that the highest and best use of this property is commercial. While the
parcel was developed with challenges, the environmental concerns are overwhelming. The dry well is a
direct link to possible contaminants in the Eagle River and he would prefer that the dry well be reanalyzed
for water quality and runoff. This project would cause further detriment to the endangered Eagle River. A
condition should be added that would eliminate the ability of the applicant to pave any closer to the river.
VI. BOARD OF COUNTY COMMISSIONERS' OPTIONS:
1. Approve the [SPECIAL USE PERMIT FILE NO.ZS-3521] request without conditions if it is
determined that the petition will not adversely affect the public health, safety, and welfare and the proposed
use is attuned with the immediately adjacent and nearby neighborhood properties and uses and the proposal
is in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle
County Comprehensive Plan(and/or other applicable master plans).
2. Deny the [SPECIAL USE PERMIT FILE NO.ZS-35211 request if it is determined that the petition will
adversely affect the public health, safety, and welfare and/or the proposed use is not attuned with the
immediately adjacent and nearby neighborhood properties and uses and the proposal is not in compliance
with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County
Comprehensive Plan(and/or other applicable master plans).
3. Table the [SPECIAL USE PERMIT FILE NO.ZS-3521] request if additional information is
required to fully evaluate the petition. Give specific direction to the petitioner and staff.
4. Approve the [SPECIAL USE PERMIT FILE NO.ZS-3521] request with conditions and/or
performance standards if it is determined that certain conditions and/or performance standards are
necessary to ensure public,health, safety, and welfare and/or enhances the attunement of the use with the
immediately adjacent and nearby neighborhood properties and uses and the proposal is in compliance with
both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive
Plan(and/or other applicable master plans).
VII. SUGGESTED CONDITIONS:
a. Except as otherwise modified by this development permit, all material representations made by
the Applicant in this application and in public meeting shall be adhered to and considered
conditions of approval.
b. Per the comment letter from Eagle County Engineering, should the seeding on the berm not
establish,the berm shall be reseeded until such time as vegetation is established.
c. The Applicant shall work with ECO Trails to define and convey to Eagle County a fifteen(15)
foot wide trail easement across the subject property for future connection of the Eagle Valley
Core Trail to the Eagle River Preserve. The final trail alignment and design must accommodate
and not block the driveway access to the subject property. The Property Owner shall submit a
legal description for the easement and a survey accurate map to Eagle County for review and
approval by September 30, 2013.
d. Per the recommendation of the Environmental Health Department,the applicant shall submit a stormwater
management plan to Eagle County for review and approval which incorporates Best Management Practices
(BMPs)designed to intercept site drainage for the purpose of keeping pollutants from entering the
groundwater regime.
e. Per the recommendation of the Environmental Health Department,the applicant shall provide Eagle
County with a report generated by a qualified professional experienced in stream bank restoration that
evaluates the feasibility and cost of improving the existing deteriorated stream bank and riparian area.
Implementation of a restoration plan will enable the proposed uses to occur within the 75'stream setback.

f. Should any materials be disposed of in the Eagle River corridor,the responsible party may have
their portion of the Special Use Permit approval revoked after a hearing before the Board of
County Commissioners.
g. The applicant shall not pave within the environmental treatment area up to and around the dry
well.

NECESSARY FINDINGS:
PROCESS INTENT
ECLUR Section: 5-250 Special Use Permits
Section Purpose: Special Uses are those uses that are not necessarily compatible with the other uses
allowed in a zone district, but which may be determined compatible with the other
uses allowed in the zone district based upon individual review of their location,
design, configuration, density and intensity of use, and the imposition of
appropriate conditions to ensure the compatibility of the use at a particular location
with surrounding land uses. All Special Uses shall meet the standards set forth in
this Section.
Standards: Section 5-250.B. The issuance of a Special Use Permit shall be dependent upon
findings that there is competent evidence that the proposed use as conditioned,
fully complies with all the standards of this Section, this Division, this Article, and

Xl-The Plan indicates that growth should be managed toward future sustainability—a healthy balance between
economic success,quality of life and the preservation of the environment and that growth should be appropriately
designed and should be located within or immediately contiguous to existing town and community centers. This
proposal will not result in any additional development potential on the subject property. The uses proposed with
the Special Use Permit request are not increasing the developed area on the property,rather utilizing existing
impacted areas in the commercial center of Edwards.
X2—The Plan speaks to commercial uses should be appropriately scaled and should occur in towns and community
centers. The proposed uses are being located in the existing commercial center and are scaled appropriately for the
site.
X3—Due to the fact that this proposal does not entail additional commercial or new residential development,the
Housing Guidelines are not applicable.
X4—The subject property is served by public water, sewer and roads. The property is immediately adjacent to
existing commercial services. In the previous Special Use Permit and FONSI process,ECO Trails requested that
the Applicant provide a fifteen(15) foot wide trail easement across the subject property to accommodate the future
route of the Eagle Valley Core Trail through Edwards,connecting to the Eagle River Preserve. The final trail
design will accommodate and not block the driveway access to the subject property.
X5—The subject property is served with public water. The Plan speaks to protecting against source water
contamination;the Applicant has built a berm adjacent to the Eagle River to reduce the possibility of contamination
from snowplowing and other activities. The berm has been built with erosion control mat and seeded. Should the
seeding not become established,the Applicant will be required to reseed the berm. Staff is concerned about the
disposal of fertilized dirt and vegetation from the plant business due to observations by Staff of this practice in the
summer of 2012. Staff suggests that should any materials be disposed of near or in the Eagle River,the Special Use
Permit, if it is approved,may be revoked.
X6—Colorado Parks and Wildlife was sent a referral and no comment was received in regards to impacts of the
proposed uses.
X7—The proposed uses avoid areas of significant natural hazard. There are no known historical or archeological
resources on the property.
X8-The proposed uses do not generate any undue ocular,olfactory or auditory impacts which will compromise the
environmental quality of the property or surrounding areas.These uses are already taking place on the property and
this process is memorializing the uses.

In 1981 when Old Edwards Estates received county approval,presumably consideration was given to
potential conflicts between the single family residential development on the north side of the Eagle River
and the existing commercially zoned property on the south side of the river. The Commercial General
designation was assigned to the subject property in 1974.
As of the writing of this report, Staff has received one opposition letter with concerns about noise in
regards to the commercial operation and the other three letters received from the owners of property in Old
Edwards Estates indicate that there is not a compatibility problem with the extraneous uses existing on the
property.

As stated previously,these uses are existing on the property and as a requirement of the 2010-2011 Special
Use Permit and FONSI, the Applicant was required to legitimize the uses. As of the writing of this staff
report, no negative comments have been received about the uses by the adjacent property owners, except
the Edwards Metro District has concerns about the impact of parked cars adjacent to the Eagle River. The
property owner has addressed this concern by working with the Engineering Department after constructing
a berm along the Eagle River then adding erosion control mat and seeding it.
