Resolution 2013-070 Supporting the Acquisition of the Glassier Property Located at 543 Hooks Spur Road, Eagle County, Basalt, Colorado Toby Sprunk, Open Space Mr. Sprunk presented the details of the request. The property had been a historic ranch and could be managed for future agricultural use and possible local food production. The town of Basalt was not able to contribute Open Space funds towards the acquisition but they supported it. The property was visible from Hwy 82, Crown,Rio Grande Trail and nearby federal lands. Trail connections were possible. He provided photos of the area and the historic buildings. The property was 137.45 acres and the county would share the cost equally with Pitkin County Open Space. Mr. Montag asked about the Great Outdoors Colorado(GOCO)grant funds. Mr. Sprunk stated that if any funds were received through the grant process,the money would be split equally between the two counties. He presented the Open Space criteria. Staff and the Open Space Committee's recommendations were"high". The project was consistent with the purposes and intents of the Eagle County Master Plan. The project was compelling due to connectivity to Red Ridge Ranch Open Space and strong partnership with Pitkin County. The project was an important element in the effort to secure key properties. Maintenance costs would be absorbed by Pitkin County. The total request was for up to $3 million dollars; receipt of GOCO funds would reduce the amount. Dale Will,Pitkin County Open Space Director believed that this was a great example of a location where the public interest and protecting the property did not stop or start at the intersection of 3 counties. Pitkin County was interested in protecting the property and the property would be managed to maximize public benefit.The Pitkin County Board of County Commissioners unanimously approved the request. He spoke about the Glassier family and the history of the property. There was an appraisal in the works and a contingency in the contract. The management plan would consider the potential uses for the historic buildings that would benefit the community. Commissioner Chandler-Henry asked about any old septic systems or other potential hazards on the property. Mr. Will stated that he was not aware of anything that was significant. Chairman Pro-Tem Ryan believed the acquisition would benefit the community. Resolution 2013-071 Authorizing any Commissioner to Execute all Legal Documents Necessary for Effectuating the Sale of 1050 West Beaver Creek Blvd., Sunridge Unit #D204, Avon, Eagle County Jill Klosterman,Housing Ms.Klosterman stated that the property was acquired in 2010. It was a property being foreclosed upon by the homeowners association. Eagle County had made two down payment assistance loans. She believed it was in the best interest of the Housing Department and Housing Down Payment Assistance Programs to acquire the property with the intent of selling it and replacing the funds into the down payment assistance loan fund. The property was held until the value went up. The property had been listed and the resolution would allow any of the commissioners to sign any documents associated with the sale of the property. Bryan Treu stated that these types of authorizations were routinely done to avoid any unnecessary delays. Chairman Pro-Tem Ryan asked the amount of the down payment assistance loan. Ms.Klosterman stated that there were two$10,000 loans. If the county had not acquired the property,the$20,000 of down payment assistance would be lost. Commissioner Chandler-Henry commended Ms.Klosterman and the Housing Department for this process. II. BACKGROUND: The property has been owned by the applicant since 1971 whose family has lived in Eagle County since the 1920's. Prior to the ADU and the septic system being destroyed by a fire in 2012, the unit was lived in by the owner's parents and the reconstructed ADU will be occupied by the owner's son in order for him to look after his parents. The proposed unit will be detached from the main home and will comply with setback, height and parking requirements. The property will stay under the ownership of Roy Nolan, the applicant, and will not be further subdivided. Zoning for the property is Resource (R) which allows for 1,800 square foot ADUs as a use by right with lots of 35 acres or greater; however, because the property is 4.99 acres, the property is a legal, non-conforming lot, therefore any ADU request must go through the Special Use Permit process. 26 08/06/2013 Water is provided by the Town of Gypsum and an on-site wastewater treatment system (OWTS) will be installed when the ADU is constructed. The new OWTS will be brought up to current standards and will service both the ADU as well as the main residence. The Eagle County Environmental Health Department has indicated that additional h i information regarding the OWTS is required prior to any building permits are issued for the property. The site is accessed via Gypsum Creek Road and a setback is required from the road. Parking will be available in the new garage constructed specifically for the ADU as well as in the driveway. Staff believes the site complies with adequate access and parking requirements. III.SITE DATA: �j�° p f '( Future Land Use Map The subject property is located outside the Town of Gypsum area in unincorporated Eagle County. The Future Land Use Map (2005) shows the property as w located within the "Countryside" land use Aerial Map designation: Countryside: The Countryside designation includes lands within unincorporated Eagle County which contain low density single family residential development. These lands are characterized by individual homes located in clusters containing a relatively small number of lots. Many of these lots are nonconforming in size, relative to the minimum lot size requirement of the underlying zone district, having been created prior the enactment of subdivision regulations in 1964. The gross density of Countryside development is expected to range from two to thirty-five acres per dwelling unit. Countryside lands provide transition areas between the County's more densely developed areas and its less densely settled rural lands. The clustering of homes is encouraged, with homes positioned on the least impactful portions of the site. Agricultural lands and lands of significant visual, cultural or environmental quality should be protected. Local-serving commercial uses are generally not provided within Countryside developments, although isolated commercial activities permitted by special review may occur when they are compatible with the character of adjacent uses and satisfy all other applicable criteria of the Land Use Regulations. Public facilities such as schools are also not typically located in developments designated Countryside. Rather, Countryside areas rely on nearby Community Centers or Rural Centers to serve their daily needs. Development on Countryside lands is typically serviced by on-site or small community water supply and sewage disposal systems. Surrounding Zoning: Resource.The purpose of the Resource zone district is to maintain the open rural character of Eagle County and to protect and enhance the appropriate use of natural resources and agricultural uses in the County including water, minerals, fiber and open land. The following section references the comments of all agencies that submitted an official referral response to Eagle County prior to the date of this report: Earle County EnRineerinn: -The Eagle County Engineering Department had no comment during the referral period. Earle County Environmental Health Department: - "An Onsite Wastewater Treatment System permit must be submitted prior to building permit issuance. As part of the OWTS criteria is demonstration of a viable alternate septic tank location; please provide a detailed site plan showing proposed location and alternate location for the septic tank." - "If the OWTS is separate from the existing primary residence, on the site plan please demonstrate a viable alternate site for the existing septic tank as well." Since the hearing before the Planning Commission on July 3, 2013, these conditions have been met by the applicant. Town of Gypsum - "The town approves the ADU currently proposed as the replacement for the previous mobile home that burned down last year.I can also confirm that the town does provide water service to the property as well." - "If the replacement ADU will be located in the general location of where the previous mobile home was it should be okay,but we request that a 25' setback of the structure be provided off of Gypsum Creek Road." o Note: Per Eagle County Land Use Regulations, any structure is required to be setback 50 feet from Gypsum Creek Road therefore a condition wasn't added to the staff report. Colorado Parks and Wildlife: -"The CPW(Colorado Parks and Wildlife)has no comments but thanks for asking." Holy Cross: -"Holy Cross has no concerns with this application,provided that all NESC clearance are met both during and after construction." V. SUMMARY ANALYSIS: 28 08/06/2013 The proposed special use to allow for an Accessory Dwelling Unit is in general conformance with the Eagle County Comprehensive Plan and the Eagle County Land Use Regulations. The Applicant has provided adequate evidence that the use can be served with public water and, with additional information from the Applicant regarding the OWTS, staff believes the site can be adequately served by wastewater services. Staff has identified no further issues or areas of non-conformance requiring additional analysis or dictating conditions of approval. From the standpoint of compatibility, staff believes the proposed use is compatible with the surrounding residential structures and uses in the area. Specifically, staff believes the ADU use will be provided adequate access, parking and facilities(similar to other residential uses in the area). Public notice was provided and staff has received no comments from adjacent property owners or other residents of the area concerning the request. VI. PLANNING COMMISSION At their regularly scheduled meeting of July 3, 2013, the Eagle County Planning Commission provided the following comments: • A Planning Commissioner suggested that the propane tank shown in the pictures be screened or buried for aesthetic reasons. • The other Planning Commissioners disagreed with this requested because they believed the request would create an unnecessary expense on the applicant and was not germane to the request. • A member of the Gypsum Fire Protection District (GFPD) was in the hearing room to speak on behalf of another file and the Planning Commission requested his input on burying or screening a propane tank. The GFPD officer stated they would rather not have a propane tank buried since they won't know precisely where it is located in case of an emergency and screening the propane tank requires a 15 foot clearance on all sides which consumes a large portion of the buildable area on the lot. • The Planning Commission voted to approve the project with no additional conditions. The motion passed 4-0. VII. SUGGESTED FINDINGS: Staff suggests the application meets the following findings necessary for the approval of any Special Use: (1) Consistent with Comprehensive Plan. The proposed Special Use IS in substantial conformance with the Eagle County Comprehensive Plan, Area Community Plans and any applicable ancillary County adopted documents pertaining to natural resource protection, affordable housing, or infrastructure management. The proposed Special Use DOES comply with all standards imposed on it by all other applicable provisions of these Land Use Regulations for use, layout, and general development characteristics. VIII. DISCUSSION: 34 08/06/2013 Ms. Valdez stated that this was a straightforward request to replace an accessory dwelling unit destroyed in by a fire. The permit approve was needed because the property was zoned resource. There were 2 parking spaces for the ADU available on the property. The town of Gypsum water served the property. The town of Gypsum requested that the unit be setback 25 feet. The request was consistent with the comprehensive plan and the use was appropriate for the proposed location. The Division of Wildlife had no concerns. The septic system issues had been addressed. The Planning Commission voted to approve the request with no additional conditions.. All the adjacent property owners had been notified and no responses had been received. Staff suggested that condition 2 and 3 be removed, as they had been satisfied. Pete Nolan was present. For various reasons,the Timber Springs Home Owner's Association now desires to create the Timber Springs Metropolitan District for the purpose of: ensuring reliable revenue streams; providing for the repair,maintenance and replacement of public infrastructure, inclusive of roads, landscaping,traffic control, drainage and potentially irrigation within the proposed District. SUMMARY OF REQUEST: The Timber Springs Property Owner's Association, in.accordance with State statutes(CRS 32-1-202(1)),has filed a Service Plan with the Eagle County Clerk with regard to the formation of the Timber Springs Metropolitan District. Service Plans for special districts are authorized by the State, pursuant to Title 32, Colorado Revised Statutes (The Special District Act) and approved by local government units such as Eagle County Government. Therefore, the process for creation and amendment to service plans is set forth by State statutes. In this instance,the Applicant has provided the necessary information within required time frames (also set forth by statute) and staff has identified no issues or negative fmdings. II. BACKGROUND: 35 08/06/2013 History and Rationale for Request Timber Springs Subdivision, comprised of eight (8) 35-acre residential lots covering approximately 292 acres, is an exempt, 35-acre subdivision created in 2001 via land survey plat. This subdivision was created in conjunction with Cordillera Valley Club Planned Unit Development (CVC PUD) located directly adjacent and to the east. Due to Timber Spring's proximity to, and relationship with, the CVC PUD, services within the subdivision have been provided by the Cordillera Metropolitan District since its creation in 2001. However, Timber Springs is not part of the CVC PUD. Recently, Timber Springs Subdivision has been excluded from the Cordillera Metropolitan District, and the property owners within Timber Springs now desire to form their own Metropolitan District in order to better provide for services, ongoing maintenance and specific infrastructure needs of the Timber Springs development. The District is proposed to provide the following basic services: • Repair, maintenance and replacement of public infrastructure including roads, landscaping, traffic control, drainage and potentially irrigation; • Ongoing operation and maintenance of public facilities; • Design review and covenant enforcement. As stated in the application: "The purposes for forming a metropolitan district include ensuring a reliable revenue stream for providing repair, maintenance and replacement of public infrastructure including roads, landscaping, traffic control, drainage and potentially irrigation within the proposed District, as well as ongoing operation and maintenance of the public facilities." Additionally,the Plan provides the following explanation as to the need for, and feasibility of,the District: "All property within the Service Area is currently practically developed. There are only limited public services or facilities within the Service Area. The District will finance, construct, complete, operate, maintain and replace those portions of the public improvements needed to serve Timber Springs. Neither the County nor any other governmental agency will finance or construct the public improvements." As noted above, the process for approval of districts is set forth by State of Colorado statute. Accordingly, specific steps must be taken within specific time frames. As in each service district plan review, the Planning Commission reviews the service plan first, forwarding a recommendation for approval, denial or approval with conditions to the County Commissioners.The Planning Commission met to consider the request on July 17, 2013. Accordingly, the Board must approve, approve with conditions, or deny the Plan at its regularly scheduled hearing of August 6, 2013. Planning Commission Review and Recommendation At their regular meeting on July 17, 2013, the Eagle County Planning Commission reviewed the requested Service Plan, considering the background of the case and the applicable findings. The Planning Commission's discussion focused on the following issues: 1. Administration and maintenance of existing On-Site Wastewater Treatment Facilities (OWTS), or individual septic systems, as well as(well)water supplies within the subdivision; 2. The general location where Eagle County's maintenance obligations for Hillcrest Drive start/stop relative to the entrance to Timber Springs Subdivision; 3. Whether public safety was considered when forming the District (whether the service plan would provide public safety powers/duties to the District); 36 08/06/2013 Regarding OWTS and well water that serve the individual lots in the Subdivision, the Applicant and staff reported that historically, each lot owner was responsible for permitting, installation and maintenance of individual septic systems; that each lot relied on well water and that the formation of a District would not change this situation. Likewise,the Applicant does not anticipate that formation of the District will alter existing maintenance schemes or responsibilities with regard to that portion of Hillcrest Drive located north of Interstate-70. At the time of writing, staff was not able to confirm with Gordon Adams, Director, Eagle County Road and Bridge Department, the exact location where Eagle County's road maintenance responsibilities start/stop with regard to the western entrance to Cordillera Valley Club or the entrance drive to Timber Springs. Staff believes the County maintains Hillcrest Road up to CVC's western entry gate; likewise, that the County does not maintain any part of the entrance drive to Timber Springs Subdivision and that formation of the District will not change this situation. Lastly, when asked about whether the District would or should assume public safety duties (as an enumerated power conferred within the Service Plan), the Applicant reiterated that traffic safety (installation and maintenance of traffic signage; entryway improvements and signage) would be a duty assigned, but that "public safety" was purposefully not included within the Service Plan. The subdivision is only eight lots and has been effectively served by the Eagle County Sheriff and other emergency service providers in the past. The Planning Commission voted unanimously to recommend approval, with one standard condition addressing representations made by the Applicant in the application and hearing process. III. REFERRAL RESPONSES: Referral copies of this application were sent on to twenty-one (21) agencies for review on July 3, 2013. As of the writing of this report,the following referral responses had been received: Eagle County Finance Department(John Lewis)—July 3, 2013 - No Comments. Eagle River Water and Sanitation District(Tug Birk)—July 11, 2013 - No Comments; the subdivision is not served by the ERWSD. Western Eagle County Metropolitan Recreation District(Steve Russell)—July 14, 2013 - No Comments. IV. SUMMARY ANALYSIS: The Eagle County Comprehensive Plan generally discourages the proliferation of special districts within the County, in part, as a means of directing future development into existing municipalities and service districts. However, in this particular instance, the creation of the Timber Springs Subdivision was made possible, in part, due to the previous formation of a special district (the Cordillera Metropolitan District). The District is proposed to serve an existing,mature subdivision that has recently been excluded from the Cordillera Metropolitan District. Therefore, and based on the evidence provided within the proposed Service Plan demonstrating the need for, and feasibility of, a new district, staff believes the benefits of formation of a new district outweigh any disadvantages. Likewise, staff believes the Applicant has provided satisfactory evidence demonstrating conformance with the required findings. V. FINDINGS: The Board of County Commissioners is required to act on the request based on a determination that that the proposed special district meets, or does not meet, all of the following findings,with or without conditions. 37 08/06/2013 a. There is sufficient existing and projected need for organized service in the area to be served by the special districts. Staff Response: The subdivision has been in existence since 2001 and is partially built-out. The subdivision has been served by an organized service district and has the need to for continued services which can best be provided by the creation of a new special district. b. The existing service in the area served by the special districts is inadequate for present and projected needs. Staff Response: The Cordillera Metropolitan District, that district which has served the subdivision since its creation, has acted to exclude the Timber Springs Subdivision from its district. Likewise,no other entity has the capability to undertake service and ongoing maintenance of the subdivision. Therefore, service is currently or projected to be inadequate for present and projected needs. c. The special districts are capable of providing economical and sufficient service to the area within its boundaries. Staff Response: According to the Service Plan and Financial Plan provided, service provision is both economically feasible and has been planned to be sufficient for the existing eight(8)lot subdivision. d. The area included in the District has, or will have, the financial ability to discharge the proposed/existing indebtedness on a reasonable basis. Staff Response: According to the Service Plan, the District will have the means to service and/or plan for any debt incurred for the purpose of maintenance or other ongoing capital improvements needs. The Service Plan includes a "Financial Plan" which details the District's estimated operating budgets and projections for revenue through the year 2037. Likewise, the Financial Plan establishes the Subdivision's assessed valuations and sets forth proposed mill levies, outlining specific means (bonds and other multi- year obligations)by which to fund future improvements. The Eagle County Finance Department has reviewed the application, with no concerns or comments forwarded. Additionally, evidence must be presented to support the following findings: a. Adequate service is not, or will not be, available to the area through Eagle County or other existing municipal or quasi-municipal corporations, including existing special districts, within a reasonable time and on a comparable basis. Staff Response: The Cordillera Metropolitan District, that district which has served the subdivision since its creation,has acted to exclude the Timber Springs Subdivision from its district. Likewise,no other entity has the capability to undertake service and ongoing maintenance of the subdivision. Therefore, service is currently or projected to be inadequate for present and projected needs. In addition, the Service Plan states (P. 3): "Discussions with Eagle County have indicated that the County does not consider it feasible or practical for the County itself to provide the area within Timber Springs with the public improvements facilities and services needed to develop the community and serve the anticipated residents." b. The facility and service standards of the Districts are compatible with the facility and service standards of Eagle County, and each municipality which is an interested party under Section 32-1- 204(1), C.R.S. 38 08/06/2013 Staff Response: Staff believes the facility and service standards of the District are proposed to meet the standards of Eagle County; staff is not aware of any requested variations to applicable standards. c. The service plan is in substantial compliance with the master plan adopted pursuant to Section 30-28-106, C.R.S. Staff Response: Staff believes the Service Plan is in substantial compliance with a majority of the stated goals and policies of the Eagle County Comprehensive Plan. The Service Plan provides for the continued support of the general health, safety and welfare of the existing and future inhabitants of Timber Springs Subdivision. However, formation of a new service district could be construed to be in conflict with a stated goal of the Comprehensive Plan to avoid the proliferation of special districts. d. The service plan is in compliance with the duly adopted long range water quality management plan for the area. Staff Response: Staff believes formation of the District should allow the owners within the Timber Springs Subdivision to maintain compliance with regional water quality management plans for the area. Specifically, planned maintenance of landscaping, irrigation and drainage improvements within the subdivision will support ongoing compliance with water quality plans and policies of Eagle County. The subdivision is served by well and septic which are individually operated and maintained by property owners. e. The service plan will be in the best interest of the area proposed to be served. Staff Response: Staff believes the formation of the District will be in the best interest of the area. Specifically, the application states that all owners within Timber Springs Subdivision support the District's formation for the purpose of better meeting the needs of the Timber Springs Subdivision. Likewise, an ongoing need for services, combined with a general lack of adequate service provision from outside sources makes formation of the District necessary. Staff believes the Applicant has provided satisfactory evidence to support a positive finding for each of the criteria listed above. VI. PROPOSED MOTION: "I move that the Eagle County Board of County Commissioners approve the Timber Springs Metropolitan District Service Plan,File No. SD-4378." VII. SUGGESTED CONDITIONS: 4. DISCUSSION: Mr. Hunn stated that this was a request for a service plan for a new metro district for Timber Springs Subdivision. The property was west of Cordillera Vale"`y,Club PUD. The applicant wished to form a new district to provide for the repair maintenance, replacement of landscaping, traffic control, drainage improvements, and maintenance and operations of public facilities, et't..:Th property_was 292-acres,split into 8-35 acre lots and previously served by the Cordillera Metro District. The subdivision,was formed in 2001. .4 The proces*'auas set forth by State Statutes. An election would also be required to fbrncl,thi district. He presented tie findings. Karl Hanlon, Karp Neu Hanlon PC spoke. He explained that Cordillera Metro had recently excluded the subdivision due to the geography and access. The property was different and the style and design was different from what Cordillera Metro required. The special district act required that debts previous incurred would continue 39 08/06/2013 until any debts were paid. This was a two-step process; once an approval was obtained by the board of county commissioners,they would submit a petition to the District Court for the formation of the district. There would be a hearing,notification and eventually an election in November. The service plan would delineate what services could be provided and the limits of the services. In this case,they were proposing to operate,maintain, and replace public improvements and finance the operations thru fees and voter approved property tax. Covenant enforcement and architectural review would also be provided by the district. He spoke about the financial aspects. The mill levy would not change until 2020. There were 4 voters qualified to vote in the upcoming election. They anticipate at build out, 8-12 registered electors. The assessed value was about 1.6 million. The total mill currently was 55. Keith Montag asked about the future projection of 60. Mr. Hanlon believed the increase was projected potentially for improvements to the entryway. Mr. Montag spoke about the road repairs and maintenance and wondered if there were being enough dollars being set aside annually. . Mr. Hanlon stated that the amounts were based on engineering advice. Commissioner Chandler-Henry asked if the overall benefit was that the current residents would pay the same but receive a better level of service. Mr. Hanlon believed that was a correct summary. The only struggle was balancing the non-resident versus resident. Ms. Mauriello wondered if there was a cap on the mills. Mr.Hanlon stated that the mill levy had to be set by a vote. Mr. Montag asked about the western entrance. Mr. Hunn stated that the county would own and maintain Hillcrest drive from the intersection of Hwy 6 under I-70 to the front gate. Timber Springs assumed no responsibilities for the section of Hillcrest Dr. Commissioner Chandler-Henry wondered if there were any liabilities of the county with a metro district of this size. Mr. Montag believed there were pros and cons. He was not overly concerned. The responsibilities for infrastructure maintenance and repair were not a burden to the county tax payer. The downside would be if there were an overlap in services. Ken Marchetti stated that there were property tax dollars available to fund the budget. There was a homeowners association as well, and the game plan was to provide service through the HOA or Metro District. Governmental immunity was one benefit of forming a metro district. Mr. Hanlon was comfortable that there would be a unanimous vote. Mr. Marchetti believed that creating the district would not change any of the county's obligations for the area. Commissioner Chandler-Henry moved to approve the Timber Springs Metropolitan District Service Plan, File No. SD-4378. Commissioner Ryan seconded the motion.
