Recognition of Eagle County Treasurer and Public Trustee Karen Sheaffer Board of Commissioners Chairman Runyon recognized Ms. Sheaffer for her 25 years of service to the county. She had been the Treasurer / Public trustee for 16 years and has received two awards as outstanding treasurer from the Treasurer's Association. She has been recognized nationally for collection of delinquent taxes. Ms. Sheaffer thanked the board for the recognition. Commissioner Fisher spoke about the state and national level of involvement by Ms. Sheaffer. She thanked her for her service. Eagle County File No. AFP -3873 Sean Hanagan, Planning Chairman Runyon asked the Attorney's Office if there were any changes to the Consent Agenda. Christina Hooper, County Attorney representative stated that item I should be pulled as the applicant was still working for the design review board. Ken Whitehead spoke about the biomass plant. He spoke about woody biomass and the cost of $15,000 a year to mulch this material. The biomass facility would remove this material from the landfill and save the county, money, and it also generated electricity for some local homes. Commission Fisher spoke about air quality concerns related to the biomass plant. She asked for Mr. Whitehead and Mr. Merry to come back to the board with information about how this would be handled. Mr. Whitehead added it was a five -year contract beginning January of 2014. Toby Sprunk spoke about the 50 -acre duck pond parcel. Today's contract was between Eagle County and the Land Trust. Kelley Collier, ECO Transit Director spoke about the bus advertising program. The minimum revenue expected would be between $100,000 and $340,000 per year. Exterior advertising would include panel advertising on a certain number of buses. There would be two to three buses fully wrapped in advertising and all ads would be passed by the ECO and Commissioners for approval. There would be 6 interior surfaces available for county use. The vendor would help the county design ads. She spoke to all town - planning departments to insure that there were no violations of their codes. The event will feature live music, a pumpkin patch, and other activities. The event will be held behind the Emerald and Opal building between the building and the bike path. Beer will be offered on a donation basis. The actual event hours will be from noon to 5 pm. All of the activities will be within the fenced area, with the possible exception of restrooms. STAFF FINDINGS: 1. The application is in order, all requirements have been met, all necessary documents have been received, and all fees have been paid. 2. The Eagle River Youth Coalition focused on substance use prevention. This year's event would be held at Riverwalk on October 201h The board asked about the perimeter. Ms. Stecher spoke about the security and one entrance and exit. Vail Valley Pharmacy has been open since March of 2012 and offers a full- service pharmacy staffed with licensed pharmacists and technicians. They also carry a full array of over - the - counter 32 10/02/2012 products including pain relievers, cold and flu products, vitamins /supplements, hair care products, bath products, baby products, and dental hygiene products. In addition, they offer boutique moisturizers and bath products, all - natural household products, soy -based candles, and gifts items such as watches, beads, scarfs and handbags. The store will mostly sell wine and some spirits (scotch, vodka, etc.). A liquor - licensed drugstore license allows the selling of malt, vinous, and spirituous liquors in sealed containers for consumption off the premise. Licensees must maintain a bona fide pharmacy and maintain drugstore operations at all times as a condition of this class of license. A licensed pharmacist must staff the prescription compounding area 50% of the time, each day. ESTABLISH NEIGHBORHOOD: The first order of business is to establish the neighborhood. Staff recommends that the defmition of the "neighborhood" include the area within a two -mile radius from the proposed location (0 105 Edwards Village Blvd.) This area includes but is not limited to Arrowhead, The Reserve, River Pines, Homestead, Old Edwards, and Singletree. Ms. Scriver explained that this is a new license and there are currently no other Pharmacy Liquor Licenses in the county. Commissioner Stavney moved that the Local Liquor Licensing Authority establish the neighborhood to include the area within a two -mile radius from the proposed location. Commissioner Fisher seconded for discussion. There was discussion about the radius and neighborhoods included. Larry Nisonoff stated that they were trying to service the Vail / Beaver Creek area as well. They had customized forms for hotels in the resort areas. They believe that many people visited the area and did not have vehicles while here. The response from Concierges and hotels was overwhelmingly positive. They had received requests from tourists and visitors for alcohol at the same time other drugstore items were delivered. Kent Lambrecht, owner spoke as one of the store pharmacists. The concierge pharmacy business included the service of advising against combining certain medications with alcohol. Mr. Nisonoff spoke about the consensus from almost all of the other business owners. Slifer management had given positive feedback for the pharmacy bringing business to the area. The motion was declared unanimous. NEEDS AND DESIRES OF THE NEIGHBORHOOD 1. All members of the Local Licensing Authority have been provided with copies of the petition submitted by the applicant. The Board will consider the reasonable requirements of the neighborhood, the desires of the adult inhabitants of the neighborhood and whether the existing licenses are adequate to meet these needs and desires, per the Colorado Liquor Code, Section 12 -47 -301 (2) (a). 2. Petition circulation was conducted by the applicant. The results were as follows: • 124 Signatures Favoring Issuance OTHER LIQUOR AUTHORITY CONSIDERATIONS: 1. Whether the licensee shall possess and maintain possession of the premises for which the license is issued by ownership, lease, rental, or other arrangement for possession of such premises. 33 10/02/2012 2. Whether the premises are within 500 feet of any public or parochial school or the campus of any college, university, or seminary. 3. Whether the fees have been paid. 4. Whether the applicant is of good moral character. STAFF FINDINGS: 1. The applicant has filed an application on forms provided by the state licensing authority and provided information as required by the state licensing authority. All applicable requirements have been met, all the proper forms have been provided, and all fees paid. 2. The applicant is over 21 years of age and reported to be of good moral character. 3. Public notice was given by the posting of a sign in a conspicuous place on the premises September 21, 2012 and publication in the Eagle Valley Enterprise on September 201" and 271, 2012. 4. The premises is not within 500 feet of a location for which, within 2 years preceding the application, a license of the same class was denied for the reason that the reasonable requirements of the neighborhood and the desires of the adult inhabitants were satisfied by existing outlets. 5. The premises are not within 500 feet of any public or parochial school or the campus of any college, university, or seminary. 6. The applicant has submitted proof of possession of premises. 7. There were no concerns expressed by any Eagle County internal departments. 8. The applicant has provided an alcohol management plan per the requirements of the Eagle County Local Licensing Authority and server training will follow with the approval of this application. 9. The applicant has met all the necessary requirements for a Liquor Licensed Drugstore. DISCUSSION: Ms. Scriver spoke about the petition of 124 signatures. In addition, the owner brought another 14 signatures of neighboring business owners, president of the association and Slifer management representative. Mr. Lambrecht stated that he did not try to get as many signatures as possible; he was just trying to satisfy the requirement. Ms. Scriver spoke about the reasonable requirements of the neighborhood and existing licenses. Commissioner Stavney wondered about the required number of signatures. Ms. Scriver stated that there was not a minimum number. Chairman Runyon asked about this type of approval. He asked if there were significant differences in this type of license. Ms. Scriver stated this type of license was an option, but no one had applied for this type of license. She related the model in other states where drug stores also sold liquor in many cases. Ms. Hooper stated that the legislature had set up a separate and distinct license. In order to convert to a retail license the applicant would need to come back and re- apply. A retail license store could not be a pharmacy. Mr. Nisonoff clarified that of the 4600 square feet they are currently allocating only about 150 square feet to liquor. Commissioner Fisher spoke about the delivery of liquor to resort establishments. She wondered if hotels allowed guests to bring alcohol onto their premises. Ms. Scriver spoke about staying at a resort and having luggage and wine shipped in for use during a stay. 34 10/02/2012 Mr. Nisonoff stated that the hotels had requested this type of service. Commissioner Fisher spoke about delivery being already available. Ms. Hooper stated that under the liquor code, certain establishments could deliver, but it was not a mandatory service to offer. She spoke about the two -mile radius and that delivery in Beaver Creek should likely not be considered. Chairman Runyon wondered if an Edward's store would deliver to subdivisions outside their jurisdiction, such as from Edwards to Avon. Ms. Hooper indicated that she did not believe this to be a problem. Commissioner Stavney wondered if in the future the store would try to convert to an all liquor store; abandoning some of their other product offerings. Ms. Hooper spoke about the delineation of the Liquor- Licensed Drug Store. Should they decide to abandon the primary use they would have to re -apply to the Board. Commissioner Stavney spoke about additional restrictions. Mr. Nisonoff indicated that the operation of a Pharmacy was the main difference from a retail liquor store. Commissioner Fisher wondered about conflicts with hours of operation. Mr. Nisonoff spoke about his commitment to the schedule presented. Commissioner Fisher wondered about stating the hours allowed for operation specifically. Mr. Nisonoff spoke about the restriction of hours per the association. Ms. Hooper spoke about the regulations and the 50% requirement for staffing. She believes the regulations were set up this way to eliminate the business from being more primarily liquor sales driven. Mr. Nisonoff indicated that a pharmacist would be on premises 100% of the time. Chairman Runyon opened public comment. Larry Eskwith spoke to the board. He presented a case in opposition to the petitioners. He was a resident of the designated neighborhood and a business owner in the neighborhood. He wondered how the board wanted to proceed. Chairman Runyon stated that it was not a judicial proceeding and the board wanted to hear concerns from the citizenry. . He was concerned about this becoming a court proceeding. Mr. Eskwith spoke about the memorandum he provided to the board. He believed that he had the right to question the applicant. He understood that this was to be informal, however the case law and statutes made it clear that he had some rights. If the applicant failed to meet certain standards, they should not be granted a license. Ms. Hooper stated that as far as case law went, it did not provide for members of the public to ask questions of the applicant, but did allow opinions to be presented. This was not a proceeding. The board had the discretion to ask questions based on testimony. Commissioner Stavney spoke about questions rather than cross - examination. Mr. Eskwith asked how the case should be presented. He wished to present his case. He wondered if his petitions had been entered into evidence yet. Ms. Scriver indicated that the petitions had been submitted to the board. Chairman Runyon stated that the board was the people's representative and they had wide latitude in making a decision about whether there was a need in the neighborhood. He was leaning more towards Mr. Eskwith's side as there was already a lot of service in the neighborhood. Mr. Eskwith stated that he was trying to present the law. He also has some people present who would be witnesses related to the needs of the neighborhood. He presented his evidence. His business was a liquor store and he was the owner of a retail liquor store in Edwards. He felt the needs of the neighborhood and desires of the inhabitants in the area are being met. He did not believe the two -mile radius needed another liquor outlet. His store was approximately 87 yards from the proposed store. Across the street was Drink and Riverwalk Wine and Spirits was across the street and finally 2 /1Oths of a mile away was the final store. He presented the petitions. There were about 230 residents opposed to the issuance of the license. He spoke about the fact that the owners were intending to provide delivery service to hotels outside of the neighborhood radius. There was a case on point in which a pharmacy and package store were next to each other and the board did not see them as the same type of entity. The court found that the alcohol sales are identical. Juli Young spoke to the board as a resident of the neighborhood. Her viewpoint included the potential to see many liquor stores in a close proximity to her residence. She was adequately supplied with anything she could want. She was not in favor of the license. 35 10/02/2012 Mr. Nisonoff stated that they are trying to separate themselves from their competition. Alan Goncharoff spoke to the board as a resident of Singletree. He patronized several different liquor stores in the Edward's area. He was bothered by the fact that with four liquor stores, a marijuana shop and proposed delivery of liquor it could get dangerous. He and his wife used the store for a pharmacy. He preferred the separation of liquor and drugs. Terry Benedict owner of Riverwalk Wine and Spirits spoke. She was opposed. She spoke about children and the community. According to Centers for Disease Control and prevention, alcohol was the most commonly abused drug in the United States. She provided statistics about under aged drinking. The best approach was increasing parental awareness. When a customer entered her store with a teenager, they watched closely. If a teenager pointed to something in the store they denied the sale. Each county decided which operations receive a liquor license. She felt that there was no need for an additional license and even within a few hundred feet. Liquor sales were highly regulated and in states where alcohol was sold in grocery stores the incidences of under aged drinking were increased. She asked the board to deny the application and stated that liquor delivery needs were currently being met by at least a dozen other stores in the area. Mr. Nisonoff stated that they sell more dangerous drugs than alcohol. These drugs were handled behind a counter as the liquor would be. Mr. Lambrecht received his doctorate degree and stated that pain pills did not have a negative impact with alcohol. They were simply adding convenience to the delivery of medications. As a pharmacy, federal and state authorities inspected their store regularly. They were also required to have a special security system just to be a pharmacy. Chairman Runyon closed public comment. Commissioner Stavney admired Ms. Benedict's logbook cataloging refusal of sales to those who were believed would be providing liquor to minors. He did not feel her testimony was an indictment against this license. The criteria was clear as far as the inadequate service of the neighborhood and the desire of the neighborhood — these were very subjective judgments. The job of the board was not to protect existing business from the free market — it was to decide if the neighborhood was already saturated. The neighborhood had been indicated as a two -mile radius. He wondered if the actual delivery was made by a pharmacist and to an individual. Mr. Nisonoff indicated that they could have a 21- year -old delivery person, but a pharmacist would deliver to the person and require a signature. Commissioner Fisher indicated that anything with prescriptions being delivered would need to be signed by the patient receiving the prescription. Commissioner Stavney spoke about the Riverwalk Inn being the only hotel in the area. There were extreme limiting factors in the business model. Mr. Nisonoff stated that they would not deliver liquor likely unless there was a prescription delivery involved. Commissioner Stavney wondered if there would be a cooler or the ability to restrict the size of the display. Mr. Nisonoff indicated that there would not be a cooler. Commissioner Stavney was concerned about the business model changing in the future and becoming more liquor centric. He wondered if the applicants would be willing to limit advertising and limit the square footage associated with liquor. Ms. Hooper stated that she didn't know if this type of restriction was allowed by law. Perhaps through the alcohol management plan these protocols would be put in place. Ms. Scriver stated that more detail could be provided in the alcohol management plan; however she didn't believe the amount of space within the location could be restricted. Ms. Hooper indicated that she did not believe this was the role of the board. Ms. Scriver presented the statutory reference about delivering alcohol. Chairman Runyon asked for a poll from the board about their positions. He was opposed to approving the application, as there were already plenty of services of this type in the community. He wondered if owners of hotels would have a different view than the concierges. Commissioner Fisher was also leaning towards denial for the same reasons. She sat on the board of the Eagle River Youth Coalition and the fact that alcohol abuse was a problem in the community already. She believed partnering alcohol with pharmaceutical services was a bad idea. The establishment had been open less than a year. Mr. Nisonoff stated that they have received many requests for this service. 36 10/02/2012 Commissioner Fisher stated that this service was already available, simply by making two phone calls rather than one. She asked staff to add the map of the area to a PowerPoint to be able to see the saturation of other liquor locations within the two -mile radius. Mr. Nisonoff indicated that he would agree to not deliver alcohol unless delivering a prescription. He and his partner were both worked as licensed pharmacists at City Market for 6 years. They did not open the store with this in mind but believed they were providing a desired costumer service. Commissioner Fisher found that marketing the pharmacy and alcohol service was a business creep and would be sending a message and providing a service that would make it that much more convenient for those that might abuse the two in a negative way. Chairman Runyon spoke about the possibility of theft and the importance of monitoring the store to avoid alcohol getting in the hands of underage customers. Commissioner Stavney agreed with the comments made by the other commissioners but stated that the board could not deny the license based on those criteria. This type of license was allowed under state law. He did not see between the two petitions a compelling argument in either direction. It was a gray area. He advised giving the applicant a week or two to listen to the discussion and testimony and return with an alcohol management plan that would define them as a pharmacy that provided liquor sales. It really came down to the desires of the neighborhood and whether it was adequately served. It was not the board's position to protect existing business from new businesses. Chairman Runyon stated that the only mechanism the local licensing authority had was the alcohol management plan. Commissioner Fisher asked about the enforceability of the alcohol management plan. Ms. Hooper stated that noncompliance with the alcohol management plan would not be a violation of the liquor code. Ms. Scriver stated that it was the licensee's responsibility to keep their alcohol management plan current. If a licensee made any physical changes to the licensed premise, a report of change would be required. Mr. Lambrecht stated that the pharmacy was so regulated by the state and federal government that they could not simply change their hours. Ms. Hooper stated that the state has authorized pharmacies to apply for liquor licenses through the local authority and the local authority's role was to determine whether the needs and desires of the neighborhood should allow it and room for this type of business in the neighborhood. Chairman Runyon stated that at one time the board was approving all types of liquor licenses because the county was growing at 9% a year. He did not see a need for another license. Commissioner Stavney stated that he would be willing to table the file and allow the applicant to brush up their alcohol management plan and talk further with staff. Commissioner Fisher stated that she was still challenged with the need from a community standpoint. She would be willing to give the applicant an opportunity to provide an operating plan expressing their intent in writing. Commissioner Stavney moved that the Board table the application until October 16, 2012, noting; that the board had established the neighborhood. Commissioner Fisher seconded the motion for discussion. Commissioner Fisher asked if public comment would be reopened. Chairman Runyon believed that public comment should be reopened. Commissioner Fisher suggested that if the public wanted to contact the board via email to send those emails to Ms. Scriver through the Clerk's Office. Chairman Runyon believed the board had enough information to make a decision. The motion passed by a vote of two to one with Chairman Runyon voting against. Commissioner Stavney moved to adjourn as the Eagle County Liquor Licensing Authority and re- convene as the Board of County Commissioners. Commissioner Fisher seconded the motion. The property owners have lived on the lower portion of the property in the single family residence for eight years, although they currently reside at their home in Minturn. The 10"' Mountain Division Hut System is routinely booked most of the winter season and the Applicant intends to offer an additional more easily accessible recreational opportunity. 2. STAFF REPORT A. NECESSARY FINDINGS: PROCESS INTENT ECLUR Section: 5 -250 Special Use Permits Section Purpose: Special Uses are those uses that are not necessarily compatible with the other uses allowed in a zone district, but which may be determined compatible with the other uses allowed in the zone district based upon individual review of their location, design, configuration, density and intensity of use, and the imposition of appropriate conditions to ensure the compatibility of the use at a particular location with surrounding land uses. All Special Uses shall meet the standards set forth in this Section. Standards: Section 5- 250.13. The issuance of a Special Use Permit shall be dependent upon findings that there is competent evidence that the proposed use as conditioned, fully complies with all the standards of this Section, this Division, this Article, and these Land Use Regulations. The Planning Commission may recommend and the 39 10/02/2012 Board of County Commissioners attach any conditions deemed appropriate to ensure compliance with the following standards, including conformity to a specific site plan, requirements to improve public facilities necessary to serve the Special Use, and limitations on the operating characteristics of the use, or the location or duration of the Special Use Permit STANDARD: Consistent with Comprehensive Plan. [Section 5- 250.B.1] The proposed Special Use shall be appropriate for its proposed location and be consistent with the purposes, goals, objectives and policies of the Comprehensive Plan and the FL UM of the Comprehensive Plan, including standards for building and structural intensities and densities, and intensities of use. (1) The proposed special use will preserve quality of life characteristics by providing outstanding recreational facilities and offer unique cultural events along with preserving vestiges of the County's western heritage and the rural quality of life found in outlying areas of Eagle County. (2) The proposed special use will continue to make Eagle County attractive and convenient for residents and visitors by offering an appropriate mix of recreational experiences. This but in particular will offer greater accessibility than other huts in the 10th Mountain Division because the cabin is only one mile from the trailhead/parking area and there is only 300 vertical feet of elevation gain. (3) The proposed special use supports the Comprehensive Plan strategy of supporting local and state winter tourism marketing programs for the huts system. (4) Water resource strategies do not apply here, as water is not a proposed part of the application. There will be no running water or well. The but users will be required to pack in any water needed for their stay. In the winter but users will use snowmelt for their water source. There will be a vault toilet and grey water leach field as directed by the Eagle County Environmental Health Department. Per comments from the Environmental Health Department, the Applicant has contracted with H.P. Geotech to provide services for soils tests, percolation tests, and for the design of the gray water leach field and vault toilet. (5) Staff has not received any comments from the Division of Wildlife for the proposed special use. According to the Applicant, they believe there will be minimal impact to the wildlife because the property is in an area already impacted by both winter and summer use by visitors and residents. Visitors to the but will utilize established trails for the 10"' Mountain Hut named Vance's Cabin, which is less than one mile away. A no pet policy for users of the but will be implemented since dogs are known to harass and chase wildlife as well as contaminate the snowmelt in the winter. (6) Regarding wildfire hazards, the Applicant has met several times with Eagle County staff and the Eagle River Fire Protection District to discuss the "high" wildfire hazard rating, as well as mitigation inclusive of creating defensible space around the proposed building site and providing access for emergency service vehicles. The Applicant has provided response comments demonstrating adherence to the 40 10/02/2012 recommendations of both the County Wildfire Mitigation Manager and the Fire District. (See attached referral comment letters from the County and the Fire District, as well as the Applicant's response letter). The Applicant has also applied for a variance to the development standard requiring dual points of access. This variance will be considered by the Board of County Commissioners concurrent with the special use. (2) Eagle County, in conjunction with the Colorado State Forest Service, will be implementing a fuel reduction project in 2012 utilizing a $20,000 grant to create fuel- breaks along the primary ingress /egress from the area (FS 731 RD). The Applicant has pledged to assist the Wildfire Mitigation Manager with this Endeavor by developing a plan to tie -in defensible space work around the proposed El Capitan Cabin with this larger project along the roadway. Once complete, this fuel break should limit rates of fire spread within the neighborhood and protect the one evacuation route from the area. Detailed evacuation and emergency response planning has been established by the Applicant. The 10'' Mountain Division Hut System has a plan informing guests what to do in the event of structure or wildland fire (as well as medical emergencies). The Applicant should mirror this plan when developing a similar strategy for the El Capitan Hut. It is recommended that the Applicant work with the appropriate Eagle County, and Eagle River FPD personnel to develop this plan. Should the special use permit and variance be granted, further wildfire mitigation requirements associated with new construction on this site would be addressed during the Building Permit process. The creation of defensible space and adherence to Eagle County Construction Guidelines for Wildfire Areas will be required for any structure on this lot (pursuant to Eagle County Wildfire Regulations and Building Resolution). STANDARD: Compatibility. This matter will be decided by the Board concurrent with the hearing for the Special Use Permit. (3) Service and delivery will be handled by the property owners. Any maintenance will be the responsibility of the owners or any agency they contract with to service the property. Besides routine maintenance of the structure, there will be annual wildfire mitigation, a service truck for the vault toilet system, propane fill, and firewood delivery. (4) The trailhead/parking would be located on the lower portion of the property adjacent to the existing structure. The trailhead is accessed by the Forest Service Road 731. The parking area will have year round maintenance. (5) According to the Applicant, there should be no noise, vibration or other disturbances to the surrounding area once the but is open for business. There will be temporary noise, vibration and other disturbances during construction. The only odor associated with the ongoing use will be during utilization of the campfire ring. The proposed campfire ring will be built similar to other primitive camping sites and when fire restrictions are in place, a metal sign stating, "No fires allowed" will be placed over the top of the campfire ring. The Applicant had spoken with Bill Johnson the real estate specialist from the USFS and Bill confirmed that access to the property is guaranteed for this special use. New traffic from but users is projected to be 2 -4 vehicles per trips per day with an average of 3.1 people per vehicle. Therefore, the estimated average of car trips per year is 300. The Applicant obtained these numbers from data provided by the 10"' Mountain Division Hut Association based on the use patterns of the existing but system. (2) The layout design takes into account existing trails on the site for pedestrian access in the summer and in the winter trails will be creating by the groups snowshoeing or cross - country skiing. (3) There is no water associated with the project. Hut users will be required to pack in any water needed for their stay. This is consistent with how other l Oth Mountain huts function. (4) The but will incorporate a vault toilet system that will be serviced on a yearly basis. The Environmental Health Department requested that the vault toilet system and gray water leach field be designed by a Colorado Registered Professional Engineer. The Applicant has contact H.P. Geotech to provide services for soil tests, percolation tests, and for the design of the gray water leach field and vault toilet. SUMMARY ANALYSIS: Benefits • The proposed use offers enhances recreational opportunity in Eagle County. • This is a small business that may assist improvement of the local economy. • As demonstrated by the reservation list for the 10`h Mountain Division Hut system, this type of recreation facility is in continual demand in Eagle County. • The but is situated in an evergreen forest with expansive views of the Sawatch Range and in close proximity to the 10`h Mountain Division Hut Association trails and the Colorado Trail. • The cabin will offer visitors many hiking, skiing and mountain biking opportunities immediately surrounding the proposed facility. • The proposed use will offer backcountry users a space to enjoy the mountains in a quiet, energy efficient, off the grid environment. • The Applicant has also pledged to have educational materials and information inside the cabin to promote nature based experiences as well as ethic of "leave no trace" and "pack it in, pack it out." Impacts & Trade -offs Potential negative impacts to the environment and community include the addition of another unit without dual access in the advent of a wildfire. Should the cabin catch fire or in the event of another emergency situation, the response time from the nearest emergency services is over 30 minutes. Comments have also been received from adjacent property owners regarding the impacts to FS Road 731. This impacts will be reviewed as part of the dual access variance request through the Engineering Department. Update and Comments The Applicant has requested that they be allowed to use the but for noncommercial activities when it is not rented out through the 10`h Mountain Division Hut system and during the off season. The Applicant has met repeatedly with adjacent property owners to mitigate the impacts of a commercial but operation and has met with County staff on numerous occasions to mitigate the wildfire hazards. Please see the attached memo of comments from the March 7, 2012 and August 1, 2012 hearing, letters from adjacent property owners, the response letter from the Applicant and the letter from the USFS concerning USFS Road 731. Summary Overall, the potential benefits from the project, specifically the addition of another backcountry recreation cabin are in line with County goals and policies and appear to outweigh any potential disadvantages or impacts. As designed and with certain (conditional) mitigation the proposed special use meets or can meet all applicable County standards. D. BOARD OF COUNTY COMMISSIONER OPTIONS: 1. E. SUGGESTED CONDITIONS: 1. Except as otherwise modified by this development permit, all material representations made by the Applicant in this application and in public meeting shall be adhered to and considered conditions of approval. 2. Prior to or concurrent with any building, electrical, grading or other, miscellaneous permit application, all comments and recommendations set forth in the following referral responses shall be incorporated into the design of the Special Use, or otherwise adequately addressed as evidenced by written documentation from the Applicant, inclusive of revised plan documents: 1. Eagle County Wildfire Mitigation Manager correspondence dated December 20, 2011; as follows: • The property owner will develop a plan, which is approved by the Wildfire Mitigation Manager for defensible space work around the proposed El Capitan Cabin. • The proposed building design will meet the construction guidelines for wildfire areas set forth by the Eagle County Building Resolution. • The property owner will provide a detailed evacuation and emergency response plan developed with input from appropriate Eagle County and Eagle River Fire Protection District personnel. 3. The Applicant will obtain approval from the Board of County Commissioners for a variance to the dual access roadway standards prior to the approval of the Special Use Permit. 4. The Applicant will accommodate ADA users as much as reasonably possible to facilitate that use. DISCUSSION: Kris Valdez presented some letters received since her staff report was submitted. She also added a map for further clarification. The board would be hearing the road improvement standard variance request following her presentation. She presented a vicinity map. The property was located on Tennessee pass off of Forest Service Road 731. The neighborhood was made up of historic mining claims, surrounded by federal land. The mining claims were all zoned resource. The US forest service property in between the mining claims was zoned resource preservation. The request was for resort recreation facility. Per the land use regulations, the owner would be allowed 12 dwelling units or 48 beds of visitor capacity. The facility would consist of 1 8- person cabin, located on 11.7 acre property. The but would be open in the summer — July 1St to September 301h and in the winter December 15th to April 1 st. The 10th Mountain Hut Division program had already approved the but within their program. The proposal was consistent with the comprehensive plan and open space plan except for wildfire regulations. However, there was fire mitigation currently taking place through a grant program. She presented the benefits of the project. The disadvantage of the unit was that there was no dual access in the event of a wildfire. She presented photos of the existing cabin and sheds. Winter parking would be on the lower portion of the applicant's property near an existing sheds. The summer parking would be located on the upper portion of the property. The 47 10/02/2012 existing cabin would be turned into an outhouse and wood storage. The applicant agreed to an emergency phone at the parking area for guests and a dry hydrant at the existing residentss. They worked through fire mitigation issues with Eagle River fire and County staff. Staff received a letter from the USFS confirming that they did not have any issues with the road being used for the special use. There had been some concerns raised by adjacent property owners such as lack of notification of the project and that there were too many existing buildings and sheds on the property. The board must find that the petition would not adversely affect the public health, safety and welfare. The proposed was in compliance with the Eagle County Land Use Regulations and the guidelines of the Eagle County comprehensive plan. Staff included some suggested conditions and the Eagle County Planning Commissioner suggested conditions as well. Those conditions were outlined in the staff report. The Planning Commission approved the proposal 4 -1. Eva Wilson, Eagle County Engineer presented file VIS -3524, variance from improvement standards. The applicant was seeking variances from the dual access, emergency vehicle turnaround, road design standards, intersection with Hwy 24, road width, road grade, and turn radius. The road volume was estimated to be 50 -100 average daily trips. There were a total of 35 parcels on the road and 13 structures. The applicant proposed to manage the annual grading, donate 3 days of time to the summer to do road maintenance work, pay thefull share of the plowing bill, use their own trails, pay an additional "road tax ", limit the number of cars per reservations to minimize traffic, limit the length of seasonal use and educated their guests prior to their arrival. Commissioner Stavney asked if Engineering was concerned with the variance. Ms. Wilson stated that as there was low road volume, she was not concerned with the request. Eric Lovgren, Wildfire Mitigation Specialist spoke. He presented a vicinity map that detailed the configuration of houses on 731 Road. Grant money was awarded about the same time the Dennis's submitted their request to remove dead trees from the roadway. There was a high wildfire hazard risk in the neighborhood. The last fire was in the 40's. Emergency response time was approximately 30 minutes. He spoke about the work being done to remove the dead trees and ongoing work would continue regardless of what happens with this file. He believed there was an opportunity for the board to condition the approval in order to improve the situation with regards to fire. Chairman Runyon wondered how this situation compared to the other but locations. Mr. Lovgren stated that the other huts were at higher elevations and less likely to burn. Melanie Dennis spoke about her and her husband's careers in the outdoor recreational industry. Their desire was to bring more people closer to the natural world. She explained that if the variance from improvement standards were not granted it would create a great hardship and it would not be feasible to improve the road significantly. The population that used the 10'h mountain huts were accustomed to driving dirt and 4 -wheel drive roads to access trailheads. She provided photos of the proposed but location, other but location, and parking areas. She believed that both beginners and intermediate users could access the proposed but easily. The but would fill a need in the but system with a growing population of users. Chairman Runyon opened and closed public comment, as there was none. Marjorie Westerman spoke about number of full and part time residents in the area. She submitted a letter opposing any commercial growth. She believed that the neighborhood's greatest concern was access via 731. The proposed access to the but went through a residential area. The residents had a plan if there was a fire. She was concerned that renters may not read the education packet and be prepared for an emergency evacuation. She did not believe that proper notification was given to all the neighbors. The only people that were notified were those with a home next to the proposed hut. Ms. Valdez stated that it was the applicant's responsibility to provide a list of mailing addresses. Her office merely verified the addresses. Ms. Westermann believed that dual access would always be an issue. She expressed concern for the 1,200 gallon water holding tank not supplying enough water. She believed there were plenty of huts available for users in the but system. Liability needed to be clearly stated to protect all private property owners from mishaps. She believed that a system of annual evaluations should be incorporated to insure the quality of the residents resources and that wildlife remained intact and in character. Chairman Runyon encouraged a site visit. He had a number of questions that could only be resolved by visiting the property. Ben Dodge, Director of 10'h Mountain Huts spoke. He believed there was a need to provide an accessible recreational backcountry experience to more people. There were currently 33 huts in the system. They were 48 10/02/2012 simply trying to accommodate beginners and younger people. The huts were a type of culture and they would like to share this experience. The huts were sustainable recreation in economic terms and ecologically. Commissioner Fisher asked Mr. Dodge to elaborate on the financials. Mr. Dodge stated that his organization was a 5010. This was their 31st year of business. There were 33 huts in the system. His organization accepted the reservations and did the marketing in exchange for a connnission. Their operating plan did not include outfitter guide operations. Chairman Runyon understood the need for beginner access. He believed that some of the other huts in the system did not have neighbors. Surly there were other huts that could fill the need that would not impinge on a neighborhood. Mr. Dodge understood that people would have to drive through a residential neighborhood to get to the but but this was similar to many of the other huts. This proposal would offer a quiet pristine experience. There were not many opportunities to build huts on public lands. The idea behind this proposal was to preserve the area and backcountry characteristics in an economically sustainable manner. Commissioner Fisher asked about the price for a one -night rental and how much of that went to the owner. Jim Farrell, owner of Vance's cabin spoke. He stated that his but slept 16 people and the fee was 30 dollars a night per person. He did not contact people personally. Insurance was high and there was a lot of overhead in addition, he paid The 10th Mountain group 20 %. Mr. Dodge stated that the huts that were closer in were more heavily booked. Phil Brodsky, the applicant's father, expressed support for the request and believed that the project. was good for Eagle County. He urged the board to approve the request. Chairman Runyon asked the rights of the property owner when it came to old mining claims. Ms. Valdez stated that mining claims were in place prior to any Eagle County subdivision or zoning regulations. As the regulation came to pass, all the mining Oaimst,*re zoned resource and considered legal non- conforming lots under the resource zone district. They are'*1.l0w l•a "single - family residence and any ancillary buildings associated with the residential use. The ownercoul'd.apply for a special use for any other use listed in the land use regulations. The existing cabin on this property was° considered the primary residence. In the future, anyone applying for a building permit in this area woul(f4ave•ty apply for a variance. Ms. Wilson stated that it was a determination by the board to balance the hardships to the applicant for not granting a variance against the adverse impact of health, safety and welfare of persons affected. David Faulkenberg spoke. He expressed concern for guests using his property. He requested the opportunity to review the documents related to user restrictions. He requested that snowmobiling be prohibited. He believed there were mining holes in the area that could be hazardous. He believed the existing building was adequate to sleep 8 people. He expressed concern for the increased density and road use as the road at the top went through several private properties. He believed that off - season usage should be denied. There should be a system in place to keep guests from traveling onto private property. The special use dates should be consistent. Ile expressed concern for fire pit use and thought it should be disallowed. He would like to see the new parking area be moved closer to the proposed hut. He believed there were already adequate structures on the property. Greg Dennis spoke. He clarified that the snowmobile shuttles were not in the current plan but they would like the but to be ADA compliant. He stated that they would like to create a fire safe zone at the but as a community benefit. They were trying to minimize car trips as much as possible. They estimated 300 -400 annual car trips a year. Commissioner Stavney pointed out that for a single - family home, the car trip numbers were about 700 annually. Seth Bossung spoke about his friendship with the applicants. He expressed support for the proposal. He believed it was a modest project. He was impressed by the applicant's care and thoughtfulness put into the project. He encouraged the board to support the request. Ms. Dennis stated that in terms of notification, they notified all the residents that had spent the most time in the area. They called community meetings and tried to be as upfront as possible. Once they met with the Planning Commission, they notified everyone. This but was not the only 10th but that required access through a residential area. In terms of support, there were property owners that had expressed support for the project. Their desire was to create a unique experience. They would happy to work with the neighbors to create a boundary so visitors know where they were allowed to go. Due to the mining claims on the property, access was open to the public. Commissioner Fisher wondered if other property owners could build a hut. Mr. Dodge believed it depended upon the carrying capacity of the area. He thought it was important to preserve the area and limit development. 49 10/02/2012 Commissioner Stavney moved to continue file no.
