Chairman Runyon recognized and thanked our local emergency responders who were recently involved in
fighting the Eby Creek fire. The response was quick and efficient, making it almost a non - event.
Commissioner Stavney also thanked the responders. The Colorado National Guard, Colorado River Crew,
Eagle River Fire Protection District, Eagle County Ambulance District, Gypsum Fire Protection District, Juniper
Valley Crew, Salvation Army, Town of Eagle, US Forest Service, BLM, Western Eagle County Ambulance
District, Colorado Department of Emergency Management, Eagle County Sheriff s Office, Eagle County
Emergency Management, Road and Bridge, City Market in Eagle, Eagle County Schools, American Red Cross,
Vail Fire Department, and many county departments assisted with the Emergency Operations Center. He
commented on how well organized the agencies were in response to this incident.
Commissioner Fisher spoke about the volunteerism by local residents. She complimented Bill Kaufman
and the Sheriff's Office. The county needed to be ever vigilant.

as part of the project would re -do the ramp intersection and asked that the county contribute to a new roundabout.
Commissioner Stavney stated that he felt it was important to make the investment. The County would not
take on any maintenance within the roundabout.

Resolution 2012 -072 for Approval of the Use of Open Space Funds and Form of
Intergovernmental Agreement for the Acquisition and Conservation of the
Saltonstall Property Located at 794 Hooks Spur Road, Basalt, Eagle County
Colorado
Toby Sprunk, Open Space
Mr. Sprunk presented a PowerPoint presentation detailing the purchase. The property was 150 acres.
Purchase of the property involved numerous partners, including Pitkin County, Town of Basalt, Mid - Valley Trails
Coalition and Eagle County. The property would provide public recreation access to the 9,300 -acre Crown. Trail
network. A $600,000 grant request was approved by the Great Outdoors Colorado. The purpose of the resolution
was to demonstrate commitment to the project for the grant application process. The $5 million purchase price did
not include transaction costs. The property was visible from Highway 82, it had access to the Crown trail :network,
and contained excellent wildlife habitat. The goal was to create conservation easements along the Roaring Fork
River. It is a highly visible piece of property from Highway 82, nearby Crown Mountain Park and Missouri
Heights. He reviewed the ranking of the Open Space funding criteria. The project had gone before 7 different
advisory boards and had received nothing but positive direction. He explained that Pitkin County would be the fee
title owner.
Chairman Runyon opened public comment.
Brian Davies resident adjacent to the property spoke. He expressed concerns about the purchase. He also
expressed concerns at the Eagle County portion of the Master Planning sessions. He stated that there were
conflicting interests. He wondered why additional access to the Crown was needed. There was easier access that
could be gained for substantially less. If this was purchased for public access, this access would have to be
maintained. He understood there would be extensive wildlife investigation. He feared that too many details were
not yet confirmed. He felt it conflicted with the Mid - Valley Master Plan because it added a density and traffic
impact. The density came in the form of home sites. On the north side, it increases the density from two dwelling
structures to three. He was opposed to the funding and conservation easement going forward. He did not believe
the impacts of the purchase were fully understood. He also wondered if it would be managed correctly. He did not
trust Pitkin County open space to manage this property adequately. He felt Eagle County needed much more say
for their investment.
Chairman Runyon closed public comment.
Commissioner Fisher asked for a reaction from Dale Will, Director of Pitkin County Open Space.
Mr. Will explained that the density issue was such that there were currently 5 units permissible, so these 5
units could be placed anywhere on the property. He did not agree that density was being increased. The density
would decrease from 5 to 2. He was pained to hear that there was no trust with Pitkin County's open space group.
He thought the management was among the best in public agencies. He could point to numerous examples in
which wildlife conservation has been at the top of the priority list. They would need the participation of the BLM
for this beautiful piece of farmland, which served as the portal. They hoped they could be a participant in a
wholistic look at the Crown. Specific dates for wildlife closure would be reasonable and were yet to be determined
exactly. He believed it was one of the best open space prospects he'd ever seen.
Commissioner Stavney thanked Mr. Davies for his comments. He also thanked Pitkin County's open space
group for leadership on the issue. He understood that there might be an ongoing issue with conflicting values. It
was important to understand that this would add use and there would be impacts but he had confidence in this

purchase and there would be winter closures for wildlife. The fee simple owner was not the most significant
consideration, rather it was who had oversight. This approach had been used before with towns and Homeowner's
Associations and Eagle County would still share responsibility for the property.
Mr. Sprunk added that the rigorous management plan process would also be important. He spoke with Bill
Heicher, chairperson of the planning commission and previous Division of Wildlife agent about how best to handle
these issues.
Chairman Runyon felt it was an astonishing opportunity. He believed that in the future this purchase would
be very highly valued. Conservation easements were forever. He knew that leveraging the Open Space funds were
critical to putting this purchase agreement together. Eagle County put in 40 %, Pitkin County put up 37% and the
Town of Basalt put in $500,000 and GOCO putting in $600,000. The purchase had support and would eliminate
any future uncertainties for potential use of the property.
Commissioner Stavney assured Mr. Davies that Eagle County did not manage conservation easements
based on popularity — it was for the values of preservation.
Mr. Will stated that Pitkin County had always put the resource first.
Mr. Davies spoke further and added that as a lifelong valley resident he had a firsthand appreciation of
growth. There were places for development and places where it was not appropriate. He had confidence that Mr.
Sprunk and the commissioners would watch out for county resident's interests.
Commissioner Stavney moved to approve the resolution approving use of open space funds and formation
of the intergovernmental agreement for the acquisition and conservation of the Saltonstall Property located at 794
hooks Spur Road, Basalt, Eagle, Colorado.
Commissioner Fisher seconded the motion. The vote was declared unanimous.

I. SUMMARY OF REQUEST:
The Applicant requests review of a major amendment to the Eagle Vail Planned Unit Development (PUD) for the
following purposes:
1. To provide a general update, inclusive of revisions to the "Definitions" section of the Eagle Vail PUD
Guide;
2. To revise certain development standards inclusive of allowable lot coverage and Floor Area Ratios (FARs)
for certain residential lots;
3. To remove "Special Review Use" from the PUD, and;
4. To include new provisions to address Medical Marijuana ( "MMJ ") facilities within the PUD.
Amendments to Definitions and Development Standards
Specifically, the Applicant proposes to amend certain definitions within the PUD Guide to match more closely
those promulgated within the Eagle County Land Use Regulations (ECLURs) and, specifically to reduce the
number of conflicting definitions between the Eagle Vail PUD Guide and the ECLURs. Importantly, definitions (all
previously provided for within the PUD Guide) for "Lot Coverage ", "Floor Area Ratio" and "Impervious
Materials" have been removed; therefore, such provisions will be defined according to Eagle County's definitions
for the same.
Likewise, the Applicant proposes to make modifications to certain Single - Family, Duplex, 4 -Plex, Multi - Family
and Commercial Zone District standards within Eagle Vail to increase slightly (in most instances, by .05 or .10
percent in most instances) the total allowed lot coverage (the percent of building coverage, including roof
overhangs); the total allowed floor area (the total habitable floor area on all floors of a building); and, the total
allowed impervious coverage (surface that does not readily allow water to infiltrate into the ground).

One may notice the relatively significant change (+ .30 %) proposed for "Total Impervious Materials" within the
Commercial Zone District. For comparison, Eagle County's standard for impervious coverage within the
Commercial General Zone District is 80% coverage (meaning, eighty percent of a commercial lot may be covered
by buildings, roof overhangs and other impervious surfaces such as parking lots and patios). Thus, the proposed
70% total cover by impervious surfaces is actually less than what is allowed in other, similar commercially zoned
areas within unincorporated Eagle County.
Perhaps the most impactful change to development standards will be the increase (from .35 to .40) in the allowable
FAR for Duplex lots. As provided within the application, for the average .25 acre Duplex lot, the increased FAR
will allow for an additional 545 square feet of living space (for the lot). With the majority of residential lots,
particularly Duplex lots, developed close to or at the maximum FAR of .35 %, the proposed amendment (along with
changes made to the Eagle Vail Design Guidelines to require new exterior appearance and parking upgrades) are
intended to encourage home owners to upgrade existing properties. It is also hoped such inducements will make it
easier for existing families to stay in Eagle Vail while maintaining property values and improving the appearance of
the community.
Additionally, the Applicant proposes to eliminate the following definitions from the PUD Guide:
• "Bed & Breakfast"
• "Day Care"
• "Dwelling Unit"
• "Home Occupation"
• "Kitchen Facility"
Other changes proposed include provisions to:
• Removal of "Special Review Use" from Section 3, "Use Regulations ";
• Revise the definition for "Multi - Family" to allow for public recreation park facility uses, bringing the
current uses of the Eagle Vail Pavilion into conformance with the PUD Guide;
• Re- designate Tract I -A (the former swimming pool site) from "Recreation" to "Multi- Family" (no new
density is proposed);
• Re- designate three duplex -zoned lots (currently owned by the Eagle Vail Metropolitan District and used as
pocket parks) as "Recreation" lots.
New Use Category Added for Medical Marijuana Businesses

The current PUD Guide does not address the potential for Medical Marijuana Businesses within the PUD. Eagle
County currently prohibits such businesses from locating within any Planned Unit Development unless expressly
allowed within the PUD. The proposed language (essentially following the general intent and language of Eagle
County's recently adopted MMJ regulations) within the Eagle Vail PUD reflects a consideration by the Eagle Vail
Joint Board of Governors to accommodate an MMJ business that was (until recently) located in the Emerald Acres
commercial development located near the intersection of U.S. Highway 6 and Eagle Road. Although this business
recently relocated, the Eagle Vail Joint Board of Governors requests consideration of the MMJ language as part of
the amendment package.
II. BACKGROUND /CHRONOLOGY:
Eagle Vail is one of the earliest, if not the first, Planned Unit Developments approved in unincorporated Eagle
County. While plats and protective covenants for the Eagle Vail subdivision were originally filed as early as 1972,
the PUD was not adopted until 1979, following several years of building activity within the subdivision.
The original PUD Guide was subsequently made part of the Eagle County Land Use Regulations, and the document
has been amended several times to address changing conditions within the PUD and within the surrounding areas of
unincorporated Eagle County.
As the community matures, additional revisions to the PUD Guide are being proposed to both update existing
definitions and language (to increase conformance with the Eagle County Land Use Regulations), and to provide
for additional land uses not contemplated within the original PUD.
Likewise, the Eagle Vail Metropolitan District recently updated its service plan to reflect changes in the types of
services needed and desired by the community, and specifically to address future infill and redevelopment activities
that may occur within the PUD. The proposed amendments to the PUD Guide, while not directly tied to the recent
service plan amendment, are yet another indication of the Eagle Vail community's desire to proactively plan for the
future while recognizing that, in some specific instances, the original intent of the PUD's development standards no
longer meet current conditions.

V. PLANNING COMMISSION DELIBERATION:

At their regularly scheduled hearing of May 16, 2012, the Eagle County Planning Commission voted unanimously
to forward a recommendation of approval for the requested amendment package, with suggested conditions by
staff. In doing so, the following summarizes the Commission's deliberations.
• One Commission member commented on the general nature of establishing a medical marijuana
dispensary/business within the confines of State and local regulations, noting that the Applicant has
matched the County's efforts to regulate such endeavors;
• One Commission member questioned the County's ability to address `existing conditions' for off - street
parking and improvements within County maintained rights -of -way. Staff reiterated the need to add
language within the proposed PUD Guide to address encroachments and/or parking improvements within
road rights -of -way as a means to clarify existing restrictions on such improvements;
• There were no further comments or questions for staff.
VI. SUMMARY ANALYSIS:
The proposed amendments have been discussed between representatives of the Eagle Vail Community and Eagle
County staff for several years - as needed in order to address certain pre- existing (pre- existing to the adoption of the
PUD in 1979) non - conformities.
As discussed in the application materials, as Eagle Vail has matured, the PUD Guide has been amended several
times. However, the current amendment package furthers the intent of the PUD while specifically addressing
certain issues pertaining to non - conformities and inconsistencies within the residential areas having to do with
development standards (or "Use Restrictions and Guidelines ") such as lot coverage and Floor Area Ratios.
Likewise, the proposed amendments will bring certain definitions within the PUD Guide into conformance with the
Eagle County Land Use Regulations.
In addition, the Applicant has reiterated the intent of the Property Owner's Association with regard to combining
the proposed amendments with certain updates to the Eagle Vail Design Guidelines (a separate document
administered by the Property Owner's Association) as a means to incentivize and, in some instances require,
maintenance and/or upgrading of property. Such changes also run concurrent with the recently amended service
plan for the Eagle Vail Metropolitan District.
With regard to the proposed inclusion of provisions for the regulation of Medical Marijuana Businesses within the
PUD, staff has received approximately fifteen (15) telephone calls regarding this issue. Staff has also received two
written comments regarding this provision (attached). The proposed regulations generally mirror Eagle County's
recently adopted MMJ regulations. The proposed regulations would essentially limit the location of any future
MMJ Business to the Emerald Acres area of the PUD. The proposed regulations were recently approved by the
Eagle Vail Property Owner's Association, in part, to bring a (then) non - conforming MMJ Business that was located
within Emerald Acres, into conformance with County regulations.
Overall, staff believes the proposed changes will maintain the intent and purposes of the original PUD. Similar to
the recently approved amendments to the Eagle Vail Metropolitan District Service Plan, amendments to the PUD
Guide are necessary and appropriate to ensure the needs of this mature residential, mixed -use community continues
to serve the existing resident's needs while proactively planning for the future.
With the exception of comments and suggested revisions by the Eagle County Engineering Department (attached),
staff has identified no further issues or areas of non - conformance requiring additional analysis or dictating
conditions of approval.
VII. SUGGESTED FINDINGS:
Staff suggests the application meets the following findings necessary for the approval of any PUD Amendment:
(1) Modification. The modification, removal, or release IS consistent with the efficient development and
preservation of the entire Planned Unit Development;

(2) Adjacent Properties. The PUD Amendment DOES NOT effect, in a substantially adverse manner, either
the enjoyment of land abutting upon or across a street from the Planned Unit Development or the public
interest;
(3) Benefit. The PUD Amendment IS NOT granted solely to confer a special benefit upon any person.
VIII. BOARD OF COUNTY COMMISSIONER'S OPTIONS:
1. Approve the [PDA-36161 request without conditions if it is determined that the petition will not
adversely affect the public health, safety, and welfare and the proposed use is attuned with the immediately
adjacent and nearby neighborhood properties and uses and the proposal is in compliance with both the Eagle
County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan (and/or other
applicable master plans).
2. Deny the [PDA-36161 request if it is determined that the petition will adversely affect the public health,
safety, and welfare and/or the proposed use is not attuned with the immediately adjacent and nearby
neighborhood properties and uses and the proposal is not in compliance with both the Eagle County Land Use
Regulations and with the guidelines of the Eagle County Comprehensive Plan (and/or other applicable master
plans).
3. Table the [PDA-36161 request if additional information is required to fully evaluate the petition. Give
specific direction to the petitioner and staff.
4. Approve the [PDA-36161 request with conditions and /or performance standards if it is determined that
certain conditions and/or performance standards are necessary to ensure public, health, safety, and welfare
and/or enhances the attunement of the use with the immediately adjacent and nearby neighborhood properties
and uses and the proposal is in compliance with both the Eagle County Land Use Regulations and with the
guidelines of the Eagle County Comprehensive Plan (and/or other applicable master plans).
IX. SUGGESTED CONDITIONS:
1. Except as otherwise modified by this development permit, all material representations made by the Applicant in
this application and in public meeting shall be adhered to and considered conditions of approval.
2. Revise proposed language regarding parking (listed under Section 5, "Use Restrictions and Guidelines ") to be
consistent for each zone district in the use of "behind" or "in front" of garage doors.
3. Revise Section 1, "General" to specify that no parking is permitted within the public rights -of -way; or, revise
the parking requirements for all land use classifications within Section 5, "Use Restrictions and Guidelines" to
specify "Off- Street Parking Requirements ".
4. Add a provision (note or other provision) within either Section 1, "General" or within Section 5, "Use
Restrictions and Guidelines" to address (prohibit) landscape improvements within public rights -of -way.

PUD zoning is in place and the Applicant proposes to amend the PUD, in part, to allow for changes to the
allowable lot coverage and floor area ratios (to permit individual property owners to pursue minor additions
of up to approximately 250 square feet per unit /lot.
PUD Intent
The intent of this PUD Amendment proposal is to provide for additional uses, and to promote greater
efficiencies in land use patterns within this mature mixed -use development by permitting minor additions
to existing units and updating parking standards.
Land Use Pattern
The Eagle Vail PUD is largely built -out. Therefore, the proposed amendments are not expected to
significantly impact or change existing land use patterns.
Constrained Design
Because the PUD is considered largely built -out, it is now possible to ascertain how the original
dimensional limitations (as prescribed in the original 1979 PUD Guide) such as building setbacks, building
height limitations and parking requirements have worked and whether there are areas in which to make
slight modifications to such standards in a manner that may incentivize property owners to improve their
properties while maintaining the intent of the PUD.
Although the Applicant does NOT propose any amendments to building height standards, the amendments
sought will increase the allowable lot coverage (the percentage of a given lot that is covered by buildings
and roof overhangs); the allowable "Floor Area Ratio" (FAR), which is the ratio of habitable floor area
within a building on all floors to the acreage of a given lot, and; the allowable "impervious materials" or
coverage, which is the total amount of surfaces (including buildings, patios and driveways) where water
cannot infiltrate the ground. Such changes, while not applying to every zone district, are generally proposed
to allow homeowners additional flexibility to make minor additions to their units depending on the size of
the lot and/or the size of any existing structures.
STANDARD: Variations Authorized [Section 5- 240.F.3.f. - provides that in order for a variation to be granted, it
must be found that the granting of the variation is necessary for the purpose to be achieved, and that the Sketch Plan
for PUD achieves one or more of the following purposes:

STANDARD: Off - Street Parking and Loading. [Section 5- 240.F.3.e (4)] — Off - street parking and loading
provided in the PUD shall comply with the standards of Article 4, Division 1, Off - Street Parking and Loading
Standards. A reduction in these standards may be authorized where the applicant demonstrates that:
(a) Shared Parking. Because of shared parking arrangements among uses within the PUD that do not require
peak parking for those uses to occur at the same time, the parking needs of residents, guests and employees
of the project will be met; or
(b) Actual Needs. The actual needs of the project's residents, guests and employees will be less than those set
by Article 4, Division 1, Off:Street Parking and Loading Standards. The applicant may commit to provide
specialized transportation services for these persons (such as vans, subsidized bus passes, or similar
services) as a means of complying with this standard.

STANDARD: Improvements. [Section 5- 240.F.3.e (8)] — The improvement standards applicable to the
development shall be as specified in Article 4, Division 6, Improvement Standards. Provided, however, the
development may deviate from the County's road standards, so the development achieves greater efficiency of
infrastructure design and installation through clustered or compact forms of development or achieves greater
sensitivity to environmental impacts, when the following minimum design principles are followed:
(a) Safe, Efficient Access. The circulation system is designed to provide safe, convenient access to all areas
of the proposed development using the minimum practical roadway length. Access shall be by a public
right -of -way, private vehicular or pedestrian way or a commonly owned easement. No roadway alignment,
either horizontal or vertical, shall be allowed that compromises one (1) or more of the minimum design
standards of the American Association of State Highway Officials (AASHTO) for that functional
classification of roadway.
(b) Internal Pathways. Internal pathways shall be provided to form a logical, safe and convenient system for
pedestrian access to dwelling units and common areas, with appropriate linkages off -site.
(c) Emergency Vehicles. Roadways shall be designed to permit access by emergency vehicles to all lots or
units. An access easement shall be granted for emergency vehicles and utility vehicles, as applicable, to
use private roadways in the development for the purpose of providing emergency services and for
installation, maintenance and repair of utilities.
(d) Principal Access Points. Principal vehicular access points shall be designed to provide for smooth traffic
flow, minimizing hazards to vehicular, pedestrian or bicycle traffic. Where a PUD abuts a major collector,
arterial road or highway, direct access to such road or highway from individual lots, units or buildings
shall not be permitted. Minor roads within the PUD shall not be directly connected with roads outside of
the PUD, unless the County determines such connections are necessary to maintain the County's road
network.
(e) Snow Storage. Adequate areas shall be provided to store snow removed from the internal street network
and from off-street parking areas.

DISCUSSION:
Mr. Hunn presented the request. The development dated back to the early 1970's. The Eagle Vail Metro
District recently updated their service plan. The purpose of the update was to provide a general update to
defmitions, revise development standards and include new provisions to regulate medical marijuana business uses
within the PUD. The PUD amendment was not solely to confer a special benefit upon any person. The amendment
was constant with the efficient development and preservation of the entire Planned Unit Development and did not
effect in a substantially adverse manner either the enjoyment or land abutting upon or across a street from the PUD
or the public interest.
Chairman Runyon asked about the intent
Rick Plyman stated that there was a medical marijuana business in Eagle Vail that was non - conforming so
the board decided to include the county's regulations related to that type of business into the PUD amendment.
Commissioner Stavney believed that one of the benefits of the amendments would allow homeowners to do
some minor upgrades.
Mr. Plyman spoke about recent improvements and the formation of committees to address traffic issues,
upgrade properties, and increase the floor areas of duplex lots. They were satisfied with the 4 conditions.
Commissioner Fisher believed it was great steps in the right direction.
Chairman Runyon opened and closed public comment, as there was none.
Commissioner Stavney moved to approve file no. PDA -3616, Eagle Vail PUD Amendment incorporating
staff s findings and including the 4 conditions.

PROJECT OVERVIEW:
The Wolcott Metropolitan District (the "District "), in accordance with State statutes (CRS 32 -1- 202(1)),
has filed for a Service Plan with the Eagle County Clerk. Service Plans for special districts such as the
Wolcott Metropolitan District are authorized by the State, pursuant to Title 32, Colorado Revised Statutes
(The Special District Act) and approved by local government units such as Eagle County Government. The
process for creation and amendment to service plans is set forth by State statutes.
The purpose of this Service Plan is to eventually serve the proposed Wolcott PUD. The Developer has
designated four separate districts to serve the Wolcott PUD community.
II. CHRONOLOGY:
April 2012 -On April 20 the applicant filed an application with the Eagle county Clerk and recorder for 4
Service Districts to service the Future Wolcott PUD
May 2012 -At their regular meeting on May 16 2012, the Eagle County Planning Commission voted
unanimously to approve the file
III. STAFF COMMENTS:
Service District 1 will be a "Control District" which will be responsible for all district operations. Service
Districts 2 and 4 are two Residential Financing Districts. District 3 is to be utilized as a Commercial
Financing District.
IV. APPLICANT'S PRESENTATION:
A complete description of the proposed service plan amendment, and justification pursuant to the below
listed statutory findings will be presented by the Applicant.

V. PUBLIC COMMENTS:
VI. FINDINGS:
The Board of County Commissioners shall disapprove the service plan unless evidence satisfactory to the
Board of each of the following is presented:
a. There is sufficient existing and projected need for organized service in the area to be served by the
special districts;
b. The existing service in the area served by the special districts is inadequate for present and
projected needs;
c. The special districts are capable of providing economical and sufficient service to the area within
its boundaries;
d. The area included in the District has, or will have, the financial ability to discharge the proposed /
existing indebtedness on a reasonable basis.
The Board of County Commissioners may disapprove the service plan if evidence satisfactory to the Board
of any of the following is not presented:
a. Adequate service is not, or will not be, available to the area through Eagle County or other existing
municipal or quasi - municipal corporations, including existing special districts, within a reasonable
time and on a comparable basis;
b. The facility and service standards of the Districts are compatible with the facility and service
standards of Eagle County, and each municipality which is an interested party under Section 32 -1-
204(1), C.R.S.;
c. The service plan is in substantial compliance with the master plan adopted pursuant to Section 30-
28 -106, C.R.S.;
d. The service plan is in compliance with the duly adopted long range water quality management plan
for the area;
e. The service plan will be in the best interest of the area proposed to be served.
DISCUSSION:
Mr. Hanagan described the request.
The applicant, Jim Collins spoke to the board. He stated that all of the property owners had been notified.
They had received no requests for exclusion from the district. They were rushing the creation of the district due to
the potential for development of the site. They were present as an option holder rather than a property owner.
There were two solutions; postpone the actual court order forming the four districts prior to September 7 and have
the election in November. There was no time limit. If the property did not close in May the districts would not be
formed. The second option was to form each district as a smaller district and then as soon as these were created
they would be expanded into the form being approved today.
Commissioner Stavney asked if each district represented different owners.
Mr. Collins confirmed this. There may be zero tax - paying electors able to sign, as most of the properties
were held in corporations, and as such unable to vote. There were no formal objections, but one of the property
owners had created a struggle in creating these districts. They would like a resolution of approval with conditions.
As far as the roads were concerned, they were not intended to be maintained by the metro districts. This would be
possible if required, but not included currently. They requested that it be postponed to preliminary plat.

Commissioner Stavney stated that CDOT would maintain Highway 6 and state highways.
Jeff Townsend with the Hermes Group explained it would be about 3 — 4 miles of road total.
Mr. Collins explained that the approval of the service plans did not affect land use approvals. The four
districts anticipate residential and commercial division of the property.
Rick Hermes spoke about the process related to legal matters in setting up the metro district service plan.
Stan Bernstein spoke about the request. He was the author of the financial model, which demonstrated that
the proposed districts would have the ability to maintain and operate their districts. He made some comments about
the plan. Residential financing districts 2 and 4 had capped mill levies. There was a total mill levy of 55 and the
cap protected the homeowners. The commercial district 3 was structured with a lower mill levy. He spoke about
the financial details of the service plan. They anticipated the 2% tax would generate close to $195,000 annually.
The service plan provided for the establishment of development fees. There was also a 1% real estate transfer fee
and 75% of those revenues were earmarked for the Wolcott Arts and Entertainment Trust Fund. He spoke about
the 25% going to the Wolcott Environmental Trust Fund which was expected to generate $1.6 million through
2030. Bonding capacity would support about $18.5 million in limited bonds. This would depend on the rate of
inflation assumption. Operating costs were paid by the 20 mills and as the district approached full build -out there
would be an allowance for administration in the amount of about $175,000 per year. Some amenities would be
operated by a traditional HOA but they were proposing loading up some of the costs on the metro district, as these
taxes were deductible.
Commissioner Stavney asked about the bonding capacity and expected metro district tax collections. He
presumed the operating expenses did not include the roads.
Mr. Bernstein confirmed this. If the district needed to take on this responsibility, the 2% sales tax could be
shifted from the debt fund to the general fund and help offset the cost of road maintenance.
Commissioner Fisher wondered if this addressed roads and sidewalks. This was a big issue in other areas.
Mr. Hermes stated that they assumed it would cover only roads.
Mr. Bernstein stated that he felt the district could handle it.
Chairman Runyon spoke about the fact that the assumtion was made that the county would handle these

Commissioner Fisher wondered what the homeowner's dues might be.
Mr. Hermes stated that across the country developments in trouble tended to be those with difficulty
collecting homeowner's fees.
Chairman Runyon stated that it needed to be clarified that Eagle County would only receive about 7% of
this total collection.
Commissioner Fisher asked about the payback priority.
Mr. Hermes stated that the bond holders and the debt holders would be paid first and the partnership would
be the last to be paid.
Mr. Collins stated that the developer would still need to build and pay for some of the infrastructure for the
development.
Chairman Runyon spoke about the road issue and the addition of water and sewer mills.
Mr. Morris stated that the road issue included the wording in the service plan and this language might be
changed. There was a way to keep this flexible. The service plan as a whole was dependent upon the Preliminary
Plan approval and the road issue would be resolved at that time. There were some timetables included which have
language that did not exist in the Eagle County planning approval process. He would work with the developer's
representative to clarify this timetable.
Mr. Collins expressed a willingness to work with Mr. Morris.
Commissioner Stavney spoke about the difference between infrastructure funding responsibilities. With an
entirely new development it was somewhat challenging. He was not interested in setting a precedent.
Chairman Runyon stated that his position was that the maintenance and upkeep of the roads would be the
districts'.
Mr. Morris stated that he had reviewed the conditions and findings.

Commissioner Fisher spoke about the duplicity of services related to the Recreation Districts. She was
concerned about the unique type of community development.
Chairman Runyon opened public comment. There was none. He closed public comment.
