She recognized the HHS staff. Older adults in the county are challenged and needed us to reach out and help them and provide the needed resources as many are unable to care for themselves and have no one to support them. She thanked Caroline Murphy, Sherry Almond and Jhandery Martinez the backup caseworker. They constituted the Adult Protective Services Team. She recognized the Economic Services staff. There was an adult protection team to bring ideas and referrals to the table. Chairman Runyon thanked Ms. Kasper for her hard work as well. Ms. Kasper encouraged everyone to reach out to older residents to help them in many ways. Commissioner Stavney thanked Ms. Kasper as well for their ongoing work on this issue. RESOLUTION DESIGNATING JUNE 15, 2012 AS EAGLE COUNTY ELDER ABUSE AWARENESS DAY WHEREAS, Eagle County's older adults are valued members of our community; and WHEREAS, abuse of older adults is an under - recognized problem with devastating and even life threatening consequences; and WHEREAS, combating abuse of older adults will help improve the quality of life for all citizens of our communities and will allow older adults to continue to live as independently as possible and contribute to the life and vibrancy of Eagle County; and WHEREAS, Eagle County's older adults should be treated with respect and dignity as they continue to serve as leaders, mentors, volunteers and important and active members of our communities; and WHEREAS, Eagle County honors the countless contributions of its older adults and recognizes all efforts to end elder abuse as vital to the interests of the citizens of this county. WHEREAS, the Board of County Commissioners of the County of Eagle, State of Colorado (hereinafter "the Board ") encourages all Eagle County citizens to "Take a Stand" in Fight Against Elder Abuse by learning the signs of elder abuse and neglect, providing respite for a caregiver, reaching out to isolated older adults or participating in awareness events. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: 1 06/19/2012 THAT June 15, 2012 be proclaimed Elder Abuse Awareness Day in Eagle County. THAT, the Board hereby finds, determines and declares that this Resolution is necessary for the public health, safety and welfare of the residents of the County of Eagle, State of Colorado. Commissioner Stavney read the resolution for the record and moved to approve the resolution designating June 19, 2012 as Elder Abuse Awareness Day. Commissioner Runyon seconded the motion. Resolution 2012 -068 Approval of a 1041 Permit for a Major Extension of Mid - valley Metropolitan District Domestic Water and Wastewater Treatment Systems, Efficient Utilization of a Municipal Water Project, and Waiver of Special Use Permit Requirements Bob Narracci, Planning Chairman Runyon asked the Attorney's Office if there were any changes to the Consent Agenda. Bryan Treu, County Attorney stated that there was one clarification with Item Q. Under condition 2 dealing with vesting, the vesting was contingent on a few things such as getting funding by a certain date, getting a building permit by a certain date, and getting an agreement with CDOT, etc. He spoke of another condition; number 8 that dealt with getting final design plan review from the county. Engineering believed it should be added under condition 2. He believed it did not matter if it was placed under condition 2 as all conditions needed to be dealt with. There were 9 conditions they had to be met to continue their vested rights. Commissioner Stavney spoke about the three issues dealing with ECO transit. Kelley Collier spoke about the various issues. They were excited about the grants received and one of these grants would allow replacement buses. There was also a grant for operating reimbursement. They would be adding bus stop enhancements in Eagle along Highway 6 near Corky's. Chairman Runyon shared that the buses added many miles in a given year. Ellie Caryl spoke to the board about the right of way deal for the Eagle to Dotsero trail. This would allow the completion of that portion of the trail by the fall. She stated that the BLM portion was about 1/4 of a mile. The remainder of the route was through CDOT right of way. The BLM was aware of the pending request to cross their lands through Red Canyon. The Red Canyon request was an amendment to an existing request. She added that there was an ongoing conversation about existing taxes that might be used for trails with approval of the voters. Mr. Montag spoke about Item J. He wondered if the contract in addition to the fees covered the costs. Ray Merry explained that it did not come close. Special Events took a lot of time. Chairman Runyon wondered about rates charged. Mr. Merry stated that these rates were set by statute. The Colorado Restaurant Association tried to make sure fees were fair across the state. Their goal was to educate the establishments in food safety. The value was to the local community and the visiting public. 3 06/19/2012 Chairman Runyon suggested looking for every opportunity to increase fees to pay for these programs. He added that Eagle County could be harmed by a major outbreak in food borne illnesses. Commissioner Stavney moved to approve the Consent Agenda, Items A -R. Commissioner Runyon seconded the motion. Of the two voting Commissioners, the vote was declared unanimous. Citizen Input Chairman Runyon opened and closed citizen Input, as there was none. Commissioner Stavney moved to adjourn as the Eagle County Board of County Commissioners and re- convene as the Eagle County Local Liquor Licensing Authority. Commissioner Runyon seconded the motion. Of the two voting Commissioners, the vote was declared unanimous. Eagle County Liquor License Authority Kathy Scriver, Clerk and Recorder's Office APPLICANT: DVT, Inc. DBA: Downvalley Tavern REPRESENTATIVE: Drew and Bonnie Scott, Owner(s) LOCATION: 64 El Jebel Road — El Jebel REQUEST: Modification of Premises STAFF REPRESENTATIVE: Kathy Scriver CONCERNS / ISSUES: None DESCRIPTION: The applicant has requested a permit to modify the licensed premises. The applicant wishes to include a grass area of approximately 4,200 square feet located adjacent to the restaurants outdoor patio area. The area will provide an outdoor venue for summer BBQs and other activities. The area is included in the lease but an approval by the property owner must be given prior to any large events. The area is fenced with a permanent 4 ft. fence. Signage will be posted at the entrance and exits. STAFF FINDINGS: • 1. The application is in order, all requirements have been met, and all fees are paid. 2. Public notice was given by posting a notice in a conspicuous place on the premises, June 8, 2012, at least 10 prior to the hearing. 3. No protests have been filed in the Clerk's Office. DISCUSSION: Ms. Scriver explained the request. There was permanent fencing around an area that would be used mostly during the summer for barbecues and outside service. Drew Scott explained that they would post permanent signage around the outside area. Commissioner Stavney spoke about the issue related to land ownership. Mr. Scott stated that the landowner installed the fencing. 4 06/19/2012 Chairman Runyon opened and closed public comment, as there was none. Commissioner Stavney moved that the Local Licensing Authority approve the modification of premises for DVT, Inc. d/b /a Downvalley Tavern as presented. Commissioner Runyon seconded the motion. Of the two voting Commissioners, the vote was declared unanimous. APPLICANT: The Literacy Project REQUEST: Special Event Permit EVENT: Spanish Rodeo DATE: Sunday, July 8, 2012 REPRESENTATIVE(s): Colleen Gray and Roberto Hermosillo LOCATION: Eagle County Fairgrounds — 0426 Fairground Road, Eagle STAFF REPRESENTATIVE: Kathy Scriver CONCERNS: None DESCRIPTION: The applicant has requested a permit for a Spanish/Jaripeo Rodeo being hosted by Promaclones Ejecutivos and being held at the Eagle County Fairgrounds. Beer (by the can) will be available for purchase from 12:00 to 9:00 pm. Promoclones Ejecutivos will oversee the security and food service. The event will feature a rodeo type activities and live music. The applicant expects 2,500 attendees (per their lease agreement with the county). STAFF FINDINGS: 1. This application is in order, all application requirements have been met, all necessary documents have been received, and all fees have been paid. 2. Public notice has been given by the posting of a sign in a conspicuous place on the premises June 8, 2012, at least 10 days prior to the hearing. 3. There have been no protests filed with the Clerk and Recorder's Office. 4. The applicant has provided proof of server training and alcohol management plan. 5. Eagle County Sheriff's Office has been notified. DISCUSSION: Colleen Gray spoke to the board. Roberto Hermosillo could not attend the hearing. There would be music and a rodeo and many people attending. Ms. Gray stated that they needed more volunteers to staff the event. She felt they could manage this event well to raise money for the Literacy Project. Chairman Runyon wondered about limiting the alcohol consumption area. Commissioner Stavney also wondered about further restriction of the consumption boundary. He wondered how they would monitor the back side of the property. Chairman Runyon stated that the Fair and Rodeo had a huge number of volunteers in comparison. Ms. Scriver indicated that there was still time to table the request and defer the decision until July 3. Commissioner Stavney stated that Roberto has done this type of thing before and he was comfortable with approving the file even though Roberto was not present to answer a few security issue questions. Commissioner Stavney moved that the Local Liquor Licensing Authority approve the Special Event Permit for the Literary Project as presented and incorporating staff's findings Commissioner Runyon seconded the motion. Resolution 2012 -069 Adopting Eagle County Medical Marijuana Business Licensing Regulations County Attorney's Office Representative Bryan Treu Mr. Treu stated that the purpose was to effectuate positions the board has already taken. There must be buffers between certain uses. The county decreased the distance from schools to 200 feet due to the proximity of commercial districts to existing schools. The County required odor control, interference restrictions, payment of possession and tax payments, state application completion. County license requirements would go into effect July 1. The Planning Director would be given responsibility to administer these licenses. Chairman Runyon spoke about the 1000 foot state requirement and the fact that Eagle County had changed it to 200 feet. He added that this length was already fairly limiting. This distance made sense for the layout of the county. Chairman Runyon opened and closed public comment, as there was none. Commissioner Stavney moved to approve the resolution adopting Eagle County Medical Marijuana Business Licensing Regulations. Commissioner Runyon seconded the motion. Of the two voting Commissioners, the vote was declared unanimous. PLANNING COMMISSION DELIBERATION: At their regularly scheduled meeting on Wednesday May 16 the Eagle County Planning Commission voted unanimously to approve the Special use ZS -3627 (808 Distillery) with the additional condition #3 as found in this staff report. Approve the [SPECIAL USE PERMIT] request without conditions if it is determined that the petition will not adversely affect the public health, safety, and welfare and the proposed use is attuned with the immediately adjacent and nearby neighborhood properties and uses and the proposal is in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan (and/or other applicable master plans). 2. Deny the [SPECIAL USE PERMIT] request if it is deter mined that the petition will adversely affect the public health, safety, and welfare and/or the proposed use is not attuned with the immediately adjacent and nearby neighborhood properties and uses and the proposal is not in compliance with both the Eagle County Land Use Regulations and with the guidelines of the Eagle County Comprehensive Plan (and/or other applicable master plans). 3. Table the [SPECIAL USE PERMIT] request if additional information is required to fully evaluate the petition. Give specific direction to the petitioner and staff. 4. Except as otherwise modified by this development permit, all material representations made by the Applicant in this application and in public meeting shall be adhered to and considered conditions of approval. 2. This Special Use Permit shall be valid for a period of not more than three (3) years prior to actual implementation of the permitted use. Upon implementation of the approved use, such permit shall remain valid, in perpetuity, and shall run with the land, provided that ownership changes and the new owner chosen to continue the use, staff will evaluate the new owner's business plan for compliance with this special use. DISCUSSION: Mr. Hanagan spoke about the request using a PowerPoint slide show. This would be a home business and micro - distillery. He reviewed details of the request. Staff had no substantive concerns. Claude Seeman and Geoffrey Leonardo were present as the owners. They were initially solely focused on sales within Eagle County. Chairman Runyon wondered about deliveries of raw materials and outgoing finished product. Mr. Seeman stated that he expected 6 vehicle trips per day with materials coming in via his pickup truck and later with a delivery van. Commissioner Stavney stated that he was comfortable due to the rural and isolated nature of the residential location. He wondered about future success and associated increase in traffic activity. Mr. Seeman stated that he had to get his licenses and permits in place before he developed a product. The whole business was "cart before the horse" reality. Aged liquors were required by federal statute to have an age declaration on the label unless they were two years or more old. Commissioner Stavney was mildly concerned about future success and expansion requests. If the operation became more industrial, it would no longer qualify as a home business. Chairman Runyon wished the owners good luck in their endeavor. Chairman Runyon opened and closed public comment, as there was none. Commissioner Stavney moved to approve file no. ZS -3627 808 Distillery. Commissioner Runyon seconded the motion. Of the two voting Commissioners, the vote was declared unanimous.
