She recommended Becky Larson and spoke about her qualifIcations. Ms. Larson currently served as the Epidemiologist and Planner for Public Health. Ms. Vitale believes Ms. Larson has a clear personal passion for the work of public health and passion for moving the county forward. Ultimately, the senior management team in HHS, herself, and the public health team feel that Ms. Larson is the best fIt out of all the candidates that they interviewed. Ann Robinson stated that Ms. Larson is an outstanding candidate and it was a unanimous decision by the Public Health Team. Bethany Van Wick stated that Ms. Larson understood the team and the work of public health at a local level. Her background and past experiences would help lead the team through the changes that public health would experience in the coming years with Senate Bill 194. Mike Johnson, representing the County Assessors Office spoke about schedule no.R056776. He stated that the abatement was denied based on the Town of Eagle data supported that the property was vacate as of January I, 2007 therefore the assessment records were correct. For the 2008 appeal, comparable sales were used from January 1,2005 thru June 30,2006, which indicated a value of$619,830.00 for the 2008 tax year. Commissioner Runyon recommended that when the recommendations are sent to the applicants the assessor's data be included. Commissioner Stavney moved that the petitions for abatement/refund of taxes for Elizabeth Behlendorf, Schedule No. R056776 be denied for the tax years 2007 and 2008 in the amounts and for the reasons set forth in the Assessor's recommendation sheets. Of the two voting Commissioners, the vote was declared unammous. 40 11/03/09 Ed Smith from the Assessor's OffIce stated that most of the files were no shows. He suggested moving forward with the Luppens file frrst as Carl and Diane Luppens were present. Mr. Luppens stated that he was one of the unfortunate owners of some vacant land in Brightwater. He spoke about the market decline and latent fraud by the developers. Their abatement petition was based on the changed conditions and the fact that there had been very few sales in the last few years. The property was assessed at $375,000 for 2007 and 2008. He believed the property was currently worth $85,000-$100,000. He believed that property owners in this situation should have the benefIt of the doubt. Commissioner Stavney stated that it was extremely unfortunate situation and wondered if there was a criminal case currently open. Mr. Luppens stated that attorneys had been retained but most property owners were waiting to see what would happen when a new board was elected. Christina Hooper, Assistant County Attorney stated that looking at values of 2007 and 2008 the county was bound by state statute to look at comparable sales that occurred during the base period for those tax years. Mark Chapin, County Assessor stated that every sales transaction that occurred in the development included golf memberships, and/or other considerations and the doc fees included those elements. This was not legal under CRS 39-13-106. The County Board of Equalization made a determination on the petitioner's property for 2009 and lowered the value to $150,000.00. He would love to honor the current economics and would do so in time but could not lawfully at this time. Mr. Luppens stated that he was not arguing current economics to pass value he was arguing the physical package of property rights. Commissioner Stavney wondered if the county had any flexibility through statute. Ms. Hooper stated that the county was bound by statute as far as setting value for 2007 and 2008. Mr. Chapin stated that the he would love to honor the current economics but his hands were tied. His offIce was trying to work with all the property owners and do the right thing within the confInes of state statutes. Chairman Pro-Tern Runyon stated that there seemed to be a range of assessments on the undeveloped lots. He asked Mr. Chapin is he was comfortable after making the adjustments for the golf memberships that within statute he had made the best assessment possible. Mr. Chapin stated that his offIce requested contracts from all the buyers so they can identify intangible elements. Commissioner Stavney stated that the lots seemed to vary in value. He wanted to know why there was such a range in pricing. Dixie Kozinski, county assessor stated that there were different areas within Brightwater that varied in price. The Luppin's lot was larger than the rest. She looked at sales that occurred specifIcally along the Luppin's street and within the said time frame and those sales after the golf membership was backed-out ranged in price from $368,400.00 to $393,500.00 and supported the $375,000.00 value. Commissioner Runyon wondered if the hearing needed to be continued to gather more information. He was sympathetic to the buyers in Brightwater and he did not see a happy resolution. Mr. Luppens believed that the Assessors' OffIce had done a good job. Mr. Chapin requested more time to gather better information regarding all the Brightwater sales.
