Chairman Runyon asked the Attorney's Office if there were any changes to the Consent Agenda.
Bryan Treu, County Attorney stated that there were no changes to the consent agenda.
Commissioner Menconi moved to approve the Consent Agenda, Items A-J.
Commissioner Fisher seconded the motion. The vote was declared unanimous.

Citizen Input
Chairman Runyon opened public comment.
Rick Cook was present to discuss the new addition to the Eagle County skate park. He stated that Alpine
Engineering had been working on the site plan for the park and the plan was almost complete. The funding was
coming along however a commitment from the county was needed before the other partners would release any
funding. The other partners requested that the monies be deposited with the county and that the county manage the
project.
Commissioner Fisher stated that she understood early on that the county had already committed to
managing the project.
Mr. Cook stated that the agreement hadn't been finalized. They are ready to begin construction this month
and he needs to get any contracts signed and ready to go. WECMRD would like to see the county participate in
funding whether it's matching funds or otherwise.
Chairman Runyon wondered if a work session between the other funding partners would be necessary. He
would like to know the complete cost for the park upfront.
Mr. Cook stated that the construction company would be putting the final numbers together. He estimated
the total cost to be around $300,000.00.
Chairman Runyon wondered how much each partner would be contributing.
Mr. Cook stated that he would provide a breakdown of the numbers.
Commissioner Fisher wondered if it wouldn't be a good idea for Mr. Cook to meet with Tom Johnson.
Mr. Baumgartner requested that the site plan, contractor contracts, and commitments be submitted to the
county for review. The commissioners would then need to decide the county's contribution.
Mr. Treu asked ifit would be a GMP (guaranteed maximum price) contract.
Mr. Cook stated that it would.
Mr. Treu stated that if the county is going to be the contracting agent it would draft its own contracts.
Commissioner Fisher suggested that Mr. Cook meet with Mr. Baumgartner, Tom Johnson, and John Lewis
to determine what agreements might be necessary.
Mr. Cook stated that at the last meeting Commissioner Menconi had some issues with funding other
applications.
Commissioner Menconi stated that if there were other applications the commissioners might need to
prioritize the higher need.

The intent of this plat is to create a nine (9) acre single family lot with a building envelope); a second
building envelop for manager residence; a new road alignment; a trail easement; and irrigation and utility
easements.
This Plat is concurrent with the approval of an equestrian facility. The Frost Creek & Salt Creek PUD
approved in 2005 and required a Special Use Permit process to allow for the development of the an

Section Purpose:
At the meeting on the Final Plat for Subdivision, the Board of County
Commissioners shall review the Final Plat, the submittal materials, provide both
County staff and the applicant an opportunity to comment, and approve or
disapprove the Final Plat for Subdivision based on whether it conforms to the
approval given to the Preliminary Plan for Subdivision and the standards in
Section 5-280.B.3.e., Standards., considering specifically the adequacy of required
improvements and the acceptance of areas dedicated for public use and easements.

Pursuant to Section 5-280.B.5.b (3), of the Eagle County Land Use Regulations, it has been found

DISCUSSION:
Ms. De Graaf stated that the applicant has had difficulty with their vendor getting the corrections of the plat
back to the County for re-review.
Commissioner Fisher moved to table file no. PDF-OOlOO Salt Creek/Frost Creek PUD Final Plat until June
24,2008, at the applicant's request.
Commissioner Menconi wondered if the applicants could continue tabling the file and if the board had
some authority.
Mr. Morris stated that there was nothing in the regulations, which limits the number of tab lings although;
the board has the power to decline tabling an application. The board can tailor a time limit.
Commissioner Menconi stated that he would like this to be the last time the applicant is permitted to table
the file.
Mr. Morris stated that it is not all together the applicants fault. There have been some complications within
the county Engineering Department as well as time spent on developing the conservation easement.
Chairman Runyon asked Ms. De Graaf if there was a reasonable expectation that the file will proceed
forward.
Ms. De Graaf stated that the applicant had requested that their vendor focus on this plat in order to make
the June 24th deadline.
Commissioner Menconi seconded the motion. The vote was declared unanimous.

Ms. Skinner-Markowitz presented the applicant's request as well as various photos of the site. The primary
reason for the amendment is to modify the lot line between 6 & 7 in order to provide the owners of lot 6 a larger
backyard. She stated that the applicant had satisfied all of the minimum standards required for an amended final
plat.
Ulf Lindroth, the applicant, was present. He stated that Ms. Skinner-Markowitz had been very helpful
through out the process. The modification would not affect anyone else and neighboring property owners do not
appear to have any concerns.
Chairman Runyon opened and closed public comment, as there was none.
