Consent Agenda
Chairman Stone stated the first matter before the Board was the Consent Agenda as follows:
A. Approval of Bill Paying for the Week of May 3,2004, subject to review by the County
Administrator
B. Approval of the Minutes of the Eagle Board of County Commissioners Meeting for
April 19,2004
C. Bills of Sale for the Berry Creek Middle School Water Main Extension and the Sewer
Line Relocation of the Berry Creek/Miller Ranch PUD

E. Intergovernmental Agreement Between the Town of Gypsum and County of Eagle

Chairman Stone asked the Attorney's Office ifthere were any changes to the Consent Agenda.
Diane Mauriello, County Attorney, requested item E, the Agreement with the Town of Gypsum,
be pulled and scheduled next week. She also asked that item G, the Agreement with Carolyn Sloan
Burton M.D., be pulled until received and reviewed by County Attorney.
Chairman Stone stated he would like to discuss item H, the agreement between WECMRD and
Eagle County for provision of maintenance for the Berry Creek Recreation Site.
Rich Cunningham, Director of Facilities Management, explained this is a contract for specific
services and not a lease for areas outside of their current leased area. This contract will be for the right-
of-way and the pond area.
Chairman Stone stated the current lease states "the District shall keep all fields and all equipment
facilities and fixtures in good order and in a clean, sanitary safe, esthetically pleasing condition,
permitting no waste, damage or injury to the fields". Commissioner Stone stated he received a few
telephone calls and e-mails from people who were upset after the soccer tournament as the fields were
not cleaned. He stated he does not believe the County should being paying for something that the
District is supposed to currently be doing. He related there is an opportunity to have a one time fee or
on a per hour basis.
Chairman Stone suggested the stakes and collars around the trees be removed.
Commissioner Menconi moved to approve the Consent Agenda as presented, pulling items E and
G.
Chairman Stone seconded the motion. Of the two voting Commissioners the vote was declared
unanimous. Commissioner Gallagher was not present due to a continuing medical condition.
Plat and Resolution Signing
Chairman Stone stated there are no plats and resolutions for the Board's consideration today.
Resolution 2004-051, Designating May 2004 as 'Firewise Month' in Eagle County
Chairman Stone stated the next item before the Board was Resolution 2004-051, designating
May 2004 as Firewise Month in Eagle County.
Commissioner Menconi read the resolution for the record as follows:
"Whereas, the Board of County Commissioners of the County of Eagle, State of Colorado
(hereinafter the "Board") acknowledges that wildfire poses a significant threat to life and property in
Eagle County;
Whereas, the actions of citizens in becoming prepared to deal with and prevent potential fires are
critical to life safety and property conservation;
Whereas, the most valuable tool that our citizens possess is knowledge of the hazards and
prevention and/or mitigation techniques; and
Whereas, the Board wishes to join the area fire departments in spreading the "Firewise" message
and encouraging all citizens of Eagle County to become knowledgeable on how to mitigate the threat of
wildfire in their homes, places of business, and communities.
Now, therefore, be it resolved by the Board of County Commissioners ofthe County of Eagle,
State of Colorado:
That, the Board hereby finds, determines and declares that the Month of May, 2004, shall be
designated as "FlREWISE MONTH" in Eagle County in order to emphasize wildfire preparedness and

That, the board hereby finds, determines and declares that this Resolution is necessary for the

Moved, read and adopted by the Board of County Commissioners of the County of Eagle, State
of Colorado, at its regular meeting held the 4th day of May, 2004.
Commissioner Menconi moved to approve Resolution 2004-051, designating May 2004 as
Firewise Month in Eagle County.
Chairman Stone seconded the motion.
In discussion, Ben Garrett, Wildfire Mitigation Specialist, stated the year is looking like a fairly
dry year due to low snow pack. He stated they are looking at some fire hazards. Staffhas been in
contact with several homeowners who want to do some fire prevention. Mr. Garrett stated he has
brochures he will be distributing to the schools and has put together a CD that staff will be getting out to
the public.
Chairman Stone called for the question on the motion. Of the two voting Commissioners the
vote was declared unanimous.
Resolution 2004-052 Designating May 2004 as 'Older Americans Month'
Chairman Stone stated the next Resolution before the Board is Resolution 2004-052, designating
May 2004 as Older Americans Month.
Commissioner Menconi read the resolution for the record as follows:
"Whereas, the Board of County Commissioners of the County of Eagle, State of Colorado
(hereinafter "the Board"), wishes to celebrate "Aging Well, Living Well" during May, 2004, which is
Older Americans Month; and
Whereas, The Board recognizes that citizens of Eagle County are representative of an
unprecedented trend in the nation's demographic makeup; and
Whereas, The Board recognizes that Older Americans are, as citizens and community members,
entitled to lives of dignity and independence, free from fears, myths and misconceptions about aging;
and;
Whereas, the Board desires to recognize that, as America grows older, each community must
strive to understand and address the evolving challenges and needs of our older citizens and the people
who care for them; and
Whereas, The Board recognizes that our society is dependent upon the nurturing, support, and
resources shared between generations, and benefits from our mutual efforts to meet the needs of
America's older persons and those who love them; and
Whereas, the Board recognizes the need for our County to continue working to fulfill our
obligations to Older Americans by providing them with services to enhance their lives; and
Now, therefore be it resolved by the Board of County Commissioners of the County of Eagle,
State of Colorado:
That, May 2004 be designated as Older Americans Month in Eagle County and be celebrated by
families and communities throughout Eagle County.
That, the Board hereby finds, determines and declares that this Resolution is necessary for the
public health, safety and welfare of the residents of the County of Eagle, State of Colorado.

In discussion, John Lowry, Eagle County Senior Services, stated there are several sites for
seniors around the County and present today is a sampling of those seniors. He stated Seniors make a
difference in our lives everyday. He presented the Board with a cake and candy.
Chairman Stone thanked the Seniors for their efforts.
Virginia Rose, Senior, thanked the Board for everything the County does for their seniors.
Commissioner Menconi stated it is a joy to see the Seniors and their smiling faces. He thanked
them for all they do for the community.
Chairman Stone mentioned the programs the seniors are involved in such as the RSVP program.
He stated all three Commissioners appreciate the young and the old. Without the wisdom of the seniors
they would continue to make mistakes. The young are the future of all.
Chairman Stone called for the question on the motion. Of the two voting Commissioners the
vote was declared unanimous.
1041-0053 Heritage Park
Chairman Stone stated the next matter is Heritage Park, file numbers 1041-0053, PDP-00026 and
2C-00065.
Joseph Forinash, Planner, stated the applicant is requesting these files be tabled to June 15,2004
when there will be a full Board.
Terrill Knight, Knight Planning, representing the applicant, stated they and County staff had
notified all neighbors
Chairman Stone stated it appears that the delay has been beneficial to the applicant as some of
the previous issues have been resolved.
Mr. Knight stated it has been beneficial and they have put in a maximum effort to work with the
residents ofthe neighborhood.
Chairman Stone suggested the applicant continue to work with the neighbors before this file
comes before the Commissioners.
Mr. Knight concurred.
Commissioner Menconi moved to table file numbers 1041-00053, PDP-00026 and 2C-00065,
Heritage Park, to June 15,2004, at the applicant's request.
Chairman Stone seconded the motion. Of the two voting Commissioners the vote was declared
unammous.
Government Week Art Contest Awards
Chairman Stone stated the next item before the Commissioners was the Government Week Art
Contest Awards. He stated this art contest was a part of National Government Week and was open to
all local middle and high school art students. Three schools participated this year, Vail Mountain
School, Art Teacher Lauren Merrill, Eagle Valley High School, Art Teacher Sue March, and Minturn
Middle School, Art Teacher Wendy Satsky. Chairman Stone stated there were 46 entries, 21 Middle
School and 25 High School. Cash awards will be as follows:

Chairman Stone stated the most enjoyable part of being in Washington D.C. is the tunnel
between the Senate and Congress is the art work. He stated thousands of people walk that tunnel and
see the art on display.
