Matt Gennett, Planner, presented the following plats and resolutions for the Board's
consideration:
5MB-00291. Village Townhomes At Arrowhead Phase III. He stated this was a Type
B Minor Subdivision intended to subdivide a portion of Lot 31A to create six residential condominium
units and related general and limited common elements. Staff findings are as follows:
Pursuant to Section 5-290 (G) (1) of the Eagle County Land Use Regulations:
5-290 (G) (1) Standards for Type A and Type B Subdivision
(G) Standards. The Board of County Commissioners and the Community Development Director
shall consider the following in the review of a Type A Subdivision, a Type B Subdivision, and an
Amended Final Plat.
Standards for Type A and Type B Subdivision.
a) Access, potable water, and sewage disposal on the land to be subdivided are adequate;
b. The plat does conform to Final Plat requirements and other applicable regulations,

Resolution 2002-004. To Approve A Special Use Permit For The Learning Camp.
Inc. Eagle County File No. ZS-0008S. The Board considered this application at its regular hearing of
October 30th, 200l.
Commissioner Menconi moved to approve Resolution 2002-004, to approve a special use permit
for The Learning Camp, Inc.

Final Settlement, Colorado Strijpe Wright, Ltd
Tom Moorhead presented final settlement with Colorado Strijpe Wright, Ltd, for the 2001
centerline marking project. He stated this matter was published and no claims have been received.
Commissioner Menconi moved to approve final settlement with Colorado Strijpe Wright, Ltd,
for the 2001 centerline marking project.

Final Settlement, GMCO Corporation
Tom Moorhead presented final settlement with GMCO Corporation. This matter was published

Final Settlement, Bogue Construction

Final Settlement, Danco Building Systems
Tom Moorhead presented final settlement with Danco Building Systems for general aviation
maintenance hangar renovation at the Eagle County Regional Airport. This matter was published and no
claims have been received.
Chairman Pro-tern Gallagher asked if this was the hangar being used for storage.
Eddie Storer, Acting Airport Manager, answered yes.
Commissioner Menconi moved to approve final settlement with Danco Building Systems for
general aviation maintenance hangar renovation at the Eagle County Regional Airport.
Chairman Pro-tern Gallagher seconded the motion. Of the two voting Commissioners the vote
was declared unanimous.
Final Settlement, Granite Construction Company
Tom Moorhead presented final settlement with Granite Construction Company for improvements
to Eagle County Regional Airport. This matter was published and they have received two verified
claims one from Brinkley Electric for $250,000.00. He stated Brinkley Electric has filed a cause of
action against Granite Construction Company in Eagle County District Court. Eagle County has been
named a party to that law suit but only as the holder of funds. The second verified claim is from Rocky
Mountain Redi-Mix in the amount of $34,000.00. They were a sub-contractor of Brinkley Electric. He
stated he is recommending approval of final settlement but no monies will be disbursed until the claims
have been settled and the County receives direction from the Courts. He stated approving final
settlement will close the account to any further claims.
Chairman Pro-tern Gallagher asked how the Board can approve final settlement that could be
inconsistent with Court action.
Mr. Moorhead stated the action of the Board today is taking care of the requirement of
publication and will be closing the file so that no further claims can be received. They are aware that
there are two verified claims that will affect the distribution of the funds.
Commissioner Menconi moved to approve final settlement with Granite Construction Company
for improvements to Eagle County Regional Airport.
Chairman Pro-tern Gallagher seconded the motion. The vote was declared unanimous.
Settlement Stipulations
Tom Moorhead stated the next item on the agenda was approval of the settlement stipulations for
the Board of Assessment Appeals. He stated there are seven stipulations as follows:
Schedule number RO 11979, P & R Partners LLC, the property is located at 228 Bridge Street in
Vail, the Board of Equalization value is $1,365,960.00 and the stipulated value is $1,250,000.00.
Schedule number RO 11981, P & R Partners LLC, the property is located at 228 Bridge Street,
Vail, the Board of Equalization value is $73,350.00 and the stipulated value is $38,300.00.
Schedule number RO 11982, P & R Partners, LLC, the property is located at 228 Bridge Street,
Vail, the Board of Equalization value is $211,510.00 and the stipulated value is $181,700.00.
Schedule number R017420, Elizabeth Kuehn Cason, the property is vacant land in sections 11
and 14, township5, range 85, the Board of Assessment value is $836,350.00 and the stipulated value is
$1,020.00.
Schedule number R043156, John Kaemmer Trustee, the property is located at 278 Hanson Ranch
Road, Vail, the Board of Equalization value is $800,160.00 and the stipulated value is $693,470.00.
Schedule number R043158, Bolanovich Trust, the property is located at 278 Hanson Ranch
Road, Vail, the Board of Equalization value is $450,090.00 and the stipulated value is $390,080.00.
Schedule number R043159, Bolanovich Trust, the property is located at 278 Hanson Ranch Road
in Vail, the Board of Equalization value is $113,010.00 and the stipulated value is $81,180.00.

National Guard Annexation Withdrawal Consideration
Diane Mauriello, Deputy County Attorney, stated the next item before the Board was
consideration of withdrawal of the annexation petition from consideration at the Town of Gypsum of the
National Guard Facility. She stated if the Board would like to change the legal description to narrow it,
they would withdraw the petition, have the surveyor redefine the legal and resubmit the petition to the
Town of Gypsum.
Commissioner Menconi moved the Board withdraw the First National Guard Annexation
Petition from consideration by the Town of Gypsum.
Chairman Pro-tern Gallagher seconded the motion. Of the two voting Commissioners the vote
was declared unanimous.
Cooley Mesa Road Annexation Reconsideration
Diane Mauriello stated next was reconsideration of the Annexation Agreement concerning the
second Cooley Mesa Road annexation and withdrawal of the annexation petition from consideration by
the Town of Gypsum. If the Board would like to revisit the legal description they will withdraw the
petition, have the surveyor redefine it and resubmit the petition to the Town of Gypsum.
Chairman Pro-tern Gallagher stated it was his understanding that the current legal description
includes a portion of the road that could be moved at a later date.
Ms. Mauriello stated that was correct.
Commissioner Menconi moved the Board withdraw approval of the annexation agreement
concerning Second Cooley Mesa Road Annexation and further that the Second Cooley Mesa Road
Annexation Petition be withdrawn from consideration by the Town of Gypsum.
Chairman Pro-tern Gallagher seconded the motion. Of the two voting Commissioners the vote
was declared unanimous.
Contract to Buy & Sell, Golden Eagle Elderly Housing
Diane Mauriello presented a Contract to Buy and Sell Real Estate, Lot 1 B, Golden Eagle Elderly
Housing, Eagle County, Colorado. She stated the Board has an offer to purchase this complex. If signed
by the Board the contract will then go to the seller who will have until 5:00 p.m. January 9, 2001 to
either accept, reject or make a counter offer. The terms are set forth in the agreement as well as the
purchase price of $1,600,000.00. It is estimated the loan assumption will be $1,070,000.00 with grant
monies being applied of $306,000.00
Commissioner Menconi moved to approve the Contract to Buy Lot 1B, also known as the
Golden Eagle Elderly Housing Complex, for $1,600,000.00 and the Chairman shall be authorized to sign
such contract.
Chairman Pro-tern Gallagher seconded the motion.
In discussion, Jack Ingstad, County Administrator, asked about releasing the entire $100,000.00
but rather just the earnest money.
Ms. Mauriello stated just the earnest money at this point, which is $25,000.00.

Commissioners the vote was declared unanimous.
Commissioner Menconi moved to adjourn as the Board of County Commissioners and reconvene
as the Local Liquor Licensing Authority.

Vail Resorts since 1997 and is changing to another establishment. He is
reported to be of good moral character.

This is a manager's registration for Jeanne Adams. She has worked for
Vail Resorts in the past and is changing to another establishment. She is
reported to be of good moral character.

Earlene Roach presented a transfer of ownership of a hotel and restaurant license with optional
premises from Eagle-Vail Metropolitan District to Boulair, Inc., d/b/a Mulligan's at Eagle-Vail. She
stated this application is in order and all applicants are reported to be of good moral character. She
stated the premise remains as it was.
Larry Martinez and Mark Windell, applicants, were presented for the hearing.
Chairman Pro-tern Gallagher asked if the applicants have been involved in the service of alcohol
in the past.
Mr. Windell stated yes. He stated he has been in the food and beverage business for the past 25
years in the Vail Valley and Mr. Martinez has been involved in the Saloon in Minturn and Chilly Willy's
for the past 15 years.

this application is in order and all fees have been paid. All applicants are reported to be of good moral
character. The stated the management company remains as it has been but they will now hold the liquor
license. Also included in this applicant is a manager's registration for Robert Dallain.
Robert Dallain, General Manager, was present for the hearing.
Commissioner Menconi asked if it was the same area as before.
Mr. Dallain stated Cresent Holdings still owns the hotel. Rosestar will not hold the lease any
longer but rather the Hyatt Corporation will.
