Final Settlement, Granite Construction Company Tom Moorhead presented final settlement with Granite Construction Company for improvements to Eagle County Regional Airport. This matter was published and they have received two verified claims one from Brinkley Electric for $250,000.00. He stated Brinkley Electric has filed a cause of action against Granite Construction Company in Eagle County District Court. Eagle County has been named a party to that law suit but only as the holder of funds. The second verified claim is from Rocky Mountain Redi-Mix in the amount of $34,000.00. They were a sub-contractor of Brinkley Electric. He stated he is recommending approval of final settlement but no monies will be disbursed until the claims have been settled and the County receives direction from the Courts. He stated approving final settlement will close the account to any further claims. Chairman Pro-tern Gallagher asked how the Board can approve final settlement that could be inconsistent with Court action. Mr. Moorhead stated the action of the Board today is taking care of the requirement of publication and will be closing the file so that no further claims can be received. They are aware that there are two verified claims that will affect the distribution of the funds. National Guard Annexation Withdrawal Consideration Diane Mauriello, Deputy County Attorney, stated the next item before the Board was consideration of withdrawal of the annexation petition from consideration at the Town of Gypsum of the National Guard Facility. She stated if the Board would like to change the legal description to narrow it, they would withdraw the petition, have the surveyor redefine the legal and resubmit the petition to the Town of Gypsum. Commissioner Menconi moved the Board withdraw the First National Guard Annexation Petition from consideration by the Town of Gypsum. Chairman Pro-tern Gallagher seconded the motion. Cooley Mesa Road Annexation Reconsideration Diane Mauriello stated next was reconsideration of the Annexation Agreement concerning the second Cooley Mesa Road annexation and withdrawal of the annexation petition from consideration by the Town of Gypsum. If the Board would like to revisit the legal description they will withdraw the petition, have the surveyor redefine it and resubmit the petition to the Town of Gypsum. Chairman Pro-tern Gallagher stated it was his understanding that the current legal description includes a portion of the road that could be moved at a later date. Ms. Mauriello stated that was correct. Commissioner Menconi moved the Board withdraw approval of the annexation agreement concerning Second Cooley Mesa Road Annexation and further that the Second Cooley Mesa Road Annexation Petition be withdrawn from consideration by the Town of Gypsum. Contract to Buy & Sell, Golden Eagle Elderly Housing Diane Mauriello presented a Contract to Buy and Sell Real Estate, Lot 1 B, Golden Eagle Elderly Housing, Eagle County, Colorado. She stated the Board has an offer to purchase this complex. If signed by the Board the contract will then go to the seller who will have until 5:00 p.m. January 9, 2001 to either accept, reject or make a counter offer. The terms are set forth in the agreement as well as the purchase price of $1,600,000.00. It is estimated the loan assumption will be $1,070,000.00 with grant monies being applied of $306,000.00 Commissioner Menconi moved to approve the Contract to Buy Lot 1B, also known as the Golden Eagle Elderly Housing Complex, for $1,600,000.00 and the Chairman shall be authorized to sign such contract.
