Consent Agenda
Chairman Stone stated the first matter before the Board was the Consent Agenda as follows:
A) Approval of bill paying for the week of November 5, 2001, subject to review by
County Administrator
B) Approval of the minutes of the Board of County Commissioners meeting of October
23,2001
C) Resolution 2001-132, conferring Power of Attorney upon the Attorney's Office to
draw on Letter of Credit No. 361 in the amount of$569,102.31, for the account ofMRLD, LLC, drawn
on Weststar Bank, Letter of Credit will expire November 13,2001
D) Resolution 2001-133, appointing Bennett Pollack and Brent Smith members to the
Eagle County Fair and Rodeo Board
E) Agreement for traffic engineering services, SH 6 Access Control Plan and Corridor
Feasibility Study
F) Contract with CDOT for shared funding of the SH 6 Corridor Feasibility Study.
Chairman Stone asked the Attorney's Office ifthere were any changes to the Consent Agenda.
Tom Moorhead, County Attorney, stated there were no changes.
Commissioner Gallagher moved to approve the Consent Agenda as presented.
Commissioner Moorhead seconded the motion. The vote was declared unanimous.

Plat and Resolution Signing
Matt Gennett, Planner, presented the following plats and resolutions for the Board's
consideration:
5MB-00287. Berry Creek Ranch Filing No.4 ARe-Subdivision of Lot 48. Block 3.
He stated the intent of this Type B Minor Subdivision is to subdivide Lot 48 in order to create two Yz
duplex lots, Lots 48E and 48W, and an access easement. Staff findings are as follows:
Pursuant to Section 5-290 (G) (1) of the Eagle County Land Use Regulations:
5-290 (G) (1) Standards for Type A and Type B Subdivision
(G) Standards. The Board of County Commissioners and the Community Development Director
shall consider the following in the review of a Type A Subdivision, a Type B Subdivision, and an
Amended Final Plat.
Standards for Type A and Type B Subdivision.
a) Access, potable water, and sewage disposal on the land to be subdivided are adequate;
b. The plat does conform to Final Plat requirements and other applicable regulations,
policies, standards, and guidelines; and
c. No Improvement Agreement is applicable.
Commissioner Menconi moved to approve final plat file number 5MB-00287, Berry Creek
Ranch, Filing No.4, a resubdivision of Lot 48, Block 3, incorporating staff findings.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
Resolution 2001-134 To Approve A Special Use Permit For San Isabel Telecom
(Eagle County File No. ZS-00073). The Applicant's request was heard by the Board of County
Commissioners at a public meeting on October 16th, 2001.
Commissioner Gallagher moved to approve Resolution 2001-134, to approve a Special Use
Permit for San Isabel Telecom, file number ZS-00073.
Commissioner Menconi seconded the motion. The vote was declared unanimous.
Final Settlement, Elam Construction
Tom Moorhead presented final settlement for Elam Construction, Inc., for the 2001 overlay
project. He stated this matter was published and no claims have been received.
Commissioner Menconi moved to approve final settlement for Elam Construction, Inc., for the
2001 overlay project.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
Change Order No.2, Concrete Works for Colorado
Ed Storer, Acting Airport Manager, presented Change Order No.2 to the agreement between
Eagle County and The Concrete Works of Colorado for South Ramp Apron Expansion at the Eagle
County Regional Airport. He stated during the excavation they ran into a layer of very heavy rock and it
took longer and cost more to remove.
Commissioner Gallagher asked where the work is being done.
Mr. Storer stated it is at the very eastern end of the runway.
Commissioner Gallagher moved to approve Change Order No.2, to the agreement between
Eagle County and The Concrete Works of Colorado for South Ramp Apron Expansion at the Eagle
County Regional Airport.
Commissioner Menconi seconded the motion. The vote was declared unanimous.

Final Settlement, Concrete Works for Colorado
Ed Storer presented final settlement for Concrete Works for Colorado for improvements to Eagle
County Regional Airport. Mr. Storer stated this matter was published and no claims have been received.
Commissioner Menconi moved to approve final settlement for Concrete Works for Colorado for
improvements to the Eagle County Regional Airport.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
Settlement Stipulations
Tom Moorhead presented the settlement stipulations for Jayco LLC, schedule number R04424l,
with a stipulated value of $375,570.00, Jayco LLC, schedule number R044233, with a stipulated value
of $397,300.00, Jayco LLC, schedule number R044242, with a stipulated value of $627,130.00, Jayco
LLC, schedule number R044234, with a stipulated value of $600,000.00 and Basalt Trade Associates,
schedule number R046237, with a stipulated value of $400,000.00. He stated the groups of stipulations
today are over lO% of the value and need Board approval.
Commissioner Gallagher moved to approve the settlement stipulations for the Board of
Assessment Appeals, schedule numbers R04424l, R044233, R044242, R044234, R046237 as presented.
Commissioner Menconi seconded the motion. The vote was declared unanimous.
Mr. Moorhead spoke to the second set of stipulations, Ernest and Lisa Scheller, schedule umber
R006084, with a stipulated value of$l,6l9,l60.00, Gary Cordes and Dorothy Farrell, schedule number
R009773, with a stipulated value of$393,120.00, the Colando Company, schedule number R009783,
with a stipulated value of$I,194,460.00, the Colando Company, schedule number R009793, with a
stipulated value of$385,840.00, Richard Liebhaber, schedule number R030977, with a stipulated value
of$395,720.00, Barbara Weinstein, schedule number R009778, with a stipulated value of$829,440.00.
Chairman Stone asked about schedule R009773, Gary Cordes and Dorothy Farrell. He stated the
value went from $680,510.00 to $393,120.00.
Max Schflaley, Appraisal Coordinator, stated the appraiser looked at the property and found the
complex was over valued and she adjusted those values which resulted in a drastic decrease. He stated
one of the problems is there are small and large units in the same complex which makes it hard to value.
He stated there were two sales from this complex, one was a $600,000.00 sale and the other was for
$1,500,000.00.
Commissioner Menconi moved to approve the settlement stipulations for the Board of
Assessment Appeals, schedule numbers R006084, R009773, R009783, R009793, R030977 and
R009778
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
SUF -00006, Final Plat, Willits Family Homestead
Cliff Simonton, Planer, presented file number SUF-00006, Final Plat, Willits Family Homestead.
The Applicant/owner is requesting final approval of a subdivision that would create four (4) lots on a 2.4
acre parcel located adjacent to Willits Lane approximately 0.2 miles south of its intersection with State
Highway 82 on the north edge of the town of Basalt. Three of the lots created will accommodate
existing single family dwellings. A new vacant lot will be created for one additional home. The lots
range in size from 15,177 sq ft to 42,587 sq ft. The existing development on the site pre-dates Eagle
County zoning, with a number of the structures having been constructed nearly a century ago as part of
the original Willits Ranch. The existing driveway will be improved to accommodate emergency access
and emergency vehicle turn around, and will be named Willits Circle.
The large trees and shrubs that currently screen the site from adjacent areas will remain largely

unaffected by the subdivision and the development of the one new lot. The Mid Valley Metropolitan
District currently serves the site with domestic water and sewer, and they have agreed to provide service
to the new lot. Irrigation water is available to the site from a historic well and from the Harris & Reed
irrigation ditch which crosses the southern edge of the property.
The chronology of the application is as follows and as shown on staff report:
July 31, 2000 Subdivision Sketch Plan for the Willits Family Homestead (SUS-00007)
and the accompanying Zone Change (ZC-00034) was approved by the Board of County Commissioners.
August 14, 2000 Variance from Improvement Standards (VIS-OO 1 0) was granted that
released the applicant from requirements for curb and gutter, asphalt surfacing, and separate path ways
for bikers and pedestrians on the newly created Willits Circle.
June 5, 2001 Subdivision Preliminary Plan for the Willits Family Homestead (SUP-
00004) is approved by the Board of County Commissioners

Agreement (SIA) for this plat.

Staff findings are as follows and as shown on staff report:
Pursuant to Section 5-280.B.5.b.(3) Final Plat for Subdivision - Action by the Board of
County Commissioners:
1) This Final Plat for Subdivision conforms to the approval given to the Preliminary Plan for
Subdivision.
2) The required improvements are adequate.
3) Areas dedicated for public use and easement are acceptable.
Pursuant to Section 5-280.B.3.e Standards of the Eagle County Land Use Regulations:
1) Consistent with Master Plan. The proposed subdivision IS consistent with the Eagle County
Master Plan and the FLUM of the Master Plan;
2) Consistent with Land Use Regulations. The proposed subdivision DOES comply with all
of the standards of this Section and all other provisions of these Land Use Regulations, including, but
not limited to, the applicable standards of Article 3, Zone Districts, and Article 4, Site Development
Standards. An approved Subdivision Improvement Agreement (SIA) will be executed concurrently with
approval of the final plat.
3) Spatial Pattern Shall Be Efficient. The proposed subdivision IS located and designed to
avoid creating spatial patterns that cause inefficiencies in the delivery of public services, or require
duplication or premature extension of public facilities, or result in a "leapfrog" pattern of development.
(a) Utility and Road Extensions. Proposed utility extensions ARE consistent with the
utility's service plan or shall require prior County approval of an amendment to the service plan.
Proposed road extensions ARE consistent with the Eagle County Road Capital Improvements Plan.
(b) Serve Ultimate Population. Utility lines ARE sized to serve the planned ultimate

population of the service area to avoid future land disruption to upgrade under-sized lines.
(c) Coordinate Utility Extensions. Utility extensions DO provide the entire range of
necessary facilities.
4) Suitability for Development. The property proposed to be subdivided IS suitable for
development, considering its topography, environmental resources and natural or man-made hazards that
may affect the potential development of the property, and existing and probable future public
improvements to the area.
5) Compatible With Surrounding Uses. The proposed subdivision IS compatible with the
character of existing land uses in the area and DOES NOT adversely affect the future development of
the surrounding area.
Chairman Stone asked for public comment. There was none. He closed public comment.
Commissioner Menconi moved the Board approve File No. SUF-00006, Final Plat, Willits
Family Homestead, incorporating Staffs Findings, and authorize the Chairman to sign the plat.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
There being no further business to be brought before the Board the meeting was adjourned until
November 13,2001.
