Consent Agenda
Chairman Stone stated the first item before the Board was the Consent Agenda as follows:
A) Approval of bill paying for the week of October 1,2001, subject to review by County
Administrator

18,2001
D) Change Order No.1 to the 2001 Overlay Contract

Chairman Stone asked the Attorney's Office if there were any changes to the Consent Agenda.
Tom Moorhead, County Attorney, stated there are no changes.
Commissioner Menconi moved to approve the Consent Agenda as presented.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
Plat & Resolution Signing
Matt Gennett, Planner, presented the following plats and resolutions for the Board consideration:
AFP-00I08. pt & Main Building Condominiums. A Reconfiguration of Lot 4.
Riverwalk At Edwards. Phase 4. The intent of this Amended Final Plat is to revise parking spaces for
units EI05, E201, E203, E204, WI03, W202, and W302. He stated staff findings are as follows:
Pursuant to Section 5-290 (G) (1) ofthe Eagle County Land Use Regulations:
5-290 (G) (1) Standards for Type A and Type B Subdivision
(G) Standards. The Board of County Commissioners and the Community Development Director
shall consider the following in the review of a Type A Subdivision, a Type B Subdivision, and an
Amended Final Plat.
Standards for Type A and Type B Subdivision.
a) Access, potable water, and sewage disposal on the land to be subdivided are adequate;
b. The plat does conform to Final Plat requirements and other applicable regulations,
policies, standards, and guidelines; and

c. No Improvement Agreement is applicable.
Chairman Stone asked if this is required in the parking plan and PUD Guide.
Mr. Gennett stated that is correct and they are just changing the numbers so they correspond with
the units.
Commissioner Gallagher asked if it is necessary to have this much government in the
renumbering of parking spaces.
Chairman Stone suggested it justifies their existence.
Commissioner Gallagher moved to approve final plat file number AFP-OO 1 08, 1 st and Main
Building Condominiums, a reconfiguration of Lot 4, Riverwalk at Edwards, Phase 4, incorporating staff
findings and authorizing the Chairman to sign the plat.
Commissioner Menconi seconded the motion. The vote was declared unanimous.
Terrorism in America
Chairman Stone stated under "Other" he would like to take the opportunity to recognize Ann
Roberts who is in attendance today. He read a remembrance dedicated to Ann Roberts for her work on
the Help American Party as follows:
"On behalf of the citizens of Eagle County, we would like to express our appreciation to Ann
Roberts, Event Coordinator extra ordinaire, for initiating and coordinating the Help America Party on
September 25,2001 and raising $17,000.00 for the American Red Cross and the Salvation Army, to
assist in the recovery efforts for the victims of the September 11,2001 terrorist attacks." He stated it
was signed by the Eagle County Board of County Commissioners. He stated they would like to hear
from Ms. Roberts where she got the vision and desire to do this.
Ms. Roberts stated she is really moved by this recognition and thanked the Board. She stated she
moved out here in July and worked in NYC for thirty years living there and in Connecticut. She stated
she has many friends who live there and lost some friends in this tragedy. She spoke to watching the
television and felt that she wasn't serving any purpose. She stated she lives on the Lazy Ranch and
suggested to the Calhoun's they have a party. She stated it started out to be at the ranch but it
mushroomed to a bigger production. It was important to keep it like family. This has always felt like
home. She stated the County was great in helping to bring it together. She stated everyone rallied. It
was an amazing experience for her. No one said no. She stated it was indeed a town effort. She stated
it was an incredible spirit that came from everyone and it helped her to focus elsewhere.
Chairman Stone stated he wanted to personally thank her. There are a lot of people out there that
want to do something. Sending money is not like being together with personal friends and the
organization of this helped people to move on with their lives.
Ms. Roberts stated she has had a number of people come up to her and thank her. It gave people
something to do where they were physically doing something to help others.
Chairman Stone stated they do not hand these recognitions out blindly. He stated because it got
to be so big and because of Ms. Roberts it was able to be held at Berry Creek. He spoke to a desire to
rename the property in Edwards and suggested that they might name it Freedom Park as a permanent
memory for those people who gave their lives in this tragedy. He stated those people didn't know that
they were giving their lives, and the hope is that the loss of life will not go unnoticed. He asked Ms.
Roberts to put that out to the public and see what kind of response it gets.
Commissioner Menconi expressed his thanks for the depth of her compassion and her service to
the community.
Commissioner Gallagher thanked her as well and thanked her for her presence in our community.
Commissioner Gallagher moved to award the Certificate of Appreciation to Ann Roberts from
the Eagle County Commissioners on behalf of the citizens of Eagle County for her participation and

leadership in the Help America Party held on September 25, 2001.
Commissioner Menconi seconded the motion. The vote was declared unanimous.
Commissioner Menconi moved to adjourn as the Board of County Commissioners and reconvene
as the Local Liquor Licensing Authority.

Liquor License Consent Agenda
Earlene Roach, Liquor Inspector, presented the Liquor License Consent Agenda for October 2,
2001 as follows:
A) Edwards Discount Liquors, Inc.
South Forty Liquors
This is a renewal of a retail liquor store license. This establishment is
located next to Stop and Save along Highway 6 in Edwards. There have
been no complaints or disturbances during the past year.
B) Golden Eagle Inn, Inc.

This is a renewal of a hotel and restaurant license. This establishment is
located in the Plaza at Beaver Creek. There have been no complaints or
disturbances during the past year.
C) Wolcott Market Ltd

This is a renewal of a retail liquor store license. This establishment is located
along Highway 6 in Wolcott. There have been no complaints or disturbances
during the past year.
D) Wolcott Market Ltd

This is a renewal of a 3.2% beer off premise license. This establishment is located
along Highway 6 in Wolcott. There have been no complaints or disturbances
during the past year.

located on Edwards Village Blvd, behind Gore Range Brewery. There
have been no complaints or disturbances during the past year.
Commissioner Menconi moved to approve the Liquor License Consent Agenda as presented.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
Peppers Mexican Grill
Earlene Roach presented a renewal of a hotel and restaurant license for Riverwalk Restaurant
LLC, d/b/a Peppers Mexican Grill. She stated this matter was tabled from September 18, 2001 as the
applicant could not be present. Ms. Roach related the Board has copies of complaints and disturbances
from the Sheriffs Office that all relate to approximately five months ago. She stated at that time she
received one ofthe disturbance reports and met with Doug Cogswell, owner, at that time. Then in
September she received the other disturbance reports and decided it was time for Mr. Cogswell to meet
with the Board to explain the situation. In the beginning this was a restaurant and had the normal
restaurant hours. Now this establishment has a Mexican dance every Saturday night. There have been

no additional disturbances in the past five months and staff believes the matter was taken care of after
her discussion with Mr. Cogswell.
Doug Cogswell, owner of Peppers Mexican Grill, was present for the hearing.
Chairman Stone spoke to the first part of the agenda being the consent agenda. He explained the
change in the regulations allowing them to only appear if there were issues of concern to be discussed.
He asked for an explanation of the situation and explained the Board attempts to work with the license
holders to be sure they understand the laws and the health, safety and welfare of the people of Eagle
County.
Mr. Cogswell stated he has completed an alcohol management plan for the Board and he
distributed those.
Chairman Stone thanked him for doing the alcohol management plan so that all the employees
and the County know what is being done to offset any concerns.
Mr. Cogswell thanked the Board for allowing him to be here. He handed out additional
information concerning the impact September 11 th, 2001 has had on other communities. He stated he
would like to brainstorm with the Board as well. He spoke to the type of license he holds which is a
retail for hotel and restaurant. He stated he was born in Colorado and moved here in 1974 and worked at
the Lodge at Vail. He worked with the Broadmoor for 18 years and ran the Antlers for 9 years. He came
back to run the Westin Hotel. After Westin sold the resort he moved to Denver. He currently has taken
a job an CEO of a hotel in Denver. He is here now for weekends. His wife is working with Servando
Rascon who is the Manager of Peppers. He stated item C shows the licensed premises and a map that
shows the map and the building.
Commissioner Gallagher asked about the exits.
Mr. Cogswell showed the front exit, the one on the side and exit off the patio. He clarified there
are two exists offthe patio. He stated on Saturday night, when they have the Salsa Night, there is no
access to the back deck.
Commissioner Gallagher asked for an explanation of Salsa Night.
Mr. Cogswell explained they saw a need for his staff and friends to have a venue for some
organized activities. He stated they take the tables out, put lights up and have music.
Commissioner Gallagher asked if they would be serving alcohol on Friday nights if they were
serving teens.
Mr. Cogswell stated if they were to host a party for teens they would not be serving alcohol. On
Saturday nights they begin the party at 10:00 and stop serving alcohol at 1:00. The party goes to 2:00.
Commissioner Gallagher asked about the placement of the tables on the back door allowing for
exit in case there is a fire.
Commissioner Gallagher asked how they close the doors off.
Mr. Cogswell stated they are available for exit but not for entrance. He explained the exits are
within easy view of the bar and they usually have people at both sides all night long. He stated from an
education and training standpoint, Hector De La Rosa has been handling the Salsa Nights. He has been
through the TIPS training. They will have staff available at the next TIPS training.
Commissioner Gallagher asked if Servando Rascon is the registered manager.
Ms. Roach responded she believes so.
Mr. Cogswell stated he is not going to run any establishment that isn't safe and that takes every
precaution to keep people safe. He stated he takes this very seriously and particularly when it comes to
minors. He stated they have an off duty Eagle County Sheriff present every Saturday from 8:30 to
closing. He stated they have an individual who checks the ID's. Rodolfo Nevarez handles the door and
checks all ID's and is accompanied by two other people and Mr. Cogswell's staff.
Commissioner Gallagher asked ifMr. Nevarez knows both the Mexicans and the non-Mexicans.
He asked about the sentence concerning the group providing music.
Mr. Cogswell stated they supply the person who plays the CD's and three people who move

around the room. He has Rodolfo and another one of his assistants and the Sheriff s officer.
Commissioner Gallagher asked if they restrict those who may smell of alcohol. He spoke to the
various degrees of intoxication and that there are other signs other than the smell of alcohol. He stated it
is his understanding that some of the current complaints is that the Salsa Night spills out into the parking
lot. He suggested it reminds him of church on Easter and asked if it is accurate that people are outside.
Mr. Cogswell stated one of the Sheriffs duties is to make sure that there is no loitering outside of
the door. He stated they have made adjustments to be sure they are handling the crowd. He spoke to the
live band at the old Champions and he suggested their crowd went down significantly.
Commissioner Gallagher complimented Mr. Cogswell on providing cultural entertainment to
those who otherwise haven't had that venue. He stated he appreciates the efforts he has made to refine
the plan and believes him attending TIPS training might help him to take a better look at the situation.
He asked Servando Rascon, one of the managers and the executive chef of Peppers, if he had TIPS
training yet.
Mr. Rascon answered no but is going to be.
Mr. Cogswell stated that Hector De La Rosa has been the night manager. Servando is actually
the food manager and the Executive Chef. He will be in charge while Hector is absent.
Commissioner Gallagher asked if Mr. Rascon has read the Colorado Liquor Code.
Mr. Rascon stated he has not.
Commissioner Menconi asked for clarification as to who has been TIPS trained.
Mr. Cogswell stated Hector Del La Rosa.
Commissioner Menconi asked who serves alcohol.
Mr. Cogswell stated the manager, himself and his wife. He stated they are the only ones trained
to serve alcohol.
Commissioner Menconi asked if he were to have all of the employees TIPS trained, how many
would he have.
Mr. Cogswell stated he would have three. He stated he received the wrath of God for not having
staff in attendance.
Commissioner Menconi emphasized the need for TIPS training and his recommendation that all
employees receive TIPS training. He stated it is good common sense and good public safety.
Mr. Cogswell asked if they have the training in Spanish.
Commissioner Gallagher stated the requirement is those who serve alcohol. It doesn't have to be
the dishwasher or the cook, if they do not serve alcohol.
Mr. Cogswell stated it is self service and you have to come to the bar to obtain a drink.
Chairman Stone asked about the brainstorming.
Mr. Cogswell stated he wanted to underscore how important the whole idea of safety and good
management is. He spoke to the Board's experience. He stated that he has told Ms. Roach he might not
want to do this anymore because of the chances and the risks. He is prepared to do anything necessary to
minimize the consequences. He thanked Commissioner Gallagher for the input.
Chairman Stone stated they like to work with people because he knows how much he cares. He
spoke to the sale of some of the businesses because of the responsibilities and the stress. He stated this
Board and the previous Board have taken the serving of alcohol seriously. He stated it seems as though
things have gotten pretty well resolved and before any serious accidents have happened. He stated they
are not saying that people shouldn't drink but they should do so responsibly and the servers should do so
with responsibility.
Commissioner Gallagher stated he will make the motion with the completion of TIPS training
being a part of the approval.
Chairman Stone asked if they can receive documentation from the Sheriff s office in a more
timely manner.
Ms. Roach stated she will contact the Sheriff and ask that they do so.

previous building envelope of9,691 square feet and a new building envelope of9,691 square feet. He
suggested the new one looks a lot bigger than the older one.
Ms. Skinner stated they are vacating a portion of the previous envelope and filling in the space.
They are moving properties around.
Commissioner Menconi moved the Board approve File No. AFP-00114 incorporating the
findings and authorize the Chairman to sign the plat.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
There being no further business to be brought before the Board the meeting was adjourned until
