Consent Agenda
Chairman Stone stated the first item before the Board was the Consent Agenda as follows:

Chairman Stone asked the Attorney's Office if there were any changes to the Consent Agenda.
Tom Moorhead, County Attorney, stated there were no changes.
Chairman Stone questioned items H, rules and procedures for arbitration and I, equalizing
property throughout Eagle County. He stated he believed the Board previously considered those.
Mr. Moorhead stated item H, rules concerning arbitration procedures has to be renewed every
year. He stated item I was previously approved and this resolution formalizes that action.
Commissioner Menconi moved to approve the Consent Agenda as presented.
Chairman Stone seconded the motion. Of the two voting Commissioners the vote was declared
unanimous. Commissioner Gallagher was not present for today's hearing.
Plat & Resolution Signing
Matt Gennett, Planner, presented the following plats and resolutions for the Board's
consideration:
Resolution 2001-110. To Accept A Fee Simple Right Of Way For A Relocated
Portion Of Bellvache Ridge Road Granted In Conjunction Of The Approval Of A Final Plat For
Red Sky Ranch Planned Unit Development (File No. PDF-00068). The Board considered this
proposal at its public hearing on July 31 st, 2001.
Commissioner Menconi moved to approve Resolution 2001-110, to accept a fee simple Right-of-
Way for a relocated portion of Bellyache Ridge Road, granted in conjunction ofthe approval of a Final

Resolution 2001-111 To Approve The Slater Zone District Amendment (File No.
ZC-00048). The Board considered this application at its public hearing on August 14th, 2001.
Commissioner Menconi moved to approve Resolution 2001-111, to approve the Slater Zone
District Amendment, file number ZC-00048.

unanImous.
Resolution 2001-112, Try Transit Week
Jim Lair, ECO Director, presented Resolution 2001-112, recognizing Try Transit Week,
September 9 through 15, 2001. He stated for the past 15 years the National Transit Association, of
which ECO is a member, has supported a Try Transit Week. This years theme is "Your Ride Is Here".
He stated each day of the week has a different theme, however Eagle County is going to try two of the
theme days. Tuesday September 11, 2001, is Try Transit Day, which gives the opportunity to encourage
new riders. He stated they will have breakfast sandwich's provided by Subway of West Vail in
Lionshead and free coffee will be available. He urged all elected officials to come down to the Vail
Transit Center and be part of the special broadcast and promotion of Try Transit Day. He stated on
Thursday they will have a barbeque and will be recognizing transit employees. He requested the
proposed Resolution be approved.
Chairman Stone read the Resolution for the record as follows:
"Whereas, the Board of County Commissioners of the County of Eagle, State of Colorado
(hereinafter the Board) acknowledges that public transportation is vital to the quality of life and the
economic well-being of the citizens of Eagle county; and
Whereas, workers, school children, senior citizens, people with disabilities and those unable to
afford automobiles use public transportation to gain access to jobs, schools, medical facilities and other
fundamental services; and
Whereas, the Board wishes to join the American Public Transportation Association, the U.S.
Department of Transportation, the Federal Transit Authority, the National Association of Counties, the
National League of Cities, and others in celebrating "Try Transit Week" on September 9 through 15,
2001; and
Whereas, "Try Transit Week" promotes the benefits of effective transit service, builds public
support by increasing awareness of how public transportation betters the quality of life in Eagle County,
attracts new customers to transit service, and honors both transit employees and regular customers; and
Whereas, the Board desires to encourage all citizens to celebrate the many benefits our
community experiences where ore people use public transportation; and
Whereas, the Board desires to encourage all employers to emphasize the many benefits of public
transportation to their employees.
Now, therefore be it resolved by the Board of County Commissioners pfthe County of Eagle,
State of Colorado;
That, the Board hereby finds, determines and declares that September 9th through the 15th, 2001,
shall be designated as "Try Transit Week" in Eagle County and be celebrated bu families and
communities throughout Eagle County. The Board calls upon all citizens to examine their personal
travel choices, to commute via transit or share a ride during "Try Transit Week".
That, the Board hereby finds, determines and declares that this Resolution is necessary for the

public health, safety and welfare of the residents of the County of Eagle, State of Colorado.
Moved, read and adopted by the Board of County Commissioners of the County of Eagle, State

Quarterly Interest Report
Karen Shaffer, Treasurer, presented the Quarterly Interest Report. She stated this is a 6 month
report for 2001 as there was no interest report presented the first quarter. She stated the County is doing
with its investments.
Chairman Stone asked how this compared to last year.
Ms. Shaffer stated they are right at where they were last year which is amazing with the interest
rates. She stated the County does not feel the effect of the interest rates as of yet but that may come next
year.
Chairman Stone asked about next years budget and the returns.
Ms. Shaffer stated she put it down a couple of hundred thousand dollars due to the lower interest
rates. She spoke to the County's investment program.
Commissioner Menconi moved to approve the quarterly interest report from the Eagle County
Treasurer, for the period of January 1,2001 to June 30, 2001.
Chairman Stone seconded the motion. Of the two voting Commissioners the vote was declared
unanimous.
Resolution 2001-113, Volunteer Appreciation Day
Chairman Stone stated the next item on the agenda was Resolution 2001-113, designating
September 11, 2001 as Eagle County Volunteer Appreciation Day.
Commissioner Menconi read the resolution for the record as follows:
"Whereas, the Board of County Commissioners of the County of Eagle, State of Colorado
(hereinafter the Board) wishes to celebrate Eagle County Volunteer Appreciation Day on September 11,
2001 and,
Whereas, the Board acknowledges that Eagle County Government utilizes more than 400
volunteers each year; and
Whereas, these volunteers perform a variety of services to benefit Eagle County Government and
the citizens of Eagle County; and
Whereas, the Board desires to encourage all citizens to give back to the State and their
neighborhoods;
Now, therefore be it resolved by the Board of County Commissioners of the County of Eagle,
State of Colorado;
That, September 11, 2001 be designated as Eagle County Volunteer Appreciation Day and be
celebrated by families and communities throughout Eagle County;
That, the Board hereby finds, determines and declares that this Resolution is necessary for the

Jody Caruthers, Eagle County Assessor, presented the Abstract of Assessment for the Chairman's
signature.
Commissioner Menconi moved to authorize the Chairman to sign the Abstract of Assessment.

unammous.
Commissioner Menconi moved to adjourn as the Board of County Commissioners and reconvene
as the Local Liquor Licensing Authority.

Edwards Business Association
Earlene Roach, Liquor Inspector, presented a special events permit application for Edwards
Business Association for September 22,2001 from 10:00 a.m. to 4:00 p.m. This event will be held at
the Edwards Village Center. The application is in order and all fees have been paid. Rita Mueller and
Laurie Asmussen were present for the hearing.
Rita Mueller, applicant, stated this is the 4th year for the Edwards Harvest Festival. This event
obtains support from the community and they will have a silent auction. They rotate charities each year
and this year they will donate to the Resource Center, which is an advocacy primarily for domestic
violence. They also work on the buddy program. She stated this year the Resource Center's priority is
to try and raise funds for a safe house for abused individuals. The event is coordinated to give back to
the community. This is a family event and starts with a family fun run. She stated they have several
vendors and invite all the restaurants to participate in the event. Food is donated and sold. Winery's and
brewery's also donate beverages.
Chairman Stone stated he noticed they have fencing around the beer garden and questioned if
they will also have perimeter fencing.
Laurie Asmussen, Event Coordinator, stated the beer tent is located in the grassy area and they
have natural barriers with the buildings. They do have perimeter fencing at the entrances and exits and
around the area for the children. She pointed out on a map the location of the four entrances and exits.
Commissioner Menconi moved to approve a special events permit for Edwards Business
Association for September 22,2001 from 10:00 a.m. to 4:00 p.m.
Chairman Stone seconded the motion. Of the two voting Commissioners the vote was declared

Liquor License Consent Agenda
Earlene Roach presented the Liquor License Consent Agenda for September 4, 2001 as follows:

Red Table Acres Public Improvement District
Chairman Stone stated the next item was a continuation of the public hearing for the Red Table
Acres Public Improvement District and a Resolution placing a question on the November ballot
concerning the formation of this proposed district.
Mr. Moorhead stated a letter from Robert Schultz has been received requesting the petition be
withdrawn and the $1,000.00 bond be returned. In reviewing State Statutes he finds no reason to not
withdraw this petition.
Commissioner Menconi moved the petition be permitted to be withdrawn after commencement
of the hearing but prior to any findings pursuant to Section 30-20-508 CRS. Any amount ofthe bond
remaining after the payment of the current costs incurred by the Clerk & Recorder shall be returned to
the petitioners committee.
Chairman Stone seconded the motion. Of the two voting Commissioners the vote was declared
unammous.
