Chairman Stone stated the first item before the Board was the Consent Agenda as follows:

Chairman Stone asked the Attorney's Office ifthere were any changes to the Consent Agenda.
Tom Moorhead, County Attorney, suggested in regard to the petition to the Board of
Equalization, item G, the Board should adjourn and reconvene as the Board of Equalization to make a
decision on that item.
Commissioner Menconi moved to approve the Consent Agenda items A through F, eliminating
item G.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.

Bruce Stessinger, Attorney's Office, presented a petition to the Board of Equalization. He stated
there were 201 hearings before the hearing officers.
Chairman Stone stated the Board has received correspondence from David Tanzer concerning
property valuation. He is requesting the Board remove his item from the petition being presented.
Mr. Moorhead stated Mr. Tanzer did avail himself from the opportunity to protest the Assessor's
valuation. Mr. Tanzer then appealed that assessment and on July 31, 2001 he had a hearing before the
referee, Ken Call. Mr. Call gave a very specific analysis and identified in his finding and
recommendation why the comparables being suggested were incorrect. He then found the comparables
from the Assessor's Office were correct. He recommended the Board approve the petition leaving Mr.
Tanzer in place. He may then move forward.
Chairman Stone asked when the hearing with the referee is over, what are the public's feelings.
Do they understand there are other options.
Mr. Stessinger stated most petitioners are aware there are other options. Most have been satisfied

with how the system works. He related he advises all petitioners of the process.
Chairman Stone stated he is interested in due process and wants to assure that due process has
taken place. He asked if it would be fair to single out one taxpayer.
Commissioner Gallagher stated it is his understanding that this taxpayer is an attorney.
Mr. Stessinger stated Mr. Tanzer represents Feno Ranch.
Commissioner Gallagher stated he assumes Mr. Tanzer gave a good presentation and he does not
wish to hear this matter again.
Mr. Moorhead recommended the Board adopt the referee's findings.
Commissioner Menconi agreed.
Commissioner Menconi moved to approve the petition to the Board of Equalization as presented.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.

Plat & Resolution Signing
Matt Gennet, Planner, presented the following plats and resolutions for the Board's
consideration:
Resolution 2001-099 To Approve A Special Use Permit For The River Dance RV
Park (Eagle County File No. ZS-00074). The Board considered the applicant's request on July 10th,
2001.
Commissioner Menconi moved to approve Resolution 2001-099 to approve a Special Use Permit
for River Dance RV Park, file number ZS-00074.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
Resolution 2001-100 To Authorize The Chairman To Sign An Application For A
State Highway Access Permit For Hillcrest Drive (Eagle County Road 28). John Vengrin from
Engineering will provide an explanation.
John Vengrin, Engineering Department, stated Eagle County has retained its Highway Access
Permitting responsibilities under the State Highway Access Code on Eagle County Roads where they
intersect State Highways. He stated they received an application from Wilmore Developments and
Cordillera Valley Club for a development of Hillcrest Drive. He related the resolution authorizes the
Chairman to sign the State Highway Access Permit.
Chairman Stone stated this property is near Lake Creek Village Apartments and there is an access
underneath 1-70 that would be the back entrance to Cordillera. The applicant is seeking to develop the
land at the back of Cordillera. He asked what was the traffic impact.
Mr. Vengrin stated they will have eight units and approximately 80 trips per day. He stated their
road will come through and connect with Hillcrest Drive where the Cordillera Valley Club has a
maintenance facility.
Chairman Stone stated in the future this area can be a full diamond intersection. He stated if
there was an opportunity to improve future improvements, he asked they not adversely impact the
possibility of putting in an interchange there.
Helen Migchelbrink, County Engineer, stated this resolution only reflects the signing of the State
Highway Access Permit and gives the County right-of-way.
Commissioner Gallagher asked where this road is going to be.
Ms. Migchelbrink stated they do have a map showing the location of the road.

Resolution 2001-101, Red Table Acres Local Improvement District
Tom Moorhead stated a couple of weeks ago, there was a presentation from the applicant who
related they would be circulating a petition and would be filing said petition, on July 31, 2001. He stated
they did file that petition with the Clerk & Recorder. The law requires as soon as possible after filing
said petition the Board shall fix by Order a place and time not less than 20 days and not more than 40
days, after the petition is filed for a hearing. He stated the hearing date being suggested is August 21,
2001. That date will provide an opportunity for all the requirements of the law to be met, providing all
notices to those within the district as well as leaving adequate time for any ballot questions.
Chairman Stone stated in the future those placing items on the agenda should be placed on the agenda in
a timely manner.
Commissioner Menconi moved to approve Resolution 2001-101 approving the order to set the
hearing date of August 21,2001 for the Red Table Acres Public Improvements District.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
Commissioner Menconi moved to adjourn as the Board of County Commissioners and reconvene
as the Local Liquor Licensing Authority.

Rancho Del Rio
Bob Emerson, Prosecuting Attorney, stated the next item was a Show Cause Hearing for Rocky
Mountain Enterprises, Inc., d/b/a Rancho Del Rio. He introduced Jeff Gibson, owner of Rancho Del
Rio, and Laura Fisher, employee. He stated this matter will proceed today without taking much evidence
as there is a Stipulation in place signed by Mr. Gibson indicating a violation did occur. He will be
presenting a report from Earlene Roach, Liquor Inspector, Exhibit 1, Sheriffs report Exhibit 2, and a
statement from Alan Burt, the patron who drank the ammonia as Exhibit 3. He requested they be
accepted into the record. There is also the Stipulation of Violation.
Chairman Stone stated the Board will accept Exhibits 1, 2, & 3 for the record. The Stipulation
will be labeled Stipulation.
Mr. Emerson requested the Board make a finding ofthere being a violation ofthe Colorado
Liquor Code, based on the Stipulation and submitted documents.
Jeff Gibson stated this was an unfortunate mistake and related they have been working with Mr.
Burt's attorney as far as medical bills and compensation. He stated he has been in business since 1990
and Ms. Fisher is the best employee he has had. He is sure this kind of thing will not happen again. He
stated he apologizes for the mistake.
Commissioner Gallagher stated it is his understanding that this is a premise licensed for off
premise consumption. He stated he wonders about the validity of Regulation 47-904 (a).
Mr. Moorhead stated that would apply to either a package establishment or a license for on
premise consumption. That deals with the condition of the alcohol container rather than the nature of the
license.
Commissioner Gallagher moved the Board find that Rocky Mountain Enterprises, d/b/a Rancho
Del Rio did violate section C.R.S. 12-47-407 (1) and Regulation 47-904 (a) of the Colorado Liquor

Code.
Commissioner Menconi seconded the motion. The vote was declared unanimous.
Mr. Emerson stated regarding consumption of alcohol in the store, he believes every owner of a
liquor store knows there shall be no consumption of alcohol on premise. He stated that goes for
customers and for employees. He believes this is a violation that occurred knowingly. With respect to
the second violation, this comes from carelessness more than anything else. He stated the reason for the
regulation is to make it improper for the owner to be serving something out of a bottle that is different
than what is on the label. That means you cannot substitute something else in the bottle. He stated it
was really not intended for this case. It was not intentional. His opinion is that the statute or regulation
was designed for this case. It is true there was a man injured as a result of the second violation. As Mr.
Gibson related his insurance is working on settling that in a monetary fashion. The function of this
Board is not to try and right that wrong or to make a determination as whether there should be money
damages awarded but rather to deal with the liquor violation.
Mr. Emerson stated there have not been prior violations and Ms. Fisher has come forward and
admitted the violation and has been cooperative with all agencies. He reviewed the possible sanctions
the Board could impose, which range from doing nothing, imposing a fine, suspend the license for a
period of time or revoke the license. The Board could impose a fine in lieu of suspension, hold some
days in abeyance. In the past he has recommended imposing a fine to cover attorney fees so that
taxpayers do not have to pay for those.
Mr. Emerson stated they are recommending a 10 day suspension, considering part served and
part in abeyance or a fine.
Chairman Stone asked what kind of a fine could the Board impose.
Earlene Roach stated it is 20% of the gross revenues of alcohol sales for the period of
suspenSiOn.
Chairman Stone asked about other entities and their penalties.
Ms. Roach stated they conducted a survey of other Counties and got approximately 15 responses
and most of them do not handle penalties but rather have the State handle the violations. She stated she
did speak with Brian Turner of State Liquor Enforcement and he related their penalty would be for 10
days, and that could be all suspension, part held in abeyance or part fine.
Mr. Emerson stated what the Code states is that if a local authority decided to suspend a license
for 14 days or less, the holder of the license may petition to pay a fine in lieu of suspension. The fine to
be imposed under that scenario is 20% of the expected gross income from the sale of alcohol during the
time of the proposed suspension, not less than $200.00 and not more than $5,000.00.
Mr. Moorhead stated the Board can impose both sanctions, part fine and part suspension.
Commissioner Gallagher asked if a fine in lieu of suspension is the only kind of a fine.
Mr. Emerson stated the Board has the ability to impose a fine as the sole sanction.
Chairman Stone asked if Mr. Gibson had discussed this matter with staff.
Mr. Gibson stated he has discussed the violation and knew there would be a penalty but did not
discuss the kind or size of the penalty.
Commissioner Gallagher asked how long Ms. Fisher has been in the alcohol business.
Laura Fisher, employee, stated she has been in the food service industry for approximately 10
years.
Commissioner Gallagher asked if Ms. Fisher had read the Colorado Liquor Code.
Ms. Fisher stated no.
Commissioner Gallagher asked how long Ms. Fisher had been working at Rancho Del Rio.
Ms. Fisher stated approximately four years.
Commissioner Menconi asked if the applicant had a recommendation for a penalty.
Mr. Gibson explained the nature of business at Rancho Del Rio. He stated it is a rafting and
fishing business and their season is relatively short. He stated he is willing to do whatever the Board

thinks is fair.
Commissioner Menconi stated hearing the different options as offered by the attorney does he
think its fair.
Mr. Gibson stated 10 days suspension now would hurt but after Labor Day it would hurt, but not
as hard.
Commissioner Menconi asked about gross revenues during the 10 days.
Mr. Gibson stated the liquor store is a small revenue for Rancho Del Rio. He stated it is more a
convenience for the quests. He stated out of a 10 day period it might be around $5,000. Shutting down
in August would be difficult. It would harshly disrupt business at this time.
Commissioner Menconi asked if the establishment had been closed at all since the incident.
Chairman Stone stated he has a concern because of the remote location, the Board would not
have even heard of this except for the unfortunate incident of switching substances in the bottle. It
makes him wonder if there have been other violations that this Board has not heard of. He stated he
believes what would be appropriate is a combination of both, some type of suspension of the license and
to pay back the citizens of Eagle County in the form of a fine for the attorney fees.
Commissioner Gallagher stated they have had before this body, liquor violations that have
resulted in injuries and even death. While the switching of substance in the liquor bottle is
unintentional, the violation of the Liquor Code brought about an injury. He stated he specifically asked
questions of Ms. Fisher because he wanted to know how serious the owner took the service of alcohol.
He stated the owner has offered no training for his employees to assure that everyone knows how to deal
with alcohol service. Because of seeing those two aspects of this case, he is prepared to make a motion
regarding penalty.
Jeff Gibson stated Ms. Fisher knows what was going on and made a mistake.
Ms. Fisher stated she is aware of the regulations and made a sick mistake and is sorry.
Commissioner Menconi stated it is important to reimburse for attorney's fees and is interested in
what Commissioner Gallagher is proposing.
Chairman Stone stated normally the Board will suspend the license for a number and hold half of
those in abeyance for a period of one year.
Commissioner Menconi stated what appears to be fair and reasonable is a fine to compensate
attorney fees, a suspension of closure for five days and five days held in abeyance.
Commissioner Menconi moved to suspend the license for a period of 10 days, holding five of
those in abeyance for a period of one year, and impose a $1,000.00 fine. The suspension shall begin
tomorrow, August 8, 2001 and continuing for five consecutive days. Notice shall be posted at the
establishment for the period of the suspension.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
Commissioner Gallagher moved to adjourn as the Local Liquor and reconvene as the Board of
County Commissioners.
Commissioner Menconi seconded the motion. The vote was declared unanimous.
VIS-0013, Arrowhead Mountain, Filing 27
John Vengrin, Engineering Department, presented file number VIS-0013, Arrowhead Mountain,
Filing 27. He stated per Section 5-260.G: Variance from Improvement Standards, The Board of County
Commissioners is the authority that decides on variances from the improvements standards. Prior
review by the Planning Commission is not stipulated.
This is a petition for a Variance Permit from those requirements of Section 4-620.B of the Eagle
County Land Use Regulations ("LUR"). The applicant wants to use a steel-backed timber guardrail in
place of the all-steel guardrail that is the standard used by Eagle County.
The petitioner's request for variance is attached to this staff report.

The Applicant has previously received Final Plat approval for Arrowhead Mountain, Filing 27
through Eagle County File PDF-00057. The roads and infrastructure are currently under construction.
The Applicant has identified a need to use a different guardrail system than the standard which is
required by Eagle County. The alternate guardrail is a steel-backed timber guardrail which has better
aesthetic qualities than the all steel guardrail.
In the letter dated July 6, 2001, the Applicant cites the following reasons for requesting the use of
the steel-backed guardrail:
"a. An installation of a guardrail that does not blend with and fit the mountainous terrain
and environment of Eagle County. (This will contradict the Intent of Roadway Standards set forth in
Eagle County Land Use Regulations Section 4-620.A)
b. Since Eagle County Engineering Staff has indicated that the applicant can install the
timber guardrail after the two-year warranty period. The Applicant/Property Owner will incur an
additional $400,000.00 for replacing the Guardrail after the warranty period is up with Eagle County.
c. Vail Resorts operates in an extremely competitive local, regional, and national resort
real estate market. The buyers have many choices available to them in many attractive locations. We
have found that the product we sell goes beyond individual homes and homesites. The product includes
the entire community and encompasses all aspects of the built environment. The aesthetic quality of the
built environment is a very important component of the Vail Resorts real estate product. We take great
pride in the quality of the infrastructure that serves our clients including the roads, signage systems,
landscaping, entrance areas, retaining walls, bridges and guardrails. The quality of design of these
elements has contributed to the world class reputation that is the cornerstone of the Vail Resorts product.
We must be able to continue to deliver this level of aesthetic quality to maintain a competitive edge in
this marketplace. We believe that the proposed guardrail will allow us to deliver that quality without a
compromise of public safety standards. Prior to the adoption of new land use regulations this general
type of guardrail was allowed and has been installed in Bachelor Gulch and Arrowhead."
The Eagle County guardrail standard follows the standard as established by the Colorado
Department of Transportation (CDOT). Since CDOT has only the all-steel type of guardrail in their
standards, Eagle County therefore has only one choice as well. However, in response to demand for a
more aesthetically pleasing guardrail, the American Association of State Highway and Transportation
Officials (AASHTO) developed the steel backed timber guardrail system. This system was subsequently
adopted by the Federal Highway Administration (FHW A) as Standard M617-60 and recommended for
use on the National Highway System.
The steel-backed timber guardrail consist of a timber rail that is backed by a 3/8" thick steel
plate. Each Rail/Plate member is spliced together at a timber post. The resulting assembly appears to be
a solid timber structure as viewed by the driver, but it is really a continuous band of steel that provides
the tensile strength necessary to guide a vehicle back towards the roadway.
This system has been crash tested, and provides results similar to the all-steel system.
The applicant has stated that the quality of their real estate product will be diminished with a
resulting decline in the competitive edge they have in the marketplace if they cannot construct a
guardrail system that is aesthetically pleasing.
Health Safety and Welfare of Persons Affected: Since the timber backed guardrail has been
successful in crash testing, and since it has been adopted for use on the National Highway System, it
appears that there will be no compromise in health, safety or welfare.
County Engineer's Evaluation: According to Section 4-610.A.2 of the Land Use Regulations,
"The County Engineer's evaluation shall consider whether the alternative will provide for an equivalent
level of public safety and whether the alternative will be equally durable so that normally anticipated
user and maintenance costs will not be increased."
Decision of the Board of County Commissioners: According to Section 5-260.G of the Land

Use Regulations, the decision of the BoCC "... shall balance the hardships to the applicant of not
granting the Variance against the adverse impact on the health, safety and welfare of the persons
affected, and the adverse impacts on the lands affected. ..."
Staff findings are as shown on staff report and as follows:
1. The petitioner has filed a petition for a Variance Permit from the Improvement Standards in
conformance with the requirements of Section 5-260.G of the LUR.
2. The petition has been properly advertised and is ready for consideration by the Board of
County Commissioners.
3. The steel-backed timber guardrail as shown on Drawing 14A dated 12/21/00 by Alpine
Engineering, Inc. entitled "Arrowhead Mountain Project, Guardrail Details" will provide an equivalent
level of public safety and durability as compared to the standard all-steel guardrail.
The Board of County Commissioners must decide on the following findings:
4. The petitioner has demonstrated hardship to the developer and the public if there is strict
adherence to the standard all-steel guardrail.
5. The petitioner has demonstrated that the hardship of not granting the variances exceed any
currently perceived adverse impacts on the health, safety, and welfare of persons affected, or adverse
impacts to the affected lands.
Staff recommends that the Board of County Commissioners approve the request for a Variance
Permit from the strict interpretation of the Road Standards in Section 4-620.B of the Eagle County Land
Use Regulations to allow the Applicant to use the steel-backed timber guardrail as shown on Drawing
l4A dated 12/21/00 by Alpine Engineering, Inc. entitled "Arrowhead Mountain Project, Guardrail
Details".
Jamie Papas, Vail Resorts Development, was present for the hearing.
Chairman Stone asked what the hardship to the developer was.
Mr. Papas stated the first hardship would be the installation of a guardrail that does not conform
to County Regulations. He reviewed the letter for the Board.
Chairman Stone read a section of the letter as follows:
"The intent of these standards is to promote and provide a system of County Roads that blend
with and fit the mountainous terrain and environment of Eagle County and, outside the primary arterial
corridors in the County, to protect the country road ambience enjoyed and desired by residents and
visitors alike, and to allow for maximum creativity of the designer in achieving these goals."
Mr. Papas stated this guardrail is the only one that fits the intent of the proposal. He stated after
the initial warranty period they could install this guardrail but it would cost them approximately
$400,000.00. The other hardship is because this guardrail has been previously approved under the old
County Regulations, this would be a competitive disadvantage to hold them to a different standard of
guardrail.
Commissioner Menconi asked about the length of the guardrail.
Mr. Papas stated it will be the equivalent of one mile.
Commissioner Menconi asked about the sale of the lots.
Mr. Papas stated the average price for the lots was 1.4 million dollars.
Commissioner Gallagher asked if this is an acceptable to use on private property.
Ms. Migchelbrink stated if the variance is passed today, she has written the language to bring
forward an amendment to the Land Use Regulations to allow this guard rail on roads not maintained by
Eagle County.
Commissioner Gallagher asked if this was the same guardrail that goes up Bachelor Gulch.
Mr. Vengrin stated the guardrail in Bachelor Gulch is rounded and the one being proposed today
is split timbers and will be uniform.
