The proposed adjustment will position the house in a more favorable location on the lot relative to the platted access easement, which crosses Lot 8B of the BBK Subdivision to the west. The Pilgrim Downs Design Review Board has reviewed and approved this proposed building envelope adjustment. Staff findings are as follows: Pursuant to Section 5-290 (G) (1) of the Eagle County Land Use Regulations: 5-290 (G) (1) Standards for Type A and Type B Subdivision (G) Standards. The Board of County Commissioners, in its capacity as the Eagle County Permit Authority, conducted a public hearing on June 19t\ 2001, to consider this application. Commissioner Menconi moved to approve Resolution 2001-087, To Approve A Permit For Site Selection And Construction Of Major New Domestic Water And Sewage Treatment Plants To Serve The Nova Guides Eagle County Site And Efficient Utilization Of Municipal Water Projects (Eagle County File No. 1041-0037). Chairman Stone seconded the motion. Of the two voting Commissioners the vote was declared unammous. Resolution 2001-088 To Approve The Willits Family Homestead Preliminary Plan (Ea~le County File No. SUP-00004). The Board of County Commissioners considered this application at its regular meeting held on June 5th, 2001. Commissioner Menconi moved to approve Resolution 2001-088, To Approve The Willits Family Homestead Preliminary Plan (Eagle County File No. SUP-00004). Chairman Stone seconded the motion. Of the two voting Commissioners the vote was declared unammous. National Association of Counties, Achievement Awards Kathryn Heider, Assistant County Administrator, stated the next item on the agenda was the National Association of Counties 2001 Achievement Awards. She introduced the participants as she handed out the awards. 1 ) Youth Conservation Corps Board of County Commissioners Category - Environmental Protection & Energy Ms. Heider explained this program is the idea of Chairman Stone and helps 4-H, Scout troops, bands and other athletic teams and youth organizations earn money for their projects while helping the Forest Service with needed trail and campground maintenance that would otherwise be deferred due to budget constraints. The young people are educated in the basics of wise multiple use of the forest. The education component is the corner stone ofthis project. During the inaugural season last year more than 200 youths participated and this year more than 500 youths have asked to participate. The program is so popular that many of the youths are on a waiting list in spite of the fact that the Commissioners have 21 07-10-2001 allocated $40,000.00 for the project this year. Additional funding is being sought to allow the maximum number of youth to participate. Chairman Stone stated he appreciates the recognition of the program and thanked the other Commissioners for their support. 2) Community Based Traffic Light Implementation Helen Migchelbrink, County Engineer Category - Criminal Justice and Public Safety Ms. Heider explained the project was to put the traffic light in at Edwards. The award recognized the efforts of Eagle County to take a leading role in solving a dangerous pedestrian crossing issue at the Eagle Valley Mobile Home Park in Edwards. A serious traffic accident provided the emphasis to bring together leaders of the Hispanic community, Colorado Department of Transportation, ECO Transit and the Mobile Home Park. Installation and the relocation of the ECO bus stop, allows pedestrians and bicyclist to safely cross Highway 6. Chairman Stone complimented Ms. Migchelbrink for her efforts and for the quick time period in which she was able to accomplish this. Ms. Migchelbrink thanked the Board for their assistance in making this happen for an often unheard from group in the County. 3) Cooperative Effort for Illegal Dump Site Cleanup Brad Higgins, Road & Bridge Director Category - Environmental Protection & Energy Ms. Heider explained the project as being removal of illegally dumped materials on public property and restore the land to its natural state. The increasing amount of illegally dumped waste on public lands causes a public health risk and degradation of public property. Although Eagle County had no legal obligation to take action on BLM property the need was apparent. The BLM contributed money and Eagle County provided labor and equipment and waived all Landfill tipping fees. The result was an eyesore was removed and a two acre site of public property was cleaned up, revegetated and restored to its natural condition. Brad Higgins accepted the award as presented. Chairman Stone complimented Mr. Higgins, Road and Bridge and those at the Landfill. He thanked them for their combined efforts. He stated it is an indication that Eagle County does care about public property and how it effects the health safety and welfare of the residents. Best Category Award 1) Rural Resort Region Child Care Project Kathleen Forinash, Health & Human Services Director Category - Children and Youth. Ms. Heider explained that there are only 15 best of category awards given out across the country. This was for the Rural Resort Regional and Eagle County won best of category. This project is a coordinated effort of Garfield County, Pitkin County, Lake County and Eagle County. It is organized to plan and develop regional child care programs that increase the capacity and enhance the quality of child care. The strategies include operating the family home licensing program, addressing issues of funding, quality of care and availability of care, coordinating access to federal funding sources and effectively leveraging local funding with other resources to increase the number of licensed child care homes in the region. She added that the number of licensed homes in Eagle County has increased by 50% in the last year and a half. Chairman Stone complimented Ms. Forinash on finding new and innovative ways to address issues within the County. He stated these kinds of efforts make Eagle County recognized nation wide. 22 07-10-2001 Special Warranty Deed, Town of Gypsum Tom Moorhead stated the next item on the agenda was a Special Warranty Deed from Eagle County to the Town of Gypsum for conveyance of a portion of Jules Drive Road. He stated it is a portion of a road, as shown on the exhibit, is being conveyed to Gypsum for the amount of $28,336.71. Additionally the County is keeping reservations for public right-of-way. Jim Elwood, Airport Manager, explained this is just a section of the discussion that previously took place with Gypsum. It was purchased with F ederal Aviation Money. The FAA will give direction how to reuse the funds that will be returned. Chairman Stone asked if there will be any additional right-of-way the Town will be looking at in the future. Mr. Elwood explained as Jules Drive is constructed there will be additional property handled in the same fashion. Commissioner Menconi moved to approve and authorize the Chairman to sign a Special Warranty Deed between Eagle County and the Town of Gypsum for conveyance of a portion of Jules Drive right-of-way. Chairman Stone seconded the motion. Of the two voting Commissioners the vote was declared unammous. Eagle County Assessor Reports Jody Caruthers, Eagle County Assessor, presented the Assessor Reports for Real and Personal Property. She explained there are three lists to be reviewed today. The first list is that of personal property appeals received in May. There were 4,904. Those adjusted through correction of error were 2,245 and denied appeals were 2,659 as they were within equity with their neighbors. The personal property list, there were 34 appeals, they adjusted 22, and denied 12. The third list is that of those people who failed to file with the Assessors Office a Personal Property Declaration. She stated there is active status on numerous files and the list is a little larger than it needs to be. Chairman Stone asked if it is a State requirement that the lists be presented to the Commissioners and they then act upon the lists. Ms. Caruthers stated the lists are presented to the Board for their edification. Chairman Stone stated the Real Property and Personal Property lists were listed on the agenda, but the Taxable Property list is not included. Mr. Moorhead stated they are not approving the actions, just accepting the reports from Ms. Caruthers. Commissioner Menconi moved to accept the Assessor Report for valuation of assessment for Taxable Real Property in Eagle County. Chairman Stone seconded the motion. She stated she the applicant was to be present today, however, they are not. Chairman Stone suggested that he would like to continue this file so that the applicant can be present. Of the two voting commissioners, the vote was declared unammous. 24 07-10-2001 SE-00021, Viuf Subdivision Exemption Matt Gennett presented file number SE-0002l, Viuf Subdivision Exemption. He stated the purpose of this Subdivision Exemption Plat is to legalize a vacant, improperly subdivided parcel. In June of 1922, the subject property was inappropriately created and is therefore eligible to be legalized via the Subdivision Exemption process. Further, the parcel in question is only 20.07 acres in the Resource (R) zone district, where a minimum of 35 acres is required in order to be entitled to all the uses by right. The applicant seeks only to locate a single family residence on this site. The chronology of this application is as shown on staff report and as follows: A tract of land designated the "Queen Tract" was approved by the Surveyor General in Denver on June 20th, 1922. Ownership of the "Queen Tract" was transferred from the Whittaker Land and Livestock Company to Allen T. Brown on September 26th, 1972. Legal Access from Salt Creek Road to the subject property was achieved through an Easement Agreement reached on May 25th, 2001. Staff findings are as shown on staff report and as follows: Pursuant to Section 5-270 Subdivision Exemption of the Eagle County Land Use Regulations, findings are follows: a. The lot in question WAS created and established in the records of the Clerk and Recorder prior to August 22, 1984 notwithstanding compliance with Eagle County Land Use Regulations in existence at the time of the creation of the parcel. b. A certified survey of the parcel HAS been submitted which includes legal description meeting the minimum requirements of a land survey plat pursuant to 38-51-106 C.R.S., and all record and apparent rights of way, easements and monumentation ARE indicated on the Plat. c. Legal and physical access to a public right of way by a conventional vehicle HAS BEEN demonstrated. d. The land proposed for exemption HAS a legal, physical, adequate, and dependable potable water supply. e. Mr. Gennett explained you go east on Salt Creek and Salt Creek Road is on the north side ofthe boundary . Mr. Fitzgerald stated it is IIz mile before the "narrows" on Salt Creek and this property is to the right. Chairman Stone asked if this has not been legally recognized as a non-conforming parcel. Mr. Gennett stated now that legal access has been achieved, this is now permissible. Commissioner Menconi moved the Board approve File No. SE-0002l, ViufSubdivision Exemption, incorporating the findings and authorize the Chairman to sign the plat. Chairman Stone seconded the motion. Of the two voting Commissioners the vote was declared unanimous. 25 07-10-2001 ZS-00074 River Dance RV Park Matt Gennett presented file number ZS-00074, River Dance RV Park. He stated the proposal calls for a 40 space Recreational Vehicle (RV) park with a "Future Lodge" use that will house the office, employee housing, a lounge, and a gift / bait & tackle shop. The permit will also allow for two points of river access for fishing, boating, and other private recreational activities. The chronology of the application is as follows: The applicant submitted an application for this special use in March of 2001. The 70.63 acre parcel upon which the 7 acre RV park is to sit has been in the Mosher family since 1883. The Planning Commission unanimously determined that the RV park is a needed amenity in Eagle County and the site itself is suited to the intended use. The recommended conditions of approval were incorporated by the Planning Commission and have since been met by the Applicant. Any concerns and issues with this proposal have been resolved. Staff findings are as follows and as shown on staff report: Pursuant to Eagle County Land Use Regulations Section 5-250.B Standards for the review of a Special Use Permit: Section 5-250.B.l Consistent with Master Plan. The proposed Special Use shall be appropriate for its proposed location and be consistent with the purposes, goals, objectives and policies of the Master Plan and the FLUM of the Master Plan, including standards for building and structural intensities and densities, and intensities of use. Rusty Moser, applicant was present for the hearing. He explained that it is a beautiful piece of property that has been in the family for some time. He stated it will blend all around the property except for 4 acres on the western end that is a private home and shielded from the park. The River Dance property will look like a larger resort than what it is and will create a buffer between Gypsum and Dotsero. It will also provide summer recreational activities for residents and guests. He stated they feel that it addresses all areas of the Eagle County Master Plan. It will be a well system and they have received State approval. The Septic System has been approved by Environmental Health and they have CDOT approval. He referred to the critical wildlife habitat and related the winter range is on the south side ofthe river. They will leave all of the natural sage, forming a natural barrier between the residents and wildlife. He spoke to the flood plain and wildlife habitat. They feel they address that issue in that this is a recreational use. He spoke to the ground water quality. He stated the disturbances being minimal and they intend to maintain the area by clearing out dead branches. He spoke to the grey water systems and once they have approval they will implement those for watering. He stated the roads will be gravel and the speed limit less than 10 miles an hour. He spoke to the energy efficiency of the site and there being direct solar exposure. They will plant trees to accommodate that in the summer. He spoke 27 07-10-2001 to the land use pattern and that this will create a beautiful buffer zone between Gypsum and Dotsero. They are leaving it as natural as they can which is what will continue to live there with minimal irrigation. He spoke to public access to lands and rivers. He stated this section has been closed to the public since 1983. They are trying to get this section designated as Gold River Waters as there is spectacular fishing available. He spoke to the balance between winter and summer activities. He stated this is primarily for summer activities. He stated they will make sure that the guests are aware of the summer activities that already exist. He spoke to locating services without polluting the area. He stated they will be housing their own employees there in a resident house. Chairman Stone asked for public comment. There was none. Commissioner Menconi asked if this property will be subject to road impact fees. Mr. Gennett stated road impact fees will be assessed at the issuance of a building permit. Commissioner Menconi asked if the owner is aware of the fees. Mr. Moser stated they are aware and are willing to comply. Mr. Gennett stated the building permit will not come into play until the building of the lodge. Chairman Stone asked if there is any work that has already been done. Mr. Moser spoke to the electrical work and the raising of the road. Chairman Stone asked if it is typical to begin work before they have the special use permit. Mr. Moser stated this parcel is a legal parcel zoned for a private use. The septic permit was issued with that in mind. The grading permission can be issued during the special use procedure. Chairman Stone asked about the installation of the water taps before the approval is granted. Mr. Moser stated they have made sure to have permits for all work that has been done. Mr. Gennett stated it is interesting that with the special use process you can still proceed with the permitting before the final approval is granted. Chairman Stone asked if before they had changed the Land Use Regulations, what would have been the fee imposed. Mr. Narracci stated he does not believe they would have collected that fee on a special use or a commercial property. Chairman Stone suggested this might need review of Mr. Montag. He suggested that once this is built out, that the road impact fee would be assessed once the lodge is being constructed. Mr. Gennett stated the impact fee will be based on acreage. Chairman Stone stated he would like to be sure that they take into consideration issues such as this for future files. He agreed that an RV park is needed. He asked if someone will be parking an RV there for a long period of time. Mr. Moser stated they are intending this for non-residential tourism industry. He stated there are as many RV's as vehicles on the road and this is an excellent opportunity to capture some of that industry . Chairman Stone asked about signage. Mr. Gennett stated they will be allowed one sign at the entrance not to exceed sixty feet. Chairman Stone asked how they propose to get people off the highway. Mr. Moser stated you can not miss the site. Commissioner Menconi suggested utilizing the blue signs on 1-70. Mr. Moser stated they are looking at that as well. John Vengrin, Engineering Department, spoke to the discussion about the flood plain. He stated they have met with Mr. Moser's engineer and they have accepted what they have provided as a reasonable explanation of the flood plains. He thanked Mr. Moser for having his engineer meet with them. Commissioner Menconi moved the Board approve File No. ZS-00074, incorporating staff findings and with the following condition: 1. Except as otherwise modified by this permit, all material representations of the Applicant in 28 07-10-2001 this application and all public meetings shall be adhered to and considered conditions of approval.
