Chairman Stone asked the Attorney's Office if there were any changes to the Consent Agenda.
Renee Black, Acting County Attorney, stated item I, the Arrowhead Agreement, has been
changed and there is someone present to discuss this matter.
Alex Siscondarian, Vail Resorts, stated they are now finishing the bike path on the north side of
Highway 6, adjacent to the Arrowhead Development. He stated a portion of the path is in the CDOT
right-of-way. He stated they needed a permit from the Colorado Department of Transportation to be able
to construct that portion of the bike path that is in the right-of-way. CDOT has created a new permit
form different than the one signed last year. He stated the path is being built in three stages, the first
section was completely on private land, the second portion was a little on private land and a little on the
CDOT right-of-way. He stated the third portion is why they are here. He stated the documents have
been reviewed and he believes the County Attorney is comfortable in those forms.
Chairman Stone asked about the letter in the Board packets, which is all they have.
Mr. Siscondarian stated that letter is the permit form that is being used.

Ms. Black stated the way this will work is that Arrowhead is responsible for some of the items
and then the County is responsible. There are things the County cannot do and she feels comfortable
with the permit form and related the County is not really signing anything
Commissioner Gallagher asked about the paragraph that Eagle County is responsible for some of
the maintenance. What is the County responsible for maintaining?
Mr. Siscondarian answered the bike path.
Chairman Stone asked if the County has agreed to maintain the trail.
Ms. Black stated ECO is working on agreements with various municipalities and entities
concerning cost sharing. She stated the maintenance is currently limited to sweeping and trash pickup.
Chairman Stone stated there have been discussions concerning the path. Eagle County has stated
they will not be responsible for maintaining the trail.
Mr. Siscondarian stated the State is relating someone has to be responsible for maintaining the
trail. Vail Resorts is responsible for maintaining the trail for two years. After that the County is
responsible for maintaining the trail. He stated the language added by Jim Fritze gives the County an out
from the maintenance.
Chairman Stone stated he felt after the discussion it was decided that CDOT wanted someone to
be responsible for the trail so language was added concerning funds for maintenance and if there were no
funds there would be no maintenance. He spoke to different entities and their contributions to
maintaining the trail.
Commissioner Gallagher stated the entity through which the path runs is responsible for that
portion of the trail. It is his understanding that ECO does a grant for $1,000 per mile to contribute to the
maintenance of the trail. The County is still not in agreement with ECO for maintenance for the portion
of the trail within unincorporated Eagle County. He asked about modifying the language to indicate the
Eagle County Transit Authority is the responsible for those portions of the trail in unincorporated Eagle
County.
Ms. Black stated the State will not accept a re-modified form.
Chairman Stone asked if this is a correct version of the meaning of the form.
Ms. Black stated the way it works, even ifthe Board signs the agreement, if it goes beyond that
year and there were no monies appropriated there would be no maintenance.
Jack Ingstad, County Administrator, stated these issues would be finalized at budget time for the
County ECO Department.
Commissioner Gallagher moved to approve the Consent Agenda for June 5, 2001 as presented.

Plat & Resolution Signing
Matt Gennett, Planner, presented the following plats and resolutions for the Board's

Public Hearing, Issuance of Bonds, Eagle County Air Terminal Corp
Jim Elwood, Airport Manager, stated the next item on the agenda was the public hearing to
consider issuance of Bonds by the Eagle County Air Terminal Corporation. He stated in order to
proceed approval from Eagle County is needed.
Chairman Stone read the following:
"This is a public hearing on the proposal that Eagle County Air Terminal Corporation
issued taxable or tax exempt bonds, in one or more series, to assist in the financing of additions to a
passenger terminal and related facilities at the Eagle County Regional Airport. Such project having an
estimated cost of just over $16 million dollars and to be owned by said corporation is now open. This
hearing constitutes the public hearing required under the Tax Equity and Fiscal Responsibility Act of
1982, Section 1-47F of the Internal Revenue Code. Notice of this hearing was published in the Eagle
Valley Enterprise on May 17, 2001."
Chairman Stone asked if there was anyone from the public wishing to speak.
There were none.
Commissioner Gallagher moved to declare the public hearing be closed for the proposal on the
sale of bonds for the Eagle County Air Terminal expansion.

Resolution 2001-079, Approving Issuance of Airport Terminal Project Revenue Bonds
Jim Elwood presented Resolution 2001-079, approving the issuance by Eagle County Air
Terminal Corporation of up to $16,050,000 Aggregate Principal amount of Airport Terminal Project
Revenue Bonds, Series 2001; authorizing the execution and delivery of a First Supplemental Ground
Lease, a Supplemental Project Agreement, (a Management Agreement), a Parking Sublease and other
related project documents; assigning certain rights and interests ofthe County in connection with the
project, authorizing incidental action, and repealing inconsistent actions.
Mr. Elwood stated this Resolution allows the Chairman to sign the appropriate documents,

including ground leases, project agreements. It modifies and updates the 1996 agreements that were in
place when the original revenue bonds were issued.
Chairman Stone stated the Commissioners and the County Attorney have had an opportunity to
review the agreements.

Beaver Creek Resort Company
Earlene Roach, Eagle County Liquor Inspector, presented a special events permit for Beaver
Creek Resort Company for June 23 & 24, 2001 from 10:00 a.m. to 6:00 p.m. for the Culinary Festival,
August 11 & 12,2001 from 10:00 a.m. to 6:00 p.m. for the Arts Festival, and September 1 & 2, 2001
from 10:00 a.m. to 8:00 p.m. for Oktoberfest. All events will take place in The Plaza in Beaver Creek.
Jean Dennison, Mike Kloser and Jim Funke, applicants, were present for the hearing. Ms.
Dennison stated this year for the first two events they have included the back lawn area of Rendezvous.
Commissioner Gallagher asked about the beer and wine booths.
Mr. Kloser stated for June it will be four, four for August and three for the September event.
Commissioner Gallagher asked about the service booths being manned by the Security people.
Mr. Kloser stated the booths will be supervised by TIPS trained individuals.
Commissioner Gallagher asked if the Board was issuing three separate permits.
Ms. Roach stated they are issuing 6 permits, one for each day.
Chairman Stone stated the events for June and August go from 10:00 a.m. to 6:00 p.m. The
event in September goes from 10:00 a.m. to 8:00 p.m.
Mr. Kloser stated they anticipate starting service around 11 :00 a.m. but have a little leeway for
stocking and may be closing a little early.

Company for June 23 & 24, 2001, August 11 & 12,2001, from 10:00 a.m. to 6:00 p.m. and September I

Edwards Business Association
Earlene Roach presented a special events permit application for Edwards Business Association
for June 18,2001 from 4:30 p.m. to 9:00 p.m. This event is being held at the Singletree Community
Center in Edwards.
Laurie Asmussen and Doug Cogswell, applicants, were present for the hearing. Mr. Cogswell
stated this will be for the Ride the Rockies, which is an event put on by the Denver Post. There are

2,000 bicyclists through a lottery. He explained the route for the Board from Crested Butte and ends in
Boulder. He stated he will be participating in this ride. He stated the Edwards Business Association was
contacted by this group to host the event. He stated this group will spend approximately $140,000
during their stay in Eagle County. He stated they will have a beer garden, music and food at the
Community Center.
Ms. Asmussen stated New Belgin Brewery is the sponsor and will be the servers. She will have
additional volunteers to do some security and the banding.
Commissioner Gallagher questioned a three hour service time.
Ms. Asmussen stated they have allowed time for set up and take down.
Commissioner Gallagher asked if the homeowners know what is happening.
Mr. Cogswell stated they are getting the word out and are extending an invitation to the
homeowners to join in.
Commissioner Gallagher asked about security along the fence.
Mr. Cogswell stated they will have off duty Sheriff s Officers who will man the one entrance.
Commissioner Menconi thanked the applicant for hosting this event.

SUP-00004, Willits Family Homestead Subdivision
Cliff Simonton, Planner, presented file number SUP-00004, Willits Family Homestead
Subdivision Preliminary Plan. Topics discussed by the Roaring Fork Valley Regional Planning
Commission include the following:
The use of building envelopes on the site (over and above merely defining "buildable areas" by
indicating front, side and rear setbacks).
The preservation of existing vegetation along the Harris & Reed irrigation ditch.
The establishment of a 25 foot building setback from the Harris & Reed irrigation ditch on Lot 2
and Lot 3.
The adjustment of lot lines between Lot 2 and Lot 3 to improve future building options on Lot 2.

The size of a new dwelling unit on Lot 3 that would be allowed by zoning dimensional
limitations. See added condition # 11
The Applicant/owner is proposing a subdivision that would create four (4) lots on a 2.4 acre
parcel located adjacent to Willits Lane approximately 0.2 miles south of its intersection with State
Highway 82 on the north edge of the town of Basalt. Three of the lots created will accommodate
existing single family dwellings and a new vacant lot will be created for one additional home. The lots
range in size from 15,177 sq ft to 42,587 sq ft. The existing development on the site pre-dates Eagle
County zoning, with a number of the structures having been constructed nearly a century ago as part of
the original Willits Ranch. The existing driveway will be improved to accommodate emergency access
and emergency vehicle turn around, and will be named Willits Circle.
The large trees and shrubs that currently screen the site from adjacent areas will remain largely
unaffected by the subdivision and the development of the one new lot. The Mid Valley Metropolitan
District currently serves the site with domestic water and sewer, and they have agreed to provide service
to the new lot. Irrigation water is available to the site from a historic well and from the Harris & Reed

irrigation ditch which crosses the southern edge of the property.
Chronology of the property is as follows:
July 31, 2000 Subdivision Sketch Plan for the Willits Family Homestead (SUS-00007) and the
accompanying Zone Change (ZC-00034) was approved by the Board of County Commissioners.
August 14,2000 Variance from Improvement Standards (VIS-00I0) was granted that released
the applicant from requirements for curb and gutter, asphalt surfacing, and separate path ways for bikers
and pedestrians on the newly created Willits Circle.

[+] One historic structure, the shop on Lot three (3), encroaches several feet into the required
12.5 foot setback from the lot line. The applicant is aware ofthe implications of this pre-existing non-
conformity, and has agreed to acknowledge the same in a note on the final plat (condition #1). With this
exception, the uses proposed by this plan are in general conformance with standards for the existing
zone designation of Residential Suburban Low Density.
Article 4, Site Development Standards
[+] Off-Street Parking and Loading Standards (Division 4-1) The Application submitted
includes a provision for three parking spaces per unit. Areas dedicated to parking are not shown,
however, and staff is concerned that a lack of parking space may compromise the availability of Willits
Circle to emergency vehicles. The development of adequate space for off-street parking will be
required, and should be addressed at Final Plat (condition #2).
[+] Landscaping and Illumination Standards (Division 4-2) The mature landscape that currently
exists on the site will be largely retained. A landscape plan has been submitted, and considerations for
landscaping and illumination have been adequately addressed.
[+] Sign Regulations (Division 4-3). No signs other than those associated with the addressing of
homes are contemplated by this plan. Owners of property within this subdivision will be required to
conform to the provisions of this Division.
[+] Natural Resource Protection Standards (Division 4-4)
[+] Wildlife Protection (Section 4-410) - Reference the letters from DOW officers Kelly Wood
(04/23/01) and Kevin Wright (01/13/00), there appear to be no conflicts with wildlife or wildlife habitat.
Protective covenants should be developed that require future owners to restrict the roaming of dogs on
the property (condition #3), and a 25 foot setback from the irrigation ditch should be established
(condition #4).
[+] Geologic Hazards (Section 4-420) - The Colorado Geological Survey found no significant
geologic hazards (letter of 05/08/0 I), but does recommend specific geotechnical studies prior to
construction and the use of best management practices to control erosion on the site.
The applicant has acknowledged the close proximity of this site to an area mapped as requiring
"extensive/detailed geologic engineering investigations" and has agreed to a plat note requiring the same
for any new structure built on the four lots (condition #5).
[+] Wildfire Protection (Section 4-430) - The Colorado State Forest Service (CSFS) has noted a
moderate risk for wildfire on this site. A condition of the sketch plan for this project required the
creation of a driveway adequate for access and turn around by fire fighting equipment. This condition
has been adequately addressed (letter from CSFS, 5/3/01). A new fire hydrant is proposed for Willits
Circle.
[+ ] Wood Burning Controls (Section 4-440) - The applicant has agreed to incorporate existing
Eagle County wood burning controls for any new wood burning devises.
[n/a] Ridgeline Protection (Section 4-450) - The proposed development is not in an area
designated on the Ridgeline Protection Map.
[+] Environmental Impact Report (Section 4-460) - A preliminary Environmental Impact Report
(EIR) was submitted with the application and was deemed to be sufficient.
[n/a] Commercial and Industrial Performance Standards (Division 4-5) Standards in this section
do not apply.
[+] Improvement Standards (Division 4-6)
[+] Roadway Standards (Section 4-620) - As noted earlier, a variance from roadway standards
for the driveway was granted in August of2000. The County Engineer has reviewed and approved the
preliminary plan documents as submitted.
[+] Sidewalk and Trail Standards (Section 4-630) - No internal sidewalks or trails are
contemplated for this small subdivision. The improved Willits Circle driveway will provide adequate

access for residents to nearby Willits Lane.
A future secondary trail is proposed by the Eagle County Trails Plan for the Willits Lane right of
way. It is unlikely that the future installation of this trail would be compromised by the approval of this
subdivision.
[+] Irrigation System Standards (Section 4-640) - Landscape improvements on the site will
continue to be irrigated with water from the irrigation ditch which crosses the property along its southern
edge and from an on site well. Plans submitted are in conformance with applicable standards.
[+] Drainage Standards (Section 4-650) - A drainage report compiled by Sopris Engineering
(11/12/00) was included in the application and has been deemed sufficient by the Colorado Geological
Survey and the Eagle County Engineer.
The Northwest Colorado Council of Governments has recommended a 25 foot setback be
established from the irrigation ditch to conform with provisions of the Regional Water Quality
Management Plan (208 Plan), and that all future structures conform to this setback (condition #4).
[+] Grading and Erosion Control Standards (Section 4-660) - Relevant information has been
provided, and has been deemed sufficient by Eagle County Engineering.
[+] Utility and Lighting Standards (Section 4-670) - Standards for utilities and lighting have
been deemed sufficient by Eagle County Engineering. Street lights are not proposed by this plan.
[+ ] Water Supply Standards (Section 4-680) - Potable water will be provided by Mid Valley
Metropolitan District (letter from Loyal E. Leaverworth, 03/29/00). A Water Use Report is required
(letter from Division of Water Resources, 05/10/01, condition # 6).
[+] Sanitary Sewage Disposal Standards (Section 4-690) - Mid Valley Metropolitan District will
provide sewer to all four lots (see letter referenced above).
[+] Impact Fees and Land Dedication Standards (Division 4-7)
Off site road impact fees and cash-in-lieu of school land dedication will be assessed for the one
new lot, and will be due prior to Final Plat (condition #7). A Subdivision Improvement Agreement will
also be required at the time of Final Plat.

With the recommended conditions, the proposed Subdivision does comply with all of the
standards ofthis section and all other provisions ofthese Land Use regulations, including but not limited

STANDARD: Spatial Pattern Shall Be Efficient. [Section 5-280.B.3.e (3)] - The proposed
subdivision shall be located and designed to avoid creating spatial patterns that cause inefficiencies in
the delivery of public services, or require duplication or premature extension of public facilities, or
result in a "leapfrog" pattern of development.
Utility and Road Extensions. Proposed utility extensions shall be consistent with the utility's
service plan or shall require prior County approval of an amendment to the service plan. Proposed
road extensions shall be consistent with the Eagle County Road Capital Improvements Plan.
Serve Ultimate Population. Utility lines shall be sized to serve the planned ultimate population
of the service area to avoidfuture land disruption to upgrade under-sized lines.
Coordinate Utility Extensions. Generally, utility extensions shall only be allowed when the
entire range of necessary facilities can be provided, rather than incrementally extending a single service
into an otherwise un-served area.
The spatial patterns proposed by this development are not anticipated to cause the kind of
inefficiencies contemplated by this standard.

to be subdivided shall be suitable for development, considering its topography, environmental resources
and natural or man-made hazards that may affect the potential development of the property, and
existing and probable future public improvements to the area.
Topography of the site is relatively flat. The three dwelling units that presently exist on the site
were constructed (or positioned) many years ago, and show no signs of failure as a result of subsurface
conditions. The applicant has agreed to a plat note requiring appropriate engineering be done for any
new construction.
[+] FINDING: Suitability for Development. [Section 5-280.B.3.e (4)]
The property proposed to be subdivided is suitable for development, considering its topography,

It appears unlikely that the future development of the surrounding area would be adversely affected by
the subdivision and development of this land.
[+] FINDING: Compatible With Surrounding Uses. [Section 5-280.B.3.e (5)]
The proposed subdivision is compatible with the character of existing land uses in the area and
will not adversely affect the future development of the surrounding area.
The Planning Commission felt due to the shape of the lot it would be wise to change the shape of
Lot 2. If the 25 foot setback comes into play then lot 2 would be so tight it would be difficult to put
anything on that lot.
The DOW's concerns was with vegetation ofthe ditch. There is no vegetation on that side of the
ditch. He stated he agrees with the applicant and is requesting the set back of the ditch be 15 feet rather
than 25 feet.
David Spearer, representing the applicant, stated the Willits Family has nothing to do with the
Willits PUD across the street. He stated the Willits have been there since 1902. He stated the applicant
would like move out of the mobile home and build a single family home on Lot 2. He stated they are
requesting the Board either eliminate the 25 foot set back from the ditch or reduce it to 15 feet. The
second point to be discussed, is the building envelope. He stated they decided the standard setbacks do
provide a sufficient building envelope. He asked they go with the floor ratio as designated by the Land
Use Regulations rather than the building envelopes if that meets with approval from the Board.
Chairman Stone asked if building envelopes are drawn on the map.
Mr. Spearer stated what they have drawn are the setbacks shown on the Preliminary Plan.
Chairman Stone stated Lot 1 keeps the unit that is currently there. Lot 4 has a rental unit which
would have to be torn down to build another and would follow the Land Use Regulations at that time.
Lot 3 has a garage building and a pre-existing non-conforming shop. Lot 2, the building would have to
be removed to place another single family residence.
Mr. Spearer stated the applicants are currently living in the mobile home and plan to remove it
and building a single family home.
Chairman Stone asked if Lot 1 would ever have the ability to have the house removed and a new
one built.
Mr. Spearer stated the senior Willits currently live on Lot 1 and will reside there until they are
deceased, then the house could be removed.
Chairman Stone asked if there was public comment.
There was none. Public comment was closed.

Commissioner Gallagher stated he has no problem in minimizing the set back from the ditch. He
stated the lot line was shaped to accommodate the existing mobile home. If the mobile home was not
there would they then make Lot 2 smaller.
Mr. Spearer answered they must meet the minimum of 15,000 square feet but it would be
straightened to make the lot more sensible.
Commissioner Gallagher asked about the life of the mobile home.
Mr. Spearer stated maybe in ten years.
Commissioner Gallagher asked about the configuration ofthe lot line when the mobile home is
moved in a few years.
Mr. Spearer stated they would move one point in and the other point out.
Commissioner Menconi stated he thought the idea was to remove the mobile home.
Mr. Spearer stated the idea is to allow the Willits to build a new home.
Commissioner Menconi asked if the applicant was okay with conditions.
Mr. Spearer stated they would like to see adjustments to two of the conditions, the elimination or
reduction of the ditch setback to 15 feet from the centerline of the ditch. He stated the other was to go
with the floor area ratio as shown in the Land Use Regulations.
Commissioner Menconi asked if the lots across the street within the Town of Basalt are either
bigger or smaller.
Mr. Spearer stated he did not know. He stated he believes the Town of Basalt has been looking
at square feet. He stated they have been looking at commercial buildings across the street and they
would not be any smaller than the Willits new home.
Chairman Stone asked about Willits Circle and asked if that was meant to be a cul-de-sac.
Mr. Spearer stated they started out with a cul-de-sac and after discussion with the Fire
Department, they agreed to a hammer head configuration. He believes that is also acceptable to County
staff.
Mr. Simonton stated it is acceptable with staff. He stated if that were to become a setback it
would further restrict lot 2. He stated there will be a plat note designating three parking spaces per unit
specifically not to be in the right-of-way of Willits Circle and not within that emergency easement.
Chairman Stone asked about on street parking.
Mr. Simonton stated on street parking could be detrimental.
Chairman Stone stated he would like to see a plat note there would be no fences and no on street
parking and nothing located on the hammerhead.
Commissioner Gallagher asked about fire protection and the size of the hammerhead.
Mr. Spearer stated it is 50 feet wide and 130 feet in length. It extends into Lot 2 approximately
50 feet.
Commissioner Gallagher asked about a fire hydrant.
Mr. Spearer stated they will be installing a fire hydrant and will be serviced by the Mid Valley
Metropolitan District.
Commissioner Gallagher asked about on street parking and the turn around being conditions.
Chairman Stone stated he would like to see those as conditions. He asked about condition
number 7 and read it for the record as follows:
"Offsite road impact fees and cash in lieu of school land dedication as determined by
Eagle County Engineering, as defined by Eagle County Land Use Regulations, be paid prior to final plat
approval. "
Keith Montag, Director of Community Development, stated the new regulations were approved
on May 15, 2001. He stated any final plat approved after that date would be subject to road impact fees.
As there are existing units on site the only added costs would be an increase in traffic.
Mr. Montag stated if an amended final plat came back with an increase in traffic those fees
would be assessed at that time.

Chairman Stone stated condition number 7 should be adjusted to accurately reflect what the Land
Use Regulations state.
Mr. Spearer stated the applicant would like the setback of 15 feet from the center of the ditch.
Chairman Stone stated he would like to see 15 feet from the edge of the ditch.
Mr. Simonton stated condition number II, the limit to the size of the home. He stated the limit
was to the square footage of the home and not to the ratio. He stated the size of the lot is so large they
could build an 8,400 square foot home.
Chairman Stone stated the applicant is trying to amend it to be 6,500 square feet. He suggested
using the building footprint.
Mr. Spearer agreed with using a building foot print of 3,000 square feet.
Commissioner Menconi stated with using the 3,000 square feet the applicant could build a larger
house by using different stories.
Chairman Stone stated a more accurate way of trying to accomplish is coverage. The real intent
is to try to leave enough open space around the outside ofthe house. He suggested maybe they could use
the building footprint of not to exceed 3,000 square feet and a total of not to exceed 6,500 square feet.
Commissioner Gallagher stated they are dealing with Lot 4. There appears to be a small rental
unit. He stated he does not want to put limitations on what they can build.
Chairman Stone asked why the Planning Commission added condition number eleven.
Mr. Simonton stated it is his recollection it was just brought up at the Planning Commission
meeting and was not part of any discussions.
Jenna Willits, applicant, stated the person who brought up the condition lives right behind her
and has a monster of a house.
Chairman Stone asked if Mr. Montag sees anything wrong with deleting number 11.
Mr. Montag stated the zoning itself will take care of all of those restrictions.
Mr. Spearer spoke to the ditch and where the ditch bank begins. He stated the home is
approximately 12 or 12 and a half feet from the ditch.
Chairman Stone asked if he was speaking about the mobile home or the addition.
Mr. Spearer answered the addition.
Ms. Willits stated it is about six and a half feet to the edge of the ditch. She stated the owners of
the ditch have written a letter indicating it is not a problem for the ditch concerning erosion.
Chairman Stone asked what Ms. Willits issue was with the Board requiring a 15 foot setback
from the center of the ditch.
Ms. Willits stated the lot would become so much smaller and they are trying to make this lot as
viable as they can.
Commissioner Gallagher stated he is concerned with the house falling into the ditch.
Chairman Stone stated Kevin Wright, Division of Wildlife, recommended a 25 foot set back
from the edge of the ditch.
Commissioner Gallagher moved the Board approve File No. SUP-00004, Willits Family
Homestead Subdivision Preliminary Plan, incorporating all staff findings and with the following
conditions:
1) That the Pinal Plat include a note that acknowledges the nonconformity of the building labeled
"shop" located on Lot 3, and states that future changes or improvements to this building will be
restricted per applicable Eagle County Land Use Regulations. That the Final Plat include a note that
acknowledges the nonconformity of the building labeled "mobile home" located on Lot 2, and states that
future changes or improvements to this building will be restricted per applicable Eagle County Land Use
Regulations.
2) That the Final Plat include a note that requires three (3) parking spaces per unit, and that there
be no on street parking on Willits Circle.
3) That measures for dog control, as referenced in the referral response from the Colorado

Division of Wildlife (letter of 01113/00) be addressed prior to Final Plat approval.
4) That a 17' building setback be established from the centerline of the Harris and Reed irrigation

structures proposed for construction on the property, as requested by the Colorado Geological Survey

6) That concerns regarding a Water Use Report and irrigation water rights, as detailed in the
referral response from the State Engineer (05/10/01) be addressed prior to Final Plat approval.

Eagle County Engineering and as defined by Eagle County Land Use Regulations, be paid as required.
8) That an addressing scheme for the four lots be developed and approved by the Eagle County
Emergency 911 Coordinator prior to Final Plat approval.
9) That all material representations made by the Applicant in submitted materials and in public
meetings shall be adhered to and considered conditions of approval, unless otherwise amended by other
conditions.
10) That the final plat include a note vhich requires that there be no obstruction of the
emergency vehicle turn-around and easementlnto Lot 2.
Chairman Stone asked about the original condition number 10, from the Roaring Fork Regional
Planning Commission, there was a conscientiol.s decision to not include that condition.
Commissioner Gallagher stated under c~ldition number 9 the applicant has made a material
representation that they will modify that lot line after removal of the mobile home.
Chairman Stone stated the material repres~ntation, although not included in the conditions, is a
requirement of Eagle County.

Review of LightinglLandscape, Edwards Drinking Water F~dlity
Bob Narracci, Planner, stated the next item is review ofthe\lighting and landscape plans for the
Edwards Drinking Water Facility by Eagle River Water & Sanitati~\l District. He stated this matter was
placed on the agenda to satisfy the conditions of the General Warranty Deed.
Chairman Stone stated this file is to satisfy a condition of the Warranty Deed signed by Eagle
County and Eagle River Water and Sanitation District. He read part oNhe condition for the record.
Lynn Shorr, representing Eagle River Water & Sanitation District, stated they requested a 1041
permit which was approved. They also have an access and grading .p>~nnit.
Charlie Nimon, Engineer, showed on a map the location of the water treatment facility, the
lighting, pump station intake, the Reserve and CDOT access. He review~ol the property and the current
screening. He reviewed the list of project components. He stated buriec!1\>elow grade are the intake
structure, pumping station, pipelines, transmission pipeline and treatmen!.rstructure. He showed a picture
of the structure. The retaining wall will be colored concrete, they will htve screening and vegetation.
He showed pictures of the lot before and the lot after the building is burifd. He pointed out the existing

bike trail. He stated it will be restored ifthere is any damage done. Mr. Nimon spoke to the overall
landscaping plan. He spoke to the intake structure.
Commissioner Gallagher asked about the yellow trees shown in the drawing. He stated in one
sketch they are showing mature trees and the other sketch shows smaller trees. He questioned doing
something on the upper edge to take away the straight line effect.
Ms. Shorr explained the trees on the river side are the existing Cottonwpods and are mature trees.
In the building face picture, the top of the building is at ground level and will not be very visible.
Commissioner Gallagher asked about parking.
Ms. Shorr stated this is an unmanned facility. It will be monitored by the Avon facility. It will
be visited once or twice a day.
Chairman Stone asked if this will be open for access to the public.
Ms. Shorr stated there will be a gate at the bike path and at the rest area. She stated there is
already a fence between the CDOT site and the railroads and their site.
Chairman Stone questioned the type of fence.
Ms. Shorr stated it is a barbed-wire fence.
Chairman Stone stated there were a lot of comments from people indicating they walk their dogs
down there, and the fisherman use it to get to the river and creeks. He asked them to address the concern
of pedestrian access.
Mr. Nimon stated pedestrians can still access the property but there will be no vehicle access.
Chairman Stone asked if they will paint the guardrail.
Mr. Nimon stated yes.
Chairman Stone thanked the applicant for coming in for the update. He stated there were a
number of people from the public who had questions.
Commissioner Menconi moved to approve the site, lighting and landscaping plans for the
Edwards Drinking Water Facility.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
