Chairman Stone asked County Attorney if there were any changes.
Renee Black, Acting County Attorney, stated she would like item F, Child Support Enforcement
Agreement, tabled to next week.
A. J. Johnson, Eagle County Sheriff, stated he would like to table items I, Annual Wildfire
Operating Plan and J, Sheriffs Fire Agency Mutual Aid Agreement, to allow some additional meetings
to be held. He stated he will reschedule those after he is finished with the meetings.
Commissioner Gallagher questioned item K, bid award for the car carrier for Road & Bridge.
Brad Higgins, Road & Bridge Director, stated this is a tow truck that will haul County vehicles.
Commissioner Menconi asked how often is it used.
Mr. Higgins stated it is used to tow County vehicles when they go down, or back to the shop and
even to car dealerships. He stated the one they have will not fit some of the current County vehicles.
Commissioner Gallagher asked about the Junior Livestock Sales Commission. He stated the
Board approved a lease agreement format for use of the Fairgrounds. There seems to be a lot of other
items on this agreement beyond the scope of the use.
Chairman Stone read parts of the agreement scope of duties, "shall include organizing the
auction, collecting all monies involved, sale at the auction livestock, promoting the sale, dispersing
monies to 4 H, arranging the transport of livestock".
Commissioner Gallagher stated this agreement seems to put the County Commissioners in a
position of making sure this independent body handles their money properly. He stated the Board does

not do that for anyone else leasing the fairgrounds.
Tom Deverauax, Director of Extension & Weed and Pest, stated this is the same agreement as
they have used in the past and they just keep using the same agreement.
Commissioner Gallagher stated last year they did approve a new lease for the Fairgrounds.
Ms. Black stated the Board wanted control as to what was going on at the Fairgrounds.
Commissioner Gallagher stated he has no problem with having the Junior Livestock Commission
do what the agreement says they are going to do. He stated he would support the agreement for this year
but would like it changed for next year.
Chairman Stone stated they would like to have the capabilities in the agreement to assure their
events are happening appropriately.
Commissioner Gallagher asked what the Junior Livestock Sales Commission have to say about
it.
Mr. Deverauax stated they believe if this is what needs to be done they do not have a problem
with it. He stated it was their thoughts that a one or two page policy that does not have to be renewed
every year would be adequate
Commissioner Menconi questioned the income coming in.
Mr. Deverauax stated the income is solely from the sale of animals. He stated they take in
approximately $100,000.00 at the beginning of August and disburse it.
Kathleen Forinash, Director of Health and Human Services, stated on item L, Early Head Start
Expansion Grant, the amount of the request of the grant was increased by $8,000.00 to $211,971.00.
Chairman Stone asked if the agreement could be tabled to next week.
Ms. Forinash stated this agreement is due in Washington D.C. next week. She pointed out the
change in the second set of application forms, federal assistance, $211,971.00 federal, $52,993.00
applicant, for a total of $264, 964.00. She stated the change is due to an error in calculating the full
salary of a staff position. She stated there is no cash match from the County in this application.
Chairman Stone asked if there was an issue with changing those figures.
Chairman Stone ask if there was a problem with changing the figures on this application.
Ms. Black stated no one would have the original figures unless they had obtained a copy ofthe
agreement.
Commissioner Gallagher asked about item H, the Eagle River Hydrology Study.
Helen Migchelbrink, County Engineer, stated in 1997 they undertook a new mapping project of
the Eagle River. She stated they paid to have aerial photographs taken from Dowd Junction to the
Garfield County line. She stated this was in anticipation of new maps being created by FEMA. For
eighteen months FEMA has balked on funding this project, so working through the Colorado Water
Conservation Board, they gave the County a $15,000.00 grant to do the hydrology study on the flows
coming from the river to determine what the mapping will be. The portion needing updated is from
Down Junction to the Garfield County line as the portion between Eagle and Gypsum has been
completed. This studies the hydrology from Minturn to Eagle.
Commissioner Gallagher asked about the rest of the Eagle River and Gore Creek.
Ms. Migchelbrink stated at this time there are no plans for further studies but after the first
portion is completed she will be meeting with CWCB to see about funding for that portion of the river as
well.
Commissioner Gallagher stated he assumes the flow studies will be during this run off period.
Are they examined and based with the understanding of this year's snow fall and other events predicted
from that.
Ms. Migchelbrink stated the way this study is done, you look at basins and what contributes to it.
There are gages at various locations in the river that measure those. The study is done on a theoretical
water calculation and not done on current run off.
Commissioner Menconi moved to approve the Consent Agenda as presented, pulling item F, I, J.

Chairman Stone stated there are no plats or resolutions for the Board's consideration.
Adam's Rib Ranch Metropolitan District No.1 & 2
Bob Narracci, Planner, stated the next item on the agenda was to set a public hearing for Adam's
Rib Ranch Metropolitan District No 1 & No 2 Service Plan. He stated this is the statutory requirement
to set the hearing date for May 29, 2001.
Commissioner Gallagher moved to set a public hearing date of May 29, 2001 for Adam's Rib
Ranch Metropolitan District No 1 & No 2 Service Plan at 1 :30 p.m.
Commissioner Menconi seconded the motion. The vote was declared unanimous.
Closing Documents, Vail Valley Jet Center
Jim Elwood, Airport Manager, stated the next item on the agenda was approval of the closing
documents concerning the purchase of the passenger terminal business with the Vail Valley Jet Center.
Jack Ingstad, County Administrator, stated the Board has two documents, a promissory note that
ECAT is expected to execute for a 4.25 million dollar loan, and an Assignment and Agreement with
Eagle County, Eagle County Air Terminal Corporation and the Vail Valley Jet Center. He stated they
have been in negotiations with the Jet Center and the Attorneys and are now in agreement. He asked the
Board review both documents. He will also be asking for a release of funds from the County's budget,
going to ECAT. He will then be asking for a release of monies from the County's appropriated budget
to ECA T once there is an executed promissory note from Mr. Elwood and an executed agreement from
the Vail Valley Jet Center.
Chairman Stone stated this was contemplated a couple of months ago for Eagle County to
purchase the commercial air passenger business from the Vail Valley Jet Center. Because of delays in
negotiating leases with the Airlines and having extended discussions, the closing date was set for today
with the ability to extend past this date with an agreement the Air Terminal Corporation would pay 7.5%
interest. He stated Eagle County will be lending the money to the Air Terminal Corporation for the
purchase of the business until bond closure which is scheduled for around mid June.
Mr. Ingstad suggested the Board first approve the Assignment and Agreement.
Commissioner Menconi questioned paragraph 3, distinctions, as to what the County is actually
buying from the Vail Valley Jet Center and to what they will be terminating.
Mr. Ingstad stated he has been unsuccessful in getting the seller to define that. He stated the
Airport Attorney is satisfied that the term is sufficient if they ever got into a situation they would be able
to call expert witnesses, i.e. the FAA, and they would be able to define to any Court what is meant by
that. He believes that this means they are buying the terminal passenger business, including the
passenger commercial planes, the leases, the chartered service, car rental companies, transportation
providers, gift shops, all the elements you see at any Airport, i.e. D.1. A. He stated the Jet Center had
concerns with the County's original definition. He stated the Jet Center will not be competing with the
County.
Mr. Elwood stated that was correct.
Commissioner Gallagher stated at the same time it does not interfere with the general aviation
portion of the Jet Center.
Mr. Elwood stated that was correct. They cannot advertise or promote items relating to
passenger business.

Commissioner Menconi stated he is not comfortable with that language. He would have thought
there would have been a little more distinction made and the seller would have been willing to do that.
Mr. Ingstad stated their attorney is not willing to budge. He stated he has to wire the money by
2:00 p.m. today.
Chairman Stone stated he can understand the Jet Center's position. He is a little displeased with
the Jet Center because the County was trying to continue to improve relations between the two entities
and they would not be in a competition situation. He was hoping they could continue to move forward
with that scenario. Even though the Jet Center has been unwilling to discuss this any further, the
Attorneys have indicated if in a court battle there would be witnesses to support what the business
consists of.
Mr. Ingstad stated the concern was one of the exhibits in the agreement. He stated they failed to
mention the most important part of the business, the commercial passenger business. He said that those
are referred to in the current agreement. He stated while they prefer to define the business, there are
three attorneys who are comfortable with the agreement as it is.
Chairman Stone stated he does not know ifhe wants to delay the matter as the Jet Center has
indicated they will not fix this item. Chairman Stone stated the County was willing to fix the lease
agreement between themselves and the Jet Center, which expires in 2016, in the spirit of cooperation. It
is unfortunate the Jet Center is not willing to fix this minor item.
Paul Gordon, General Manager of Vail Valley Jet Center, stated Mr. Allen's understanding is
there was an agreement that was reached a number of months ago and these talks are trying to define
what the Vail Valley Jet Center can and cannot do with Terminal B. They do not know what they are
going to do with the building but do not want to be limited on what they can do. They are well aware
that they cannot complete with Eagle County in any way for commercial passenger revenues related with
commercial business.
Commissioner Menconi asked why that was not in writing
Mr. Gordon stated what is not in writing is the list of businesses that they cannot get into.
Mr. Ingstad stated perhaps that was aggressive but they have rolled that back and went with what
seemed to be reasonable to everyone. There has been an unwillingness on Mr. Allen's part to even
discuss this.
Commissioner Menconi stated he is hesitant to enter into an agreement with taxpayer money on
something he has heard discussion on having a clear understanding of what is and is not included.
Mr. Gordon stated he understands but it is not his decision. He stated it is his understanding that
Mr. Allen was offended when approached and the list of the many many items that were on the original
list.
Commissioner Gallagher stated he feels better if an agent would speak to the limitations.
Commissioner Menconi asked Mr. Gordon to send his apologies to Mr. Allen.
Mr. Ingstad stated the agreement can be changed.
Commissioner Menconi stated he believes the other two Commissioners are ready to move
forward. He stated his no vote is a message to Mr. Allen as to why he would not want to work out
something that was said.
Commissioner Gallagher moved to approve the Assignment and Agreement between the Vail
Valley Jet Center, and authorize the Chairman to sign said agreement.
Chairman Stone seconded the motion. Commissioners Stone and Gallagher voting aye and
Commissioner Menconi voting nay.
Mr. Ingstad stated the next matter is the promissory note and the release of the 4.25 million
dollars to the Eagle County Air Terminal Corporation.
Ms. Black stated this promissory note is based on the direction of the Board at 10.5%. The
attorney felt this was a form that bond counsel will agree with. Eagle County will not be a part of this
note but rather it will be ECAT. She stated it is her understanding that as soon as the bonds come

through the note will be paid off immediately.
Chairman Stone asked what is the term of the note.
Ms. Black stated it is a 30 year note with no penalty for pre-payment.
Mr. Elwood stated it is the intention of ECA T to pay this note off immediately after the bond
sale.
Commissioner Gallagher moved to approve the form of the promissory note, loaning Eagle
County Air Terminal Corporation 4.25 million dollars and authorizing the Treasurer to release the funds
and the Chairman to sign the note. Also included in the motion is authorization for the finance director
or the budget officer to prepare the paperwork to release those funds.
Ms. Black stated it is a promissory note from ECA T to Eagle County and the Board is just
approving the form.
Commissioner Menconi asked about the signature page.
Mr. Ingstad stated the signatures will be ECA T' s.
Commissioner Menconi seconded the motion. The vote was declared unanimous.
Commissioner Menconi moved to adjourn as the Board of County Commissioners and reconvene
as the Eagle County Air Terminal Corporation.

Commissioner Gallagher seconded the motion. The vote was declared unanimous.
The Shortstop
Earlene Roach presented a renewal of a tavern license for Stasmore, Inc., dba/The Shortstop.
She stated there were two items with intoxicated individuals. Staff wanted to bring this applicant in due
to the numerous contacts in the past. As we have had other establishments that had similar contacts staff
felt it important to start with a clean slate on all applicants who have numerous contacts. Mike
Stascavage, owner, is present for the hearing. As the Board can see these contacts started in February
1990 to current day. There are a total of 57 disorderly's and 74 contacts that mayor may not have been a
problem. For the 57 disorderlys that averages 5.18 contacts per year in an 11 year period.
Chairman Stone stated the Liquor License Board has become very concerned with the service of
alcohol because of a problem resulting in a death last year. He believes this Board has grown to have a
heightened awareness of what the Colorado liquor laws have to say about disorderly conduct, over
serving to someone visibly intoxicated, etc, all which can be causes for lack of renewal of a liquor
license. That is not Eagle County's law that is Colorado law.
Ms. Roach stated the question marks she has on the contact sheet are suspicious and such and the
disorderlys are actually the intoxicated individuals, disorderly's, etcetera.
Commissioner Menconi asked if the staff at the establishment had called in on the disorderly's.
Ms. Roach answered no, only the two from last year.
Ms. Stascavage stated they called on the two from last year. They have a very open relationship
with the Sheriff s Office.
Commissioner Menconi asked how long he had been the owner of this establishment.
Mr. Stascavage stated it will be 12 years in July.
Commissioner Menconi asked the only two occurrences last year the owner called because the
individuals arrived at the establishment intoxicated.
Mr. Stascavage related they had also turned over five or six fake ID's to the Sheriffs Office last
year. He stated they are doing their best to assure that under aged drinking and service to minors does
not occur.
Commissioner Gallagher pointed out that the column labeled relationship, those that read
complainant is where the Shortstop called and made the complaint. Where it says location is where they
did not call and make the complaint. He stated one of the things that came to light at a liquor license
hearing where there was not a renewal, was a pattern of disregard to the rules, regulations and good
common sense of having a liquor licensed establishment. He asked Mr. Stascavage to describe his

establishment for the Board.
Mr. Stascavage stated it is approximately 3,000 square feet of bar area and approximately 800
square feet of kitchen area. There is a small patio out front, a U shaped bar in the center of the room,
pool tables on one side and a dance floor and darts on the other side. There is also a small game room in
the back and booths near the dance floor for people to sit.
Commissioner Gallagher asked what was the seating capacity.
Mr. Stascavage stated 152.
Commissioner Gallagher asked how many meals do they prepare.
Mr. Stascavage stated they do not offer meals as they are a tavern license. He stated they have
sandwiches and snacks.
Commissioner Gallagher asked if there was a reason the working man could not get a meal there.
Mr. Stascavage stated when Wendy's opened across the street it hurt his food business. It was
not profitable to continue the food business.
Commissioner Gallagher asked about the number of employees and what were their job
descriptions on a Friday night.
Mr. Stascavage stated there is a bartender, a door man and himself, ifhe is available. They just
started doing bands again.
Commissioner Gallagher asked if he had wait staff.
Mr. Stascavage answered no. He stated they do not hustle drinks to the customer, they must
come to the bar.
Commissioner Gallagher stated he runs 152 seats with two individuals.
Mr. Stascavage stated they generally do not have over 50 to 70 people. He stated there is no taxi
service in the EI Jebel area. He related he and his staff will give people rides home if they have gotten to
the point where they have had one too many.
Commissioner Gallagher asked how many people are on his payroll.
Mr. Stascavage stated there are five including himself.
Commissioner Gallagher asked how many of those five are TIPS trained.
Mr. Stascavage stated all of them at some point in their career.
Commissioner Gallagher stated he wonders about something Mr. Stascavage said, that his
interest is not in not serving someone but rather making sure they don't drive drunk. How would it work
if they were not served until they reached that point.
Mr. Stascavage stated there have been instances where some have brought in their own alcohol
without his staff knowing it. He stated they monitor it as best they can. If someone from the bar goes to
the liquor store they will call and let the Shortstop staff know.
Commissioner Gallagher commented for the 22 years he was a policeman, if he had a nickel for
every time someone said they only had a couple of beers, he would be a rich man.
Chairman Stone asked if it was within the Board's ability to have a condition regarding approval
of the renewal. He stated he was thinking about having everyone TIPS trained within a certain period of
time. He stated he has found in their discussions with Champions Bar & Grill, there was a general lack
of knowledge for the liquor laws.
Ms. Roach stated the Board can condition the renewal but maybe not for TIPS training.
Ms. Black stated her recommendation would be rather than a condition to let the owner know
that if the Board does not receive verification of TIPS training you would like to see them for a decision
as to whether the license should continue.
Mr. Stascavage stated they have tried to set up TIPS training through a Basalt location and it will
be canceled because there have not been enough people to make it worthwhile.
Chairman Stone asked about getting the State Enforcement Officer to do some training.
Ms. Roach agreed.
Commissioner Gallagher asked about the hours of operation.

Mr. Stascavage stated from 11 :30 a.m. until close, which is anywhere from 10:00 p.m., 11 :00
p.m. or 2:00 a.m.
Commissioner Menconi moved to approve the renewal of a tavern license for Stasmore, Inc.,
dba/The Shortstop. Staff shall be directed to have the State Enforcement Officers meet with the crew at
the Shortstop and do some additional training.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
Los LLaneros, Inc.
Earlene Roach presented a special events permit application for Los Llaneros, Inc. This event is
scheduled for May 13,2001 from 2:00 p.m. to midnight at the Eagle County Fairgrounds. The applicant
is proposing a Mexican rodeo.
Olga Galindo, applicant, is present for the hearing. She stated they will most likely not serve
after 12:00 a.m. but have allowed extra time to close everything up.
Ms. Roach gave the Board copies ofthe TIPS cards, showing all those involved with alcohol
have been trained. She stated the Board also has an Alcohol Management Plan from the applicant.
Chairman Stone asked if they were going to be serving in the rodeo arena.
Ms. Galindo stated they will be serving from the concession stand.
Chairman Stone asked what controls were in place for the alcohol.
Ms. Galindo stated the entire premise is licensed. She stated they have 10 security officers who
will be working the crowd. She stated they will be serving food also.
Commissioner Gallagher asked about licensing the entire fairgrounds.
Ms. Galindo stated they want to do that just in case people wander outside of the arena.
Commissioner Gallagher asked if the premise includes the exhibit hall and the livestock barn.
Ms. Galindo stated it includes the barn but they will not use the exhibit hall.
Chairman Stone asked where people will be parking.
Ms. Galindo stated not inside the fence.
Chairman Stone suggested they have a security officer at the gates where they are selling tickets.
Ms. Galindo agreed and stated they currently search anyone that goes into the arena to assure that
no one is carrying a weapon. She stated they are experienced in these events and reviewed other places
where they have been held. She stated they will also be using wrist bands.
Commissioner Gallagher asked what they are going to serve.
Ms. Galindo stated they will have only beer.
Commissioner Gallagher asked if this was the second time they have done this rodeo in Eagle
County.
Ms. Galindo answered yes but at the first event they did not sell alcohol.
Ms. Roach stated but they did a good job keeping the alcohol out of the area.
Commissioner Menconi asked about having a large area, individuals buying two beers and taking
it back to someone in the stands.
Ms. Roach stated they need security to patrol the stands to see who the extra beer is going to.
Commissioner Menconi asked how many people will be at this event.
Ms. Galindo stated they are expecting 500.
Commissioner Menconi asked about law enforcement officers.
Ms. Galindo stated there will be two Sheriffs Officers at the event.
Commissioner Gallagher moved to approve a special events permit for Los Llaneros, Inc. for
May 13,2001 from 2:00 p.m. to midnight.

Eagle County Government
Earlene Roach presented a special events permit for Eagle County Government for May 5, 2001
from 6:00 p.m. to midnight for the Rocky Mountain Oyster Feed. Also for July 28, August 1, 2, 3 and 4,
2001 for the Eagle County Fair, from 6:00 p.m. to midnight. Rusty Williams, Melissa Johnson and
Richard Kessler, applicants, were present for the hearing.
Chairman Stone asked if these applicants have been involved with an alcohol license before.
Mr. Kessler stated he has attended 11 ofthe 12 Rocky Mountain Oyster Feeds and has been
involved with beer sales for the last eight years.
Chairman Stone asked how this event will differ from those held in the past.
Mr. Kessler stated the Oyster Feed will have beer sales in the exhibit hall from 6:00 p.m. to 8:00
p.m. At 7 :00 p.m. they will open the bar at the livestock pavilion. He stated there will be Sheriff's
Deputies and 14 Fairboard members at this event assuring it goes well. He stated they are all graduates
of the ESAS, which is Earlene's School of Alcohol Sales.
Commissioner Gallagher asked what happens on July 28th.
Mr. Kessler stated that is the Bullriders Classic, which is the kick off to the Fair. It is a Saturday
evening and will include the bull riders event and an arena dirt dance. He stated there are Fair events
between the 28th and August 1st but it is horse shown, 4H events and such. There will be no beer sales
between those two dates.
Ms. Roach stated there will be no beer sales on Sunday.
Commissioner Menconi asked how many people will be at the Oyster Feed.
Mr. Kessler stated they have averaged approximately 800 in the past.
Commissioner Menconi moved to approve a special events permit for Eagle County Government
for May 5,2001, July 28,2001, August 1,2,3 and 4,2001, from 6:00 p.m. to midnight.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.

G-00013, Vacation of a Portion of Bellyache Ridge Road
John Vengrin, Engineering Department, presented file number G-00013, Vacation of a Portion of
Bellyache Ridge Road. He stated on March 21,2001 the Eagle County Planning Commission
recommended approval to the Eagle County Board of County Commissioners of this petition for
vacation of the portion of Bellyache Ridge Road through the Red Sky Ranch PUD with the following
three conditions:
1) The effective date of the vacation of this road shall be the date on which the last of the three
following documents has been recorded with the Eagle County Clerk and Recorder: 1) Resolution of the
Eagle County Board of County Commissioners, 2) Quit Claim Deeds, and 3) Temporary Easement Deed
for the existing road during the interim period prior to acceptance of the new alignment.

all surviving rights-of-way and refer to this Road Vacation action.
Mr. Vengrin stated this is a petition for the vacation of a portion of the public road known as
Bellyache Ridge Road (Eagle County Road 35) on the Red Sky Ranch PUD. Under the Eagle County
Land Use Regulations, this road is considered to be public and is therefore subject to the requirements of

Section 5-2200 Public Way and Easement Vacations.
The Petitioners want to vacate this road so they can develop the Red Sky Ranch according to
plan. The plan includes relocating a portion of the road to the east. The vacated portion of the road
would then be used for a combination of golf course, driving range, single family building lots, or access
roads. They agree to reconstruct a new portion of Bellyache Ridge Road through the eastern portion of
their property for continued access to land on Bellyache Ridge south of the Red Sky Ranch. The
construction plans for the relocated road were approved by the Eagle County Board of County
Commissioners (BoCC) as part of the Red Sky Ranch PUD Preliminary Plan; and, in fact, most of the
embankment for the relocated road was constructed in 2000 under a separate Special Use Permit for the
Red Sky Ranch.
The applicant's petition for vacation of the road is attached to this staff report.
Referral responses are as shown on staff report and as follows:
Land Surveyor: The reviewing Land Surveyor, Roger W. Meyer provided comments in a letter
dated February 20, 2001, which is attached to this report.
Eagle County Planning Division: Joseph Forinash of the Eagle County Planning Division
provided comments in a memorandum dated February 13, 2001. Attached to that memorandum was a
letter dated January 17,2001 which he had sent to the applicant for the Red Sky Ranch. The letter
discusses procedural issues for the road vacation and Final Plat of Red Sky Ranch. The memorandum
and letter are attached to this report.
Staff has no major concerns regarding the vacation of the road as requested by the Petitioners.
However, the following issue must be resolved:
Timing: The vacation must be effective prior to the recording of the Final Plat of Red Sky
Ranch. However, the existing alignment will need to be used for a brief period after the Plat is recorded
and before the new alignment is accepted by Eagle County. The applicant proposes to dedicate a
temporary easement for the existing alignment during this interim period.
Engineering Staff suggests that the vacation become effective after a) a Resolution of the BoCC,
b) quit claim deeds for the vacated portion of the road, and c) a temporary easement deed for the existing
road during the interim period, are recorded with the Eagle County Clerk and Recorder.
Mr. Vengrin stated the applicants engineer has questioned one of the requirements from Mr.
Meyer. He stated the engineering staff still believe that a Land Survey Plat must be filed and recorded.
Staff findings are as follows and shown on staff report:
1. The applicant has filed a petition for a Vacation of a portion of Bellyache Ridge Road in
conformance with the requirements of Section 5-2200.
2. Proper Public Notification for the petition has been issued in conformance with Section 5-
2200.C.4.a and the petition is ready for consideration by the Eagle County Board of County
Commissioners.
3. The petition has demonstrated the vacation request to be in the general interest of the public's
health, safety, and welfare, not to be in violation oflaw, and to be in compliance with the Land Use
Regulations, and the Master Plan.
On March 21,2001 the Eagle County Planning Commission recommended approval to the
Eagle County Board of County Commissioners of this petition for vacation of the portion of Bellyache
Ridge Road through the Red Sky Ranch PUD with the following three conditions:
a. The effective date of the vacation of this road shall be the date on which the last of the three
following documents has been recorded with the Eagle County Clerk and Recorder: 1) Resolution of the
Eagle County Board of County Commissioners, 2) Quit Claim Deeds, and 3) Temporary Easement Deed
for the existing road during the interim period prior to acceptance of the new alignment.

Staff recommended conditional approval as recommended by the Planning Commission.
Rick Plyman, Peter Jamar and Associates, introduced Kent Kriehm with Alpine Engineering and
stated Bellyache Ridge Road comes off of the 1-70, Wolcott Interchange. There are a handful of minor
subdivisions located along this road. They went through a special use permit process for the Jouflas
Ranch golf course. He stated they wanted the driving range to be on the same side of the road as the golf
course. He stated they now have the final plat application before staff and it is time to vacate that
portion of road to be abandoned and the new portion of road will be dedicated at final plat. He pointed
out the existing road to be abandoned and the proposed new section. He stated there will not be any
interrupted access to anyone's property. He stated they will accept the requirement ofthe Land Survey
Plat.
Commissioner Gallagher asked if it is staff s recommendation that the items in the letter from
Kent Kriehm be added to the conditions.
Mr. Vengrin answered no.
Commissioner Gallagher asked about the plat.
Mr. Vengrin stated the applicant has submitted a subdivision plat. He stated a Land Survey Plat
is submitted to the Engineering Department showing they have performed a survey.
Commissioner Gallagher asked if the plat gives monuments and references.
Mr. Vengrin answered yes.
Kent Kriehm, Alpine Engineering, stated that is how he understood it. He stated he just wanted
to minimize the number of plats as he felt all of those things would be on the subdivision plat.
Commissioner Menconi stated this is a fairly steep road and asked about the shifting the road.
He questioned how staff goes through and accepts the grade of the road.
Mr. Vengrin stated the staff was given leeway in assessing the road. As long as they replace the
road to the same condition as before they will be allowed to do that.
Commissioner Menconi asked about the surface of the road.
Mr. Vengrin stated the surface ofthe road will be better, everything else will be the same.
Commissioner Menconi asked how many lots there will be.
Mr. Plyman explained there is a total of 87 dwelling units. 26 or 27 of those will be smaller
cluster type units.
Commissioner Gallagher moved to approve file number G-OOO 13, Vacation of a Portion of
Bellyache Ridge Road incorporating staff findings and with the following conditions:
1. The effective date of the vacation of this road shall be the date on which the last of the three

Resolution 2000-064, LUR-00035, Building Code Amendment
Dan Stanek, Building Official, presented Resolution 2001-064, file number LUR-00035,
Building Code Amendment. This amendment is to allow for modifications of the Eagle County

1. Amendments to the Uniform Building Code 1997:
a.) Inspection record card (inspectors sign offs not required).
b.) One hour ratings requirements for 400,000 btu boilers in single family homes
downgraded.
2. Amendments to the Uniform Plumbing Code 1997:
a.) Add gas shutoff valves outside of fireboxes in gas appliances.
3. Amendments to the Uniform Mechanical Code 1997:
a.) Fireplaces in bedrooms and bathrooms to be sealed units and must have outside
combustion air.
b.) Add gas shutoff valves outside of fireboxes in gas appliances.
4. Amendments to the National Electrical Code 1999
a.) Low voltage fire alarm systems to be permitted separately.
5. Amendments to NFPA 13D 1996
a.) Delete listed pumps and go to NFP A wording in the code.
b.) Add fire department connections to residences that are sprinkled.
c.) Fire sprinklers to be required in residential garages, if house is required to be
sprinkled.
6. Amendments to Eagle County Building Resolution:
a.) Add a right of way construction permit to driveways connecting to Eagle County

Comments were received from numerous agencies. Issues identified through the referral process
have been analyzed and taken into consideration. Relevant changes to the draft document have
occurred.
Staff findings are as follows and as shown on staff report:
Pursuant to Section 1.15, Chapterl of the Eagle County Land Use Regulations, the
following findings are acknowledged:
1. Recommendations from the appropriate referral agencies have been considered..
2. The Building Resolutions as drafted, is in general conformance with the policies and
regulations of the Eagle County Land Use Regulations.
Pursuant to the findings in section III, the staff recommends approval.
On April 4th, 2001 the Eagle County Planning Commission recommended approval with

minor modifications. These changes have been incorporated into the document.
a.) Fire sprinkler to delete "monitored" and add required sec.3-7, and delete within 6 feet of the
knock box sec.3-7.
On April 19th, 2001 the Roaring Fork Valley Regional Planning Commission, recommended

Commissioner Gallagher asked if they were currently using the 1997 codes.
Mr. Stanek answered yes.
Commissioner Gallagher asked about the Fire Code.
Mr. Stanek stated they are currently using 1997 and will change in 2003 with that year's code.
Commissioner Gallagher asked about the inspector record cards and signature is not required.
Mr. Stanek stated now that they are computer based the inspections are input onto the computer
and signatures are not required.
Commissioner Gallagher asked how does the contractor or property owner get the results.
Mr. Stanek stated they get the original at the time of inspection.
Commissioner Gallagher asked about deleting the list of pumps.
Mr. Stanek stated Eagle County had a resolution that listed the NFP A 13 does not have the word
listed. He stated he could not find anywhere where the pumps were not working listed or not.
Commissioner Gallagher stated the Planning Commission recommendation requested deleting
the word monitored. He stated monitored does not equal a lock box.
Mr. Stanek stated Mr. Brave suggested taking the word monitored out and explained to those
present. He stated he does understand it.
Commissioner Gallagher asked if the Design Review Board decided if it is monitored.
Mr. Stanek that was correct.
Discussion followed on taking monitored out.
Chairman Stone stated the sprinkled homes were required to be sprinkled. He stated the Board
felt that should be a condition of the PUD.
Commissioner Gallagher asked if in the past they were ignoring the code and having some homes
sprinkled and some not.
Mr. Stanek stated sprinkling is required through the Board of County Commissioners or through
the Design Review Boards.
Commissioner Menconi moved to approve Resolution 2001-064, file number LUR-00035,
Building Code Amendment, incorporating staff findings.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
PDP-00019, PDA-00032, Cordillera Southern Parcel, Phase II
Chairman Stone stated the applicant has requested this matter be tabled until May.
Commissioner Gallagher moved to table file numbers PDP-00019, Cordillera Souther Parcel,

until May 8, 2001, at the applicants request.

Winners, High School Art Contest
Kathryn Heider, Asst. County Administrator, stated the next item on the agenda is the
announcement of the winners of the High School Art Contest. She stated for the last few weeks lots of
people have been voting on individual pieces and group pieces.
Commissioner Gallagher stated for best individual piece, 2nd place goes to Cora Neubecker for a
painting of purple flowers, a $50.00 prize.

$100.00 prize.
Commissioner Gallagher stated for best body of work there was a tie and one prize goes to Cora
Newbecker for Katy's Creative Collection, a $100.00 prize. Katy Butters was the other winner of a
$100.00 prize for Imagineering.
Abatements
Max Schflaley, Chief Appraiser, presented a petition for abatement for Beth and Jack Watson,
schedule number R043298. The petitioner is requesting a change in classification to agriculture. The
Assessor recommended an abatement for 1999. The abated amount would be $201,190.00 with a tax
amount of$11,859.76 leaving a balance of $3,490.00 assessment with a tax amount of$205.72.
John Kelly, Oates, Knezevich and Gardenswartz, stated in 1999 they had a hearing on five of the
eight lots. He stated five lots were granted agricultural status. He stated they are just going back and
adjusting the three lots that were left out.
