Chairman Pro-tern Gallagher stated the next item before the Board was the Consent Agenda as

Chairman Pro-tern Gallagher asked the County Attorney if there were any deletions or additions
to the Consent Agenda.
Renee Black, Acting County Attorney, stated there were no changes to be made.
Chairman Pro-tern Gallagher asked about the use of magnesium chloride.
Brad Higgins, Road and Bridge Director, stated that the concerns are more with winter use. He
stated he has the studies available for review.
Ray Merry, Environmental Health Officer, concurred with Mr. Higgins and stated with the use of
magnesium chloride, the benefits are greater than the detriments. He stated he thinks it is appropriate to
use this as a dust suppressant and that not using anything at all makes matters worse.
Commissioner Menconi asked about the damage to vehicles.
Mr. Merry stated relative to the corrosiveness, it is not as bad as salt. He stated that combination
with sand is worse for the animals and water quality. He stated it does seem to have more adhering
properties. He stated the biggest concern is the trace compound that can be part of the other compounds.
Chairman Pro-tern Gallagher asked if they use the better quality magnesium chloride.
Mr. Merry answered yes.
Commissioner Menconi suggested they might do a press release to educate those who have
voiced concerns.
Chairman Pro-tern Gallagher spoke to the number of contracts for Health and Human Services
and suggested they might try to consolidate those when possible.

Plat & Resolution Signing
Matthew Gennett, Planner, presented the following Resolution to the Board for their approval:
AFP-00117, Bachelor Gulch Village Filing No.3, A reconfiguration of Tracts L, P-l
and P-3 "The Firelight Lodge". The intent of this Amended Final Plat is to reconfigure the lot line
between Tract L, Tract P-l and Tract P-3 in Bachelor Gulch Village. Staff findings are as shown on
staff report and as follows:
Pursuant to Section 5-290 (G) (1) ofthe Eagle County Land Use Regulations:
5-290 (G) (1) Standards for Type A and Type B Subdivision
(G) Standards. The Board of County Commissioners and the Community Development Director
shall consider the following in the review of a Type A Subdivision, a Type B Subdivision, and an
Amended Final Plat.
Standards for Type A and Type B Subdivision.
a) Access, potable water, and sewage disposal on the land to be subdivided are adequate;
b. The plat does conform to Final Plat requirements and other applicable regulations,
policies, standards, and guidelines; and
c. No Improvement Agreement is applicable.
Chairman Pro-tern Gallagher asked the purpose of this reconfiguration.
Mr. Gennett responded it will increase the size of Tract L.
Commissioner Menconi moved to approve AFP-00117, Bachelor Gulch Village Filing No.3, A
reconfiguration of Tracts L, P-l and P-3 "The Firelight Lodge". The intent of this Amended Final Plat is
to reconfigure the lot line between Tract L, Tract P-1 and Tract P-3 in Bachelor Gulch Village.

Resolution 2001- 046, A Resolution To Allprove A Special Use Permit For Western Mobile
Northern. Inc.. A Subsidiary Of Lafarge Corporation (Eagle County File No. ZS-00070). The
Board considered the Special Use Permit request on March 20th, 2001.
Chairman Pro-tern Gallagher asked if this is the pit by the Fairgrounds.
Mr. Gennett responded it is.
Commissioner Menconi moved to approve Resolution 2001-046 for a Special Use Permit for
Western Mobile Northern, Inc., A Subsidiary of Lafarge Corporation, file number ZS-00070.

Child Care Programs
Kathleen Forinash, Health & Human Services Director, stated there are a couple of child care
programs she would like to discuss. She referred to the RFP they discussed last week. On the back of
the application are all the State and Federal requirements. It is Staffs recommendation they proceed
with the proposal to the community with a return date of May 1, 2001.
Chairman Pro-tern Gallagher asked about a cap.
Ms. Forinash spoke to a phone call received this morning from the Town of Vail and what is
being proposed for the space above City Market is the establishment of a 501 C3 non-profit board that
could be used to understand and advise on growth for child care facilities.
Chairman Pro-tern Gallagher asked if that could reduce the work for Health and Human Services.
Ms. Forinash stated in fact it could. She stated they will have to review what will be the scope of
the program, finding operators for the facilities, subsidizing, creation of the 501 C3 itself. It might be a
funding mechanism as well as operating. She stated they are moving forward on this and would like to
know the Board's opinion on them participating.
Commissioner Menconi referred to the Youth Coalition and that it won't cost anything other than
the time involved and then initiating the effort.
Ms. Forinash spoke to the financial exposure.
Commissioner Menconi questioned other than the start up costs, what would it be. He referred
again to the Youth Coalition.
Ms. Forinash stated they would have to oversee the issues and the budgets involved. She spoke
to assurances from the 501C3 that they have the funds available.
Commissioner Menconi asked how this can help the existing child care task force.
Ms. Forinash stated if different governmental entities make a community statement, it is a
psychological plus. It does open the way for different types of fund development, partnership
agreements, and puts them in a position to do an ongoing assessment of the needs. It moves it out of just
being a County concern to a broader community concern.
Chairman Pro-tern Gallagher asked ifthere is an anticipation of County leadership.
Ms. Forinash suggested this is a new concept, but she anticipates it being a joint leadership
venture.
The Board concurred to direct Ms. Forinash to proceed.
Abatement
Renee Black introduced Max Schlafley, Assessor's Office, who presented an abatement request
for Moses Lerner, Schedule Number 039921, for the year's 1998 and 1999. Mr. Schlafley stated Mr.
Lerner who owns the property has requested an abatement for 1998 and 1999. However, for 1999 he
filed an appeal previously. This request is only for 1998 and the Board of Assessment Appeals decision
was issued in error. He read from the Board of Assessment Appeals decision. He stated the Assessor's
Office is recommending denial based on the recorded document which was the plat of record.
Chairman Pro-tern Gallagher asked where in the supporting information is the error noted.
Ms. Black stated she believes that is the determination ofthe Assessor's office. Mr. Lerner has
submitted the report from the BAA for 1999. She stated Mr. Lerner presented evidence that he had
made measurements. She stated the BAA made their ruling by taking Mr. Lerner's numbers. However,
the Assessor's office must use the documents of record, i.e. the plat, and that Mr. Lerner would need to
have corrections made to the plat of record.
Mr. Lerner stated he met with the Attorney for the Ramshorn Condominium Association and that
the declarations list each unit. He stated the areas may have all been measured incorrectly, but the
declarations are a common distribution. He suggested he doesn't believe that all owners want to have
their condominiums re-measured. He spoke to a computer program which will measure each unit. He

stated this would establish an accurate proportional ownership. This, however, has nothing to do with
the actual measurement of the unit. The BAA has accepted his architectural measurements and he
believes the Assessor should do that as well. He stated they have used a measurement that is in error by
about 6%. He is requesting a refund for 1998 and for every year that he has paid taxes incorrectly.
Chairman Pro-tern Gallagher asked Ms. Black for direction in regard to the conclusion specified
by the BAA.
Ms. Black stated at that time there was no guideline that says that the Assessor will go by what is
recorded and stated on the plat.
Mr. Schlafley stated when they questioned the appraiser at the Department of Property Taxation
and learned that they did not take the statute changes in 38-33-105.5. He pointed out the contents of
declaration and the inclusion of the description of each unit and that is what the plat is supposed to state.
Ms. Black stated that is a legal requirement to form a condominium and that becomes the record.
Ifthat were not the case, they would then have to measure each condominium in Eagle County. They
base their findings on what is of record.
Chairman Pro-tern Gallagher clarified. He asked what an owner would do if there was a
remodel.
Ms. Black stated they would seek to have the plat and the declarations updated. She stated a
declaration declares what is common area and the plat map is just that, it depicts the square footage.
Those are on record with the County Clerk & Recorder.
Chairman Pro-tern Gallagher asked Ms. Black to respond to Mr. Lerner's claim that the
declarations were defined just to determine the costs.
Ms. Black stated she does not believe that was the intent when they started the project. That is
the tool used by all Assessors.
Mr. Schlafley stated he does have a copy of the condominium plat and the measurements of
record. He stated they did not include the hallways on that.
Chairman Pro-tern Gallagher asked for Mr. Lerner's comments.
Mr. Lerner stated he understands the need to get the area for establishing the tax base. He stated
for many years they used the area in the declaration. He stated about a year and a half ago they agreed,
he and the Assessor, on the market value. That is when they learned they were using the incorrect area.
He asked if the Assessor would meet with him to measure the unit. He refused. He could then go to a
surveyor or to his architect. He stated they measured the condominium from the outside wall to the
middle of common walls. That is where they got the 2120. He referred to the plat that is recorded from
the Clerk's office. He asked the architect to measure from the inside walls and came up with 2070
which is less. He stated he doesn't know how the plat was measured. He stated he plans on suggesting
to the other homeowner's that they measure it all. He stated this hearing is about taxes and he feels it
was measured incorrectly for many years.
Chairman Pro-tern Gallagher asked how they measure.
Mr. Schlafley stated from the outside walls.
Chairman Pro-tern Gallagher asked about the difference between the plat and the declaration
figures. He read from the BAA findings. He stated he is assuming they convinced the BAA there was a
difference.
Mr. Schlafley stated they noted that each calculation gave slightly different figures.
Mr. Lerner spoke to a letter from the developer that he presented to the Board indicating he sold
2100 square feet and that is a second confirmation.
Commissioner Menconi asked if Mr. Lerner had met with the Association members to redraft the
declarations.
Mr. Lerner stated he was able to meet with the Attorney for the association and that the areas in
the declaration may not be exact as they are to establish what each owner must pay in common area
expenses.

Commissioner Menconi asked what kind of discussions they had in order to change the
declarations.
Mr. Lerner stated there are two ways to do it, one is to hire a surveyor and measure each unit. He
is not sure that the owner's are willing to do that. He is going to recommend that they submit the plat
map to his architect and run it through the software to come up with consistent measurements. He stated
they may tell him they are not going to change the plats.
Commissioner Menconi asked if there is a condominium out there that has a different
measurement than what is of record. Is there a different way to remedy the problem by measuring and
revising the plat.
Jody Caruthers, Eagle County Assessor, stated they can revise the plat but they value according
to market. If the market changes, that may change the appraisal.
Commissioner Menconi asked how you determine market value.
Ms. Caruthers explained by using the sales in the last 18 months.
Commissioner Menconi asked Ms. Caruthers why she feels the request should be denied.
Ms. Caruthers stated it is based on market and if a specific sized unit sells for market price, if
they used the square footage to value, it could be effected slightly. They have used the market price and
valued accordingly.
Commissioner Menconi asked if Mr. Lerner were to re-measure it may not change the tax rate.
Mr. Schlafley stated it could increase the tax rate for other units.
Ms. Caruthers stated they would change future calculations, but they would not go back
retroactively.
Mr. Schlafley stated all the condominiums are treated the same.
Commissioner Menconi questioned if Mr. Lerner goes out, changes the square footage, will that
change his tax rate.
Mr. Schlafley stated the BAA ruled on a square foot basis. He stated they had sales that they
used. It mayor may not change the value.
Commissioner Menconi suggested that Mr. Lerner would like to change the plat in the future and
then come back and ask for remedy for past years.
Mr. Schlafley stated Mr. Lerner can only go back to 1998.
Ms. Black explained the two year limitation on going back for taxes.
Mr. Lerner stated he thinks there is a misunderstanding of the comments. He stated they are in
agreement with the 1999 market value. He went through six comparable's and they used the same
values. They are not in disagreement with the square foot value. He is contesting that for all these years
the Assessor's office has used the wrong square footage. The Board of Assessment Appeals has
concluded the measurements were correct. It is still the same area. For all these years the only thing that
has to change is the 2244 and that they will be using that again. In 1999 they had a second ruling on
value but they are not accepting the 2010.
Mr. Schlafley stated they could have challenged the BAA ruling but determined it was not worth
their time to challenge.
Ms. Caruthers stated the State of Colorado has always instructed them to use the square footage
on the plat for valuing condominiums. She stated the BAA got a different ruling and they believe the
BAA ruling was in error.
Chairman Pro-tern Gallagher asked if the DPT is educating the BAA on this matter.
Mr. Schlafley stated they advise. He recalls the DPT having given bad advise.
Chairman Pro-tern Gallagher asked for the status of the BAA decision and if it is binding.
Ms. Black stated it is for the particular year. She stated if Mr. Lerner doesn't agree with the
determination made here, he can appeal it to the BAA.
Chairman Pro-tern Gallagher asked about case law or precedent setting.
Ms. Black stated only for that year.

Mr. Lerner stated they are not talking about market value, but the measurements. That has to be
binding before and until he makes some modifications.
Chairman Pro-tern Gallagher stated the Assessor's office has followed and continue to follow the
directions from the State. They have shown Mr. Lerner how to correct this by correcting the plat. That
has not happened. He stated he is inclined to follow the practice of the Assessor's office. The petitioner
has a right to appeal it to the Board of Assessment Appeals.
Commissioner Menconi stated at the last meeting they gave Mr. Lerner the time and the
encouragement to change the plat and record it accordingly.
Mr. Lerner stated they are asking him to get thirteen other owners to do something that they may
not be willing to do. He can prove that the area is correct and that was agreed by the BAA for 1999. If
the Assessor wants to rely on the documents that are incorrect, they must make their record correct. He
stated he has a ruling from a higher power and he doesn't understand how they can disregard that ruling.
Chairman Pro-tern Gallagher stated the BAA has only the right to make determination on a single
case. He asked if there is anything other than the plat or declaration that they would accept for a change
in square footage.
Ms. Caruthers stated there is not.
Mr. Lerner asked ifthey will accept a computerized plat from his architect that is sealed.
Commissioner Menconi moved to deny the abatement for Moses Lerner, Schedule Number
039921, for the year 1998.

easements on previously un-platted Land in Arrowhead at Vail, Filing 27, also known as Development
Area "P" of the Arrowhead at Vail PUD. It is located east of Edwards, South of Highway 6, Filing 13
(Cresta). The intent of this plat is to: create 15 single family lots; cluster home, open space, road, and
recreation tracts; and easements. This development will be Filing 27, and/or Development Area 'P' of
the Arrowhead at Vail PUD guide.
Staff findings are as shown on staff report and as follows:
Pursuant to Section 5-280.B.5.b (3), ofthe Eagle County Land Use Regulations:
a. This final plat DOES conform to the of the approval ofthe Preliminary Plat for subdivision.
b. Required improvements ARE adequate.
c. Areas dedicated for public use and easements ARE acceptable and;
Pursuant to Sections 5-280.B.5 and 5-280.B.3.e. of the Eagle County Land Use Regulations:
(1) Consistent with the Master plan. The proposed subdivision IS consistent with the Eagle

Spatial Pattern Shall Be Efficient. The proposed subdivision IS located and designed to avoid
creating spatial patterns that cause inefficiencies in the delivery of public services, require duplication or
premature extension of public facilities, or result in a "leapfrog" pattern of development.
Utility and Road Extensions. Proposed utility extensions ARE consistent with the utility's
service plan or shall be required prior County approval of an amendment to the service plan. Proposed
road extensions ARE consistent with the Eagle County Road Capital Improvements Plan.
Serve Ultimate Population. Utility lines ARE sized to serve the planned ultimate population of
the service area to avoid future land disruption which would occur if under-sized lines had to be
upgraded.
Coordinate Utility Extensions. Utility extensions shall only be allowed when the entire range of
necessary facilities can be provided, rather than incrementally extending a single service into an
otherwise un-served area. This area IS served by the Arrowhead Metropolitan District, as well as other
utilities.
Suitability for Development. The property proposed to be subdivided IS suitable for
development, considering its topography, environmental resources and natural, or human-made hazards
that may affect the potential development of the property, as well as existing and probable future public
improvements to the area.
Compatible with Surrounding Uses. The proposed subdivision IS compatible with the character

of existing land uses in the area and DOES NOT adversely affect the future development of the
surrounding area.
Staff recommends approval.
Chairman Pro-tern Gallagher asked what a cluster home is.
Gerri Arnold, with Vail Resorts, stated a cluster home is a larger area in which they can design
with more flexibility.
Chairman Pro-tern Gallagher asked if they are talking about a multi-unit dwelling. He asked how
many there are.
Ms. Arnold responded they have 15 single family homes and 20 cluster homes. There is a limit
of twenty cluster homes in this project.
Chairman Pro-tern Gallagher asked if they are talking four groups of five or what.
Jamie Papis, Vail Resorts, stated they have two separated groups, five homes on one sight and
fifteen in the other.
Ms. Arnold stated it is a two phase development.
Chairman Pro-tern Gallagher asked for public input. There was none.
Commissioner Menconi moved the Board approve File No. PDF-00057, Arrowhead at Vail,
Filing No. 27. incorporating the findings and authorize the Chairman to sign both the Plat and the
associated SIA Agreement.

PDF -00066 Ute Creek Storage PUD
Peter Boyer, Planner, presented file PDF-00066 Ute Creek Storage PUD a resubdivision of lots,
open space tracts, and easements in the Ute Creek Planned Unit Development. This is located in Tract
47, Sections 11 and 12, Township 4 South, Range 83 West of the Sixth Principle Meridian
(approximately one mile east of the Eagle County Landfill).
The intent of this plat is to resubdivide the lots, easements, and open space tracts of the Ute
Creek PUD.
The chronology ofthis property is as shown on staff report and as follows:
April 2, 1996: The BoCC approved the Final Plat for the Ute Creek PUD (PD-314-95-F).
May 30, 1995: The BoCC approved the Preliminary Plan, the Zone District Amendment, and the
Development Control Guide for the Ute Creek PUD (PD-314-94-P and ZC-264-94).
May 18, 1995: The Planning Commission approved the Preliminary Plan, the Zone District
Amendment, and the Development Control Guide for the Ute Creek PUD (PD-314-94-P and ZC-264-
94).
November 9,1993: The BoCC approved the Sketch Plan for the Ute Creek PUD (PD-314-93-S).
November 3, 1993: The Planning Commission approved the Sketch Plan for the Ute Creek PUD
(PD-314-93-S).

technically an additional lot was created.

(2) Consistent with Land Use Regulations. The proposed subdivision DOES comply with all
applicable standards and provisions of the Land Use Regulations, including but not limited to, the
applicable standards of Article 3, Zone Districts, and Article 4 Site Development Standards.
a. Spatial Pattern Shall Be Efficient. The proposed subdivision IS located and designed
to avoid creating spatial patterns that cause inefficiencies in the delivery of public services, require
duplication or premature extension of public facilities, or result in a "leapfrog" pattern of development.
i. Utility and Road Extensions. Proposed utility extensions ARE consistent with
the utility's service plan or shall be required prior to County approval of an amendment to the service
plan.
ii. Serve Ultimate Population. Utility lines ARE sized to serve the planned
ultimate population of the service area to avoid future land disruption which would occur if under-sized
lines had to be upgraded.
iii. Coordinate Utility Extensions. Utility extensions shall only be allowed when
the entire range of necessary facilities can be provided, rather than incrementally extending a single
service into an otherwise un-served area.
iv. Suitability for Development. The property proposed to be subdivided IS
suitable for development, considering its topography, environmental resources and natural, or human-
made hazards that may effect the potential development of the property, as well as existing and probable
future public improvements to the area.
v. Compatible with Surrounding Uses. The proposed subdivision IS compatible
with the character of existing land uses in the area and DOES NOT adversely effect the future
development of the surrounding area.
Terrill Knight, Knight Planning, representing the applicant, stated circumstances change over
time. The intent was not to create additional lots. They had hoped to keep the same number of lots. The
interpretation today was because of the road. The uses do not change, the area doesn't change nor does
the open space. It is an improvement to the property with no increase in the uses.
Chairman Pro-tern Gallagher stated it looks to him like there is more than storage. There is work
going on there. He asked if it is okay to be building log houses there.
Mr. Knight stated those are all permitted uses. The County was very supportive in finding a sight
outside of the 1-70 corridor for uses to occur where they won't be seen. Those uses are permitted and
there is a fairly wide range of uses. None of those things will change with this modification. He spoke
to the log building on stilts.
Commissioner Menconi asked to clarify the length of time that has passed. He understands the
preliminary plan was done five years ago.
Mr. Narracci stated it was preliminary planned and final platted. The only way to achieve the
goal was the final plat.
Commissioner Menconi asked if the PUD allows for people to live there.
Mr. N arracci stated they are not.
Commissioner Menconi stated he believes people are living in the trailers there.
Mr. Knight stated they will check into that. They are not allowed and Mr. Jouflas has not
allowed it. They will follow through on this.
Commissioner Menconi stated it appears that they have brought in housing for employees
working on the homes.
Mr. Knight stated they will look into that. He stated they have changed the naming to create a

unique name to keep the files separate.
Commissioner Menconi stated he is not certain that anyone is living there, but it gives the
appearance.
Chris Jouflas, applicant, stated he doesn't want anyone living there. He stated he believes there
are offices there to get out of the weather. He stated they have expressed a desire to live there, but he
has said no.
Chairman Pro-tern Gallagher spoke to the gas tanks there and the concern of fire. He spoke to
the catch basins.
Mr. Knight stated that is a requirement of everyone up there. He stated if there are violations, he
is unaware of that, but they will look at it.
Chairman Pro-tern Gallagher asked whose fire district it is.
Mr. Knight stated they are right in between. He stated they will immediately get together with
staff to make sure there are not any problems.
Chairman Pro-tern Gallagher asked for public comment. There was none.
Commissioner Menconi moved the Board approve File No. PDF -00066, Ute Creek Storage
PUD, incorporating the findings and authorize the Chairman to sign the Plat.
Chairman Pro-tern Gallagher seconded the motion. Of the two voting Commissioners the vote
was declared unanimous.
There being no further business to be brought before the Board the meeting was adjourned until
April 3, 2001.
