Plat & Resolution Signing
Matt Gennett, Planner, presented the following plats and resolutions for the Board's
consideration:
AFP-OOI07. Cordillera Subdivision. Filin~ No.1 & No.2. ARe-subdivision of Lot 33

and Lot 34. He stated this was an Amended Final Plat, the purpose of which is to vacate the common
lot line between Lots 33 and 34 in order to create one single family lot, Lot 34, as shown on the plat.
Staff findings are as follows:
Pursuant to Section 5-290 (G) (1) of the Eagle County Land Use Regulations:
5-290 (G) (1) Standards for Type A and Type B Subdivision
(G) Standards. The Board of County Commissioners and the Community Development Director
shall consider the following in the review of a Type A Subdivision, a Type B Subdivision, and an
Amended Final Plat.
Standards for Type A and Type B Subdivision.
a) Access, potable water, and sewage disposal on the land to be subdivided are adequate;
b. The plat does conform to Final Plat requirements and other applicable regulations,
policies, standards, and guidelines; and
c. No Improvement Agreement is applicable.
Commissioner Gallagher asked if these are two separate lots in two different filings?
Mr. Gennett explained the filings 1 and 2 converge where this lot is located.
Commissioner Gallagher asked how they should be described.
Bob Loeffler, Deputy County Attorney, explained it will now be reflected on the plat and the title
companies will pick it up accordingly.

Subdivision, Filing No.1 & No.2, a resubdivision of Lot 33 and Lot 34, incorporating staff findings.

Resolution 2001-001. Approvin~ An Amendment To The Two Rivers Planned Unit
Development (Eagle County File No. PDA-00028). The Board considered this application on
September 18th, 2000.

the Two Rivers PUD, file number PDA-00028.

Resolution 2001-002. To Approve A Zone District Amendment For Abrams
Subdivision (Eagle County File No. ZC-00041). The Board considered this application on November
20th, 2000.

lena Skinner, Planner, presented file number PDS-00024, Kodiak Park. She stated at the
Roaring Fork Valley Regional Planning Commission November 2nd, 2000 hearing, the applicant decided
to alter the plan to reflect concerns from the Planning Commissioners before proceeding to the Board of
County Commissioners. This Staff report is based on the December 7th hearing date. The applicant
wishes to obtain approval for a mixed use PUD (Sketch Plan) including the following land uses:
Mixed use lots comprised of a variety of potential uses including:
29 live/work artist lofts;
Artist and craftsperson studios (shops);
Wholesale trade, office, retail;
6 residential lots; restaurant;
Clean manufacturing;
Daycare center;
A community barn/center;
Forty-five unit lodge comprised of a mix of cabins and a traditional lodge;
5 deed restricted affordable housing units;
Retail and wholesale nurseries;
Water ski lake and ancillary marina uses;
Restricted open space;

The chronology is found on staff report and is as follows:
1992 - The Board of County Commissioners approved a Special Use Permit for a private water
ski lake.
1994 - The Board of County Commissioners approved a Special Use Permit for a landscape
nursery .
1994 - The Board of County Commissioners approved an Amendment to the Zone District Map
to re-zone the application parcel to PUD, as well as approved a PUD Preliminary Plan which included a
ski lake, existing single-family and ranch uses, 18,000 square feet of service commercial uses and open
space.
1997 -The Board of County Commissioners approved a one year extension to the PUD
Preliminary Plan approval. The Preliminary Plan has now expired.
1999 - The property still retains the PUD zoning, however, uses designated in the lapsed PUD
Preliminary Plan are no longer valid.
1999 - The Board of County Commissioners approved a PUD Sketch Plan for Kodiak Park for a
mixed use PUD including a variety of uses ranging from artist studios, to a 50-60 room lodge
hotel, to a ranch and open space.
2000 - Staff has determined that proposed changes to the current Sketch Plan were too significant
for their present approval. The applicants were advised to re-apply with a new Sketch Plan application.
The Planning Commission had many issues with this file at the November 2nd hearing. The
applicant decided to address those issues, and changed their plan accordingly. Seeing these changes, the
Planning Commission was much more positive towards the Kodiak Park PUD Sketch plan.
The main topics of discussion included: the necessity for Kodiak Park to work with RFT A
concerning public transit stops; that buildings Wand X are fine where they are now located (neighbors
wanted them moved); that the applicant is taking a chance with applying for Sketch with no access as the
time it takes getting approval may exceed the actual approval of this Sketch Plan; that lack of access for
Sketch Plan is fine but must be in place before approval can be given for Preliminary; mosquitos must be
controlled and shall be part of the Preliminary plan; and that the hours of operation must also be
addressed at Preliminary Plan.
The first motion made by the Planning Commission included all of the Staff findings and
conditions as stated in this Staff report, except that they believed that condition numbers 2 and 6 had
been adequately addressed as part of this Sketch Plan and should, therefore, be eliminated, and that a
condition 12 should be added which stated that "the single family homes as proposed shall be eliminated
in this plan." This motion was not seconded.
The second motion included all of the Staff findings and conditions as stated in this Staff report,
excepting numbers *2 and *6, and eliminated condition 12, thus, allowing the single family homes to be
approved. This motion was seconded, and carried through.
*Conditions 2 and 6:
(2) Street / road standards must be re-evaluated and designed as per a memo from the Eagle
County Engineering Department dated October 21, 2000, to be submitted as part of the Preliminary Plan.
(6) Eagle County Housing comments, as per memo dated October 11, 2000, must be addressed as
part of the Preliminary Plan submittal.

Additional landscaping and buffering should be considered for the lodge and related parking
areas that are located in more visible portions of the site. Maybe reconfigure the demo gardens to act as
buffering.
The PUD should be designed to eliminate the potential for the PUD developing as a highway
oriented commercial center.
Permanent conservation easements should be considered for natural open space areas (restricted
open space, of which they plan calls for already).
Planning for future transit usage should be considered as part of the development review process.
Commuter stop locations should be considered.
RFT A policies regarding transit rider crossing four lane highways (Kodiak to Willits) need to be
considered. Also to be considered: RFT A input on routing and service in the EI lebel areas.
Pedestrian connections and circulation of riders between Kodiak and Willits may need special
intersection improvements, signalization, sidewalk extensions, etc. This should be addressed in the
access control plan, and should have County, Town, and RFTA input.
Note: Since this memo, the applicant has met with the Town of Basalt to discuss the public
transportation aspect of the Kodiak Park plan.
Staff findings are as follows:

Pursuant to Eagle County Land Use Regulations Section 5-240.F.3.e Standards for the
review of a Sketch Plan for PUD:
STANDARD: Unified ownership or control. [Section 5-240.F.3.e (1)] - The title to all land
that is part of a PUD shall be owned or controlled by one (1) person. A person shall be considered to
control all lands in the P UD either through ownership or by written consent of all owners of the land
that they will be subject to the conditions and standards of the PUD.
The Applicant has demonstrated that the entire site is owned in fee simple.
[+] FINDING: Unified ownership or control. [Section 5-240.F.3.e (1)]
The title to all land that is part of this PUD IS owned or controlled by one (1) person.
STANDARD: Uses. [Section 5-240.F.3.e (2)] - The uses that may be developed in the PUD
shall be those uses that are designated as uses that are allowed, allowed as a special use or allowed as
a limited use in Table 3-300, "Residential, Agricultural and Resource Zone Districts Use Schedule", or
Table 3-320, "Commercial and Industrial Zone Districts Use Schedule", for the zone district designation

properly address and acknowledge all uses of the site including specific details pertaining to such things
as building height, future uses, setbacks, etc.
[+] FINDING: Uses. [Section 5-240.F.3.e (2)]
The uses that may be developed in the PUD ARE NOT uses that are designated as uses that are
allowed, allowed as a special use or allowed as a limited use in Table 3-300, "Residential, Agricultural
and Resource Zone Districts Use Schedule" for the zone district designation in effect for the property at
the time of the application for PUD. However, variations MAY be granted along with approval of the
Sketch and/or Preliminary Plan.
STANDARD: Dimensional Limitations. [Section 5-240.F.3.e (3)] - The dimensional
limitations that shall apply to the PUD shall be those specified in Table 3-340, "Schedule of
Dimensional Limitations", for the zone district designation in effect for the property at the time of the
applicationfor PUD. Variations of these dimensional limitations may only be authorized pursuant to
Section 5-240 F3.f, Variations Authorized provided variations shall leave adequate distance between
buildings for necessary access and fire protection, and ensure proper ventilation, light, air and

snowmelt between buildings.
The current zone district is PUD, however, there are no uses associated with it as the previously
approved guide has expired. Dimension limitations will be incorporated within the new PUD.
[+] FINDING: Dimensional Limitations. [Section 5-240.F.3.e (3)]

340, "Schedule of Dimensional Limitations", for the zone district designation in effect for the property at

STANDARD: Off-Street Parking and Loading. [Section 5-240.F.3.e (4)] - Off-street parking
and loading provided in the PUD shall comply with the standards of Article 4, Division 1, Off-Street
Parking and Loading Standards. A reduction in these standards may be authorized where the applicant
demonstrates that:
(a) Shared Parking. Because of shared parking arrangements among uses within the PUD that
do not require peak parking for those uses to occur at the same time, the parking needs of residents,
guests and employees of the project will be met; or
(b) Actual Needs. The actual needs of the project's residents, guests and employees will be less
than those set by Article 4, Division 1, Off-Street Parking and LoadinfJ Standards. The applicant may
commit to provide specialized transportation services for these persons (such as vans, subsidized bus
passes, or similar services) as a means of complying with this standard.
There are 531 identified parking spaces, which shall be designed to comply with Section 4-140 of
the Eagle County Land Use Regulations. Parking shall be a mix of on-street parking/lot parking.
Engineering, as per attached memo, has some concern to which kind of on-street parking should be used
for this type of development. It is Engineering Staff s opinion that the parking should be on-street
parallel parking or lot parking for safety concerns. The referral letter from the Town of Basalt also
suggests limiting the number of spaces.
[+] FINDING: as conditioned Off-Street Parking and Loading. [Section 5-240.F.3.e (4)]
It HAS been demonstrated that off-street parking and loading provided in the PUD complies with
the standards of Article 4, Division 1, Off-Street Parking and Loading Standards, without a necessity for
a reduction in the standards.
STANDARD: Landscaping. [Section 5-240.F.3.e (5)] - Landscaping provided in the PUD
shall comply with the standards of Article 4, Division 2, Landscaping and Illumination Standards.
Variations from these standards may be authorized where the applicant demonstrates that the proposed
landscaping provides sufficient buffering of uses from each other (both within the P UD and between the
PUD and surrounding uses) to minimize noise, glare and other adverse impacts, creates attractive
streetscapes and parking areas and is consistent with the character of the area.
Landscaping is a major component of this development. Staffs only concern pertains to the
potential ability of the proposed tree farm area (at the south end of the lake) to adequately screen both
the south end buildings, X and Y, and potential outside "storage" items (related landscaping equipment
and/or materials).
[+] FINDING: Landscaping. [Section 5-240.F.3.e (5)]
Landscaping provided in the PUD DOES comply with the standards of Article 4, Division 2,
Landscaping and Illumination Standards.
STANDARD: Signs. [Section 5-240.F.3.e (6)] - The sign standards applicable to the PUD
shall be as specified in Article 4, Division 3, Sign Regulations. unless, as provided in Section 4-340 D.,
Signs Allowed in a Planned Unit Development (PUD). the applicant submits a comprehensive sign plan
for the PUD that is determined to be suitable for the PUD and provides the minimum sign area
necessary to direct users to and within the PUD.
The Kodiak PUD guide refers to the Eagle County Land Use Regulations for standards.

However, applicant may want to specify size limitations for certain signs to be used, prior to the final
PUD guide approval by the Board of County Commissioners (at Preliminary Plan).
[+) FINDING: Signs. [Section 5-240.F.3.e(6)]
The sign standards applicable to the PUD ARE as specified in Article 4, Division 3, Sign
Regulations. The draft Kodiak Park PUD guide will use the Eagle County comprehensive sign plan, as
provided in Section 4-340 D., Signs Allowed in a Planned Unit Development (PUD), that IS suitable for
the PUD and provides the minimum sign area necessary to direct users to and within the PUD.
STANDARD: Adequate Facilities. [Section 5-240.F.3.e (7)] - The applicant shall demonstrate
that the development proposed in the Preliminary Plan for PUD will be provided adequate facilities for
potable water supply, sewage disposal, solid waste disposal, electrical supply, fire protection and roads
and will be conveniently located in relation to schools, police and fire protection, and emergency
medical services.
The Mid Valley Metropolitan District has stated that they will provide water and sewer to the
Kodiak Park development providing that the enter into certain agreements. These agreements shall be in
place prior to Preliminary Plan submittal.
[+) FINDING: as conditioned Adequate Facilities. [Section 5-240.F.3.e (7)]
The Applicant HAS clearly demonstrated that the development proposed in the Preliminary Plan
for PUD will be provided adequate facilities for sewage disposal, electrical supply, and roads; the
applicant HAS clearly demonstrated that the development proposed in the Preliminary Plan for PUD
will be provided adequate facilities for potable water, solid waste disposal and fire protection. In
addition, the Applicant HAS demonstrated that the proposed PUD will be conveniently located in
relation to schools, police and fire protection, and emergency medical services.
STANDARD: Improvements. [Section 5-240.F.3.e (8)] - The improvements standards
applicable to the development shall be as specified in Article 4, Division 6, Improvements Standards.
Provided, however, the development may deviate from the County's road standards, so the development
achieves greater efficiency of infrastructure design and installation through clustered or compact forms
of development or achieves greater sensitivity to environmental impacts, when the following minimum
design principles are followed:
(a) Safe, Efficient Access. The circulation system is designed to provide safe, convenient access
to all areas of the proposed development using the minimum practical roadway length. Access shall be
by a public right-oi-way, private vehicular or pedestrian way or a commonly owned easement. No
roadway alignment, either horizontal or vertical, shall be allowed that compromises one (1) or more of
the minimum design standards of the American Association of State Highway Officials (AASHTO) for
that functional classification of roadway.
(b) Internal Pathways. Internal pathways shall be provided to form a logical, safe and
convenient system for pedestrian access to dwelling units and common areas, with appropriate linkages
off-site.
(c) Emergency Vehicles. Roadways shall be designed to permit access by emergency vehicles to
all lots or units. An access easement shall be granted for emergency vehicles and utility vehicles, as
applicable, to use private roadways in the development for the purpose of providing emergency services
and for installation, maintenance and repair of utilities.
(d) Principal Access Points. Principal vehicular access points shall be designed to provide for
smooth traffic flow, minimizing hazards to vehicular, pedestrian or bicycle traffic. Where a PUD abuts
a major collector, arterial road or highway, direct access to such road or highway from individual lots,
units or buildings shall not be permitted. Minor roads within the PUD shall not be directly connected
with roads outside of the PUD, unless the County determines such connections are necessary to
maintain the County's road network
(e) Snow Storage. Adequate areas shall be provided to store snow removed from the internal

street network and from off-street parking areas.
At this time, the new, proposed entrance to the Kodiak Park development has not been finalized.
The applicant, Eagle County, Town of Basalt, other persons with development interests along Hwy 82
and CDOT are creating a Highway Access Control Plan which would study the Kodiak/Willits entrance
as a part of the plan. Currently, Eagle County, the permitting body, other local developments, CDOT,
and the Town of Basalt are all in support of the proposed entrance.
Sketch Plan applications are conceptual in nature. With the previous Sketch Plan applicationfor
Kodiak Park, approval by the Board of County Commissioner was obtained without having the precise
point of access defined and permitted. As such, Staff is of the opinion that at this stage of review, an
actual access permit is not necessary. In this instance, as indicated above, all interested parties are in
mutual agreement on the proposed access location. Prior to the Board of County Commissioner
approving the Preliminary Plan for this project, the applicant must first obtain an access permit which is
consistent with the point of access proposed at Sketch Plan, as written in the conditions.

Currently, there exists other mixed use developments in the near vicinity of the Kodiak Park
property. Staff feels that this proposal is compatible and in character with the majority of neighboring
uses. The only concern is that development be limited to the west end of the lake, away from Laura J.
Estates. Staff feels that this is demonstrated as shown on the Kodiak Park Master Plan.

should be a wide variety of housing to fulfill the needs of all its residents, including families, senior
citizens, and those who work here. Elements of Eagle County's vision for housing are:

The Master Plan encourages cluster development, where as this project has a low density
"cluster" (they are all concentrated in the same area) development.
New development shall have a 200' setback from Hwy 82; there currently exists development
within this setback. The proposed development is also proposed to be less than 200'. As some of the
existing buildings will be replaced by new buildings, this finding is in conformance.

STANDARD: Phasing [Section 5-240.F.3.e (11)] - The Preliminary Planfor PUD shall
include a phasing plan for the development. If development of the P UD is proposed to occur in phases,
then guarantees shall be provided for public improvements and amenities that are necessary and
desirable for residents of the project, or that are of benefit to the entire County. Such public
improvements shall be constructed with the first phase of the project, or, if this is not possible, then as
early in the project as is reasonable.
At this time, a phasing plan has not been presented as part of this application.

A phasing plan IS NOT necessary for this development at this time, however, should be a
component of the Preliminary Plan.
STANDARD: Common Recreation and Open Space. [Section 5-240.F.3.e (12)] - The PUD
shall comply with the following common recreation and open space standards.
(a) Minimum Area. It is recommended that a minimum of25% of the total PUD area shall be
devoted to open air recreation or other usable open space, public or quasi-public. In addition, the P UD
shall provide a minimum of ten (10) acres of common recreation and usable open space lands for every
one thousand (1,000) persons who are residents of the PUD. In order to calculate the number of
residents of the PUD, the number of proposed dwelling units shall be multiplied by two and sixty-three
hundredths (2.63), which is the average number of persons that occupy each dwelling unit in Eagle
County, as determined {n the Eagle County Master Plan.
(I) Areas that Do Not Count as Open Space. Parking and loading areas, street right-oi-ways,
and areas with slopes greater than thirty (30) percent shall not count toward usable open space.
(ii) Areas that Count as Open Space. Water bodies, lands within critical wildlife habitat
areas, riparian areas, and one hundred (100) year flood plains, as defined in these Land Use
Regulations, that are preserved as open space shall count towards this minimum standard, even when
they are not usable by or accessible to the residents of the PUD. All other open space lands shall be
conveniently accessible from all occupied structures within the PUD.
(b) Improvements Required. All common open space and recreational facilities shall be shown
on the Preliminary Planfor PUD and shall be constructed andfully improved according to the
development schedule establishedfor each development phase of the PUD.
(c) Continuing Use and Maintenance. All privately owned common open space shall continue
to conform to its intended use, as specified on the Preliminary Planfor PUD. To ensure that all the
common open space identified in the PUD will be used as common open space, restrictions and/or
covenants shall be placed in each deed to ensure their maintenance and to prohibit the division of any
common open space.
(d) Organization. If common open space is proposed to be maintained through an association
or nonprofit corporation, such organization shall manage all common open space and recreational and
cultural facilities that are not dedicated to the public, and shall provide for the maintenance,
administration and operation of such land and any other land within the PUD not publicly owned, and
secure adequate liability insurance on the land The association or nonprofit corporation shall be
established prior to the sale of any lots or units within the PUD. Membership in the association or

nonprofit corporation shall be mandatory for all landowners within the PUD.
Maintenance responsibilities have not been clearly identified within the Kodiak Park plan. Staff
recommends that any associations/people responsible for park maintenance be identified within the
Preliminary Plan application.

Chairman Stone asked that the applicant provide a before and after snap shop of the project to
help remind them of what has changed.
Glen Horn, Davis, Horn Incorporated, was joined by Glen Rappaport and Rob Cumming. He
stated the owners are Ace and Jennifer Lane and Rob Cumming. He stated Mr. Cumming brought some
new ideas to the project to incorporate comments by the Town of Basalt, The Planning Commission and
the Board of County Commissioners as well as the neighbors. He stated one of the issues was the
orientation of the lodge/hotel. He showed where the hotel was previously located as they had considered
the south facing side of the lake to be offlimits. He stated it was suggested by the Roaring Fork
Planning Commission to incorporate small cabins and move the site of the lodge to the south side of the
lake. That was the principal change. They believe in that location it would not be highway oriented.
Other changes came from a recommendation of the Planning Commission was placement of the open
space portion in a conservation easement. He stated only about 25 acres of this parcel will be developed
with 180 acres placed in a conservation easement. He stated it is generally consistent with the adopted
plans of the community. It was also suggested they have some sort of a community space which is the
community barn they have incorporated. He spoke to the discussions with the Laura J. Estates residents.
They have oriented the tree farm nursery operation at that end, but with the trees becoming a buffer
between the nursery and the neighbors. He spoke to the relocation of the buildings which are used to
house equipment for the nursery operation. He showed the demonstration gardens pedestrian area. He
stated they have taken out the short term accommodation site keeping the cabin in place for a picnic
area. They handed out a drawing of the picnic shelter. They have a trail about one mile long around the.
lake that will be open to the public. They are proposing a park and trail in the woods which will be
accessible to the Blue Ridge subdivision. He suggested that most of the site remains in green and would
be open space. Many of the areas will be deed restricted. He stated they tried to be responsive to what
they heard the first go around.
Chairman Stone spoke to working together with Blue Ridge about access and coordinating the
entrance with Blue Ridge.
Rob Cumming stated they are working with Blue Ridge to come up with a cost analysis. Blue
Ridge will take a pro-rata share of the costs. There will be a cost sharing agreement between the two
parties.
Chairman Stone spoke to the discussion with them and with Blue Ridge and the two parties
working together to make both the roads compatible.
Glen Rappaport stated the roads are the same size and same configuration. He stated they are
still working from the original agreement and essentially there is a square footage kick in.
Commissioner Phillips stated she doesn't really have any questions. She asked if there are any of
the eleven conditions that the applicant is questioning.
Mr. Rappaport stated the other issue regarding the site circulation was the language in the
approval documents on the access on the Aspen end. They have eliminated that access on this plan. The
up valley end does not have an access point.
Chairman Stone asked if there is any public input.
Barbara Briverti, property owner of Laura J. Estates, suggested some of the concerns she might
have may be more appropriate at preliminary plan. She stated the access for the southeast end is of

concern. She stated she was told by Phil Scott this was not a legal access. Rudy Zetti stated it would be
for emergency use only. She asked that emergency be defined as they have that access being used for
delivery of trees. There is concern with mosquitos. She spoke to a third party who has helped with the
mosquito problem on Willits Lane.
Chairman Stone stated mosquito control shall be included as part of the pIan.
Ms. Brivetti questioned the boat noise.
Chairman Stone stated the PUD guide must address boat usage and types of boat.
Brivetti questioned the hours of operation for boats and for the nursery.
Commissioner Phillips asked if the nursery is part of the plan.
Chairman Stone stated it reads that hours of operation will be specified at preliminary plan.
Ms. Brivetti stated they have really listened to the neighbors. There are things about the plan
they would rather not see, but hope they will take into consideration the berming. She stated the access
is still a concern and they would like to know how it will be used. She stated this is from Highway 82
and the road that goes into Kodiak Park. She stated the access was waived at some point in time and that
it is in fact for emergency use only. She stated the big semis have knocked down signs with deliveries
being made through that access.
Terry Brucker, Laura J. Estates property owner, suggested that the two big buildings are not
compatible with the development and that all storage is to be indoors. She does not see that in the
conditions. She asked if this plan, if approved, will eliminate the previous plan.
Chairman Stone stated it will supercede the previous plan.
Glen Horn stated the issues brought up by the neighbors including the storage, the mosquitos, etc
are all issues they anticipate addressing in the PUD guide. He stated they can also address the conditions
and provisions for emergency access. They don't envision a big truck warranting use of that access.
Commissioner Phillips asked again about the conditions.
Glen Rappaport spoke to the access points beforehand and the realignment of the access road.
He stated the only issue he sees is #2 and the street and road standards. He stated their intent was to look
at this as a town street. He showed the frontage road entrance. They had their traffic consultant review
this and they do have some difference with what is being suggested by the Planning Commission. Now
they are proposing angled parking not parallel parking.
Commissioner Phillip asked about delivery trucks being lined up.
Mr. Rappaport stated their new diagram has not yet been engineered but they are showing an
appropriate stacking distance without parking interfering on both sides. They may lose some spaces in
the zone and the configuration may change but there is a required dimension of about 180 feet from
Highway 82.
Commissioner Gallagher asked how they manufacture clean.
Mr. Cumming responded a kayak builder, fly tying operation, etc.
Commissioner Gallagher asked about the structure on the north side of the lake.
Mr. Rappaport stated they have a trail that goes around the lake and around the wetland area. He
stated the diving board will be removed.
Commissioner Gallagher stated he is happy to hear of the access. He asked what the design of
the trail would be around the lake and could if facilitate emergency vehicles.
Mr. Rappaport stated their desire is to meet County trail requirements and would think that it
could handle emergency vehicles. He spoke to the road coming in and noted it as the Ranch Road.
Commissioner Gallagher asked how many artists they plan on having.
Mr. Rappaport suggested this would be a live, work, sell kind of process. This might be an e-
business as well. He stated they are looking at bringing a major portion of the infrastructure through the
area which will accommodate emergency vehicles.
Chairman Stone stated it looks like the Planning Commission motion was eliminating what were
conditions 2 and 6. He asked if their condition 6 exists.

Ms. Skinner stated there were two motions and they eliminated condition 2.
Chairman Stone asked if what did pass accepted conditions 2 and 6. The Planning Commission
did not believe that condition 6 was needed.
Ms. Skinner stated it was tabled by the Planning Commission and when they came back they
added the five deed restricted employee housing units and they were then satisfied.
Chairman Stone asked if the applicant believes that condition 2 is not needed.
Mr. Rappaport stated they do not agree in designing it with the memorandum from the Engineer.
Chairman Stone read from the document, "street and road standards must be evaluated and
designed as per memorandum from the Eagle County Engineering Department, dated October 21, 2000,
to be submitted as part of the preliminary plan."
Mr. Cumming stated the Planning Commission liked the on street parking rather than the
memorandum from the County Engineer.
Mr. Horn stated the issue comes down to the on street parking on SpikeLane/Blue Ridge Lane.
They would like to have the capability to have on street parking much like Midland Avenue in the Town
of Basalt.
Mr. Rappaport stated they would like the design speed be consistent with the road that goes
through Blue Ridge. They would like to design the parking around those parameters.
Commissioner Phillips suggested the memo shows opposition to the head in parking rather than
the parallel parking. The Planning Commission agrees that head in parking would be okay.
Jim Fritze, County Attorney, stated he thinks that the actual configuration of the road designs
will be dealt with at preliminary plan. Variances might be required at that time.
Chairman Stone suggested that #2 doesn't need to be in there at all as part of the Land Use
Regulations it will have to be included and addressed at preliminary plan stage.
Jim Fritze concurred.
Mr. Rappaport stated it would be important for them to get a signal that it would be considered as
it is something different than what is technically correct in the standards.
Chairman Stone explained the Board can review the variance requests and does so based upon a
number of conditions in the Land Use Regulations where it makes more sense to do the variance than to
make the applicant adhere to the letter ofthe law. He spoke to the provision of hardship. He stated they
would be willing to consider it.
Commissioner Phillips stated to look at a rural feel of the community can be eliminated as a
result of adhering to the standard.
Commissioner Gallagher stated he would look for some one to address to the safety concerns as
set forth in the Engineers memorandum.
Commissioner Phillips spoke to the elimination of #2. It would still require a look at the Land
Use Regulations.
Commissioner Phillips moved the Board of County Commissioners approve File No. PDS-
00024, incorporating all Staff findings, and the following conditions:
1. Except as otherwise modified by these conditions, all material representations of the Applicant
in this application and all public meetings shall be adhered to and considered conditions of approval.
Commissioner Phillips questioned if #2 should be included or not.
Chairman Stone stated he confirmed with the County Attorney wasn't required until preliminary
plan stage.
2. All garbage receptacles shall be bear proof, as deemed necessary by the Division of Wildlife
memo dated October 11,2000. This requirement shall be incorporated as a component of the final
Kodiak Park PUD guide.
3. Any agreement with the Mid Valley Metropolitan District, as per a memo dated September
2,1999 must been finalized prior to Preliminary Plan submittal.

4. A permit for the proposed point of access must be obtained prior to Preliminary Plan approval
by the Eagle County Board of County Commissioners.
5. Applicant must participate with both Eagle County and the Roaring Fork Transit Authority
when decisions are made concerning public transit in their area.
Commissioner Phillips asked what that means.
Chairman Stone suggested it is now referred to as the Rural Transportation Authority.
Commissioner Phillips suggested participation be clarified.
6. An emergency access (for the lodge and cabins) shall be addressed as part of the Preliminary
Plan.
7. Mosquito control shall be included as part of the Preliminary Plan.
8. Hours of operation shall be included as part of the Preliminary Plan.
9. The Kodiak Park PUD guide must address boat usage (includes models of boats, etc).
10. Preliminary Plan phasing plan must address trail development.
Commissioner Phillips asked if they plan on maintaining the internal trail.
Mr. Cumming stated they do.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
SMA-00009 & ZC-00031, Nystrom Ranch
lena Skinner presented file numbers SMA-00009 and ZC-00031, Nystrom Ranch. She stated the
applicant has requested this matter be tabled until February 20, 2001. She stated the Nystrom Ranch
property has been sold and taken over by a new applicant. They may want to make some changes.
Chairman Stone confirmed it is a Tuesday.
Campbell Meyer, working with Isom and Associates, stated there has been a transfer of
ownership and they have recently been retained to work with the new owners.
Commissioner Phillips moved to table file numbers SMA-00009 and ZC-00031, Nystrom Ranch
to February 20, 2001, at the applicants request.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
PDA-00046, Logan Park PUD
lena Skinner presented file number PDA-00046, Logan Park PUD. She stated the intent of this
plat is to: (1) create the Logan Park PUD lots 1-5 (with building envelopes), including open space and
drainage easements as shown, (2) vacate and create a new Cemetery Road, and (3) a new access
easement known as Logan Court.
Logan Park PUD has previously had the vacation of Cemetery Road approved under Resolution
No. 2000-133.
Staff findings are as shown on staff report and as follows:

avoid creating spatial patterns that cause inefficiencies in the delivery of public services, require
duplication or premature extension of public facilities, or result in a "leapfrog" pattern of development.
a. Utility and Road Extensions. Proposed utility extensions ARE consistent with the
utility's service plan or shall be required prior County approval of an amendment to the service plan.
Proposed road extensions ARE consistent with the Eaele County Road Capital Improvements Plan.
b. Serve Ultimate Population. Utility lines ARE sized to serve the planned ultimate
population of the service area to avoid future land disruption which would occur if under-sized lines had
to be upgraded.
c. Coordinate Utility Extensions. Utility extensions shall only be allowed when the entire
range of necessary facilities can be provided, rather than incrementally extending a single service into an
otherwise un-served area.
d. Suitability for Development. The property proposed to be subdivided IS suitable for
development, considering its topography, environmental resources and natural, or human-made hazards
that may affect the potential development of the property, as well as existing and probable future public
improvements to the area.
e. Compatible with Surrounding Uses. The proposed subdivision IS compatible with the
character of existing land uses in the area and DOES NOT adversely affect the future development of
the surrounding area.
Ms. Skinner stated there is an issue with the title certificate to which the applicant would like to
respond. She stated all staff findings have been met and recommends approval.
Jim Fritze stated the current title certificate shows the owner to be William L. Leidy and Genna
Leidy. Genna Linning is deceased. He explained the process the applicant can do to correct the
ownership records.
Kevin Lindahl, representing the Palmateers, stated they are in agreement to do that.
Jim Fritze suggested the approval would be with authorization for the Chairman to sign once the
change has been made.
Mr. Lindahl stated this is coincidental that this may be his last hearing representing a client in
front of the Board of County Commissioners. He stated the only other concern they have is that the
County is contemplating a road through this parcel. He stated if the County decides not to proceed with
using this as a major access, it is likely the right of way would be vacated. He stated the statutes say if it
is vacated that it would go back and be combined with this parcel and that an amended final plat would
then be submitted.
Chairman Stone indicated the Board can not make any findings or recommendations for
something that mayor may not happen in the future.
Commissioner Phillips moved the Board approve File No. PDF-00046, Logan Park, incorporating
Staff findings and authorize the Chairman to sign both the Plat, and the SIA Agreement once the title
certificate on the plat is modified to reflect the holder of the deed of trust is solely William Leonard
Leidy.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.

Gran Palmateer thanked the Board and stated they started this project some three and a half years
ago and when you take a small project and run it through all the process it is the same thing a project of
500 units goes through. He stated this is an observation and not a judgement and doesn't know that
there is an answer as to how to do it or how to do it differently. He stated the next point he would like to
make is that he has known Commissioner Phillips for many years and he and Paula extend their thanks
and appreciation for all that she has done.
Commissioner Phillips moved to adjourn until January 9, 200l.
Commissioner Gallagher seconded the motion and thanked Commissioner Phillips for her service.
