Plat & Resolution Signing
Matt Gennett, Planner, presented the following plats and resolutions for the Board's
consideration:

this was a Minor Type B Subdivision, the intent of which is to re-subdivide Lot 2 into two (2), 'l2 duplex
lots, Lot 2A and Lot 2B. He stated staff findings are found on staff report and as follows:

Edwards Cemetery Road. Heard by the Board on August 14th, 2000. The Quit Claim Deed was
recorded with Resolution No. 2000-133 at Reception No. 742143, however, the Quit Claim Deed was
never signed and attested.
Commissioner Gallagher moved to authorize the Chairman to sign a Quit Claim Deed which was
overlooked at an earlier date for Eagle County File No. G-OOlO, a Vacation of a Portion of Edwards
Cemetery Road.
Commissioner Phillips seconded the motion. The vote was declared unanimous.
Commissioner Phillips moved to adjourn as the Board of County Commissioners and reconvene
as the Local Liquor Licensing Authority.

Liquor License Consent Agenda
Chairman Stone stated the first item before the Liquor Authority was the consent agenda as
follows:

This is a renewal of a hotel and restaurant license. This
establishment is located at 0057 Edwards Access Road #B. There
have been no complaints disturbances during the past year.

establishment is located on Beaver Creek Mountain. There have
been no complaints or disturbances during the past year.

Abatements
Max Schflaley, Assessor's Office, presented a petition for abatement for Eagle Airpark
Partners, schedule number 047045. The Assessor recommended denial as the petitioner has filed a
complaint due to the notice sent out by the Assessor's Office. The property is located in Valley Airpark
across from the Airport. The Assessor believes the change is warranted. He stated they must correct any
errors found.
Jack Stanford, petitioner, stated he is not asking for an abatement on the value that was placed on
the property. He stated he is requesting the manner in which this was levied. He stated the re-
evaluations must be done in a timely manner. This property was overlooked in the beginning. It was re-
evaluated in December 1999. Mr. Stanford stated his tenants were sent their bills before this valuation
was done. He stated he cannot charge his tenants an additional fee for the increase in taxes that did not
appear until April of2000. He stated the County cannot run a business in that way.
Max Schflaley stated the property was inspected in December of 1998 and the commercial
appraiser had a stroke during that time frame and his work load got backed up. He stated the assessment.
for this property was given a discount for 1999.
Commissioner Gallagher asked how long has Mr. Stanford been the Senior Partner.
Mr. Stanford stated since the beginning.
Mr. Schflaley stated this was the first tax notice as they purchased the property in 1998.
Chairman Stone stated the Assessor's Office, on a number of occasions, when making a mistake,
have corrected that mistake and reduced the taxes. Because of an error, they have gone back and related
they taxed this property wrong and need to bring it before the Board to correct it.
Jody Caruthers, Eagle County Assessor, stated mistakes do happen. He stated Mr. Stanford
should have said something in January of this year.
Chairman Stone asked what Mr. Stanford thought when being assessed on land only.
Mr. Stanford stated he thought they were only be taxed on the property because they were still
under construction. He stated they believed the taxes were based on an uncompleted project. He stated
he did not expect to get a $10,000.00 bill later because of an error.
Commissioner Phillips asked about the incomplete building.
Mr. Schflaley stated the records indicate the west building was at 100% percent complete and the
other building was about 80% complete.
Mr. Stanford stated neither building was complete at that time.
Mr. Schflaley asked when they took occupancy.
Commissioner Phillips asked if the Assessor's Office and the petitioner could set down and work'
this situation out.
Chairman Stone stated he agreed with tabling this matter.
Commissioner Phillips moved to table schedule number 047045, Eagle Airpark Partners, until
discussion is had between the Assessor and the petitioner to November 20,2000.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
Max Schflaley presented a petition for abatement for Patricia K Anderson-Hand, schedule
number R002670. The Assessor recommended this property be classified residential rather than
commercial. He stated the commercial portion of their property has been changed. He stated the
Assessor is recommending this abatement be approved for a tax amount of$1,777.30, leaving a balance
of$1,555.92 taxes owed.
Patricia K. Anderson-Hand, petitioner, was present for the hearing and stated she agreed with the
recommendation.

tax rate. The Assessor recommended approval for the year 1999 from $16,389.10 leaving a balance of
$10,362.50 for taxes owed.

Mr. Schflaley stated the next schedule number R04849l, W. Grant Williams Family
Partnership. He stated this was also an Assessor generated abatement on the basis a physical inspection
was done of the property and it was found the square footage was over stated. The abatement is for 1999
and goes from $8,724.62 to $1,041.96 being abated leaving a balance owed of $7,682.66

R03l529. The Assessor recommended for the years 1998 in the amount of $27,320.97 with a balance

Jeff Monroe, Tax Profile Services, stated they examined five comparable properties which had
approximately the same amenities. He handed out a packet on how they evaluated this property and the
figures they came up with. He stated they used the occupancy rate and operating expenses. He stated
there are differences and the Assessor's office has related, there are tangible differences. He related the
personal property was valued at $2,061,520.00 in 1998. He spoke to the management technique. He
stated they recommended a 4% to 5% for a intangible portion. He continued to explain the calculations.
Chairman Stone asked about the request differing from the abatement request.
Mr. Schflaley stated the Assessor valued the property at $2,635,540.00 for both years.
Mr. Monroe stated they are requesting the property be valued at $2,533,100.00
Mr. Schflaley stated this property is probably one of the premier hotels in the state. It is very
difficult to assess because of the amenities. He stated Mr. Monroe is dealing with the actual room rates
and not the restaurant or the spa. He stated all the amenities must be included in the appraisal. He stated'
they did a pro-forma on the value of the property. He stated the spa would have a different ratio than the
hotel. He stated they deducted out the portion they felt was attributed to the lodging portion.
Mr. Monroe stated the complete revenue strains are located in the packet if the fees need to be
deducted.
Mr. Schflaley stated when you talk about the cap rate, there is an error. He is not really sure what
is being asked to be considered.
Chairman Stone suggested that even though they tried to short cut the understanding process, it
didn't work. He stated he finds enough confusion and would look for a motion to table this to have it
heard again on the 20th of November. He suggested the applicant will have to do a better job of coming
up with an argument. He suggested they get with Mr. Schflaley to clarify this. He asked both parties to
be better prepared.

Mr. Schflaley stated he has not seen a 13% cap rate on newer properties in this area. Typical
they have lower cap rates. He stated a lower cap rate yields a higher appraisal.
Mr. Schflaley presented a petition for abatement for Stag Gulch Partners, schedule number
R040943. He stated the request is for 1997, 1998 and 1999. The subject is a 4,781 square foot
community center in Cordillera.
Chairman Stone asked where this is.
Mr. Monroe responded it is located at the Trailhead.
Mr. Schflaley stated for 1997 and 1998 there has been an appeal filed on this property and
therefore they are precluded from filing an abatement. For 1999 it was reassessed and compared to
comparable sales.
Mr. Monroe stated they would request the 1997 request be denied and that they withdraw the
1998 request. He stated 1997 was never heard and whether that can be appealed, he has not been
advised.
Chairman Stone stated for 1998 they can grant a withdrawal. He asked Ms. Black about 1997.
Ms. Black responded that is appropriate.
Chairman Stone asked if the petitioner is agreement for 1999.
Commissioner Phillips moved schedule number R040943, Stag Gulch Partners, be denied 1997,
it is withdrawn for 1998, and approval of 1999 as recommended by the Assessor in the amount of
$15,044.96.

Mr. Schflaley presented a petition for abatement for Rebecca Stuart, schedule number R016131.
The Assessor recommended approval. He stated this property was appealed in 1999 and a notice was
mailed by the Assessor. He stated therefore the petition should be denied.

Max presented a petition for abatement for Isidoro & Frances Quintana, schedule number
R005090. The Assessor stated on this file the petitioner is requesting an abatement for 1999. The
abatement was submitted again because abatement can not increase the mill rate due to tax area
boundary errors. He recommended a partial abatement in the amount of$1,127.88.
Commissioner Gallagher asked if this is addition to the previous abatement.
Mr. Schflaley responded this is to correct the mill levy.

Ms. Black pointed out a letter was sent to her as follows:
"We have received your October 3,2000 concerning the assessment of unit 305 in the Lazier
Arcade. We appreciate the Assessor's analysis but would like to point out the following, although
Brentwill capital LLC purchased unit 305 in November 1999 for $475,000.00 the unit was listed for only
$495,000.00 not the appraised value of $525,000.00. Unit number 303 in the same building was listed at
$475,000.00 during the valuation period. Number three, the comparable sales are not comparable in that
the Lazier Arcade Building does not have an elevator nor parking access. Number 4, the only unit in the
Lazier Arcade Building with a higher value was a corner unit which probably does have a higher value.
Unfortunately I cannot attend the November 6th hearing but would appreciate the above comments being

Mr. Schflaley stated they are in the lower range of the sales and they were within 10%.

Joe Forinash, Planner, presented file number AFP-OOlOO, Cordillera Filing 9, Lots 25 & 26. He
stated this was an amended final plat which would vacate the building envelope for Lot 25 and vacate
the lot line between Lot 25 and Lot 26, creating a new lot to be known as Lot 26. This Amended Final
Plat is a Minor Modification permitted per Section 1.05.2 of the current Cordillera PUD Guide.
The Board of County Commissioners approved Filing 9 in the Cordillera PUD in November
1993. An amended final plat which amended the building envelope on Lot 26 was approved by Board of
County Commissioners in November 1994.
Pursuant to Section 5-290.G.2 of the Eagle County Land Use Regulations, the Community
Development Director has made the following findings:
a. The Amended Final Plat DOES NOT adversely affect adjacent property owners.
b. The Amended Final Plat IS consistent with the intent of the Final Plat.

SMA-00013, Beaver Creek Subdivision, 3rd Filing, Tract B, Lots 4 & 5
Cliff Simonton, Planner, presented file number SMA-00013, Beaver Creek Subdivision, 3rd
Filing, Tract B, Lots 4 & 5. He stated the Vail Corporation has applied for a Minor Type A Subdivision
to create two (2) lots on a previously unplatted 21.81 acre portion of Tract B (total acres 29.3) in the
Beaver Creek Planned Unit Development. This proposal would create a 6.172 acre Lot 4 and a 15.637
acre Lot 5. Per the Amended and Restated Guide to the Beaver Creek Planned Unit Development, the
land use category for Tract B is Resort Commercial, a mixed use zoning allowing hotel, apartment,
single and multi-family residential, commercial, recreation and resort operations. No development is
contemplated for these lots at this time. Upon approval of this file, all of Tract B will be platted.
The original Beaver Creek Planned Unit Development was approved by the Board of County
Commissioners on May 1, 1978. An approved Preliminary Plan does exist for Tract B, Beaver Creek
Planned Unit Development.
On January 6, 1981 the Board approved a final plat for the Beaver Creek Subdivision, Third
filing, Tract B, that included an eight lot configuration on a portion of Tract B. That same year,
construction began on two of the proposed four buildings known as "The Tames". All four buildings of
The Tames have since been completed.
The land use designation of Resort Commercial (a general mixed use category) was assigned to
the parcel in 1994, with an with an adjusted allowed density of 300 dwelling units. 136 units currently
exist in The Tames, leaving a balance of 164 for future development.
Tract B was subsequently reconfigured, and Lots 1, 2 and 3 of Tract B, Filing 3 where platted
and approved by the Board in May of 1999 (SMA-00008).

Adequate water is available and can be provided by the Bachelor Gulch Metropolitan District.
Sewer lines operated by Eagle Valley Water and Sanitation exist in adjacent road right of ways, and are
available to serve the proposed lots in the event of development. Detailed engineering plans for water
and sewer systems will be required as a part of any proposal to develop these lots.

The land proposed for subdivision lies within the Beaver Creek Planned Unit Development and ,
is in conformance with The Beaver Creek Planned Unit Development Guide. As such, this application is
consistent with Eagle County's Master Plans and Future Land Use Map.

subdivision IS consistent with Eagle County Master Plans, and with the Future Land Use Map (FLUM).

subdivision shall comply with all of the standards of this Section and all other provisions of these Land

Article 3, Zone Districts
[+] The proposed lots are zoned PUD, Resort Commercial, as defined in the Amended and
Restated Guide to the Beaver Creek Planned Unit Development. While the PUD Guide does provide for
additional development on these sites, no development is proposed for these lots at this time.
Article 4, Site Development Standards
[+] No development is anticipated on Lot 4 or Lot 5 of Tract B at his time. As such, details
regarding specific development plans were not provided as a part of this plan, and those standards
applicable to site development do not apply. The applicant will be required to demonstrate that
standards for site development have been met prior to the issuance of any permits related to any
development on these sites.

No specific land use is proposed as a part of this application. A future application for
development on Lot 4 or Lot 5 will be required to demonstrate that this standard has been met. It is
unlikely that the future development of the surrounding area will be adversely affected by the proposed
subdivision.
[+] FINDING: Compatible With Surrounding Uses. [Section 5-280.B.3.e (5)] - For the present,
no development is contemplated on the land being subdivided. Future development plans for these sites,
however, CAN BE made compatible with the character of existing land uses in the area, and SHALL
NOT adversely affect the future development of the surrounding area.

development is currently proposed for the land affected by this application, the Applicant IS NOT
ABLE TO fully demonstrate conformance with all ofthe standards of this Section.. However, the

STANDARD c: Improvements Agreements [Section 5-290.G.1.c] The Board of County
Commissioners shall consider the adequacy of the proposed Improvements Agreement, where
applicable.
No development on Lot 4 or Lot 5 is contemplated at this time, and as such no improvements are
proposed by this project that require collateralization.
+] FINDING c: Improvements Agreements [Section 5-290.G.1.c] - A Subdivision
Improvements Agreement is not applicable for this project.
Chairman Stone asked in a general nature, if the applicant has the ability to build a certain
number of units on this property and are they regulated under the PUD Guidelines.
Mr. Simonton stated that is correct. He stated there are still 164 units available.
Geri Arnold, Vail Resorts, Inc., was present for the hearing.
Chairman Stone asked why the applicant was doing this.
Ms. Arnold stated this has been a part of the Master Plan since it's conception. She stated no
development is proposed at this time. Ms. Arnold stated in the Master Plan it was defined as Tract B, as

one parcel. She stated they have only platted the middle. She pointed out on a map the location of the
property. She stated this property has always been noted as Tract B, the middle portion has been platted
previously and the area on either side of the platted portion is what is being platted now.
Commissioner Gallagher asked if what is known as Tin City has been platted.
Ms. Arnold stated it is on Lot 4, which is being platted today.
Commissioner Phillips moved the Board approve File No. SMA-00013, Beaver Creek
Subdivision, Third Filing, Tract B, Lots 4 & 5 and authorize the Chairman to sign the plat.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
SMA-00015, Bachelor Gulch, Filing 4
Matt Gennett presented file number SMA-00015, Bachelor Gulch, Filing 4. The proposed
subdivision will create two (2) lots from an existing, unplatted 8.870 acre parcel. The gross density of
the proposed subdivision is one (1) unit per 4.43 acres. The existing parcel is located at the top of
Horizon Drive and is part of the Arrowhead at Vail Planned Unit Development. The proposed two (2)
lot subdivision is consistent with the purpose and intent of the Arrowhead at Vail Planned Unit
Development Guide.
CHRONOLOGY:
On June 30th, 1983, The Eagle County Board of County Commissioners authorized the
Arrowhead Planned Unit Development by Resolution (83-52), and approved the Arrowhead at Vail
Planned Unit Development Guide.
On November P\ 1993, the Eagle County Board of County Commissioners approved certain
amendments to the Arrowhead at Vail Planned Unit Development by Resolution (93-128).

The site proposed for development is accessed from Horizon Drive and access easements has
been established for each of the proposed lots.
Water and sewage service will be provided by Bachelor Gulch Metropolitan District and Eagle
River Water and Sanitation District, respectively.
FINDING: Access, Water, and Sewage [Section 5-290.G.1.a] - The access, potable water, and
sewage on the land to be subdivided are shown as adequate.
STANDARD: Conformance with Final Plat Requirements [Section 5-290.G.1.b] The Board of

Mr. Loeffler stated the lots are identified sufficiently.
Ms. Arnold answered yes.
Chairman Stone stated this is taking a previously un-platted parcel and creating two single family
lots.
Ms. Arnold pointed out on a map the location of the parcels. She stated they are the very last site
encountered when you enter Bachelor Gulch. She stated they have been looking at issues involving

Commissioner Gallagher asked if these are shown on the plat.
Ms. Arnold stated these are shown on the preliminary plan.
Commissioner Phillips asked what were the issues that deterred Vail Resorts from developing
these lots earlier.
Ms. Arnold stated it has to do with geography. She stated when they decide to develop this
parcel they will come back before the Board for approval.
Commissioner Gallagher moved the Board approve File No. SMA-00015, Bachelor Gulch,
Filing 4, incorporating staff findings and authorize the Chairman to sign the plat.
Commissioner Phillips seconded the motion. The vote was declared unanimous.
SE-00022, Red House
Jena Skinner presented file number SE-00022, Red House. She stated this is an Exemption Plat '
to legally recognize two parcels of land owned by the Vail Corporation. The total combined acreage of
the lots is approximately 1.4 acres. These lots have a Commercial Limited zoning designation, however,
they were never platted. The Red House, situated on Lot 1 (the smaller of the two parcels), has been in
existence since the early 1900's. Lot 2 has no development upon it, and has also existed for many years.
These lots currently have a single, shared driveway, with access to Highway 6. They also have legal
sewer and water.
The Red House parcel has existed since 1904. Both parcels were deeded over to Vail
Corporation in 1979. The zone change occurred in 1981- Resource to Commercial Limited. 2000- Vail
Corp. has applied for an Exemption to legally recognize the "Red House" Parcels.
Staff findings are as shown in staff report and as follows:
Pursuant to Section 5-270 Subdivision Exemption ofthe Eagle County Land Use Regulations,
findings are follows:
a. The lot in questions WAS created and established in the records of the Clerk and Recorder
prior to August 22, 1984 notwithstanding compliance with Eagle County Land Use Regulations in
existence at the time of the creation of the parcel.
b. A certified survey of the parcel HAS been submitted which includes legal description meeting
the minimum requirements of a land survey plat pursuant to 38-51-106 C.R.S., and all record and
apparent rights of way, easements and monumentation ARE indicated on the Plat.
c. Legal and physical access to a public right of way by a conventional vehicle HAS BEEN
demonstrated.
d. The land proposed for exemption HAS a legal, physical, adequate, and dependable potable
water supply.
e. The land proposed for exemption HAS a waste water disposal system, or other lawful means
of disposing of human wastes that complies with all public health laws.
f. Satisfactory evidence HAS been provided demonstrating that the exemption WILL NOT
create hazards, and the lot DOES contain a safe, adequate building site.
Chairman Stone asked Mr. Loeffler ifhe could explain why this file is different than one heard
earlier this year where there are two parcels that were merged into one lot.
Mr. Loeffler stated the merger exemption does not comply. The others were non-conforming
lots. The other application could have gone through a zone change.
Commissioner Gallagher asked if the applicant could show them the lots on the map.
Ms. Arnold pointed out on a map the location of the two parcels.
Chairman Stone asked about the gray area on the map.
Ms. Arnold stated those were the set backs.

Chairman Stone asked if the Red House was in the set backs.
Ms. Arnold stated part of it is and it is grandfathered in.
Chairman Stone asked why Vail Resorts was platting this at this time.
Ms. Arnold stated it is the proper time.
Commissioner Gallagher asked if the Board would be creating a useless lot.
Ms. Arnold stated it is a very restricted lot and because of the restrictions and the close vicinity
they are expecting to eventually combine the two lots.
Commissioner Gallagher asked why they are not combing them now.
Ms. Arnold stated these are the original lots as they received them.
Mr. Loeffler stated in order to get an exemption they must stick to the original boundaries
description..
Commissioner Phillips moved the Board approve File No. SE-00022, Red House, incorporating
the findings and authorize the Chairman to sign the plat.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
