Chairman Stone asked if there are any changes to the consent agenda. Renee Black, Asst. County Attorney, stated items D and E can be pulled as they have received duplicate Letters of Credit. Commissioner Phillips stated on page 1, nine sentences from the bottom it reads, Chairman Stone called for the question, it should have "on the motion" should be added. She spoke to page 5 and a question on the .5% being Yz cent. The Board concurred it would be the same. Commissioner Gallagher spoke to that same sentence where it reads "approve". It should read "approved" . Commissioner Gallagher moved to approve the consent agenda as presented with the changes to the minutes as stated, pulling items D and E. Commissioner Phillips seconded the motion. The vote was declared unanimous. Plat & Resolution Signing Matt Gennett, Planner, presented the following plats and resolutions for the Board's consideration: 5MB-00131. RiverEd~e at Beaver Creek Condominiums. He stated intent of this 19 09-05-2000 Minor Type B Subdivision is to subdivide the RiverEdge buildings into (employee) condominium units, as well as to create an access and utility easement as shown on the plat. (Tabled from 8/28/2000.) He stated this was tabled from last week to allow for quesitons of the applicant. Jim Mandel, Senior Vice President of Vail Resorts, introduced Jack Lewis, Director of Employee Housing, Martha Rehm, Senior Vice President General Counsel for Vail Resorts, and Geri Arnold, Director of Planning & Zoning for Vail Resorts. He stated they are condominimizing these units because they want to. They have no intention to sell them in whole or in part at this time. He stated what he is saying about this file is applicable to the Tames as well. He stated they want to do this today, because they can. They would like to avoid things that will not allow for it, like the growth amendment. He stated because they have the right to do this they want to. In the future they may want to sell these, possibly to employers. In the future this may not make sense for employee housing. The units are not specific to any site. The conveyance of a unit is not without consequence. Finally, as to RiverEdge and the Tames to get full citizenship within the Resort Company, it is necessary to condominimuize to get full benefit of ownership. Chairman Stone suggested it is their intent to condominimize either for financial or other reasons they may have to preserve the ability to do so. What concerned the Board was a letter that was read that said something to the effect they would not be changed from employee housing units during the term of the bond. Mr. Mandel stated that was requested by the County. The financing was done by the County through Revenue Bonds. The County Attorney's office wanted to make sure there wasn't confusion while the bonds are in effect. When the bonds are paid off they can do something different and though they don't intend to do so today, that should not restrict them. Chairman Stone asked if the units would have to be replaced. Mr. Mandel stated yes to meet the obligations for housing with Eagle County. Michael Cacioppo stated he is extremely concerned about them passing this. He suggested memories are short. He stated while he is aware they have the ability to do certain things when the bonds are paid off, Vail Resorts drives a lot of the demand for employee housing. For those of us who get sick and tired of hearing how we need more affordable housing on open space land, to allow them to condominimize and sell these off, for even the previous Commissioners not to have restricted these units, continues to drive the need for employee housing on open space. He does not see why Vail Resorts would not want to maintain in perpetuity the management of these units for employees. He spoke to the ongoing sale of Vail Resorts and their obligations being to themselves, the stockholders and the individuals. He asked the Board deny this by a three to zero vote. He stated Mr. Lewis' job is to get the tax payer to pay for as much affordable housing as possible, and he's done a good job when he served on the School Board. He asked them not to let them take this away and condomininimumize it. The Tarnes at Beaver Creek Condominiums. He stated this is a Minor Type B Subdivision, the intent of which is to subdivide four buildings, known as the Tames at Beaver Creek, into 136 separate (employee) residential condominium units, associated common areas, and to create one 20' utility easement. Chairman Stone thanked the applicant suggesting that they may want to be present in the future when they have an item, even if they may consider it routine. 5MB-00248. Arrowhead at Vail. Filin2 No. 15. Lot 18. He stated the intent of this Minor Type B Subdivision is to re-subdivide Lot 18 into two (2) ~ duplex lots, Lot 18E and 18W. The vote was declared unanimous. Establishing Rural Transportation Authority George Roussos, Asst. County Administrator, stated the next item is the second public hearing 21 09-05-2000 on establishing a rural transportation authority in the Roaring Fork Valley and consideration of Roaring Fork Transportation Authority Intergovernmental Agreement. He stated this IGA has been considered and approved by all of the applicable municipalities and it is being heard by Pitkin and Garfield Counties today. He stated the second item is the resolution concerning ballot language. Chairman Stone asked for public input. Commissioner Gallagher stated it is an amazingly good thing to get all of the entities in the Roaring Fork Valley to commit to this. He stated it is an astonishing accomplishment and he would encourage unanimous support by the Board. Mr. Roussos stated if this should pass, the riders will have added service to Rifle and improve bus service in the Roaring Fork Valley in general and it will move the supporting funds from the general fund to the R T A. Commissioner Phillips moved to approve an Intergovernmental Agreement between the Roaring Fork Transportation Authority and Eagle County. Commissioner Gallagher seconded the motion. The vote was declared unanimous. Resolution 2000-127, Submission of Ballot Question for Roaring Fork Transportation Authority Chairman Stone stated the next item is Resolution 2000-127 providing for the submission to the registered qualified electors of Eagle County with election precincts 7,8,24 & 25, a question to establish the Roaring Fork Transportation Authority for the purpose of providing the bus services currently provided by the Roaring Fork Transit Agency plus expanded mass transit and other transportation services in accordance with an Intergovernmental Agreement among Eagle County and if the appropriate voters approve the RTA, Aspen, Snowmass Village, Basalt, Glenwood Springs, Carbondale and Pitkin and Garfield Counties, said question to be submitted at the election to be held November 7,2000, prescribing the form of ballot question for submission at said election, providing for certification of the election question to the County Clerk & Recorder. Notice of Appeal, Roger Behler Helen Migchelbrink, County Engineer, presented a notice of appeal of administrative decision from Roger Behler. She stated this is file ASD-00007 to reject Mr. Behler's request to have the speed bumps remain. Ms. Migchelbrink spoke to receiving a request from a neighbor who asked to have the speed bumps removed. After researching this and vising the site, she realized it is under the County's jurisdiction. She wrote a letter to Mr. Behler directing them to remove the speed bumps from the public right-of-way. Mr. Behler related to her that he was going to file an appeal, which he has. Ms. Migchelbrink stated the discussion today will be whether or not this is in a public easement. Wendell Porterfield, Attorney representing the appellant, Roger Behler, stated the question is whether the access easement on Mr. Behler's property and the neighbors is public or private. He believes it is private. He stated this is not a question as to whether this is wise or between the parties, it 22 09-05-2000 is a right. It is their position that this is not a public right-of-way. He explained he has a couple of documents to present, the first is copies ofthe plat recorded in 1974. He stated it is a four page plat. The second is a blow up of the first page of the plat containing the certificate of dedication. Chairman Stone stated those will be accepted into the record. Mr. Porterfield presented them stating there are some highlighted areas. Roger Behler was sworn in by the County Clerk & Recorder. Mr. Porterfield questioned Mr. Behler about where he lived and how long he lived there. He also questioned Mr. BeWer on the adjacent property owners. Mr. Behler stated in 1996 the easement was paved, which was paid for by himself and the adjacent property owner. Mr. Porterfield spoke to a picture taken by the County Engineer and asked if the Board had that in their information. Chairman Stone stated they did not. Mr. Porterfield asked the photograph be accepted into the record. The Board concurred to accept the picture into the record. Mr. Porterfield spoke to the two signs and asked who installed them. Mr. Behler stated he did. Mr. Porterfield asks who uses the area ofthe easement. Mr. Behler stated only visitors to his house and the people living on Lot 18. Mr. Behler stated in the winter he removes the speed bumps and puts them back in the spring. He stated the speed bumps are made out of plastic, they are three inches high. They do slow traffic down. He stated he has the permission of his neighbor on lot 13 to install the speed bumps. Mr. Porterfield stated they would like to tender an affidavit from Mr. Bower giving his consent to this. Chairman Stone stated that would be accepted it into the record. Commissioner Phillips asked if Mr. Bower lives there. Mr. Behler stated he does not. Mr. Porterfield asked to Ms. Migchelbrink who made the complaint. Mr. Migchelbrink responded Diane Gallegos. Mr. Porterfield asked how Ms. Migchelbrink came to the conclusion this was a public easement. Ms. Migchelbrink read from the plat legal description, indicating the street and alleys were dedicated to the County. She stated she refers to this easement as a Place. She stated it is very clear it was the intention of the Board of County Commissioners at that time for this to be a public easement. Mr. Porterfield stated there are two 20' utility easements are shown on this plat. Glen Gallegos, owner oflot 18, stated they have been there since 1978. They no longer reside there and the Ingstad' s are the renters. He stated when they bought this property the road was the only access into the property. He suggested legally there shouldn't be any question. Morally, this should be solved by neighbors. Mr. Behler took it upon himselfto install the speed bumps. He stated they can and will do damage to cars. He stated there is no question this is a legal easement. He stated it is unfortunate they couldn't have worked together as neighbors. Chairman Stone asked if there is any other way to get into the lot. Mr. Gallegos stated the other entrance is very steep. Mr. Porterfield asked if the general public has the right to use this easement to get to any place they choose. Mr. Gallegos stated according to the legal definition it is allowed. Mr. Porterfield asked if he believes the public has a right to use this property. Mr. Gallegos stated people used it for years. They are curious to see what is up there. Commissioner Gallagher asked if there are covenants for that area. Mr. Gallegos stated there are covenants and deferred to his wife Diane. 23 09-05-2000 Diane Gallegos, co-owner of lot 18, stated this has always been a public way. She was president of the Board for six years and was instrumental in getting the paving done. She stated they didn't pave the easement because the road was not fixed. At that time the County was fully aware that it was a public way as she was responsible for collecting the signatures. She explained the County time constraints and why the improvements were not made. Commissioner Gallagher asked if there were covenants restricting the use. Mrs. Gallegos stated there are four of them using that road. She stated Mr. Bower is only here two weeks out of the year and there are renters in their house. She stated once they talked about the speed bumps and contacted Rich Bower and the Ingstad's. Neither claimed to have been contacted by Mr. Behler. She knows from her experience on the Homeowners Association Board that it is a public right-of-way. Renee Black, Asst. County Attorney, stated they did receive a letter from Mr. and Mrs. Brower to be part of the file. She stated Mr. Porterfield has seen the letter. She asked it be read into the record. Chairman Stone read the letter into the record as follows: "I am over the age of 21 and have personal knowledge of the facts, and I believe them to be true. Number 2, my wife Sharon and I own property at 49 Idelweise Place in Lake Creek Meadows Subdivision. Our family occupies the property for 4 to 6 week every summer and approximately 4 weeks during the rest of the year. Our home is at the end of the drive in which Roger Behler installed speed bumps and at least one speed limit sign about 9 months ago. We have an access easement over the drive and there is no other access to our property. We were not consulted by Roger Behler prior to the installation of the speed bumps or signs. The unauthorized and unnecessary installation of the speed bumps has impaired my use of the easement. The speed bumps are unusally steep and it is therefore necessary to come to a complete stop before crossing over the bumps. When I crossed one of the bumps at a slow speed without coming to a complete stop the front end alignment was damaged. Based on the foregoing I hereby request the appeal be denied and any subsequent permit application for the installation of speed bumps be denied. The letter is signed by Richard Brower. Mr. Porterfield noted the affidavit isn't notarized and believes it is irrelevant. He stated the question is not the wisdom to install speed bumps. The question is, is this a public way. The plat is for dedication for the streets hereon. He referred to the County Engineer's interpretation that this is a Place. He stated the plat has roads and has streets. This is noted as an access easement. He spoke to the drainage easements. He stated there is no question it is an easement for the use and benefit of lot 18. He stated the owners can make any use of the easement that does not reasonably interfere with the other users. But that is not the question here. He stated they run the risk of sovereign amunity, there may be liability to the County as well. He stated the people that have a right to use it are lots 12, 13, and 18. The owners of lot 18 do have access through the courts. Chairman Stone asked where it says that only the owners of 12, 13, and 18 are allowed to use it. Mr. Porterfield stated by not dedicating something to the public you would reserve the rights of the property owners. Mrs. Gallegos stated when she first moved into the house and they asked the County to plow the easement they said they would be more than willing to do so if it was improved. She stated there were other property owners above them that were going to use it as well. They have approached it always as a public way. Chairman Stone closed public comment. Commissioner Phillips reviewed the use of the term Place. She agrees with the County Engineer that this is considered as a Place and been accepted as such. Commissioner Gallagher asked Mr. Behler about the photograph and identified their home. He asked if they have ever used a speed detection devise on the road. Mr. Behler stated no. Commissioner Gallagher asked about the number of travelers. 24 09-05-2000 Mr. Behler stated about 15 per day. Commissioner Gallagher asked if Mr. Behler had tried to contact the County about the traffic. Mr. Behler stated no. Commissioner Gallagher asked if Mr. Behler asked the County about signage and if they asked for assistance. Mr. Behler stated no. He stated all he is trying to do is slow the traffic down by his house. Chairman Stone stated on the plat it plain and simple English it states, "do hereby grant to the County of Eagle, for public use, the streets shown hereon, including avenues, drives, courts, places and alleys." He stated this is a place where people drive, he would consider it a drive. He stated everyone's addresses consider it a Place. Renee Black requested the Board put this in writing. She stated the Board needs to approve or disapprove the staff interpretation of this regulation. Commissioner Gallagher moved to deny the appeal of administrative decision from Roger Behler, file number ASD-00007, affirming the staff decision regarding use of the easement. Commissioner Phillips seconded the motion for discussion. In discussion, Commissioner Phillips asked when and how the speed bumps will be removed. Ms. Black stated there was a notice of violation sent which is to expire on September 10,2000. She recommended the Board allow Mr. Behler to remove the speed bumps himself, and if not done by September 10, 2000, the County have them removed. Chairman Stone called for the question on the motion. The vote was declared unanimous. Mr. Gallegos stated the safety and welfare to the Behler family is of concern to all of them as well and believes they should open the doors and get this matter worked out. Grant Agreement, AIP-3-08-0020-27 Jim Elwood, Airport Manager, presented the Grant Agreement for AIP-3-08-0020-27. He stated this construction was awarded to Grant Construction for the runway rehabilitation last fall. There was additional scope added to the scope ofthat project. These funds are federal funds to cover that work. Commissioner Phillips moved to approve the Grant Agreement for AIP-3-08-0020-27 authorizing the Chairman to execute the grant agreement. Commissioner Gallagher seconded the motion. The vote was declared unanimous. Completeness Hearing, Adams Rib Ranch Ray Merry, Environmental Health Director, presented the completeness hearing for Adams Rib Ranch. He stated the action that will be requested from the Board on September 5,2000, is to determine completeness of a 1041 Permit application and to estimate associated processing fees. Adam's Rib has submitted a 1041 Permit application for Maj or Extensions of existing domestic water and sewage treatment systems and efficient utilization of municipal and industrial water projects to serve Adam's Rib, "The Ranch," pun. The project is located adjacent to and South of the Town of Eagle extending approximately 5 miles South through the Brush Creek Valley. Staff has reviewed the above referenced application and has found it to be complete. We have tentatively scheduled the hearings for the Planning Commission and Permit Authority on October 18, 2000 and October 30,2000, respectively. Estimated fees for the above referenced 1041 Permit application are as follows: Community Development Staff 12 Hrs @ $42.50 = $ 510.00 Engineering Staff 8 Hrs @ $42.50 = $ 340.00 25 09-05-2000 Attorney Staff 8 Hrs @ $75.00 = $ 600.00 TOTAL = $1,450.00 Commissioner Gallagher moved the Board accept the application submitted by Adam's Rib "The Ranch" for major extensions of existing domestic water and sewage treatment systems and efficient utilization of municipal and industrial water projects. The estimated fee to process this application is $1,450.00 and may be altered to cover the actual cost of review and public hearings. Commissioner Phillips seconded the motion. The vote was declared unanimous. Commissioner Phillips moved the Board approve the applicant's request for waiver of the special use permit requirement as allowed in section 3-310-1 of the Eagle County Land Use Regulations. Commissioner Gallagher seconded the motion. The vote was declared unanimous. Resolution, Multifamily Housing Project Revenue Bonds Chairman Stone stated the next item is a Resolution approving the issuance by Mountain Glen Housing Corporation of Multifamily Housing Project Revenue Bonds, (GNMA Mortgage Backed Securities Program) Series 2000, in an aggregate principal amount of $10, 165,000.00, authorizing a Project Agreement, a Financing Agreement, a Mortgage Note and a Residual Receipts Note and authorizing Incidental Action. Renee Black stated this has been rescheduled to September 11, 2000 so that bond council can be present. Commissioner Gallagher moved to adjourn as the Board of County Commissioners and reconvene as the Local Liquor Licensing Authority. Commissioner Phillips seconded the motion. The vote was declared unanimous. Liquor License Consent Agenda Commissioner Stone stated the next item on the agenda was the Liquor License Consent Agenda as follows: A) Beaver Creek Food Services, Inc. dba/Allie's Cabin This is a managers registration for David Sanchez. Mr. Sanchez has worked in the restaurant business for Vail Associates sincel993, and in Florida at Hattricks in 1998, Jacksons Bistro in 1997 and Hoot Toot & Whistle in 1997. He is reported to be of good moral character. Allie's Cabin is on Beaver Creek Mountain. B) Swiss Stubli, LLC dba/Swiss Stubli Authentic Swiss Restaurant This is a renewal of a hotel and restaurant license. This establishment is located at 76 Avondale Lane. There have been no complaints or disturbances during the past year. Commissioner Phillips moved to approve the Liquor License Consent Agenda for September 5, 2000, as presented. Commissioner Gallagher seconded the motion. The vote was declared unanimous. Edwards Business Association Earlene Roach, Liquor Inspector, presented a Special Events Permit for Edwards Business Association for September 23,2000, from 10:00 a.m. to 3:00 p.m. in the Edwards Village Center 26 09-05-2000 common area. Joe Trevino, Edwards Business Association, was present for the hearing. He stated this is a one day event and the benefits go to the Vail Valley Medical Center Cancer Research. Chairman Stone asked if this happened last year. Mr. Trevino stated this is the third year and that previously he just helped with setting up and tearing down. Chairman Stone asked about concerns or problems with the past two events and the boundaries. Ms. Roach stated there have been no problems in the past and the boundaries are the same. Mr. Trevino stated all those purchasing or drinking alcohol will have to be banded. The area will be fenced and they will have security. Commissioner Gallagher asked for clarification about the tasting amounts. Mr. Trevino stated they will serve smaller amounts. Commissioner Phillips moved to approve a Special Events Permit for Edwards Business Association for September 23,2000 from 10:00 a.m. to 3:00 p.m. Commissioner Gallagher seconded the motion. The vote was declared unanimous. Vail Board of Realtors Earlene Roach presented a Special Events Permit for the Vail Board of Realtors for September 23,2000 from 5:00 p.m. to midnight at the Diamond Star Ranch. Laddie Clark, Vail Board of Realtors, was present for the hearing. He stated because this event is being held on private land, the intent is to use any profits from this to go into the Hope Chest for the Board to disperse at a later date. The purpose of the license is really to have greater control of the alcohol. Chairman Stone asked who will be serving the alcohol. Mr. Clark stated they will have two professional bartenders who are educated in checking I.D.'s and such. He suggested the average age will be far greater than 21. Chairman Stone asked how they will control the area. Mr. Clark stated primarily through signage and volunteers. He stated he does have pictures of the property and the boundaries. Chairman Stone asked Ms. Roach if she believes they will have adequate control of the property. Ms. Roach stated she believes they do. Commissioner Gallagher stated he has a concern with having signs in as much as they require every other special use permit to have fences and controlled access. He stated he has no doubt they will have Chairman Stone asked if they have one access/entrance if they can have someone stationed at the door of the building to get into the facility. Mr. Clark yes they will. Commissioner Phillips stated she believes posting is necessary. Mr. Clark stated it is a structured event. Chairman Stone asked if they can have someone there especially late in the evening to see that no alcohol leaves the premises. Mr. Clark stated they will have someone stationed at the door. Commissioner Gallagher moved to approve a Special Events Permit for the Vail Board of Realtors for September 23, 2000 from 5:00 p.m. to midnight. Commissioner Phillips seconded the motion. The vote was declared unanimous. Commissioner Phillips moved to adjourn as the Local Liquor Licensing Authority and reconvene as the Board of County Commissioners. 27 09-05-2000 Commissioner Gallagher seconded the motion. The vote was declared unanimous. Resolution 2000-128, Responsible Growth Initiative Chairman Stone, said the next item is Resolution 2000-128, approving Eagle County's interpretation for portions of the proposed responsible Growth Initiative. He stated this is virtually the same as that reviewed last week. Robert Loeffler, Deputy County Attorney, stated there have been a lot of questions by developers regarding how the development issues would work. He spoke to the language of "valid development application" and Eagle County's understanding of that term through the Land Use Regulations. He suggested this resolution says that the various types of land use applications, some of which are single stage, and some which are multi-stage, the interpretation being that with any of these applications, they consider it to be a valid development application. He suggested the interpretation is something which they believe is entirely within the Board's power and will be a benefit. Bob Brotman, area resident, asked about the 35 acre parcel and that not requiring a development application. He asked if they would have to submit a development application with this interpretation. Chairman Stone suggested Mr. Brotman was looking for a legal opinion and that the interpretations produce more questions than answers. He suggested there is not a definitive answer today due to lack of experience with this amendment. He suggested it will produce more legal battles. Mr. Loeffler stated they can't be in a position to give legal advice to individuals. Mr. Brotman suggested that on the application and with the short time frames that some provision be made for the planner to submit the application on behalf of the owner. Chairman Stone stated they are not changing the process or coming up with a short form. All they are doing is interpreting what might be considered an application. Mr. Brotman asked who signs the application now. Keith Montag, Community Development Director, stated it either has to be signed by the land owner or a power of attorney from the land owner to an agent. Chuck Crist, resident of Eagle-Vail, asked if the application has to include all of the things listed or anyone. Chairman Stone stated that anyone of the items constitutes an application. Commissioner Gallagher stated this resolution sets out what already exists in the Land Use Regulations. He thinks it serves the public's interest very well. Commissioner Phillips suggested they recognize that this initiative may be hard to get the voters not to vote for it. When they believe unbridled growth is not good for Colorado and they need to have smaller group meetings to do something about getting some kind of law on the books. She does not believe that a change to the constitution is the right way to go. She stated we are not going to stop growth. It is the people that live here now that populate the County. It is unfortunate that the bill that CML and CCI worked to get past the legislation last year didn't happen. She believes that this is not something that they need to have in place and that they encourage support from the legislation in 2001. She stated she will never say no growth as there will be growth. She stated those coming in have to have a place to live. Not being a total proponent for unbridled growth, she believes they have to make a commitment to those who are living here. Chairman Stone stated they worked at trying to figure out what they can do to resolve the problems that will occur if this does pass. They feel as a Board that this is about as far as they can go without making changes in the Land Use Regulations which is an extensive process. He doesn't think any of them think this is the right solution to the problem. Proponents of this seem to have the theory, not letting the facts get in the way of a good story. He believes that there is great opposition brewing and mentioned Habitat for Humanity and the School Boards. He suggested it is way too extreme of a measure and especially so for a Constitutional Amendment. He spoke to Pitkin County placing an item 28 09-05-2000 on the ballot to exempt them for two years. He suggested it is interesting that Pitkin County is against this as well. He suggested the people for it must be from out of state. Commissioner Gallagher moved to approve Resolution 2000-128, approving Eagle County's interpretation for portions of the proposed Responsible Growth Initiative.
