Sara Fisher, Eagle County Clerk & Recorder, spoke to item C, stating the minutes for July 31 sl
need be tabled to next week
Bob Loeffler, Deputy County Attorney, spoke to item L and the fact the contract has not yet been
received by the Board. He stated they are waiting for it to arrive by Federal Express.
Commissioner Phillips spoke to item L and questioned the provider being from Denver and not
having local support. She also spoke to the amount being more than Century tel which is a local
company.
Rich Cunningham, Director of Facilities Management, stated they put out an RFB and received
proposals from GTE, Century tel and Share Technologies. He stated they did a comparison. He stated
based on past service with Century tel, they had some grave concerns. He stated GTE has agreed to drop
the trip charge after the first year. Depending on the number of hours of service, the service fee will
drop with the greater number of hours of service. He explained based on the interview, Century tel has
not provided the quality service they are looking for. GTE has committed to a two hour emergency
response time.
Commissioner Phillips spoke to the pass being closed and what would be the solution.
Mr. Cunningham stated Century tel will still provide service as requested even if GTE is
requested. They won't have the purchasing leverage. They felt the 99% ofthe time they feel they can
get better service from GTE. He stated part ofthe contract involves 24 hour monitoring so they will in
fact know before Facilities Management ifthere is a problem with the switch. He stated they should
know ahead of time and avoid the unplanned catastrophe.
Commissioner Phillips asked about the answering system and if answering devices will be
installed.
Mr. Cunningham stated it won't change how departments do business, but it will expand the

services available and expand the number of lines. It will also allow for upgrading the system both
within this building and to the outlying buildings. Then there will be extension dialing to all those
facilities. He stated they are proposing to go to four digit dialing, upgrading to new phone sets, call
accounting, code access for long distance dialing.
Commissioner Phillips moved to approve the consent calendar as presented, tabling the minutes
from July 31 st to August 14, 2000 and authorizing the Chairman to sign the contract for item L, once the
contract has been received.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
Plat & Resolution Signing
Matt Gennett, Planner, presented the following plats and resolutions for the Board's
consideration:

The intent of this Minor Type B Subdivision is to create Lots 40A and 40B, and a corresponding access

5-290 (G) (1) Standards for Type A and Type B Subdivision
(G) Standards. The Board of County Commissioners and the Community Development Director
shall consider the following in the review of a Type A Subdivision, a Type B Subdivision, and an
Amended Final Plat.
Standards for Type A and Type B Subdivision.
a) Access, potable water, and sewage disposal on the land to be subdivided are adequate;
b. The plat does conform to Final Plat requirements and other applicable regulations,
policies, standards, and guidelines; and
c. No Improvement Agreement is applicable.
Commissioner Gallagher moved to approve final plat file number 5MB-00229, Berry Creek
Ranch, Filing No.4, a resubdivision of Lot 40, Block 3, incorporating staff findings.

Resolution 2000-114. To Vacate A Public Utility Easement On Lots 9 & 10 In The

1041 Permit Completeness Hearing, Edwards Treatment Plant
Ross Easterling, Planner, presented the 1041 Permit completeness hearing for site selection and
construction of a major new water treatment system; major extensions of existing water systems and the
efficient utilization of municipal water projects, Edwards Treatment Plant. He stated the correct name
for this is the Edwards Drinking Water Facility. They have reviewed the application and found it to be
complete.
The action that will be requested from the Board on August 7, 2000, is to determine
completeness of a 1041 Permit application and to estimate associated processing fees.
The Upper Eagle Regional Water Authority has submitted a 1041 Permit application for the
construction of major new domestic water treatment system (Edwards Drinking Water Facility) and for a
major extension of the existing drinking water system to tie into the new system and, finally, for the
efficient utilization of municipal water systems. The expansion is to serve the area currently served by
the low zone pumps of the Avon Drinking Water Facility. The service area includes the Arrowhead,
Berry Creek, Edwards and Cordillera/Squaw Creek Metropolitan Districts.
Staffhas reviewed the above referenced application and has found it to be complete. We have
tentatively scheduled the hearings for the Planning Commission and Permit Authority on September 20,
2000 and October 2,2000, respectively. Estimated fees for the above referenced 1041 Permit
application are as follows:

Jim Elwood, Airport Manager, presented the next item on the agenda, approval ofthe PUD
improvements for the Colorado Army National Guard. He spoke ofthe work session with Colorado
National Guard and their desire to put in a new roof and build a picnic area. He stated this is the final
action for them to proceed with their improvements.
Commissioner Phillips moved to approve the plans for the improvements to the PUD for the
Colorado Army National Guard as stated by Mr. Elwood.

located along Highway 131 in Bond. There have been no complaints or
disturbances during the past year.

located at the Chateau on Scott Hill Road in Beaver Creek. There have

Beaver Creek Resort Company
Earlene Roach, Liquor Inspector, presented a Special Events Permit application for Beaver Creek
Resort Company for September 2 & 3, 2000, from 10:00 a.m. to 8:00 p.m. This application is in order
and all fees have been paid. She spoke of the map submitted. Staff is recommending approval.
Jean Dennison, applicant, was present for the hearing. She stated this is the third annual
Octoberfest Celebration. She stated they do anticipate having a number of food booths and a stage in the
center of the plaza. She stated the boundaries are less than they have been in the past.
Chairman Stone asked about the access points and questioned if they will having fencing in place
and security.
Ms. Dennison stated they will be working with Beaver Creek Security, with people at all entry
and exit points of the plaza with barriers to indicate the entrances and exits.

from 10:00 a.m. to 8:00 p.m. for Beaver Creek Resort Company.

Eagle Valley Chamber of Commerce
Earlene Roach stated the special events application for the Eagle Valley Chamber of Commerce
has been withdrawn.
Chairman Stone stated so noted for the record.

as the Board of County Commissioners.

Executive Session
Chairman Stone asked for a motion to adjourn into "Executive Session" to discuss airport

Board's agenda.

Abatement Hearings
Renee Black, Asst. County Attorney, stated the first the Ziets which are listed as item F have
asked to be heard first as they are from the Basalt area and have to get back. Also, items N, 0, and P
have been withdrawn for the Halsteads.
Chairman Stone stated those are schedule number R006489, R031780, and R031781.
Max Schlafley, Appraisal Coordinator, presented a petition for abatement for Robert & Theresa
Ziets, schedule number R046679. He stated this is a tax payer generated abatement request. The
Assessor recommends approval in part on the abatement. He stated the subject property is a mixed use
bed and breakfast property with residential living quarters located on the Frying Pan River in Basalt.
There is also an old log cabin and a garage located on the property. He stated the 1999 abatement
request is $717,780.00. The allocation of value for commercial is 52%, 48% for residential. The
petitioners are asking the Assessor's Office to look at the breakdown commercial versus residential. He
stated he reviewed the property and determined the log home had been classified as un-inhabitable in

previous years and determined in 1999 it was habitable. He stated they also reviewed the square footage
of the property. He stated they made the change on the total property taking it to 46% commercial and
54% for residential. The Assessor recommended an abatement in part for 1999 of an assessed value of
$17,550.00 leaving a balance of$124,840.00. The tax amount abated would be $1,128.50 leaving a
balance of $8,027.46.
Commissioner Phillips asked if the petitioner agrees to the partial abatement.
Theresa Ziets, owner of the Shanendowa Bed and Breakfast stated the log cabin was
uninhabitable until 1996 and that is why it didn't show up on the records as such.
Commissioner Phillips moved to approve the recommended partial abatement for schedule
number R046679, in the amount of$I,128.50, for a balance tax amount of $8,027.46, for Robert &
Theresa Ziets, as recommended by the Assessor.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
Max Schlafley presented a petition for abatement for Carolyn Bernhardt, 3 Birds Nest LLC,
schedule number 049226. The Assessor recommended an approval in part. He stated there were
comparable sales in Red Canyon and one in Overlook. The Assessor recommended an abatement in the
amount of$28,160.00 for a balance of$96, 080.00. The tax amount was $6,355.62 and the abatement
amount is $1,440.55, for a balance of$4,915.07.
Commissioner Gallagher asked about the procedure and the comparison to property value in Red
Canyon.
Mr. Schlafley stated they compare to vacant land in comparable locations. He stated they also
used a vacant lot in the Terrace.
Chairman Stone asked about the assessed value and asked if it is 29%.
Commissioner Phillips asked about the selling price.
Mr. Schlafley stated it was outside of the time frame and it has subsequently been divided to
multi-family.
Commissioner Gallagher moved to approve a partial abatement for scheduled number 049226,
Carolyn Bernhardt, 3 Birds Nest LLC, abating $28,160.00 from the assessed value leaving an assessed
value of $96,080.00 and abating $1,440.55 leaving a balance tax amount of$4,915.07.
Commissioner Phillips seconded the motion. The vote was declared unanimous.
Max Schlafley presented a petition for abatement for Booth Falls HOA, schedule number
R008094. He stated this is the tennis courts for Vail Village Filing #12 Booth Falls area. This parcel
has previously been considered Homeowner Association property and has not been taxed. In the
conversion process to the new computer system, the extra feature codes responded differently in the new
system and got taxed. The original assessed value of $27,120.00 will be changed to zero value. The tax
amount of $1,174.48 will be abated.
Commissioner Gallagher asked if all property owned by the Homeowners Association is
considered tax exempt.
Renee Black stated the thinking is the value of the common property is part of the value of each
of the units and that is where the value shows up.
Commissioner Phillips moved to approve an abatement for schedule number R008094, Booth
Falls Homeowners Association, with the tax amount being $1,174.48 abating the entire amount, leaving
a zero balance, as recommended by the Assessor due to an administrative error.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
Max Schlafley presented a petition for abatement for Edward & Evelyn Lang, schedule number

R041933. This parcel has an upward adjustment on the improvement of 45% in error. It is the only
improvement with an adjustment in Cordillera Filing 14, also known as Club Cottages. Removing the
adjustment equalizes the value with other parcels in Club Cottages. Pursuant to CRS 39-10-114, this
abatement should be granted for overvaluation. The Assessor recommended an abatement from the
original value of $92,760.00 assessed value and abating $25,970.00 with a balance of $66,790.00
assessed value, taking the tax amount from $6,921.10 to $4,983.40 and refunding $1,937.70.
Commissioner Gallagher asked what the percentage is for residential property.
Mr. Schlafley responded 9.74%.
Commissioner Gallagher moved to approve and abatement for schedule number R041933,
Edward & Evelyn Lang, abating $25,970.00 assessed value, leaving a balance of $66,790.00 and abating
$1,937.70 tax amount, leaving a tax amount of $4,983.40, as recommended by the Assessor.
Commissioner Phillips seconded the motion. The vote was declared unanimous.
Max Schlafley presented a petition for abatement for Dennis E. Cooper and Russell V.
Umphenour, schedule number R018004. He stated the subject property is a condo located in the
Village Hall Condominium complex at Beaver Creek. The value of the subject was adjusted for 1998
and 1999 due to an error in the Assessors calculated square footage. Pursuant to CRS 39-10-114 the
1998 and 1999 assessment is illegal and erroneous due to this clerical error and should be abated. It is
noted that this property was appealed in 1999. However, that appeal was based on valuation and was
denied. This abatement is based entirely on a clerical error in the County records and therefore should
be approved. The Assessor recommended an abatement assessed value of $32,220.00 with a balance of
$89,270.00 with an original tax amount of$10,271.98 refunding $2,724.20 leaving a balance of
$7,540.78 for 1998. For 1999 the assessed value was $215,060.00 with an abated amount of$58,960.00,
leaving a balance of$156,100.00 assessed value, and the tax amount was $15,969.72, with an abatement
of$4,378.20 leaving a balance tax amount of$II,591.52.
Chairman Stone asked how they confirm the square footage amount.
Mr. Schlafley stated they refer to the original plat as the document of record.
Chairman Stone spoke to the taxpayer statement that the square footage on the original plat was
incorrect.
Commissioner Phillips asked if they went out and inspected the property.
Mr. Schlafley stated they did do an on site inspection. He suggested they typically take the
square footage from the original plat. He stated the main floor area was inadvertently doubled.
Commissioner Phillips moved to approve an abatement with a balance of$7,540.78 with a
refund of $2,724.20 for 1998 and a balance of$II,591.52, with a refund of$4,378.20 for 1999 for
schedule number R018004, Dennis E. Cooper and Russell V. Umphenour, due to a clerical error as
recommended by the Assessor.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
Max Schlafley presented a petition for abatement for Fritz Schmidt, Edwards Plaza II LLC,
schedule R048538. He stated the subject property is located in the Edwards Commercial area and has
good access to traffic flow. A special notice of valuation was sent out on February 7, 2000 adding the
building for 1999 at 100% complete. It was constructed during 1998 and the core and shell were
completed by January 1, 1999. However, there were no tenants to the building until mid to late April
1999, when the bank opened. The second tenant was the Asia Restaurant which opened in May 1999. It
should be noted that an appeal was filed May 19, 1999 on land only because the Assessor's office had
not added the improvement yet. Therefore it is the recommendation of the Assessor's office that the
assessed valuation be reduced from the original amount of$883,720.00 by $263,880.00 assessed value
for a balance of$619,840.00, with an original tax amount of$34,989.l6 with a refund of $8,660.22 for a

balance of $26,328.94 for 1999.
Chairman Stone asked if they went out and inspected the building.
Mr. Schlafley responded they did and the petitioner had taken 60% of the total value and they
cannot take partial values on land.
Commissioner Gallagher moved to approve and abatement for schedule number R048538. Fritz
Schmidt, Edwards Plaza II LLC, in the amount of $8,660.22 , as recommended by the Assessor.
Commissioner Phillips seconded the motion. The vote was declared unanimous.
Max Schlafley presented a petition for abatement for Fred & Leslye Sugar, schedule number
RO 1813 7. He stated the value assigned to the subject is proper based on the sales of similar property in
the subject neighborhood. The subject is a single family home located in Arrowhead. The value
assigned to the subject is $2,053,520 which is based on 7,127 effective square feet at $288.13 per square
foot. A review of the sales of comparable properties in the subject neighborhood found the range of
square footage prices were $273.00 to $351.00 per square foot, for a medium value of $289.00 per
square foot. The Assessor recommended the abatement be denied. The original assessed value be
confirmed at $200,010.00 with a tax amount of$13,878.90.
Chairman Stone asked when they make the assertion that the valuation increased 33%, if the
property would have been appraised each year.
Mr. Schlafley stated it is a two year cycle.
Commissioner Phillips moved to deny the abatement request for schedule number RO 1813 7, Fred
& Leslye Sugar, as recommended by the Assessor.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
Max Schlafley presented a petition for abatement for Linda Ann & Sammy J. Cathey, schedule
number R044650. The subject is a single family home (townhome) located in Wildridge. The value
assigned to the subject is $288,780 based on 2,080 effective square feet at $138.84 per square foot. A
review of sales of comparable properties in the subject neighborhood was made to verify the value
assigned to the subject. The range in value of the comparable properties is $122.74 to $141.12 per
square foot, with a medium value of#138.86 per square foot. The Assessor recommended denial.
Chairman Stone stated these people are experiencing what many are in the value of their real
estate going up. He reminded the property owner it is not the County that sets the value but the market.
Commissioner Gallagher moved to deny the abatement for schedule number R044650, Linda
Ann & Sammy 1. Cathey, as recommended by the Assessor, leaving the assessed value and tax amount
the same.
Commissioner Phillips seconded the motion. The vote was declared unanimous.
Max Schlafley presented a petitions for abatement for Isidoro & Frances Quintana, schedule
numbers 006000. This parcel of land is encroached by mobile homes from parcel 2103-03-010. The
parcel has been changed from vacant residential land to manufactured housing land for 2000, changing
from vacant land to improved land. The Assessor recommended a partial abatement. The original
assessed value was $43,040.00 and the abatement is $28,590.00, with a balance of$14,450.00 assessed
value, and tax amount was $2,455.70, abating $1,631.24, leaving a balance of $824.46.
Chairman Stone asked if encroached means there are mobile homes partially on one piece of
property and part on another.
Mr. Schlafley stated all the mobile homes are listed on one parcel though they do encroach on to
the vacant lot. It changes the percentage from the vacant rate to the mobile home.
Commissioner Gallagher suggested this is an appeal on lot 10 but the encroachment is from lot
10.

Mr. Schlafley stated lot 10 is a separate parcel. This is on is on 2103-351-03-010. That was not
appealed.
Mr. Quintana stated it is three lots with the mobile homes on two of the lots. He stated the
driveway is on the third lot.
Jody Caruthers, Eagle County Assessor, stated the other parcel that was mentioned was not part
of the abatement. That is where the mobile homes are mostly sitting. He is asking for the residential
rate on part of the lot.
Mr. Schlafley stated the mobile homes do encroach on this. He stated you have to drive across
the neighboring parcels to get to the other lots.
Ms. Black asked if in summary they are considering this parcel residential use.
Chairman Stone stated residential is only 9.74% and vacant is valued at 29%.
Mr. Quintana stated at one time it was all together.
Commissioner Phillips moved to approve the abatement for schedule number 006000, Isidoro &
Frances Quintana, as recommended by the Assessor in the original tax amount of$2,455.70, abated
amount of $1,631.24, with a remaining balance of $824.46.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
Max Schlafley stated the denial on R004550 is a property located in Minturn and based on
comparable sales in neighborhood it is valued at $326,000.00. The subject is an 832 effective square
foot house with a value of $225,250.00 thus an effective price per square foot of $270.73. This is in line
with the rest of the neighborhood.
Commissioner Gallagher asked what parcel this is.
Mr. Quintana stated he didn't realize this was part ofthe abatement.
Mr. Schlafley stated this is located about 1/4 of a mile down the road from the above property.
Mr. Quintana asked if this is 907 Main Street.
Mr. Schlafley stated this is 24 Main Street, South Minturn Addition, Lot 42, and is back toward
town beyond the mobile homes.
Commissioner Gallagher moved to deny an abatement for schedule numbers R004550, Isidoro &
Frances Quintana, as recommended by the Assessor.
Commissioner Phillips seconded the motion. The vote was declared unanimous.
Mr. Schlafley stated the next abatement is for schedule number 005090, a parcel of land which is
also encroached by mobile homes from parcel 2103-351-010. The parcel has been changed from vacant
residential land to manufactured housing land for 2000. The mill rate was also incorrect and has been
corrected on this abatement for 1999. The correct mill rate is also in CAMA. He stated the original
assessed value was $43,410.00 with an abatement of$28,830.00 with a balance of$14,580.00. The
original tax amount was $2,476.80, with an abatement of $1,644.92, leaving a balance of$831.88 for
1999.
Chairman Stone asked if this is similar to the file heard previously.
Commissioner Gallagher stated he is confused by this as the claim is the trailers on lot 10 are on
lot 10.
Mr. Schlafley stated there are nine mobile homes.
Mr. Quintana stated when he bought the land it was 50 foot parcels. He stated on the first parcel
is mobile homes, the second is the driveway and the third is more mobile homes.
Mr. Schlafley stated another word is contiguous.
Ms. Caruthers stated the problem here is the legal description should read part of lot 10. She
explained if a part of the property is used as residential it can be given the lower valuation.
Commissioner Phillips moved to approve an abatement for schedule numbers 005090, Isidoro &
Frances Quintana, as recommended by the Assessor in the amount of $1 ,644.92, with a remaining
balance of $831.88.

Max Schlafley presented petitions for abatement for John S. Gentle, Union Pacific Railroad,
schedule numbers C805901, C970075, C970070, C805917, C805915, C805903 and C805904. He
stated the Division of Property Taxation has reviewed this abatement request and recommended
approval in part. The real property portion can be prorated and abated according to CRS 39-3-130(1)
which states in part "Whenever any previously taxable real property becomes legally exempt, the person
conveying such property shall be relieved from all further tax obligations with respect to such property
on the date the title in conveyed...". The subject property was purchased by the Roaring Fork Railroad
Holding Authority on June 30, 1997. He stated the petition is stating the refund due is $1,997.78, the
taxes they paid were $2,331.96, for a total of $5,355.67. Apparently there were refunds from the
Treasurer's Office for 1997. The State has indicated the abated amount for 1997, as per the State, is
$3,905.93 from a total of$5,355.67.
Commissioner Phillips moved to approve an abatement for schedule numbers C805901,
C970075, C970070, C805917, C805915, C805903 and C805904, John S. Gentle, Union Pacific
Railroad, as recommended by the Assessor in the amount of $3,905.92, a refund of $869.29 and $580.45
for the entities mentioned in the schedule numbers.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
Ms. Caruthers clarified that part of that was for personal property.
Max Schlafley presented a petition for abatement for TCI, schedule number P024839+24.
Marty McGinnis, Assessor's Office, stated there are in fact ten schedule numbers, P024 747,
P024838,P024840,P024843,P024844,P024845,P024846,P024847, P024842,P024839.
Mr. Schlafley stated the subject properties are comprised of 25 separate schedules each
containing numerous electronic equipment sites in Eagle County. The petitioner states that according to
CRS 39-3-199.5 that each ofthese equipment sites should be considered individually and valued
separately. Valuation of each site individually would cause all of theses properties to be exempt, as the
individual values fall below the $2500 valuation threshold for personal property. According to a recent
Colorado Court of Appeals decision in Montezuma County vs TCI Satellite, the Court found in favor of
the County's argument and related they have to be taxed as per the assets.
Commissioner Gallagher asked if they were to file them separately, would they be tax exempt.
Ms. McGinnis stated they can be listed separately but only if they differ by tax area code.
Commissioner Gallagher moved to deny an abatement for schedule numbers P024747, P024838,
P024840, P024843, P024844, P024845, P024846, P024847, P024842 and P024839, TCI, as
recommended by the Assessor.
Commissioner Phillips seconded the motion. The vote was declared unanimous.
There being no further business to be brought before the Board the meeting was adjourned until
August 14,2000.
