Chairman Stone stated the next item before the Board was the consent agenda as follows:

Commissioner Gallagher stated on item C, the Board minutes, he has a couple of corrections. On
page 8, middle of the page, it refers to "Chairman Phillips" and it should be "Commissioner Phillips",
and "over whelming" is one word.
Commissioner Phillips stated on page 1, it says "Chairman Stone read Resolution 2000- ???",
insert the number of the resolution, and it says "Beaver Creek Rimes" and it should be "Beaver Creek
Times". In the portion concerning Blue Ridge, starting on page 4, referring to staffs findings, she
believes some of those should be changed from has not to has. She stated some of those were done
before the variance being approved.
Commissioner Gallagher stated the presentation on page 4 is staffs report and not the Board's
action.
Commissioner Phillips stated she realizes that but the minutes are the record of the Board and
she believes it should read as later agreed to.
Chairman Stone stated it continues through page 14.
Commissioner Phillips stated on page 16, second paragraph, it states "Mr. Vengrin stated ther
and it should be there". Also on page 18, it states "Commissioner Gallagher moved to adjourn and it
should read Commissioner Phillips moved". On the second motion it should be "Commissioner
Gallagher moved rather than Commissioner Phillips".
Bob Loeffler, Deputy County Attorney, stated since the Board has questions on the Blue Ridge
matter, maybe the minutes should be brought back after they are corrected and reviewed again by the
Board.
Chairman Stone stated the minutes do not find as the Board did.
The Board concurred to pull the minutes.
Jack Ingstad, County Administrator, stated on item J, staff is asking the Board approve the
Intergovernmental Agreement with the Town of Vail as is. Those items not included in the agreement
will be worked out at a later date. He stated this matter is time sensitive.
Chairman Stone asked about resolution of those issues.
George Roussos, Asst. County Administrator, stated there is a meeting with the Town's Attorney
on Thursday this week.
Mr. Loeffler stated on item F, they are requesting the Board's signature. He stated the SIA for
Cordillera was approved a month ago. Cordillera is selling a block of property to Centex Homes, who
will be taking over the responsibility of the SIA. He has no concerns with this contract.
Commissioner Gallagher moved to approve the consent calendar as presented pulling item C, the
Commissioner minutes.
Commissioner Phillips seconded the motion. The vote was declared unanimous.

Plat & Resolution Signing
Matthew Gennett presented the following plats and resolutions for the Board's consideration:
Resolution 2000-076. To Deny An Appeal Made By Jerry D. Nelson And Sharla R.
Nelson Of A Staff Decision That An Amended Final Plat Cannot Be Used To Alter Lot Lines
Between Two Subdivision Exemption Parcels. Pursuant to File Numbers SE-284-92 and SE-285-92,
Jerry D. Nelson and Sharla D. Nelson (Applicant) were granted Exemptions from Subdivision
Regulations for two contiguous parcels ofland. On or about February 22, 1999, Applicant submitted (to
the Eagle County Department of Community Development) an application for an Amended Final Plat to
change the lot line between these two Subdivision Exemptions. The Community Development Director
determined, based on the Eagle County Land Use Regulations, that since no Final Plat for Subdivision
Exists, one cannot be amended.
Commissioner Phillips moved to approve Resolution 2000-076, to deny an appeal made by Jerry
D & Sharla R Nelson of a staff decision than an amended final plat cannot be used to alter lot lines
between two subdivision exemption parcels.
Commissioner Gallagher seconded the motion. The vote was declared unanimous.
ASD-00006, Lake Creek Meadows Subdivision
Joe Forinash, Planner, presented file n ASD-00006, Lake Creek Meadows Subdivision, Block 2,
Lot 5. He stated the Lake Creek Meadows Subdivision was approved by the Board of County
Commissioners in 1974. In about 1977, the existing residence on this site was built. Mr. Bonidy
maintains that a portion of the house (or the deck) was built within 30 feet of the high water mark,
although, based on the site plan provided by Mr. Bonidy, the residence itself (exclusive of decks)
appears to be approximately 40 feet from the high water mark. The subdivision regulations in effect at
the time required a 30 foot live stream setback.
In September 1999, Mr. Bonidy had a conversation with George Roussos, Eagle County
Engineer, regarding an addition/renovation of the residence on this site. Mr. Bonidy understood from
that conversation that, because of a drainage easement which exists in the vicinity of East Lake Creek in
this area, the current live stream setback of 50 feet would not be applicable. Mr. Bonidy faxed his
understanding ofthat conversation to Mr. Roussos. Although Mr. Roussos' understanding of the
requirement regarding the setback is not consistent with that ofMr. Bonidy, and Mr. Roussos does not
recall any statement which would have given an incorrect impression in this regard, Mr. Roussos was not
aware of Mr. Bonidy's misunderstanding and did not either confirm nor correct Mr. Bonidy's facsimile
communication.
Earlier this year, Mr. Bonidy inquired about amending the drainage easement in this area based
on an updated calculation of the 100 year flood plain. At that time, he was also referred to a planner in
the Community Development Department. After several internal discussions, including a referral to the
staff Development Review Team, Mr. Bonidy was advised that there is no provision in the Land Use
Regulations which waives the minimum stream setback if a drainage easement exists in the same
vicinity.
Mr. Forinash stated there appears to be three bases for this appeal as follows:
The first basis for this appeal is that the current owner of the parcel relied on an understanding of
the Land Use Regulations which Mr. Bonidy believed to be correct based on discussions with a

representative of Eagle County.
Response: Notwithstanding Mr. Bonidy's facsimile communication in which he attempted to
confirm his understanding, no representative of Eagle County recalls saying or knowingly giving Mr.
Bonidy the impression that the 50 foot live stream setback would not be applicable in this instance.
The second basis for this appeal is that existing improvements caused Mr. Bonidy to believe that
the live stream setback was not applicable.
Response: Unfortunately, non-conforming conditions do exist throughout the County. Their
existence cannot be taken to represent what is required by the Land Use Regulations.
The third basis is that it "made absolutely no sense that the county went through the procedure of
platting a 'drainage' only easement if a more restrictive condition existed."
Response: The rationale for what is incorporated on a final plat may not always be readily
apparent. Nonetheless, the requirements of a plat are binding, as are the requirements of the Land Use
Regulations.
With respect to all three bases cited by Mr. Bonidy, the burden for affirmatively determining all
applicable provisions of the Land Use Regulations falls on the owner of a property, and/or his or her
representatives. It is advisable that any understood representations by staff should be confirmed by
specific reference to the Land Use Regulations.
He stated the Board has a letter dated May 8, 2000, from TAB Associates, Inc., regarding "Lake
Creek Meadows Subdivision - Block 2, Lot 5, Appeal of Staff Decisions/Interpretations", with several
attachments.
Mr. Forinash stated staff recommended denial of this request.
Chairman Stone asked if this was a proposed project that has never happened or if there are
buildings there.
Mr. Forinash stated there is a building on site which is planned for a substantial expansion which
would move the building closer to the stream and into the live stream setback.
Tap Bonidy, Tap Architects, was present for the hearing. He stated Jerry Spector, current owner
of the property, had a contract to purchase the property in September of 1999 and wanted to add on to
the house. He hired Tap Architects. There is a barn and a horse stable located on this property. The
original building was built in 1976 or 1977. When they came to the County to obtain a copy of the plat
there was only a drainage easement shown on the plat. He stated they contacted Eagle Valley Surveying
to assure it was only a drainage easement and not utilities. He stated the only purpose for this easement
was drainage. He stated they were concerned with the 100 year flood plain which did not exist at that
time. He stated he met with George Roussos, County Engineer, who got them the FEMA maps and
explained how those worked. He stated they were confused as the house was built in the 50 foot live
stream set back. He presented a map and explained the pink line is the current 50 foot live stream
setback, the blue line is the 30 foot stream setback, which is what was in existence when the house was
built. The yellow line is the drainage easement and the green line is the high water line. He stated the
existing house corner touches the drainage easement and is well within the 30 foot live stream setback.
The ILC shows the house and deck were actually built outside the drainage easement. No expansions
would be possible in this area.
Commissioner Phillips stated the house does not interfere with the drainage easement.
Mr. Bonidy replied that was correct.
Chairman Stone asked if the map Mr. Bonidy was showing the Board indicates that is how the
house and deck are today.
Mr. Bonidy stated the deck was added onto later and steps down into the drainage easement. The
ILC is for when the house was built. Everything is in its current condition but there is an additional deck
that is in the drainage easement. He stated they were hired to find out where the current owner can add
on to this house.
Chairman Stone asked what the Land Use Regulations say about building in a drainage easement.

Keith Montag, Director of Community Development, stated the Land Use Regulations refer to a
50 foot setback based on Article III, which is the same for all standard zone districts. The foot note
reads "a fifty foot strip of land or the 100 year flood plain, whichever is the greater distance, measured
horizontally from the high water mark on either side of such live stream, shall be protected in its natural
state, with the exception of foot paths, bridges, fences, irrigation structures, flood control and erosion
protection devices, may be constructed thereon. If necessary to protect the stream, additional width may
be required".
Mr. Loeffler pointed out 50 feet was put in place in 1999 and it was 30 feet when the house was
built.
Chairman Stone stated the Land Use Regulations are pretty clear it is 50 feet from the high water
mark. He questioned if the map submitted by the applicant adequately reflect the lines.
Mr. Montag stated if the map shows the 50 feet from the high water mark, then it is indeed
correct.
Commissioner Gallagher asked Mr. Montag to read the section from the Land Use Regulations
agam.
Mr. Montag re-read from the Land Use Regulations.
Commissioner Gallagher asked if that is the annual high water mark.
Mr. Montag stated the Land Use Regulations refers to a 10 year high water.
Commissioner Gallagher stated 50 feet from 10 year high water, if that is inside, closer to the
stream, they can only come as close as the 100 year flood plain. He questioned what body of water the
applicant is speaking of.
Mr. Bonidy stated it is Lake Creek. He stated they did not understand what the drainage
easement was for. He stated the drainage easement is inside the 30 foot setback and it is way inside the
50 foot setback.
Chairman Stone questioned what the drainage easement has to do with this application.
Mr. Bonidy stated they did not understand what the drainage easement line was. The drainage
easement line is inside the 30 foot high water setback and way inside the 50 foot setback. Here the
house is built and all construction is kept outside the drainage easement. The construction is within the
30 foot high water setback, which was in place at the time. They spoke to the County and found out
there was no 100 year flood plain. They then ask about the line they could build to. Mr. Roussos related
the drainage easement was platted to be the line. It made all the sense in the world. He stated they did a
telephone letter and mailed it off. He stated the owner wanted to know where the 100 year flood plain
was so he hired an engineer and found out it was less restrictive. He stated the owner wanted to adjust
the drainage easement line. He stated they are here because they believe the owner has suffered a severe
hardship because of all of the finances that have been expended. They believe the owner bought the
property, performed all the studies, and cannot live in the house because it is in the 50 foot setback.
Chairman Stone stated he can live in the house but cannot build on to the house in that area. He
asked if there was anything in the Land Use Regulations that would allow for hardships.
Mr. Loeffler stated what should have been done is to apply to the Zoning Board for a variance,
who would then consider the hardship clause.
Mr. Forinash stated that is an option for the applicant.
Mr. Bonidy stated they were told it would be futile.
Mr. Loeffler stated he believes that would be the proper procedure to consider the hardships in
this instance.
Chairman Stone referred to a resolution earlier in the day when the Board had to deny an appeal
of a staff decision as they must stick to the Regulations. He agreed the applicant should apply to the
Zoning Board. The Commissioners do not have the ability to ignore the Land Use Regulations. He
stated they are pretty clear.
Mr. Bonidy stated in their last meeting with Mr. Montag he suggested they should come to the

Board meeting.
Mr. Montag stated one of the options was to appeal a staff decision. He stated they also spoke to
the zoning process which was the establishment of a hardship.
Chairman Stone stated they have had two appeals of staff decision in two or three weeks. Maybe
the applicants should be educated as to the process.
Mr. Loeffler stated while he believes the Zoning Board of Adjustment is the proper procedure
and is the correct process, maybe the best place to start was with the Board as there is a time frame with
appeals and that is not true with an application for a zoning variance. Had the applicant applied with the
Zoning Board of Adjustment, he would have lost the right for an appeal before this Board.
Commissioner Gallagher questioned if the purpose of the appeal is to add onto the house.
Mr. Bonidy stated that was correct.
Commissioner Gallagher stated he does not believe the drainage easement effects this request at
all.
Mr. Bonidy stated the drainage easement was put on the plat at the time to do exactly the same
thing.
Chairman Stone stated when there is a conflict between two, the Land Use Regulations take over.
Mr. Bonidy stated they agree but they were told they could build to the easement line.
Chairman Stone asked if Mr. Roussos would like to speak.
Mr. Roussos answered no.
Mr. Loeffler stated the County does not get involved in private covenants. He stated the County
does not govern setbacks, zoning, etc.
Commissioner Phillips asked how this application could work.
Mr. Montag stated the easiest choice is to relocate the addition. The second option would be to
go through and attempt to obtain a variance from the Zoning Board of Adjustment.
Chairman Stone stated with it being an option what is the chance of this applicant being granted
a hardship variance.
Mr. Montag stated establishing a hardship would be difficult. He stated staff would not be able
to support an application for variance and would recommend denial.
Commissioner Phillips stated the house was built during time of the 30 foot setback. She stated
now they are at a 50 foot setback. She stated she has a problem with using different rules than when the
house was built.
Mr. Montag stated the house is legal but is non conforming to the current Land Use Regulations.
He stated what they are facing is the expansion of a non conforming use.
Mr. Loeffler stated they could expand the house in a different area back away from the set back.
Commissioner Gallagher moved the Board deny file number ASD-00006, Lake Creek Meadows
Subdivision, Block 2, Lot 5, incorporating staff findings.
Commissioner Phillips seconded the motion. The vote was declared unanimous.
George Roberts, RR Contracting, stated the next step is to appeal to the Zoning Variance
Committee. He stated PUD's did not exist at the time of this subdivision process. He stated it appears
the 30 foot set back was established but was ignored and the drainage easement was used instead. He
stated they were the first ones to ever survey that high water mark. He related the only reason they are
here is due to the information they submitted.
Mr. Loeffler stated the only thing the Board could say is this is not a PUD. Easements on plats
are as common as dirt and ordinarily have nothing to do with setbacks. It is difficult to look back at a
subdivision plat and wonder what they were thinking back then. If a building were built in violation of
the regulations, one could not be too surprised they do exist and are marked wrong. A deduction cannot
be made where the house exists relative to the regulations. If it does not appear to be in the right place it
could be nonconforming. He stated it is helpful the applicant found the 100 year flood plain but the
setback has always been from the high water mark.

Mr. Bonidy stated he is confused why it mentions platted drainage easements in the Regulations.
The plat was adopted by Eagle County and had an established easement shown.
There being no further business to be brought before the Board the meeting was adjourned until
June 19,2000.
