This being a scheduled Public Hearing the following items were presented to the Board of
County Commissioners for their consideration:
Consent Calendar
Chairman Phillips stated the first item on the agenda was the consent calendar as follows:
A) Approval of bill paying for week of March 8, 1999, subject to review by County
Administrator
B) Approval of payroll for March 11, 1999, subject to review by County Administrator
C) Approval of the minutes of the Board of County Commissioners meeting of February
16, 1999
D) Resolution 99-028, designating the Child Protection Team as the Juvenile
Community Review Board
E) Agreement between Eagle County and Allwest Systems, Inc. for Allwest to design and
install new control panels within the Court Facilities
F) Resolution 99-029, transferring and distributing revenues from the County Forest
Reserve Fund, Fiscal Year 1998
G) Resolution 99-030 and Power of Attorney conferring authority on Attorney's Office
to draw on Letter of Credit No. 45 in the amount of$95,997.20 for Eby Creek Mesa Limited
Partnership, (Phase I) to expire 3-11-99
H) Tower Agreement between Eagle County and Colorado RSA #3 Limited Partnership,
dba/Air Touch Cellular.
Commissioner Johnson stated he would like to discuss item E. And regarding item F, he knew
that they were going to set up a work session.
Jim Hartmann, County Administrator, recalled they were going to schedule that discussion for
item F as part of the budget process.
Chairman Phillips suggested this is current revenues.
Commissioner Johnson stated they agreed that they would have the work session and invite the
School District to attend as well.
Commissioner Johnson spoke to E and page 2 where it discusses the non-responsibility for
consequential damages.
Renee Black, Asst. County Attorney, stated it is a pretty standard clause and they are protecting
themselves from liability.
Commissioner Stone asked if they would typically put this out for bid.
Paul Gregg, Facilities Management, explained that All West works with many facilities within
the department of corrections. It was not a bid operation and more proprietary.
Commissioner Johnson asked if a judge presses a panic button and gets electrocuted, is that a
consequential damage.
Ms. Black explained.
Commissioner Phillips asked if the other members had any concerns with the minutes as she was
not present on the 16th.
Commissioner Stone moved to approve the consent calendar as presented.
Commissioner Johnson seconded the motion. The vote was declared unanimous.

Plat & Resolution Signing
Scot Hunn, Planner, presented the following plat and resolutions for the Board's consideration:
5MB-00161. Bachelor Gulch Village, Filing No.3 - Tracts. He stated this was a Minor
"Type B" Subdivision, a resubdivision of Tract T, Bachelor Gulch Village, Filing No.3, to create three
(3) tracts, Tract T-1, T-2 and T-3. This plat also will vacate and create certain ski-way, utility and access
easements.
Commissioner Johnson moved to approve final plat file number 5MB-00161, Bachelor Gulch
Village, Filing No.3 -Tracts, incorporating staff findings.
Commissioner Stone seconded the motion. The vote was declared unanimous.
5MB-00163. Lot 42, Berry Creek Ranch. Filing No.4. He stated this was a Minor
"Type B" Subdivision, a resubdivision of Lot 42 to create two (2) residential lots, Lot 42 A and Lot 42
B, along with a Common Parcel, Lot 42 C. This plat does contain a duplex split caveat stating that only
one two-family residence may be built on the combined area of the two lots.
Commissioner Stone moved to approve final plat file number 5MB-00163, Lot 42, Berry Creek
Ranch, Filing No.4, incorporating staff findings.
Commissioner Johnson seconded the motion. The vote was declared unanimous.

Amended Final Plat to amend the building envelope for Lot 4, Cordillera Subdivision, Filing 32. The
building envelope is being moved further away from the front property line to allow for better design of
access to the lot. This Amended Final Plat is being sought pursuant to the Cordillera Subdivision,
Fourth Amended and Restated Planned Unit Development Control Document, Section 1.05.3: Building
Envelope Adjustments, which allows for the administrative adjustment in location of building envelopes
if approved by the Eagle County Director of Community Development. Upon approval by the Director,
the Director may request that the Chairman of the Board of County Commissioners sign the plat.
Commissioner Johnson moved to approve final plat file number AFP-00058, Lot 4, Cordillera
Subdivision, Filing No. 32, incorporating staff findings.
Commissioner Stone seconded the motion. The vote was declared unanimous.
Resolution 99-031, RE50J School District
Jim Hartmann presented Resolution 99-031, approving an Intergovernmental Agreement
between Eagle County Recreation Authority and RE50J School District. He explained the agreement to
the Board and recommended the Board approve the resolution. He stated they had a work session at
which time the Board voiced a few concerns as did the County Attorney regarding the TABOR
agreement. The resolution allows the other requirements to be added to the IGA.
Commissioner Johnson suggested it would be helpful to convene a meeting with all parties
including the recreation authority. He suggested it is very helpful in seeing where everyone is.
Mr. Hartmann stated he can bring that up to the Recreation Board, and with the adoption of the
IGA it would be very helpful.
Commissioner Stone asked if anyone else has signed this.
Mr. Hartmann reviewed the participation ofthe various entities.
Commissioner Stone stated he wants to make sure they are approving what is the final document.
He asked if this same document is that being presented to Avon and Vail.
Mr. Hartmann explained there have been enhancements suggested by Eagle County as well as the

equestrian segment. This may have to go back to member jurisdictions. He thinks approving it in this
form at this time is appropriate, but it will undoubtedly be amended. He stated an agreement such as this
is a little cumbersome. The basic components will remain consistent, but there will probably be
amendments.
Commissioner Stone questions if they sign it they are accepting the terms.
Ms. Black stated an IGA that is subject to change, when it is all over and the changes have been
made, they will have signed and agree only to the items contained.
Commissioner Johnson stated they are approving the resolution that states the IGA will be
coming back to them for signature.
Commissioner Johnson moved to approve Resolution 99-031, approving a proposed
Intergovernmental Agreement between Eagle County Recreation Authority and RE50J School District
incorporating the conditions included therein.
Commissioner Stone seconded the motion. The vote was declared unanimous.
Resolution 99-032, Civil Rights Officer
Renee Black presented Resolution 99-032, appointment ofthe Eagle County Civil Rights Office.
The appointment is for Carla Budd.
Commissioner Johnson questioned whether this is an annual appointment or until they appoint
another officer.
Ms. Black stated it is done yearly.
Commissioner Johnson stated it would then be for one year or less.
Commissioner Stone moved to approve Resolution 99-032, appointment of the Eagle County
Civil Rights Officer.
Commissioner Johnson seconded the motion. The vote was declared unanimous.
PDS-00014, Deer Park PUD
Scot Hunn presented file number PDS-00014, Deer Park PUD. He stated this was a request to
create a PUD to include 106 dwelling units on 8.816 acres located just west ofthe Eagle River Mobil
Home Park in Edwards on US Highway 6. The proposed PUD is located within the Community Center
future land use designation and will allow for the creation of one hundred and six town home units,
along with common areas to be used in part as open space. Approximately 1.8 acres ofthis common
area will be devoted as "open-air" open space and will include two "tot-lots" and a community garden
area. The internal circulation includes privately maintained roads and an internal pathway system for
pedestrian circulation.
Mr. Hunn referred to the issues of concern. He stated there was discussion regarding density.
On page 8 of 17 he spoke to the roadway standards. He stated this issue came up regarding
consolidating the access points. He stated they have been working with the applicant on that. On page 9
of 17,4-650 the applicant has worked with them regarding the site plan. The sketch plan shows a
proposed trail link on the north end ofthe property. It also shows that trail running across easements and
the railroad right-of-way. Their concern is that it should all fit. On page 10 of 17 and the gated entry,
staff has some concerns. There are certain Planning Commission members that have a concern. He
understands that the applicant intends to take it out of the project. Findings on page 11 of 17 are
pursuant to the Eagle County Land Use Regulations. He spoke to item 12 and the effort made by the
applicant to bring the minimum area of open space to 20%. On page 14 of 17 , the Planning
Commission deliberation, there was discussion regarding the cost versus the number of units. There was
a difference in opinion regarding 12 acres per unit versus 10. Mr. Hunn reviewed their concerns as

noted in staff s report. Staff recommended approval with conditions. Mr. Hunn stated he has three
letters that came in Thursday and Friday from Singletree Homeowners, Warner Development and from
Mr. David Lach, a Singletree homeowner. Mr. Hunn handed the letters to the Board.
Chairman Phillips asked they receive copies of the letters they had not received.
Commissioner Johnson asked if this is different from the one they received earlier. He asked if
the applicant also had gotten copies of the letter.
Pattie Haefelli, with Contra Engineering, explained the proposal saying the applicant has revised
this proposal numerous times. She explained the changes since the first presentation and the redesign.
She stated the applicant requested a tabling to address the revisions. She showed the different site plans
with one showing the revisions. She explained the proposal has 20% open space, 45% green space. She
explained the improvements they would be making to the Edwards area. She showed photos of the area
and the proposed sit location. She explained the zoning is within the community center. The proposal is
for 106 units starting at $225,000. The units would be approximately 1,148 square feet with garages.
She showed the adjoining PUD being the Catholic Church. She spoke to the countryside characteristic.
Staff maintains the trails along the east and west portion of the property should remain. They are
recommended to be 6 to 8 feet wide. Concerns were raised they are too close to the dwellings and they
concur. They think it would be a better buffer. They have provided paths within the development. The
applicant will work with CDOT as needed. She stated the applicant is willing to work with staff. She
spoke to the backup by the Eagle County Transportation Authority. She explained the bus shelter and
the traffic to be generated.
She spoke to the master plan and the concept that there exists a fringe in the community center.
She stated there is no reference to fringe. Community center pods are general locations and are
conceptual. Ms. Haefelli referred to an exhibit of community centers. She spoke to El Jebel, Gypsum,
Eagle and other developments. The site is located on a major highway with infrastructure. The site is
within the Edwards area community center.
She spoke to the numbers being requested but reminded that land use development is subject to
interpretation. She questions the need for a private entity to supply specific costs to the Board. She
spoke to the request by the Planning Commission for density reduction. She stated the applicant is
working on the water, the paths, drainage, bus shelter locations, on site detention which can be located
on site. If any utilities need to be replaced, they can. Regarding open space, the project has 45%
landscaped area with a 25% figure of open space. She spoke to an article on affordable housing and read
that article. She spoke to the lack of housing, the downward trend of the ski resorts, resulting is a
shortage of employees.
Michael Gregg, Contra Engineering, spoke to the traffic to be generated on the Edwards Road.
He explained that they are estimating 685 trips from this project. He explained the State Highway
Access Code was used to generate the numbers. He stated the numbers do not warrant the
improvements but the applicant is willing to do so. He explained the roadway improvements and the
addition of the access/decelllanes. He stated they would be in conformance with what the County is
proposing. The Edwards Area Access Plan has spoken to the levels of operation and service for that
area. He reviewed the associated traffic and that approximately 9000 trips will be added in time. This
project is about 6% of that total. He spoke to the drainage standards and what they would do to meet the
standards.
Chairman Phillips asked when they would propose to put in the access/decelllane.
Mr. Gregg stated it would happen at the time of construction.
She asked what about the rest of the road.
Phil Scott, Engineering Department, stated they will tie into existing improvements. He stated it
is not the complete final access plan but it is in conformance with the rest of improvements from Squaw
Creek to east of the mobile home park. There will not be the jogging.

Ms. Haefelli introduced Susan Kraemer from Preferred Real Estate who spoke to the frustrations
of those who can't afford housing. 3/10 of 1 percent is the rental vacancy rate. She spoke to the
commuters and those traveling upwards of200 miles per day. She spoke to the diminished quality of
life and the dreams of home ownership. She stated there are very few opportunities available. She
stated valley wide, as of today, there are 32 town homes on the market for under $300,000, more west of
Edwards. The west end offers more for the price, but many want to live in the same are in which they
work. She supports the project as it offers options to the families. She suggested the ultimate winners
are the individuals and the employers. She stated Deer Park will provide a quality product in a much
needed price range.
Ms. Haefelli introduced Paul Mullock from Norwest Mortgage. He stated at 106 units the
purchase price will be at $245,000. He explained a purchase incentive and the programs they could
provide. He handed out information to the Board. He stated they have a 3% down payment program for
first time buyers. He explained by lowering the density to 97 units it pushes the price up to $320,000.
He explained there is no 3% program at that amount. He stated they will be paying higher rates. He
stated Norwest is committed to first time home buyers. He stated a $54,000 combined income would be
required to qualify for a unit at this price. In order to break the economic cycle alternatives such as Deer
Park must be offered.
Mark Kleimer, Preferred Real Estate and an applicant for this project, spoke to his experience in
this valley and his children and them having to leave the valley. He stated this may not be an absolutely
perfect plan but they have spent hundreds of hours discussing the need for a community, having children
stay in the valley. There is a need for community. We are about people and this is about people. He is
offended and hurt by those who have such concern in preserving their quality of life. If everyone felt
that way, they wouldn't be here either. If they built this today, the average price will be $236,000. It is
his duty to make this successful. It is his challenge to take care of people.
Ben Kleimer, Preferred Real Estate, stated he has been a valley resident for more than 20 years.
He sated he is here today because of the urgency. He explained the need for providing for the people
who want to live and own a home here. He stated they are having to settle for condominium living. He
explained they could stack more units on this property by making Deer Park Condominiums. Town
homes will allow for the space and time to grow. The population has changed. But the economic
success has come at the exclusion of the workers. When there are not enough homes, people leave. This
community is not building its future. Ifthere is no room for young families to stay, there is no room for
the future.
John Perkins, Architect, stated they have worked on this project since July. He stated he believes
the project is better today than what they started with. He explained the vertical design and the open
space on the project and the desire to keep away from the garage door being the focal point. He spoke to
the dormers and the cottage appearance. More of an old town cottage type building. The color scheme
will vary so that all the buildings will not be the same color.
Ms. Haefelli responded to the letters received today and asked the Board refer to the letters sent
to the various organizations asking to meet with them. They did not respond except through the letters
received today. She spoke to the Berry Creek Project being 15 units per acre and the Homestead units
which was approve for 12.5 units per acre. She spoke to the Edwards Area Submaster Plan. She stated
when adopted the approximate population was 1,450. She stated the majority of commercial was B &
B. There could be a population of 13,000. She read from the plan. She spoke to the clustering of
densities. This is an area on a major transportation corridor. She spoke to the housing need being for
the long time residents. She spoke to the bike path and the bus shelter.
Dave Sloan, a property owner of Homestead and on the Board of Directors, read the letter dated
3/5/99 for the record. He stated the residents of Edwards are against the upzoning. He spoke to the
traffic on Highway 6, water that can not be accommodated. He spoke to the confrontations and without

the zoning changes being made by the Board, there would not be such a need for water. He asked they
delay the approval of projects that allow for upzoning. 11 units per acre is against the master plan and
the residents within the area. He stated residents of Homestead are opposed to the Deer Park proposal.
Mr. Sloan stated they have a community in Edwards. He believes their wishes are being ignored. He
stated they have high density and they request they slow down. He stated the Sub Area Master Plan is
outdated. They have asked the development be slowed down until issues such as water and traffic can
be addressed. He stated the authority says they can supply the water but they really can't.
Commissioner Stone asked about the request to delay the approval of the project. He asked until
when.
Mr. Sloan spoke to the highway study plan and the traffic. He stated they were told there would
be an updated Sub Area Master Plan for Edwards which hasn't happened either. He spoke to the schools
and the fact they are filled to capacity. He stated the infrastructure is not there.
Jeannie Huff, representing her family and neighbors, suggested there is a gap in the philosophy.
She stated people want to move into a beautiful valley but what they are going to get is smog in
Edwards. There is a lot of development that has been approved. She takes issue with there being more
approved before they see the results of all that has been approved. She questioned the fringe notion.
She believes the village core needs to have lower densities out from the core. She thinks it is setting a
damaging and dangerous precedent. She doesn't think they need to give up on Edwards just yet.
Homer Williams, representing Singletree, stated he did not participate in writing the letter. He
asked if they can have his points put on the record. He stated there is nothing in this program that speaks
to restrictions or the homes being for first time buyers. He suggested there be some type of deed
restrictions. He suggested the financing won't work with the type of income in this valley. He
suggested the green space comes from changing the elevation from 35 to 42 feet. He suggested the
traffic hasn't improved any and this won't either. He questioned if they get the prices they want if the
trailer park will disappear too.
David Lach, Edwards Metropolitan District Board Member, Berry Creek Metro and an Edwards
homeowner, suggested he was disturbed that the letters didn't get from staff to the Board.
Commissioner Johnson suggested they faxed a letter on March 4 and typically the Board is not
here on the weekend.
Mr. Lach read his letter into the record. It spoke to the traffic and the safety of the roads. He
spoke to the 12 units per acre. He suggested it is not necessary to approve the highest density allowed
and especially for this property. The Planning and Zoning Commission failed to adhere to the master
plan and they were misled by the developers. He explained the location. He questioned the zoning of
resource. He believes it is not suited for high end development because of its location. He stated a
realistic value is half what they are asking. He referred to the Sub Area Master Plan. He suggested the
town center keeps moving around.
Mr. Lach stated their number one reason for opposition is that it doesn't adhere to the master
plan. Roads and public safety are in jeopardy and is their second concern. He stated they would like to
see the Sub Area Master Plan adhered to and will work with the County to update it. Density should
decrease east and west of the spur road. He spoke to the properties closer in. As far west as this
property, the Sub Area Master Plan is rural. He believes the only reason they need the number of units
is to get the sellers the price they want. He stated the property does not have the 3.2 million dollar value.
He spoke to property closer in at $148,000 per acre. He stated they are also opposed to a gated
community. He stated Homestead has 1.1 unit per acre. They have 880 units on 800 acres. He stated
they are trying to develop every square inch of their acreage.
Commissioner Johnson stated the zoning there presently is RSL and not rural. He stated also the
additional cars are really additional vehicle trips.
Commissioner Stone asked about the gate.

Ms. Haefelli stated the gate is a non-issue.
Mr. Lach suggested there is no reference by staff to the Edwards area Sub Area Master Plan.
Commissioner Johnson stated it is referenced in the County's Master Plan.
Mr. Lach spoke to the Edwards Metro District having not been contacted by Staff. He stated
they meet monthly and had hoped the applicant would contact them. He stated he does not believe
communication was made with the Berry Creek Metro district either. Mr. Lach spoke then to River
Pines and Danny Broce's project. He spoke to Brett Ranch and the resale that is taking place. He spoke
to McDonald/Wallace's development of units in the mid $300,000 range. They are selling now from
$425,000 to $450,000. He believes the Board needs to come up with real guide lines and deed
restrictions. It may be affordable for the first buyers, but not for any others. He spoke to a project he
built in Homestead of 19 town homes. He questioned the time frame the applicant is saying they can
build in. He suggested the last time they went through planning and zoning they had a buy down
project. He suggested the planning and zoning members were provided with erroneous information.
Kirk Keltner owns the property to the west of the project. He stated he feels fortunate to be here
and after the last meeting he was rear-ended. He asked regardless of whether this passes or not, he
would like to see yellow lines on Highway 6. He asked about the water and the easements.
Art Kleimer stated he will supply them with water and there is a non-potable well across the
street for landscaping.
Mr. Keltner asked about the landscaping separating the property.
Ms. Haefelli stated they would do a complete review of the site and there will be screening on
the plan. Ifthe project goes forward they would meet with him and buffer the site.
Mr. Keltner stated he does burn wood there and asked if that would be a concern. He stated if
they need more land, he could work with them on that too.
Steve Ruder, a property owner ofthat area since 1967, spoke to the traffic and has a concern.
106 units will make a difference but not cause that big of problem. He stated he has a concern with the
well and has a concern with the Brett ditch. He feels that entire area is the right area for affordable
housing because of where it sits and all of the working area. As an adjacent property owner he feels it
would be fine for the County Commissioners to approve this property.
Paul Mullock, from Norwest, stated he lives in Lake Creek Village. He believes growth is
inevitable. He stated he doesn't like to see this as well but they must meet the needs of Edwards
residents. He stated it is ironic as a mortgage banker. He would like a home he can afford and believes
this to be useful to Edwards.
Commissioner Stone asked if this would be affordable to him.
He stated once they get the down payment.
Commissioner Johnson questioned the presentation at the Planning Commission meeting and the
payment of$1100.
Mr. Mullock stated he heard the comments.
Mr. Kleimer stated the statement made was that someone paying rental of $1100 could translate
into a payment of $1500. He explained there will be buy down programs.
Chairman Phillips asked if there was further public comment. There was none.
Chairman Phillips closed Public Comment.
Ms. Haefelli spoke to the public comments. She spoke to the school numbers saying this would
give only 28 additional students. They believe the students being produced are already in rental units.
She stated Brett Ranch is already sold out. There will be speculation and that is the way it has always
been. She stated the speculation is high because the demand is high. She suggested that capping
everything doesn't work. They are projecting 10,000 more people in Eagle County in the next ten years.
This is an ideal area. She stated the buildings in the PUD guide are 35 feet. Ms. Haefelli stated there are
already 38 people wanting to take advantage of the opportunity for home ownership, and that is with no

advertising.
Mr. Hunn spoke to the internal trail system and the response from the trail committee with them
being too close to the units. He would like them to remain as alternative routes. Mr. Hunn stated this
does conform with the Eagle County Master Plan.
Commissioner Johnson suggested Mr. Lach's concern was non-conformance with the Edwards
Sub Area Plan. He asked about road improvements and asked about those being undertaken by CDOT.
He asked how much are those improvements supposed to cost, is there funding and when will they be
done.
Phil Scot stated the total project is estimated at $14,000,000. There is not a funding mechanism
in place at this time. The time period could be now. He stated they could be put in now which would
speed up the growth rate. The Edwards Area Access Control Plan has been approved by the BoCC. The
IGA is being reviewed by the State and there has not been a mention of the time period. He suggested
within the next five years.
Commissioner Johnson asked ifthe funding in the twenty year plan is in these projects.
Steve Hulse stated the funding is not in place.
Chairman Phillips asked about expediting the process.
Commissioner Stone asked if there is a copy of the Edwards Sub Area Master Plan.
Chairman Phillips spoke to the traffic and suggested it will improve the traffic concerns in the
area. She suggested as each development comes on line they must improve the traffic. She recognizes
the need for affordability.
Commissioner Johnson questioned the concern by the Singletree Property Owners that with units
this large the extra space will become a rental unit. He questioned caretaker units within the
development.
Mr. Hunn stated there is nothing to prohibit any of the units being rented. He stated they spoke
of this at the Planning Commission. There will be basements that are unfinished.
Ms. Haefelli stated with regard to the floor area calculations, they are inaccurate. They will have
2,068 square feet per unit. She stated the applicant will write into the covenants that apartments will not
be allowed.
Commissioner Stone stated there is a real problem in the area with cumulative effects and it is
how to address that that is a difficult question. He stated he is not motivated by the density being
necessary because of the cost per unit. The County needn't be concerned with what is being paid for the
land. He is concerned with more what the visual effects will be and the effects to the community. He
suggested they try to have higher density around the center of the community and less as they move out.
He questions the effects of the mobile home park. It will improve the value of the neighbors land. The
mobile home park is some of the limited amount of affordable housing. He asked what the density is of
Brett Ranch and of Lake Creek Village.
Ms. Haefelli stated with Lake Creek Village there is 29 units per acre and at Brett Ranch, 18
units per acre.
Commissioner Stone stated he would like the total acreage.
Mr. Hunn suggested it would be closer to nine units per acre.
Commissioner Johnson asked about supply and demand for units between $150,000 and
$250,000 and those between $250,000 and $350,000. He asked ifthe former is higher.
Ms. Kramer stated anything below $250,000 is going very quickly. You are looking at different
types of buyers.
Commissioner Johnson asked about the number of units under 1300 square feet.
Ms. Kraemer stated people want a home not a condominium so they are purchasing in Eagle and
Gypsum rather than in Edwards. Ms. Kraemer stated it is the type of housing and where they work.
Commissioner Johnson asked if there is a number of houses that are in this price range that are

available for sale.
Ms. Kraemer stated there are not many projects out there right now.
Ms. Haefelli stated she doesn't know the numbers but the lots in Eagle Ranch are going for
$80,000.
Dave Lach spoke to Jen Wright and stated at Eagle Ranch the lots are selling for $125,000.
Commissioner Stone stated Mr. Lach is mistaken.
Commissioner Johnson asked how many units in the town site there are.
Commissioner Stone stated he doesn't have that answer at this time.
Chairman Phillips suggested we all know there are not enough units for those wanting to buy
today.
Commissioner Stone stated he needs to do some additional work and is not ready to make an
informed decision today.
Commissioner Johnson asked about deed restrictions.
Mr. Kleimer stated they have agreed to an initial deed restriction to Eagle County residents that
have lived and worked here for at least one year. There will be deed restrictions for initial purchases.
The rental restrictions will require they be rented to employees and if they sell, they must first offer them
to their employees. Mr. Kleimer stated the purchase price is no where near the 3.2 million dollars.
Commissioner Johnson referred to the article read by Ms. Haefelli. He suggested that deed
restrictions can't just be on the first buyers.
Mr. Kleimer stated because they are private and not governmental he believes there are some
Issues.
Commissioner Johnson spoke to Riverwalk and their PUD.
Bob Loeffler, Deputy County Attorney, concurred stating the deed restrictions are defined in the
PUD guide.
Commissioner Johnson asked that the applicant determine how long they will need to answer the
questions that have been asked.
Ms. Haefelli asked the questions be reiterated.
Commissioner Johnson suggested market demand, number of units throughout the County that
are below $300,000, supply verses demand, number of units approved but not sold within the price range
(i.e. Eagle Ranch, Edwards Village project, etc.) and the number of units under $300,000 that don't have
a size restriction. He stated he is confused as well with the size of the units 1,488 to 1,688.
Ms. Haefelli stated some of the information they have is based on the original submittal.
Mr. Hunn stated he thought that information was current.
Commissioner Stone asked for clarification on the road system and how that fits into the twenty
year plan. He also asked to verify the number of units on Brett Ranch, Lake Creek Village and River
Pines.
Ms. Haefelli stated River Pines is 15 units per acre.
Mr. Kleimer stated there are 52 units on the market and then went on to discuss the square
footage.
Commissioner Stone moved to continue file number PDS-00014, Deer Park PUD, to March 22,
1999.
Commissioner Johnson seconded the motion. The vote was declared unanimous.
SMA-00006, Edwards Station
Teri Bernath, Planner, presented file number SMA-00006, Edwards Station. She stated this was
a request to plat the previously unplatted Texaco Station Parcel and collateralize improvements on
redevelopment. Staff recommended approval. She stated they have received the copies of the SIA's.

incorporating staff findings.
Commissioner Stone seconded the motion.
In discussion, Homer Williams, Berry Creek Metro District, asked if this is going to be a twenty
four hour operation.
Brian Radon, East West Partners, stated their intent has never been to have a well lite, twenty
four hour operation. They do want to have credit card service available.
Mr. Williams stated it would more be the signage.
Mr. Radon stated they don't have a sign plan approved and understand the sign code to be pretty
restrictive.
Chairman Phillips called for the question on the motion. The vote was declared unanimous.
Commissioner Johnson asked about the SIA's.
Mr. Radon stated one is for the pedestrian path and one for the Miller Ranch Road
improvements.
Commissioner Johnson stated he can't approve the SIA's without having the ability to review
them.
Mr. Loeffler stated they may want to review their decision on the plat.
Commissioner Johnson suggested he would like to reconsider the approval of the plat and that
they would approve the plat and the SIA's at the same time.
Mr. Loeffler suggested that he hasn't read the SIA's.
Commissioner Johnson suggested they take a 15 minute break and read the SIA's. They all
agreed.
Commissioner Stone stated they have approved the plat and then took the break to read the
SIA's.
Commissioner Stone moved to approve the on-site SIA for SMA-00006, Edwards Station.
Commissioner Johnson seconded the motion. The vote was declared unanimous.
Commissioner Johnson moved to approve the off-site SIA for SMA-00006, Edwards Station.
