Laurie Asmussen, Fair Coordinator, stated CSU Cooperative Extension prefers to have judges not from Eagle County as they believe Eagle County people know the children, Commissioner Phillips questioned item SS, Chairman Johnson stated the Board would like a further breakdown on the 120 hours worth of work so this matter will be tabled to another date. Chairman Johnson suggested adding the mileage costs to the contracts in which we are paying mileage, Commissioner Phillips moved to approve the consent calendar as presented pulling item D, tabling items L and P until this afternoon at 1:30 p.m, and tabling item SS to July 27,1998. Commissioner Gates seconded the motion. The vote was declared unanimous, County Houses Jim Hartmann, County Administrator, stated the Board will draw from the names of employees who will be renting the houses owned by the County, The Board drew names and numbered them accordingly. Plat & Resolution Signing Scot Hunn, Planner, presented the following plats and resolutions for the Board's consideration: 5MB-00120. Lot 37. Berry Creek Ranch. Filini: No.1. He stated this was a Minor Type "B" Subdivision, a resubdivision of Lot 37 to create two (2) lots along with an access easement. This plat does contain a duplex split caveat stating that only one (1) two-family residence may be built on the combined area of the two lots, Commissioner Gates moved to approve final plat file number 5MB-00120, Lot 37, Berry Creek Ranch, Filing No, 1, incorporating Staff findings. Commissioner Phillips seconded the motion, The vote was declared unanimous, 5MB-00122. Lot 16-C. Villas at Beaver Creek. He stated this was a Minor Type "B" Subdivision, a resubdivision of Lot 16-C, Tract A, Block 1, Beaver Creek Subdivision, to create 13 condominium units, common elements and easements, Commissioner Phillips moved to approve final plat file number 5MB-00122, Lot 16C, Villas at Beaver Creek, incorporating Staff findings. Commissioner Gates seconded the motion, The vote was declared unanimous. AFP-00045. Lot 8. Beaver Creek Subdivision. He stated this was an Amended Final Plat for Lot 8, Tract F, Beaver Creek Subdivision, Filing No, 2. He stated this item needs to be pulled, The Board concurred to pull this item. Resolution 98-85. SUP-00001, Sopris Mesa Subdivision. He stated this was a resolution to approve the Subdivision Preliminary Plan for Sopris Mesa Subdivision. The Board considered this file on June 1, 1998, Commissioner Gates moved to approve Resolution 98-85, file number SUP-00001, Sopris Mesa Subdivision, Commissioner Phillips seconded the motion, The vote was declared unanimous, Commissioner Gates moved to adjourn as the Board of County Commissioners and reconvene as the Local Liquor Licensing Authority. He reviewed what the company has done in the past regarding reclamation and removal of tailings. He showed a sequence of pictures of the tailings and removal of the tailings, and water quality data, Glen Porzak, counsel for a group of prospective purchasers, Eagle Park Company, said the project is a culmination of Eagle River Assembly, He stated this project is meeting the water requirements in this area, is compatible with area water flows, and is not interfering with water rights in the area. He mentioned benefits from this project, collateral benefits, water testing shows the reclamation has been successful and the water meets water drinking standards. He stated the Clinton Reservoir does not come into play at this time. He stated the two could be combined in the future, where increase in yield is possible, Michael Gallager, Minturn resident, asked about Vail Associates senior water rights, Mr, Porzak talked about water rights of Vail Associates, Upper Eagle Valley, and other entities coming together to insure the reservoir will be filled during a dry year, He stated the water rights are decreed for domestic, agricultural, snowmaking, water rights can be used for any various purposes. He stated that roughly 900 acre feet are owned by municipalities, 1100 acre feet are owned by V A, not necessarily used for snowmaking, Mr, Gallager asked about the status of Eagle County's participation. He understood that Eagle County has an interest including some water rights. Commissioner Gates stated to purchase 100 acre feet there would be a conflict of interest during 1041 hearings, but there is an agreement with the River District regarding the 100 acre feet, Commissioner Gates stated the River District has taken over the negotiations etc, Mr. Gallager asked for a copy ofthe agreement with the River District to get details ofthe agreement.
