This being a scheduled Public Hearing the following items were presented to the Board of County
Commissioners for their consideration:
Consent Calendar
Chairman Johnson stated the first item on the agenda was the consent calendar as follows:
A) Approval of bill paying for week of April 27, 1998, subject to review by County Administrator
B) Approval of the minutes ofthe Board of County Commissioner meetings for April 13, 1998
C) Resolution 98-57, proclaiming the week of May 3 through 9, 1998 as Teacher Appreciation
Week in Eagle County
D) Notice of Award for the Bellyache Ridge Road Paving Project to B & B Excavating, Inc.
E) Agreement between Eagle County and Derringer for entertainment at the Eagle County Fair
Benefit
F) Retainer Agreement between Eagle County Board of County Commissioners and Eagle County
Board of Social Services for representation of the Eagle County Department of Health and Human Services by the
Office of the Eagle County Attorney.
Commissioner Gates moved to approve the consent calendar as presented.
Commissioner Phillips seconded the motion. The vote was declared unanimous.
Plat & Resolution Signing
Scot Hunn, Planner, presented the following plats and resolutions for the Board's signature:
5MB-OOllO. Lot 7. Arrowhead at Vail. Filing No. 19. He stated this was a Minor Type "Boo
Subdivision, a resubdivision of Lot 7 to create two lots, Lot 7 A and Lot 7 B. This plat does contain a duplex split
caveat stating that only one two family residence may be built on the combined area the two lots.
Commissioner Phillips moved to approve final plat file number 5MB-001IO, Lot 7, Arrowhead at Vail,
Filing No. 19, incorporating Staff findings.
Commissioner Gates seconded the motion. The vote was declared unanimous.
Resolution 98-58, ZS-00026. Basalt Sanitation District. He stated this was a resolution to approve
the Special Use Permit for Sludge Application within the Resource Zone District for the Basalt Sanitation District.
The Board considered this file on March 23, 1998.
Commissioner Gates moved to approve Resolution 98-58, file number ZS-00026, Basalt Sanitation District.
Commissioner Phillips seconded the motion. The vote was declared unanimous.
1041 Permit Application, Sylvan Lake
Tambi Katieb, Environmental Health, presented a 1041 Permit application for Sylvan Lake for the extension
of a major domestic water system and the efficient utilization of water provided thereto. He requested the Board
find the application complete and set the estimated fees at $745.00.
Commissioner Phillips moved to find the 1041 Permit application complete for Sylvan Lake, and establish
the estimated fees at $745.00.

Jim Elwood, Airport Manager, requested the Board approve Isbill Associates for airport engineering for a
term of five years. He explained the project to the Board saying they had followed the FAA requirements by
requesting an RFP. They received three responses which they then reviewed and scored accordingly. They chose
Isbill Associates.
Chairman Johnson asked why this is done separately and not on the consent calender.
Jim Hartmann, County Administrator, explained they have done so to make a clearer record and allows the
Board to ask for specific questions of staff.
Commissioner Phillips spoke to Isbill's qualifications.
Commissioner Phillips moved to approve Isbill Associates as the airport engineering firm for a period of
five years.
Commissioner Gates asked about the cancellation clause.
Mr. Hartmann explained that each project with come back for an amendment. There are no dollar amounts
associated with this contract, but will be each time an action is to be taken.
Commissioner Gates seconded the motion. The vote was declared unanimous.
PDF-00016 Cordillera, Filing 30, Gray Hawk
Tambi Katieb presented file number PDF-00016, Cordillera, Filing 30, Gray Hawk. He stated this was a
request to final plat for 15 lots on Tract I and Filing 24. Mr. Katieb explained the file and stated staff recommended
approval for the final plat and the SIA.
Commissioner Gates moved to approve file number PDF-00016 Cordillera, Filing 30, Gray Hawk,
incorporating Staff findings.
Commissioner Phillips seconded the motion. The vote was declared unanimous.

FPV-0001, Two River Village, Variance
John Vengrin, Engineering Department, presented file number FPV-0001, Two Rivers Village, variance
from Floodplain Regulations. He stated the applicant is requesting a variance from section 6.06.06.2 of the County
Floodplain Regulations. He reviewed staff findings for the Board and read the applicable citation. Mr. Vengrin
spoke to the application for a floodplain permit. He stated they, in the Engineering department, are still working on
the permit. He doesn't believe the facts on the permit application are relevant. Staff recommended denial.
Chairman Johnson asked if they are looking at the timing.
Mr. Vengrin stated the applicant should get their floodplain approval prior to applying for any other permits.
The applicant is asking to have the 1041 and the final plat application given before the permit is issued.
Commissioner Gates asked if they have been studying this since last year, how much longer will be needed
before they can submit this to FIMA.
Mr. Vengrin stated their consultant has asked for more information. He is not sure how long will it take.
Commissioner Phillips asked why the Planning Commission would approve the variance by an
overwhelming majority.
Mr. Vengrin stated many of the Planning Commission members believed they had the information to do so.
They concurred that there was enough assurance if the variance was granted that it would meet regulations.
Chairman Johnson suggested this is a timing issue rather than them waiving anything that is a health or
safety issue.
Mr. Vengrin stated that is his understanding but a key element are the conditions recommended by the
Planning Commission.
Mr. Vengrin stated the approval for the variance is covered.
Chairman Johnson asked Mr. Vengrin to read the section.
Commissioner Gates stated they are letting the applicant proceed with no assurance he will get the permit.
Mr. Vengrin stated there is a chance that the amount of developable land could change as a result of the
permit.
Chairman Johnson asked ifMr. Vengrin would be comfortable if the three conditions are included.

Tambi Katieb presented file number PDA-00007, Bachelor Gulch Village/Arrowhead PUD, He stated this
was a request to amend the Arrowhead at Vail PUD Development Guide, The proposed changes comprise a total of
nine separate requests, outlined in detail in their application letters of February 6, 1998 and March 27, 1998, The
amendments include: tract boundary adjustments, changes in commercial space allocation, required parking
changes, and changes in the definition of dwelling units, Mr. Katieb spoke to the concern ofthe Planning
Commission which was addressed in a letter attached to the back up, Staff recommended approval.
Tom Ragonnetti, representing Vail/Arrowhead, Inc" stated the changes requested are in the nature ofa tune

lock offs, and clarification of use definitions. He stated it is really a tune up, At Planning Commission they
questioned the open space recreation area being considered commercial. He stated the PUD guide defined it as such
but it was withdrawn by the applicant. The Planning Commission also questioned the parking formula, Mr,
Ragonnetti stated the Planning Commission made a proposal which they accepted requiring slightly more parking.
He stated they were asked to address in the employee housing formula the increased intensity use, They addressed
the Planning Commissions conditions and those were acceptable to them.
Commissioner Gates suggested they actually increased the parking,
Mr. Ragonnetti responded they did by adopting the formula suggested which worked quite well.
Commissioner Gates moved to approve file number PDA-00007, Bachelor Gulch Village/Arrowhead PUD
and that the file will be continued to May 11, 1998 for a resolution.

ZC-00022 & PDP-00007, Diemoz River Ranch
Paul Clarkson, Senior Planner, presented file numbers ZC-00022 & PDP-00007, Diemoz River Ranch, He
stated this was a request to consider a PUD Preliminary Plan and Zone District Amendment for a 46 acre parcel.
He explained this application was heard about a year ago. He expalined Doug Pratt is the representative today, Mr.
Clarkson stated most of the concerns that staff had identified have been addressed, There are two that are still
outstanding being recommended condition lA, the fifty foot right of way on Hooks Spur, and the right-of-way, He
suggested he spoke with the applicant before the meeting, Staff recommended approval with conditions,
Doug Pratt reviewed the concepts of the plan and location. He spoke to the 38 acres of open space with four
two acre lots with a two thousand foot building envelope, He spoke to the discussions with environmental health
and the leach fields they have developed, He explained their moderations, He explained their first preference
would be soil studies within the lot, but they can be located within the common area if necessary. The uses in the
common area include the building of a joining agricultural building. He spoke to the fishing easement and it being
five feet being above the property line, He spoke to the question about the right of way for Hooks Lane and having
moved the road and putting in a hedge, He stated there is not a right of way granted on the Glacier property, He
stated they will dedicate the 28 feet on the end if an easement is ever granted, In the meantime, they will move the
intersection on to Mr. Diemoz' property, In terms of other uses, there are a series in the covenants for agricultural
uses, Regarding easements for irrigation, they will allow them as a use within the common area, They will not
have prescribed easements throughout the property, They would like to have a 16 foot road with two foot
shoulders, A 22 foot wide road will encourage people to drive faster, They did commit to sprinkling the buildings,
The fire district stated they would like to see a water reserve, Mr. Pratt explained they intend on two dry hydrants,
They agreed a cistern might be a better way with stored water for each residence,
Mr. Clarkson stated staff had originally recommended denial but most of their concerns have been resolved,
the planning commission and staff have two different sets of conditions, Mr. Clarkson spoke to 1A being a
requirement of any subdivision. The Planning Commission felt the right of way dedicated was enough, He stated if
