Fisher Chairman Commissioner Commissioner County Administrator Clerk to the Board This being a scheduled Public Hearing the following items were presented to the Board of County Commissioners for their consideration: Consent Calendar Chairman Johnson stated the first item on the agenda was the consent calendar as follows: A) Approval of bill paying for week of April 27, 1998, subject to review by County Administrator B) Approval of the minutes ofthe Board of County Commissioner meetings for April 13, 1998 C) Resolution 98-57, proclaiming the week of May 3 through 9, 1998 as Teacher Appreciation Week in Eagle County D) Notice of Award for the Bellyache Ridge Road Paving Project to B & B Excavating, Inc. E) Agreement between Eagle County and Derringer for entertainment at the Eagle County Fair Benefit F) Retainer Agreement between Eagle County Board of County Commissioners and Eagle County Board of Social Services for representation of the Eagle County Department of Health and Human Services by the Office of the Eagle County Attorney. Commissioner Gates moved to approve the consent calendar as presented. Commissioner Phillips seconded the motion. The vote was declared unanimous. Plat & Resolution Signing Scot Hunn, Planner, presented the following plats and resolutions for the Board's signature: 5MB-OOllO. Lot 7. Arrowhead at Vail. Filing No. 19. He stated this was a Minor Type "Boo Subdivision, a resubdivision of Lot 7 to create two lots, Lot 7 A and Lot 7 B. This plat does contain a duplex split caveat stating that only one two family residence may be built on the combined area the two lots. Commissioner Phillips moved to approve final plat file number 5MB-001IO, Lot 7, Arrowhead at Vail, Filing No. 19, incorporating Staff findings. Commissioner Gates seconded the motion. The vote was declared unanimous. Resolution 98-58, ZS-00026. Basalt Sanitation District. He stated this was a resolution to approve the Special Use Permit for Sludge Application within the Resource Zone District for the Basalt Sanitation District. The Board considered this file on March 23, 1998. Commissioner Gates moved to approve Resolution 98-58, file number ZS-00026, Basalt Sanitation District. Commissioner Phillips seconded the motion. The vote was declared unanimous. 1041 Permit Application, Sylvan Lake Tambi Katieb, Environmental Health, presented a 1041 Permit application for Sylvan Lake for the extension of a major domestic water system and the efficient utilization of water provided thereto. He requested the Board find the application complete and set the estimated fees at $745.00. He explained the project to the Board saying they had followed the FAA requirements by requesting an RFP. They received three responses which they then reviewed and scored accordingly. They chose Isbill Associates. Chairman Johnson asked why this is done separately and not on the consent calender. Jim Hartmann, County Administrator, explained they have done so to make a clearer record and allows the Board to ask for specific questions of staff. Commissioner Phillips spoke to Isbill's qualifications. Commissioner Phillips moved to approve Isbill Associates as the airport engineering firm for a period of five years. Commissioner Gates asked about the cancellation clause. Mr. Hartmann explained that each project with come back for an amendment. There are no dollar amounts associated with this contract, but will be each time an action is to be taken. Commissioner Gates seconded the motion. The vote was declared unanimous. PDF-00016 Cordillera, Filing 30, Gray Hawk Tambi Katieb presented file number PDF-00016, Cordillera, Filing 30, Gray Hawk. He stated this was a request to final plat for 15 lots on Tract I and Filing 24. Mr. Katieb explained the file and stated staff recommended approval for the final plat and the SIA. Commissioner Gates moved to approve file number PDF-00016 Cordillera, Filing 30, Gray Hawk, incorporating Staff findings. Commissioner Phillips seconded the motion. The vote was declared unanimous. The vote was declared unanimous. FPV-0001, Two River Village, Variance John Vengrin, Engineering Department, presented file number FPV-0001, Two Rivers Village, variance from Floodplain Regulations. He stated the applicant is requesting a variance from section 6.06.06.2 of the County Floodplain Regulations. He reviewed staff findings for the Board and read the applicable citation. Mr. Vengrin spoke to the application for a floodplain permit. He stated they, in the Engineering department, are still working on the permit. He doesn't believe the facts on the permit application are relevant. Staff recommended denial. Chairman Johnson asked if they are looking at the timing. Mr. Vengrin stated the applicant should get their floodplain approval prior to applying for any other permits. The applicant is asking to have the 1041 and the final plat application given before the permit is issued. Commissioner Gates asked if they have been studying this since last year, how much longer will be needed before they can submit this to FIMA. Mr. Vengrin stated their consultant has asked for more information. He is not sure how long will it take. Commissioner Phillips asked why the Planning Commission would approve the variance by an overwhelming majority. Mr. Vengrin stated many of the Planning Commission members believed they had the information to do so. They concurred that there was enough assurance if the variance was granted that it would meet regulations. Chairman Johnson suggested this is a timing issue rather than them waiving anything that is a health or safety issue. Mr. Vengrin stated that is his understanding but a key element are the conditions recommended by the Planning Commission. Mr. Vengrin stated the approval for the variance is covered. Chairman Johnson asked Mr. Vengrin to read the section. Commissioner Gates stated they are letting the applicant proceed with no assurance he will get the permit. Mr. Vengrin stated there is a chance that the amount of developable land could change as a result of the permit. Tom Ragonnetti, representing Vail/Arrowhead, Inc" stated the changes requested are in the nature ofa tune up that are designed to respond to requests of the people in Bachelor Gulch, He stated there are some minor parcel reconfigurations, a redistribution of residential density, the minor redistribution of commercial, a clarification of lock offs, and clarification of use definitions. He stated it is really a tune up, At Planning Commission they questioned the open space recreation area being considered commercial. He stated the PUD guide defined it as such but it was withdrawn by the applicant. The Planning Commission also questioned the parking formula, Mr, Ragonnetti stated the Planning Commission made a proposal which they accepted requiring slightly more parking.
