This being a scheduled Public Hearing the following items were presented to the Board of County
Commissioners for their consideration:
Consent Calendar
Chairman Johnson stated the first item on the agenda was the consent calendar as follows:
A) Approval of bill paying for weeks of February 23, 1998 and March 2, 1998, subject to review by
County Administrator
B) Approval of payroll for February 26, 1998, subject to review by County Administrator
C) Approval of the minutes of the Board of County Commissioners meeting for February 9, 1998
D) Contract between Eagle County and Xerox Corporation for the purchase and maintenance of a
replacement fax machine for the buildings and grounds department
E) Resolution 97-26, adopting a fees and charges schedule for the Eagle County Animal Control
F) Resolution 97-27, repealing and restating Resolution No. 96-23, concerning the control and
licensing of dogs and impoundment and disposition of animals
G) Resolution 97-28, appointing Norma Olsen and Polly Pollard to the Basalt Library District
H) Resolution 97-29, appointing Glenn Miller, Wayne Nelson and George Gates to the Weed
Advisory Committee
I) Resolution 97-30, for recognition and support ofthe 1998 Winter Olympic Athletes
J) Resolution 97-31, in the matter of applying for grant funds from the Colorado Association of
Realtors Housing Opportunity Foundation to provide housing assistance.
Commissioner Gates moved to approve the consent calendar as presented,
Commissioner Phillips seconded the motion, The vote was declared unanimous,
Plat & Resolution Signing
Scot Hunn, Planner, presented the following plats and resolutions for the Board's consideration:
5MB-00095. Lots 2 & 3. Perouges Subdivision He stated this was a Minor "Type B" Subdivision,
a resubdivision of Lots 2 & 3 to create four (4) lots, Lot 2, Lot 3, Lot 4 and Lot 5, This resubdivision is to
accommodate the physical constraints and geologic conditions of the site. He stated they don't know the status of
the Plat at this time, Mr, Hunn stated before Mr. Montag will sign the plat, they need some questions answered.
Kathy Eastley, representing Cordillera, stated Cordillera has submitted a plat that will gain them a net of one
lot. This net gain is coming out of the Village Center core, Ms, Eastley stated they will provide a planning parcel
summary, but she does not have it with her.
Bob Loeffler, Deputy County Attorney, asked if it is on the plat.
Ms, Eastley stated there is no requirement to have it on the plat though it has in the past.
Chairman Johnson suggested that in the future it may not be clearly understood.
Ms. Eastley spoke to the maximum units and the planning parcel summaries, She stated she can provide
backup documentation and will submit that to the Board, She requested this matter be tabled,
Keith Montag, Director of Community Development, suggested the Board could approve and authorize the
Chairman's signature once the information is received and reviewed.

would be a summons offence, They propose to add section 613 for designation of highway maintenance and
construction zones, The bond be $100 and the penalty assessment be double,
Commissioner Gates asked where they get the Bond amounts,
Ken Wilson, Eagle County Sheriff s Office, stated he and the Sheriff referred to the State code for a
guideline, Section 1101 breaks it down in to five offences, the State uses four. He stated it is a summons offence
and the points should be six,
Chairman Johnson asked about 25 and over.
Mr, Loeffler explained,
Ken Wilson stated 1 - 4 is a $20,00 fine, 5 - 9 is $50,00, 10 - 19 $100, $20 and over, a summons. The points
should be 1/3/4/6, For an adult driver twelve points will take the license away, They would recommend that all
items on the penalty sheet that don't have penalties shown should be removed,
Chairman Johnson asked about 808 and ifhe could be walking and get 8 points,
Discussion continued and the points in the State schedule are O.
Sheriff Johnson spoke to other causes for youth to lose their driver's license. He stated that is one ofthe
areas they are attacking, They agreed there should be no points for pedestrians who hinder a person with a
disability from proceeding,
Commissioner Gates spoke to people on bicycles,
Mr. Loeffler continued by saying the other issue is that the County Court Judge has seen this draft and her
reaction was that it would be difficult it administer because the fine structure is different than State. She strongly
encouraged the fine adopted be that of the State, He reviewed the fine structure under the different distinctions,
Ken Wilson explained how they came up with he average of$25.00, He understands Judge Diem's concern,
Chairman Johnson asked about HBI059 will effect section 15, That is higher sanctions in school zones. He
asked will 1059 increase the fines even earlier.
Mr, Wilson asked if that has been passed,
Sheriff Johnson stated they will have to amend and adopt any new regulations,
Chairman Johnson stated he is concerned with quadrupling fines.
Mr. Loeffler stated they would need to have signs that show beginning and end of residential as well as at
the end or beginning of school zones for double fining.
Commissioner Phillips moved the Eagle Board of County Commissioners approve and adopt the Ordinance
for Regulation of Traffic adopting by reference the 1995 Edition of the "Model Traffic Code" and amendments
thereto with the amendments made at this hearing,
Commissioner Gates seconded the motion, The vote was declared unanimous,
There being no further business to be brought before the Board the meeting was adjourned until February
24, 1998,
