This being a scheduled Public Hearing the following items were presented to the Board of County
Commissioners for their consideration:
Consent Calendar
Chairman Phillips stated the first item on the agenda was the consent calendar as follows:
A) Approval of bill paying for weeks of December 15 & 22, 1997, subject to review by County
Administrator
B) Approval of payroll for December 18, 1997 subject to review by County Administrator
C) Quit Claim Deed between Eagle County and Douglas J. Wight for a 70' wide access easement that
is no longer required
D) Resolution 97-165, authorizing the commencement of the warranty period for the reclamation
agreement between Eagle County and Corn Construction Company for the reclaimed site of the temporary asphalt
plan in Wolcott
E) Maintenance Agreement between Eagle County and Xerox Corporation to purchase a Xerox
copier, Extension Department
F) Agreement between Eagle County and New Shoes to perform at the 1997 Eagle County
Employee Holiday Party
G) Agreement between Eagle County and 4 Eagle Ranch to cater the 1997 Eagle County Employee
Holiday Party
H) Contract between Eagle County and U,S. West for an upgrade for the wide area network for
improved speed, capacity and band width
I) Approval of County Veterans Service Officers monthly report for September

Commissioner Johnson asked about item C, the Quit Claim Deed,
Ellie Caryl, Planner, stated this is the Wild Cat issue, She stated they had an easement to the ball field but
since the ball field has been moved they are returning the land to the owner.
Commissioner Gates moved to approve the consent calendar as presented,
Commissioner Johnson seconded the motion, The vote was declared unanimous,
Plat & Resolution Signing
Scot Hunn, Planner, presented the following resolutions for the Board's consideration:
Resolution 97-166. PDA-00005. Edwards Nursery Planned Unit Development Amendment.
This is a resolution to approve the amendment to the Edwards Nursery Planned Unit Development to include a
phasing plan and to clarify the PUD Guidelines. The Board considered this file on September 2, 1997,
Commissioner Johnson moved to approve Resolution 97-166, file number PDA-00005, Edwards Nursery
Planned Unit Development Amendment.
Commissioner Gates seconded the motion, The vote was declared unanimous,

Chairman Phillips suggested since the property doesn't exist she believes the Board should issue a refund,
Mr, Black stated the property was sold by a tax deed.
Chairman Phillips asked how long Mr. Collett had been paying taxes.
Mr, Collett stated he has been paying taxes on this property since 1986, He stated he has paid $1,800
including interest.
Chairman Phillips asked how this came to light.
Mr. Collett explained the history of the property and the tax notices being received, He stated in the
Enterpirze this property was going to sale for delinquent taxes. He paid the delinquent taxes, He stated when he
went to transfer the deed, he hired a surveyor to find the markers, The surveyor explained he had surveyed there
and the property didn't exist. He contacted Terry Quinn, an Attorney, who had been involved previously with Mr,
Gallegos, Mr. Collett explained Mr. Gallegos was the legal owner of the property and was also paying taxes, He
stated they both paid the taxes and he is requesting a refund,
Commissioner Johnson suggested they were just coming forward today to be sure that there was no legal
claim to the property,
Terry Quinn spoke to his recollection of the 1st hearing and the Assessor was lacking information, Mr,
Black has reviewed the information and learned the history from Mr. Quinn,
Commissioner Johnson asked how can they give Mr. Collett back his money,
Mr. Quinn suggested they issue a refund.
Commissioner Johnson stated legally the Board cannot issue an abatement.
Commissioner Gates stated they agreed to give the money back according to statute,
Renee Black stated you can consider it to be erroneous taxes and can make a motion accordingly, She
cautioned the Board about giving moneys back that have already been allocated, She suggested they make findings
as to why they are issuing a refund,
Chairman Phillips stated she believes it to be an error made by Eagle County and Mr, Collett is owed the
refund,
Commissioner Johnson moved to approve a refund for schedule number 14730, J, Fred Collett,
incorporating Staff findings that the County erroneously sent out a tax bill which was paid by Mr, Collett and will
therefore will be refunded including the I % interest.
Commissioner Gates seconded the motion. The vote was declared unanimous,
Commissioner Johnson moved to adjourn as the Board of County Commissioners and reconvene as the
Local Liquor Licensing Authority.

Fitzsimmons Motor Company
Earlene Roach, Liquor Inspector, presented a renewal of a 3,2% Off Premise Beer License for Fitzsimmons
Motor Company, She requested this matter be tabled to allow the applicant to be present.
Commissioner Gates moved to table the renewal of a 3.2% Off Premise Beer License for Fitzsimmons
Motor Company to December 29 at 10:45 at the applicants request.
Commissioner Johnson seconded the motion,
In discussion, Chairman Phillips asked if it was necessary for the applicant to be present.
Ms, Roach responded he was not here last year and needs to be present at this hearing,
Chairman Phillips called for the question on the motion. The vote was declared unanimous,
Legends Restaurant
Earlene Roach presented a renewal of a hotel and restaurant license for Robert Y. Prigmore, dba/Legends
Restaurant. She stated this application is in order and all fees have been paid. The Sheriff s Office reports no
complaints or disturbances during the past year. Staff recommended approval.
Mr. Prigmore was present for the hearing, He introduced himself.
Commissioner Johnson asked the location of Legends.
Mr. Prigmore responded it is in the Poste Montane building on the Plaza at Beaver Creek.

Gerry Best, applicant, introduced himself and his wife Vera, He explained their desire to do a sixteen acre
plus open space reserve area, He stated they have a wildlife sensitive subdivision and are addressing that. He
apologized for the delay and is hoping to begin soon,
Commissioner Gates asked if the sixteen acres will be held in common,
Mr, Best responded yes,
Commissioner Johnson stated even though the County does not enforce covenants, they are relying on them
to control the habitat, fencing, etc. He spoke further concerning the design review Board, He spoke to the
memberships.
Mrs, Best stated there was a typo and each lot would be entitled to one vote,
Commissioner Johnson stated he does not see where the make up of the Board of Directors would be,
Mrs, Best explained with three parcels there would be three representatives,
Commissioner Johnson asked that it be defined. He suggested he didn't want it excluded as it may cause for
confusion, Commissioner Johnson asked about the number of swine not being specified.
Mrs, Best stated they don't want a lot of swine but they would want a child to be able to raise them for 4-H.
Commissioner Johnson stated he has a concern with no limit.
Ms. Best stated there is a total limit of seven animals. She provided an up dated copy of the covenants,
Commissioner Gates asked if the seven animals includes the deer. He asked about payment of a mitigation
fee confirming they have set aside 16 acres as permanent habitat.
Chairman Phillips asked about the impact fee, It was specified they have two residences there now but are
adding one more home,
John Althoff stated they are creating two new lots, therefore there will be three in total.
Commissioner Gates moved to approve SM-942-94, Ute Springs Ranch Subdivision, incorporating Staff
findings and recommendations,
Commissioner Johnson seconded the motion, The vote was declared unanimous,
SE-00002, Paas Exemption
Scot Hunn presented file number SE-00002, Paas Exemption. He stated this was an exemption plat to
legalize a 2.056 acre parcel created on April 20, 1970. Existing land use on this parcel is single family residential.
Water is provided by a legal well, sewer is provided by the Town of Basalt, and access is provided via an access

interest. The possibility of a conflict was reported to the Secretary Of State. This provides, with that disclosure, the
person in conflict can be part of a decision, When the Board was deadlocked, the conditions of the statute being
met, the Chairman was allowed to participate in the decision, The Chairman announced she was in favor of the
application but instructed staff to develop conditions, Because of that tabling, the Chairman can participate in the
decision making process,
Mr. Loeffler reminded all present, in their opinion, there is no conflict of interest. If there were, the statute
allows the Chairman to take part in a decision if there is no affirmative action, Mr. Loeffler referred to the land use
regulations and the inability to take action if there is a tie vote, The applicant has completed their presentation and
public comment has been closed, At this time it is appropriate to consider the conditions. If the Board chooses they
may open public comment but it must be limited to the specific conditions,

Commissioner Johnson stated he would drop it if the applicant so desires.

Mr. Hoover explained item 2d, the required permitting or submitting a storm water management plan, He
stated he has a problem with the italicized part because it is not a permit issued by Eagle county, He asked who
would have jurisdiction?

Chairman Phillips understood it must be submitted to the State and they would have jurisdiction,
Mr. Hoover stated that is the same concern with 2E because they are not approved by Eagle County,
Paul Clarkson stated they do have the expertise on staff to review these things. The word approved may be
too much but Eagle County would like to have the right to review these plans, They are plans that must be in place,
Mr. Hoover stated he has to get the permits,
Chairman Phillips suggested that Eagle County has the right to inspect these permits whenever they feel
appropriate.
Mr. Loeffler suggested the permits be submitted to Eagle County Environmental Health when submitted to
the State. Perhaps they may find a reason to comment to the applicant and/or to the State,
Chairman Phillips stated she would like them submitted to staff for review and comment to the State if it is
considered necessary, Ms. Eastley stated the intent is that staff will review rather than approve.
Commissioner Gates stated the issue comes down to instructing simultaneous submission of permit
applications to the County for review as submitted to the State.
Kevin Lindahl stated he is concerned for more regulation by the County than what is legal.
Scott Hover referred to his requirements, He stated the problem he is having with this document is that they
are making requirements that are not standard, He stated they are reinventing the wheel here,
Chairman Phillips asked why more strenuous conditions are being required,
Ms, Eastley stated these are no greater than the conditions placed on previous plans, Ms, Eastley stated the
environmental concerns are things they are dealing with on a daily basis. She stated this is a very different air shed
and will experience other concerns,
Commissioner Johnson stated they would be asking that when plans are submitted to the State that it be
submitted to the County at the same time.
Mr, Hoover stated they agree to that.
Commissioner Gates and Phillips agreed as well.
Mr. Hoover spoke to items H, I, J, and K.
Mr. Lindahl spoke to the road cut permit as the road construction would be done in conjunction with Road
& Bridge, He doesn't see that the permit would be required if they are working with Eagle County Road & Bridge.
Commissioner Johnson clarified that if the permits are required, they will need to submit them, They don't
have to do things that they wouldn't ordinarily need,
Mr. Lindahl asked if a grading permit will be required.
Chairman Phillips stated she would like to see any required County permit.

Kevin Lindahl stated they can't agree to this as they do not own the property, They are not creating an
impact to other people's access. All access is permissive by Dr, Jacobson. Mr, Hoover objects to this as it does not
relate to the permit and he does not own the property.
Commissioner Johnson stated he would be in favor of eliminating that one.
Paul Clarkson stated though this is not the applicants land, the applicant is Dr. Jacobson because he owns
the property, Claiming they can do this because they are not the property owners, mixes issues, This is in response
to a BLM referral.
Commissioner Johnson stated that even though BLM has made this request, they are requiring an easement
across the land and they don't have the power to do that. Mr. Hoover stated BLM did not request an easement but
stated they have used it historically for wildlife fire control, etc, They did not request an easement,

Commissioner Gates suggested if they volunteer to do the day before he would be in agreement with that.
Commissioner Johnson clarified that it would make sense to do the day prior to hunting season opening,

limitations and or infractions, Mr. Hoover stated the correct action is to call the Sheriff and not Community

Chairman Phillips stated she is sure they will hear the complaints but does not see the need to submit the
complaints to Community Development.
Commissioner Gates stated when he gets complaints he sends them on to the Sheriff s department.
They agreed to require B & B to educate on speed limitations,
# 15c, Mr. Hoover stated is regulated by the State of Colorado,
Ms. Eastley stated both 15b and c were a result of the concerns of property owners, These were their efforts
to mitigate those concerns,
Mr, Loeffler asked ifthat is strictly an education issue. #15d was stricken,
# 16, the applicant stated, should not be in his court. They are welcome to come look at the site whenever
they want. Mr. Hoover stated they will pay an inspection fee when it is required by all other operators,
Ms. Eastley stated they don't require an inspection fee but none of the other operators have a scheduled
annual inspection,
Commissioner Johnson stated this is something they need to tickle internally, As far as fees are concerned,
they need to do an overall fee schedule. Everything in italics is eliminated as agreed by the Board,
#17 the applicant stated it does not work for them. What they are trying to do is regulated the amount of
traffic going into the site, He stated you can't control the demand, as it is market driven,
Commissioner Johnson stated there are certain standards regarding road improvements, The mitigations are
not required within the conditions.
Mr, Hoover explained they are in total agreement with Road and Bridge but to have them do a monthly
report submitted to Eagle County signed by an engineer is difficult at best.
Commissioner Johnson stated he doesn't have a problem with not providing a monthly report.
Mr. Hoover stated if there is a day they don't make thirty trips, he has lost thirty trips, Trying to regulate
truck trips to satisfy demand is not possible. If they have to bid jobs but be limited to the number of trips, they
won't be able to get the jobs done,
Commissioner Gates asked how far ahead do they get notification for jobs,
Mr. Hoover stated that will vary with the client. It's not an open ended thing,
Commissioner Gates suggested there could be notification to the neighbors,
Mr. Hoover stated their are attempting to mitigate this by limiting the amount oftonnage per year, This is
micro management.
Commissioner Johnson stated the measures used by engineers are based on different types of traffic. He
stated squeezing this into a three month period will take them outside of the standards. If everything is condensed
into two months, there will be no disturbance the rest of the time,
Commissioner Johnson stated they are trying to provide for some mitigation over the busy, four month
period of time,
Commissioner Gates stated he seeS the differences but hopes they can keep it under control so that not all
the gravel is moving out during a short period of time. He agrees with the 50,000 ton limit but doesn't see how that
will work.
Commissioner Johnson asked to strike the percentage of vehicles and everything after the word annually,
Chairman Phillips asked if there are other gravel operations that have these conditions.
Ms, Eastley stated the restrictions come from information in the application and that is where this language
comes from. She stated staffs concern is that the annual operation will occur over 280 days. What that doesn't do

has the authority to require improvements to a road the Forest Service has the right of way to,
Mr, Loeffler stated we do in cooperation with the Forest Service and BLM, They do their roads and vice
versa, They can maintain the road or they can maintain it with County forces,
Commissioner Johnson stated the easement would be in place but anything beyond the easement would be
on the applicants land,
Mr. Loeffler stated if the condition is for 22 feet on a 10 foot wide easement, they would be required to give
an additional 12 feet,
Commissioner Johnson stated they would have private traffic,
Mr. Loeffler stated every John Doe driving up Coffee Pot road would be in the travel range,
Mr, Hoover stated the special use permit gives the authority to request that but the Dr. is not required to give
more of an easement without compensation.
Pete Viceman from Vail was present because of the conflict. Mr. Viceman stated all of the conditions that
have to be reported to the planning commission, he questions if the planning commission is out of control. He is
not blaming anyone but requests the Board take a look at the micro management.
Dick Turgeon, area resident, thanked the Board for scrutinizing the conditions, He suggested they missed
the caretakers unit and they should be allowed an outside light that be left on nightly,
Chairman Phillips stated the lighting needs to be conservative and B & B is in agreement.
Commissioner Johnson stated they should add the caretaker unit following house/office.
Mr, Turgeon stated there should be a light on the crusher if they are going to 5:30, Mr, Hoover stated they
will not operate crushers during nighttime hours. The hours were reviewed, They agreed to the conditions
submitted by Mr. Hoover.
Andy Weissner stated he is not a paid employee of any environmental group and the insinuation is
ludicrous, Mr. Weissner asked if they are making a finding that the use in consistent with the neighborhood,
Commissioner Johnson stated they cannot make the approval with out the findings.
Mr, Weissner asked if they are making a finding that this use is consistent with the character of the area, He
asked about the finding that it is in conformance with the master plan. Mr. Weissner spoke to #13 and asked there
be no operations of any kind on the opening or closing days of Anderson Camps, He stated it is a very busy time
and he would recommend on those days they be restricted, He stated he has no problems with gravel mining but
with truck traffic and safety.
Chairman Phillips asked Scott Stewart form Anderson Camps to address it.
Mr. Stewart explained they have four sessions each summer and have opening and closing times that are
very busy,
Chairman Phillips stated she's not sure it is any different than school opening and closing times,
Mr. Hoover asked if those dates are Saturdays and Sundays.
Mr. Stewart stated the dates are within a day or two each year,
Commissioner Johnson stated they should submit a schedule to B & B,
Mr, Hoover stated they will work with their neighbor on a friendly basis, but he would not like to see it
being a condition,
Commissioner Gates stated if they have no trucks going north, there may be no impact. He was satisfied
with Mr. Hoover working with Anderson Camps and Mr. Stewart,
Commissioner Johnson stated he would prefer a condition placed similar to that ofthe hunting season,
Commissioner Gates stated that would be consistent.
Commissioner Johnson stated condition #27 read there be no gravel hauling operations during the opening
and closing days of each session and that hauling be suspended during the check in check out time per the schedule
supplied by Anderson Camps not to exceed four sessions and only during check in check out time of approximately
four hours each day for not more than eight days,
The Board agreed,
Mr. Weissner spoke to section # 17 and the annual number of truck passes. This was proposed to be a
dramatically scaled down operation but, if the whether is bad they may have to do more passes some days. Mr,
Weissner stated he is convinced they will see major traffic in the summer and be up to 200 trucks daily in the
summer, He is concerned they will see 100 to 200 truck passes per day and that is unacceptable, He would like
them to go back to 30 trips per day,
Chairman Phillips stated that is an average,

number of trucks per day allowed you can have a hundred passes in one day, He stated there must be an upper limit
on the number of vehicles per day,
Chairman Phillips stated it was addressed in the application at 16 truck trips per day.

Chairman Phillips questioned them allowing the hundred and some trips on Highway 6 without accellldecell

Mr, Hoover stated by doing so, he believes it will kill the project. They are mitigating by the tonnage they
will produce,
Chairman Phillips suggested the hours will limit the number of trucks too,
Mr, Hoover stated they have already limited them from being open on Saturday and Sunday,
Chairman Phillips reiterated her requirements,
Mr. King asked that somehow, someway, the residents and visitors need to maintain their existing lifestyles,
One hundred truck trips in a day will greatly influence those who live there, Mr. King stated they may have
hundreds of trips per day, Mr. King asked if they believe it will go over.
Mr. King stated B & B can say one thing and another thing can happen. He stated ifthey run 300 trips per
day it could happen, Mr. King stated it can't be controlled if a maximum is not stated.
Commissioner Gates suggested that a maximum of 36 truck trips be required,
Commissioner Johnson agreed,
Mr. Hoover stated ifthey put a limitation that it not be so close to what the average is that it would totally
restrict them, He asked it be closer to one hundred,
Commissioner Gates stated the number of truck passes per day not to exceed thirty six trucks trips per day,
That is eighteen loads per day,
Mr. King stated you'll an get 118 days worth of gravel.
Commissioner Johnson asked for a ten minute recess.
Commissioner Johnson stated the number of truck trips will be limited to 30 truck trips daily with no more
than 36 truck trips in anyone day.
Mr. Hoover asked ifit is an average of36 per day or a maximum?
Mr. Johnson stated 36 would be the maximum,
Mr. Hoover stated if 36 is the maximum, it will not work. He stated they cannot live with a maximum of 36
per day, He stated there are two expert witnesses here, one is their competitor and one is their engineer. Any
number of maximum will have to be 100 per day otherwise it kills the proposal.
Commissioner Gates stated he can accept Mr. Hoover's testimony,
Chairman Phillips suggested they look at some reasonable condition or deny it. She again spoke to the
annual restrictions. She stated she does not want to put a limit of 36 per day.
Michael Cacioppo, area resident, asked about the zoning and that it is zoned resource, He asked who will
count the trucks and if his tax dollars will count them, He stated it is a whole lot of micro management, With all
the laws, neighbors fight each other and it goes on and on, Mr. Cacioppo stated the County is in the gravel
business.
Commissioner Johnson stated they are not in the gravel business,
Chairman Phillips clarified they do make money on royalties but they are not in the business,
Mr. Cacioppo stated as a tax payer he would hate to have his tax dollars support litigation against the
County,
Commissioner Johnson instructed Mr. Cacioppo to limit his testimony to the conditions,
Chairman Phillips concurred.

tapes, The recommendation for denial was not unanimous, She stated the motion made by the planning
commission member to deny did not attend the 17th meeting or do a site visit. She stated the Colorado State Statute
declares the deposits are essential and should be extracted, Eagle County needs the gravel for multiple reasons,
She stated the gravel has to be extracted where it is. She stated they have listened to the planning commission and
concerns of open space, Without the pits and use of the deposits the cost of housing will go up, Without
employees the economy will falter. The master plan is a guide approved by the planning commission, The
planning commission gives recommendations, but the Board makes policy. She spoke to the Town of Gypsum and
the Town of Eagle asking that no additional pits be approved on the I-70 corridor or on Highway 6, There has been
a Board member that wrote a letter to the paper and that was surprising to her. With that, she asked for any other
discussion,
Commissioner Gates stated he can remember when they talked about timbering the flat tops, He stated if
they don't approve this one what will happen when growth continues up there, He stated he is not insensitive to the
people who live there, The camp is a good one and he respects that. He stated some of the nearest wrecks he's had
have been with rafters, The impact is tremendous and not just with hunters, He stated now that they have a road up
Coffee Pot, it wouldn't hurt his feelings if they shut if off. He stated he is not insensitive to what is happening but
he would be if he only looked at one side of the issue.
Commissioner Johnson stated he is still not convinced this is right for this neighborhood at this time. He
stated he understands what Bud is saying about the danger of the road, He sees this as another reason that this is not
a good thing to approve at this time, They have not mitigated the impact. There is not immediate danger of this
being developed at this time, Litigation must be introduced to protect areas where we are having quick
development. He spoke to the gravel reserves at the fair grounds and holding on to those for sale down the line. He
stated that location can and will be bid out. Commissioner Johnson stated he will vote no,
Chairman Phillips called for the question on the motion. Commissioners Gates and Phillips voting aye and
Commissioner Johnson voting no,
Mr. Loeffler stated the written resolution must be adopted and in the meanwhile they will ask the applicant
to sign the forty day waiver for drafting the resolution, Mr. Loeffler asked this matter be tabled to December 29, for
preparation of the resolution,
Kevin Lindahl stated they will agree to that for the limited purpose of adopting the conditions as discussed
today into a resolution,
Commissioner Johnson moved to continue this to December 29 for the purpose of writing a resolution to
reflect the decisions made today,
Commissioner Gates seconded the motion, The vote was declared unanimous,
