Consent Calendar
Chairman Phillips stated the first item on the agenda was the consent calendar as follows:
A) Approval of bill paying for the weeks of November 3, and November 10, 1997 (subject to review
by the County Administrator)
B) Approval of payroll for November 6, 1997 (subject to review by the County Administrator)
C) Approval of the minutes of the Eagle Board of County Commissioners meetings for October 27,
1997
D) Agreement between Eagle County, State of Colorado and the Colorado Avalanche Information
Center to provide avalanche information and education for the benefit of the Eagle County
E) Change Order No, 1 for the 1997 Guardrail Contract between Eagle County, State of Colorado
and Gonzales Construction Company, Inc.
F) Change Order No, 1 to the Agreement between Eagle County, State of Colorado and Motorola,
Inc, For the microwave equipment (tabled from 10/20/97)

Jim Fritze, County Attorney, stated regarding items G & H, he has received nothing from the applicants so
both resolutions need to be approved,
Commissioner Gates stated he would like to discuss item F.
A.J. Johnson, Eagle County Sheriff, spoke to item F, He stated when they started into Phase 2, equipment
was being purchased but all monies were not spent. He stated Motorola preferred not to rewrite the agreement, but
rather update the two sites,
Jim Hartmann, County Administrator, stated the monies for this program were budgeted in a supplemental
budget,
Sheriff Johnson stated several agencies have come on the system and he expected more in the future, He
stated a lot of things have changed since the beginning of this program,
Chairman Phillips stated she had seen in papers that some of the Towns are coming on and Vail is planned
to be the dispatcher,
Sheriff Johnson stated his assumption is that everyone will eventually move towards Vail rather than go to
Grand Junction for a dispatcher.

analysis that has been undertaken,
Mark Donaldson & Russell Guise, architects, were present for the hearing,
Mr, Donaldson stated the objective was to build more on the natural bench, which nestles it in the trees, As
Upper Boarders Road has changed over the past several years, the applicant is proposing to set his house in between
the two properties on either side, He stated retaining walls have been reduced with the proposed setback.
Jim Fritze stated the applicant must mark all items as exhibits and surrender them to the Clerk at the end of
the hearing,
Mr. Lindahl marked Exhibits 1,2,3,4 & 5.
Mr, Donaldson explained the exhibits to the Board, He continued with his presentation speaking to solar
power, ridge line, setbacks and traffic,
Mr. Guise spoke to the drawings presented, He stated the setback is planned for 26 feet but the building is
only being moved 22 feet. He stated the view angle was increased and pointed out the view corridors on a plat. He
explained the measurements used for shadowing. He stated the house is two feet below the maximum building
height. He spoke to Exhibit 5,
Commissioner Gates moved to accept the exhibits into the record,
Commissioner Johnson seconded the motion, The vote was declared unanimous,
Mr. Guise showed a short video for the Board and pointed out various houses, ski slopes, retaining walls,
corners of the property,
Commissioner Johnson asked about trees to be taken down,
Mr. Guise stated any tree 4 inches in diameter will be transplanted, Anything larger will be cut down, He
continued to review the video,
Mr. Lindahl asked the Board join their Staff and the Beaver Creek Review Board and approve this
application, He spoke to the relevancy of any testimony other than those five adjacent property owners,
Mr. Fritze advised the Board can weigh any testimony,
Patricia Harrington, area resident, stated she believes this application is precedent setting,
Commissioner Johnson asked if the Town Council at Vail ever over rode an application,
Ms, Harrington answered yes,
Sheila Shmomiroff, area resident read a letter from the Reinholtz's, adjacent property owner, into the record,

Commissioner Johnson seconded the motion. Commissioners Phillips and Gates voting aye, Commissioner
Johnson abstained,
Chairman Phillips advised the applicant they may take their application before the civil courts for review,
Agreement, Town of Avon
Jim Fritze, County Attorney, presented an Intergovernmental Agreement between Eagle County and the
Town of Avon regarding Consultation on Planning,
John Dunst thanked Jim Fritze for these continuing negotiations and a presented a draft agreement which
serves the interest of the Town of Avon and the County of Eagle, He stated the Council supports the contents of the
agreement.
Peter Jamar, representing the owners ofthe proposed Vail Valley Center project, asked Mr. Fritze to give an
overview. He reiterated he is supportive of this intergovernmental agreement. He made clarifications in the IGA.
Bart Johnson reviewed the suggested language for the agreement. He wants to include that the Town does
not have unilateral denial rights.
Mr. Fritze stated the Board is giving the Town rights, He reviewed prior happenings for the Board, He
stated the Board did not feel it appropriate to approve that plan granting the Town of Avon the right to veto those
properties within unincorporated Eagle County, and stated those properties might remain there for an eternity, He
stated the County would consult with the Town and consider the Town's master plan, The Town would also be
agreeing to consult with the County and consider County Regulations,
Commissioner Johnson agreed with Mr, Fritze there may be some paranoia here. He stated if you look at
State Statutes, before you are able to adopt such plans there are certain things that have to be done, He stated one of
those criteria is a public hearing must be held,
Chairman Phillips stated the Town would serve as advisory to any property in unincorporated Eagle County,
Mr, Dunlevy stated he will pass the Board's comments on to the Avon Town Council. He stated the Town
is satisfied with the language,
Mr. Fritze stated he does not have a problem saying it is not these things if the Town of Avon doesn't. He
stated the Town of Avon has stated it is not their intent to veto applications,
Mr, Dunlevy stated this is a matter between the Board and the Town of Avon,
Commissioner Gates moved to approve the Intergovernmental Agreement between Eagle County, State of
Colorado and the Town of Avon, State of Colorado regarding Consultation on Planning.
Commissioner Johnson seconded the motion, The vote was declared unanimous,
Human Services Recommendations for 1998 Grant Funding
Kathleen Forinash, Human Services Director, stated the next item on the agenda was recommendations from
the Human Resource Council for funding 1998 Human Service Grants. She reviewed the proposed grants for the
Board, She stated the Eagle Care Clinic has seen a dramatic increase in their patients, The continuing grants in
priority one category are very important.
Chairman Phillips stated Eagle Care has been a benefit to the area, however she felt the majority of visiting
patients are primarily pre-natal and delivery services,
Ms, Forinash stated they are seeing a lot of those type patients and a meeting has been scheduled to discuss
these issues,
Chairman Phillips stated she believes it is a worth while grant but she believes the County also takes care of
the babies after they are born,
Ms, Forinash stated there are possible additional fees to be discussed.
Chairman Phillips asked about Mountain Hospice,
Ms, Forinash stated they are in very good financial status now,
Chairman Phillips questioned Cowboy Dreams, She stated she would like to see them get some monies,
Ms, Forinash stated they have grown a great deal in their fund raising, She stated the County does not make
referrals to that organization, They have not been certified as of yet and are in category 3 at the current time,
Commissioner Gates stated he believes the monies last year was for start up only, He questioned United
Way Eagle Valley,
Ms, Forinash explained the organization to the Board. She stated they are just getting started, She stated
