decision to be overruled so that they can keep this project moving forward.
Commissioner Gates asked if this was extended,
Mr. Clarkson responded it was extended one time,
Commissioner Gates questioned why they didn't bring it up at the time oftabling,
Mr. Clarkson stated staff made a decision based on the language of the resolution approved in January, Mr,
Clarkson further explained,
Chairman Phillips asked why a work in process doesn't meet the deadline,
Mr, Loeffler stated the regulation requires it be approved,
Commissioner Johnson stated it requires an approval by the Board of County Commissioners and the
request must be made in writing to the Board of County Commissioners thirty days prior to the expiration of the
sketch plan,
Commissioner Gates asked for advice,
Mr. Loeffler stated this regulation was adopted because the District Court did not allow for the extension
unless they adopted a regulation, The Board has no power other than that of the regulation, The result of that is the
Board doesn't have the right to extend this sketch plan approval. (The applicant didn't make a request until long
after the sketch plan had expired,) Mr, Loeffler pointed out this was the same problem when the applicant got an
extension the first time, Under this regulation, there is nothing to extend,
Chairman Phillips questioned the loss of the submitted documents, She suggested that should have
prompted discussion of the date of expiration,
Mr, Nichols stated had they been aware this was going to be the situation, they would have gone before
Planning and Zoning then,
Chairman Phillips asked if they have a date of completion,
Mr. Nichols stated they would like to discuss the outstanding issues with staff and move forward, however,
they do have matters yet to be discussed,
Commissioner Gates asked what options they have if in fact that have no right to extend this,
Mr. Loeffler responded it may not leave any positive options for the applicant. They fact is, he doesn't see
authority to extend the sketch plan approval.
Mr. Loeffler recalled a conversation in which this regulation was discussed, thus the extension for six
months,
Merv Lapin stated the distinction was that it had to be submitted, not that it had to be approved, He stated
they made the submittal in a timely fashion,
, Chairman Phillips questioned if Staff knew it would expire,
Mr. Clarkson responded he didn't until pointed out by the Attorney's Office,
Mr, Nichols was under the impression the submittal was the important issue,
Mr. Loeffler suggested it was stated at the hearing, and he has listened to the hearing tape, where the
regulation was quoted,
Chairman Phillips suggested the two year issue,
Commissioner Johnson explained what he recalled and that six months was requested because that was all
the time needed,
Mr, Lapin stated in this case, they were ready to move forward but staff lost the appropriate documents,
Mr. Loeffler stated they are stuck with the regulations as well as the County, He told the Board they can't
give a remedy in this situation, whether a remedy is required or not.
Commissioner Gates suggested that doesn't give them any freedom to try to solve, make it right, or make it
fair.
Mr, Loeffler suggested they could waive the fees if the sketch plan is resubmitted and resembles the
original.
Commissioner Johnson spoke to the court rulings and the requirements thereof, The applicant is then at
risk.
Mr. Lapin stated they know what they are getting into and the liability, It is not like this is a fast track
project, Mr, Lapin stated they are coming in with nearly the same project that they have seen, They will be trying
to phase it more than what they are currently showing.
Chairman Philips asked if a new submittal would be with the two year requirement.
Mr. Lapin stated they are hoping to get through this as it is very expensive to go through the sketch plan
