HomeMy WebLinkAboutMinutes 07/14/97 BOARD OF COUNTY COMMISSIONERS EAGLE, COLORADO RECORD OF PROCEEDINGS FORM 50 HOECKEL'S 387869 PUBLIC HEARING JULY 14, 1997 Present: Johnnette Phillips George "Bud" Gates James Hartmann Sara J, Fisher Chairman Commissioner County Administrator Clerk to the Board Absent: James Johnson, Jr, Commissioner This being a scheduled Public Hearing the following items were presented to the Board of County Commissioners for their consideration: Consent Calendar Chairman Phillips stated the first item on the agenda was the consent calendar as follows: A) Approval of bill paying for week of July 14, 1997, subject to review by County Administrator B) Approval of payroll for July 17, 1997, subject to review by County Administrator C) Approval of the Board of County Commissioner meeting minutes for June 26 & 30, 1997 and July 1, 1997 D) Approval of the County Veterans Service Officer's monthly report for June 19097 E) Agreement between Eagle County and Ireland Thomas Industries to crush, bale and remove all available white goods and scrap metal from the Eagle County Landfill F) Notice of Award for the 1997 Eagle County Guardrail project to Gonzales Construction Company, Inc, G) Agreement between Eagle County and The Guadalupe Dancers to provide entertainment at the Eagle County Fair H) Agreement between Eagle County and World Art Explorers to provide a childrens hands on art project at the Eagle County Fair I) Agreement between Eagle County and CZ Express to provide entertainment at the Eagle County Fair. Commissioner Gates asked about item E, Ron Rasnic, Eagle County Landfill, stated this is an annual disposal of the white goods, i,e, refrigerators, stoves, water heaters, etc. Commissioner Gates moved to approve the consent calendar as presented, Chairman Phillips seconded the motion, Of the two voting Commissioners the vote was declared unanimous, Commissioner Johnson was not present for the meeting, Plat & Resolution Signing Scott Hunn, Planner, presented the following plats and resolutions for the Board's consideration: 5MB-00065 Berry Creek Ranch Filing No.1. Commissioner Gates moved to approve Resolution 97-89 file number LUR-0026, Section 2,05.22 Commission Definition, ofthe Amendments to the Eagle County Land Use Regulations, incorporating Staffs findings and the insert of the comments, Chairman Phillips seconded the motion. Of the two voting Commissioners the vote was declared unammous, Mr. Montag presented Resolution 97-90, Section 2,07,14 Contiguous Parcels, He stated this language is being added to the regulations to provide for single ownership of contiguous parcels unless previously approved through the county subdivision process, Mr. Montag explained, Commissioner Gates asked if there is any discrimination between mining claims and plain lots, Mr. Montag responded no, Chairman Phillips asked what about a family? She referred to a situation in the Roaring Fork valley, Mr. Montag stated if the parcels are 35 acres or larger, they can do so without requiring a PUD, Mr. Montag stated in a situation where a rancher wants to deed off to separate individuals they can, Commissioner Gates asked about acreage less than 35 acres, Mr, Montag stated it can be done ifthey have the proper zoning and go through the subdivision process, Chairman Phillips stated that's what she is trying to avoid, Commissioner Gates moved to approve Resolution 97-90, file number LUR-0026, Section 2,07.14 Contiguous Parcels as an Amendment to the Eagle County Land Use Regulations, incorporating Staffs findings, Chairman Phillips seconded the motion. In discussion, Chairman Phillips stated she wanted the record to reflect there are always exceptions, Chairman Phillips called for the question on the motion, Of the two voting Commissioners the vote was declared unanimous, Mr. Montag presented Resolution 97-91, Section 2,17,02 Sketch Plan Review and Section 2,18.02 Preliminary Plan review, Per recently revised State Statute, the review time for referrals has been changed from 35 days to 21 days, Commissioner Gates moved to approve Resolution 97-91 file number LUR-0026 Sections 2.17,02 and 2.18,02, Amendments to the Eagle County Land Use Regulations, incorporating Staffs findings, Chairman Phillips seconded the motion. Of the two voting Commissioners the vote was declared unanImous, Mr, Montag presented Resolution 97-92, Section 2,15 Submittal Dates, Review Procedures and Fees, He stated per recently revised State Statute, public hearings on land use applications cannot be continued for more than 40 days without written consent of the applicant, a procedure is being proposed for various land use applications to "post" the property with a sign(s) that provides information relative to Planning Commission and Board hearing dates, Language for Board of County Commissioner hearings is being established to allow for Monday or Tuesday public hearings, Currently all planning files are heard by the Board on Tuesday's This allows more flexibility for the Board to hear planning files. Mr. Clarkson spoke more specifically to condition #6 stating they would be receiving more information as the proceed this year, The Planning Commission did approve this file with two conditions. Sara Scott, applicant, thanked the Board for hearing this issue, She stated they have been limited by the Forest Service to 2,500 vehicles, They don't want to have that many, They have set a limit to 1500 owners vehicles with a couple of staff vehicles, She stated they are close to that point. She stated they get about 2,7 people per vehicle making for about 4,500 people, A big part ofthis program is to educate their users on off road abilities by their vehicle, They have 4 X 4 trails that they rate. If an owner is interested they may call in to determine where they will be placed on the skill level trails, They send people out on the trails about every hour. They have a maximum of ten vehicles going out on the trails at one time, They are increasing their presentation of Trail Guides on the trails, They are experienced off roaders and know the area, She asked for specific questions to be answered, Commissioner Gates asked about reseeding, Ms. Scott stated they have had a revegetation plan the last two years, They have suggested that perhaps they not revegitate again this year, Commissioner Gates stated he doesn't understand why this kind of thing can continue without an full environmental study, Chairman Phillips asked about the EIS and the forest service determining not to do it. She asked if the Board can require it. Jim Fritze, County Attorney, stated the regulations require they look at the environmental issues though they are preemptive from looking at the land use regulations, He stated the County has the power to enforce the environmental concerns. Nicola Ripply, Mountain Environmental Solutions, stated when they came on Board they have assimilated the information gathered by the Forest Service, They have done some studies and addressed the issues brought up by the DOW, They looked at the success of the revegetation and considered it reasonably successful. She stated making the area a sacrifice site has come up since, From the last planning commission meeting they were asked to look at storm water issues, They propose to be present at the event and then submit a report after the event to provide an independent summary of the events, Commissioner Gates asked what would happen if they come back and find they should have done something they didn't. Mr, Clarkson suggested they would have to use this as an educational experience but he doesn't think that they can condition after the fact. Chairman Phillips suggested it would impact their coming back another year, Sheriff A.J, Johnson was present and stated he has been part of this for the last few years, He stated they have found the events to be very orderly and the damage, from their standpoint, to be minimal.
