This being a scheduled Public Hearing the following items were presented to the Board of County
Commissioners for their consideration:
The Board convened as the Local Liquor Licensing Authority,
Fireside Lodge
Earlene Roach presented a renewal of a Hotel and Restaurant License with Extended Hours for Gwendolyn
Braatz, dba/Fireside Lodge, The Sheriffs Office reports no complaints or disturbances during the past year, This
application is in conformance with all rules and regulations and all fees have been paid, Staff recommended
approval.
Gwen Braatz, owner of the Fireside was present for the hearing,
Commissioner Gates moved to approve the renewal of a Hotel and Restaurant License with Extended Hours
for Gwendolyn Braatz, dba/Fireside Lodge,
Chairman Phillips seconded the motion, Of the two voting Commissioners the vote was declared
unanImous,
Lodge at Cordillera
Earlene Roach presented a modification of premises for Kensington Management, Inc., dba/Lodge at
Cordillera, She stated the applicant is proposing to add twenty-eight rooms to the existing lodge and three separate
optional premises, She stated the application is in conformance and the Board has been given the maps, There
have been no complaints or disturbances during the past year and all fees have been paid, Staff recommended
approval.
Commissioner Gates asked if this is an addition to the premises,
Ms, Roach responded yes,
Mark Avery, Kensington Partners, explained the expansion ofthe lodge, He stated they are licensing the
short course, the ten hole course called Kensington Green, They wish to have a pub there and license it as well.
Commissioner Gates asked if the tennis courts are considered,
Mr. Avery responded they are part of the original license.
Commissioner Gates questioned people walking from the golf course to the tennis courts.
Mr, Loeffler asked the applicant to explain the maps,
Rick Rosen, Attorney representing the applicant, stated the map they are speaking of shows the red in the
upper portion outlining the lodge, the path to the tennis courts is shown as well as the actual courts, These are not
include in this application as they have been previously licensed, He stated the current modification is a two piece
modification, One with the expansion ofthe hotel and as shown on another map, the lodge and the larger, green
area, which is the ten hole golf course, Because there is a roadway, they are asking for more than one optional
premise to encompass the golf course, The pub is part ofthe new facility,
Commissioner Gates asked about the path from the lodge to the tennis courts and if people will be walking
from the tennis courts to the lodge,
Mr, Rosen explained the path is strictly a path, It can be patrolled, but they have not found it necessary to

Max Scott, Oedipus Inc" passed out a report summarizing their survey findings, Mr, Scott stated this is
their 28th business year. They have done over 5000 surveys for licensing, He explained their procedures, He
stated the format they use, which was recommended by the county, allows them to determine the need, He
explained the survey results.
Mr. Loeffler asked about the lines on the maps, Mr, Loeffler suggested the area defined as the
neighborhood is where they collected signatures. He suggested the Board redefine the neighborhood,
Mr. Rosen stated they would go back to the original recommendation by staff for the neighborhood
boundaries,
Commissioner Gates modified his original motion regarding the neighborhood to in a two mile radius from
the establishment.
Chairman Phillips seconded the motion, Of the two voting Commissioners the vote was unanimous,
Commissioner Gates moved to establish the need for the Cordillera Valley Club as evidenced by the
submitted petitions,
Chairman Phillips seconded the motion, Of the two voting Commissioners the vote was unanimous,
Commissioner Gates asked if this is a gated community,
Mr. Avery stated it is still a gated community but members of the public will be admitted through the gates
for golf and to the restaurant.
Mr, Rosen explained this license is very similar to the GEMSA license, He stated the license application
has been provided and he believes they will find the application complete,
Chairman Phillips asked who will be managing the license,
Mr. Rosen stated it will be John Warnack. He stated Mr, Warnack is very familiar with the Colorado Liquor
codes and understands the liquor laws,
Mr. Loeffler asked about the control within the restaurant facility and conduct of employees,
Mr. Rosen responded it will be similar to the way they run the other club,
Commissioner Gates moved to approve the new hotel and restaurant license with extended hours and
optional premises for CVC Management, dba/The Chaparral.
Chairman Phillips seconded the motion. Of the two voting Commissioners the vote was declared
unammous.
Commissioner Gates moved to approve the managers registration for John Warnack.
Chairman Phillips seconded the motion, Of the two voting Commissioners the vote was declared
unammous.
Lodge at Cordillera
Chairman Phillips continued the hearing with the modification of premises for the Lodge at Cordillera,
Mr. Loeffler explained his understanding that the management and support will be provided by the Lodge,
There was discussion of the facility and how it relates to the recreational facilities and the similarities to Whittaker
Cabin,
Commissioner Gates moved to approve the modification of premises for Kensington Partners, dba Lodge at
Cordillera,
Chairman Philips seconded the motion, Of the two voting Commissioners the vote was declared
unammous.
Commissioner Gates moved to adjourn as the Local Liquor Licensing Authority and reconvene as the Board
of County Commissioners,
Chairman Phillips seconded the motion, Of the two voting Commissioners the vote was declared
unanImous,
Abatement Hearings
Allen Black, Assessor's Office, presented a petition for abatement, schedule number 011885, First Bank of
Vail. The Assessor's Office recommended an abatement different than requested, He stated this is for 1994 and
1995, He stated the abated amounts vary, They are recommending for 1994 an abatement in the amount of

and for the clubhouse itself. 1994 is not subject to abatement. They have a copy ofMr. Monroe's exhibit A. He
stated the date of appraisal is 1996, The date of valuation the Board needs to look at is June 1, 1992, Mr, Black
explained the clubhouse construction and the remodel. Based on what they learned, they came out with a square
footage of 15,000 square feet more or less. Mr. Monroe has provided them a copy which shows the square footage
of 13,500. Mr, Monroe is contesting the valuation ofthe golf course, Mr, Black referred to a valuation placed on
the land by the Board of Equalization, Mr, Black handed out a sheet that compares the values, In 1994, the course
they felt was $2,800,000,00, Mr. Black further explained,
Mr, Monroe stated some of the dogumentation was submitted because the original hearing was going to be
for more than one year,
Mr. Black stated to summarize for 1994, his office is recommending denial.
Mr, Monroe stated in looking at the property in 1994 and the methodology used to arrive at the clubhouse
value and the golf course value they found the square footage of the clubhouse was incorrect, They corrected that,
They also looked at the restaurant approach,
Mr. Black interrupted and clarified the valuation,
Mr, Monroe stated the square footage was corrected once reduced by 2,500 square feet. The components of
a clubhouse were reviewed, The clubhouse is ten years old, Mr. Monroe then spoke to the golf course which was
constructed in 1984, The land value was established,
Chairman Phillips stated the items have been appreciated since they were built. He showed the information
to Mr, Monroe,
Mr, Black stated because they weren't allowed in the property they had to guess the square footage, That
has been corrected, Mr. Black spoke to the other golf courses having been built in the valley, He stated
comparisons cannot be made outside of the valley, The maintenance is standard for any course in this part of the
State,
Mr. Monroe spoke to the depreciation factor having reviewed Mr, Black's documentation, He spoke to the
cost approach, Monroe further discussed his point of view on these valuations,
Mr, Black stated the correction to the square footage was wrong, They have not done a physical inspection
though they have been welcome to it. To make an adjustment now, that they are able to provide documentation to
will not hold up, Mr, Black again spoke to the valuation made at that time,
Chairman Gates asked if the corrections have been made,
Mr, Black stated based on the information they have received they have made the square footage correction
for 1996, Mr. Black stated that was reflected in the tax bill for 1996,
The Assessors Office recommended denial of all petitions,
Commissioner Gates moved to deny the petitions for abatement schedule number 020827, 18626, 18128,
17834,020833 and 20829, as recommended by the Assessor.
Chairman Phillips seconded the motion, Of the two voting Commissioners the vote was declared
unanImous.
Commissioner Phillips asked they return to schedule numbers 030413 and 030415,
Mr, Black stated they have combined the valuations for the tax year 1994 for the two different schedule
numbers, Mr, Black explained they recommended denial because the income approach resulted in a greater
valuation than with the proforma income approach,
Mr, Monroe stated for 1995 that has been settled,
Mr. Black explained they are in agreement for tax year 1995 on 030413. On 030415 they are in agreement
as well, Tax year 1994 is still in question.
Commissioner Gates moved to deny the abatement for 1994 for file #030413 and 030415.
Chairman Phillips seconded the motion, Of the two voting Commissioners the vote was declared
unanImous,
Commissioner Gates moved to approve, for 1995, the abatement for file #030413 in the amount of
$5676,79 and for #030415 in the amount of $3,584.43,
