Commissioner Johnson asked to discuss item C. He asked if the monies to pay for this project will be reimbursed from either the Texaco or Wendy's corporation. Peter Sulmeister, Engineering Technician, stated he is not completely sure. He said this is part ofthe striping project and there was some additional stripping done in that area. Commissioner Phillips stated they had some monies left over as part of the collateral. Jim Fritze, County Attorney, stated they would have to do a change order to do the project. He explained the normal process and that they have not drawn on the collateral because they don't know the extent of the damages at this point. Chairman. Gates asked if this can be pulled for a week. Mr. Fritze responded the work is done and there is no reason to delay payment. Either he or Mr. Hartman can review it. Commissioner. Johnson suggested tabling until tomorrow and item #B also. He questioned item #D and the fact it runs from September to September. He would like to see the dates changed to be December to December. Mr. Sartin looked at the contract. Commissioner. Phillips suggested they first started this in September in 1987. Commissioner Johnson stated the problem is they are approving a contract that has already been in effect. He would like to see this end on December 31, 1997. Mr. Sartin concurred. He suggested A.J. Johnson be the one to make the final decision. Mr. Fritze stated there are other people involved and Colorado West may want it as is. Chairman. Gates suggested it be tabled to tomorrow as well. Commissioner Johnson asked that item #E be tabled for a week or so, or however long it will take to see if there is a way to work the Friday after Christmas into the plan. Mr. Fritze stated the only constraint is that New Year of 1997 must be published. Mr. Fritze suggested they amend the resolution eliminating the half day before Christmas and then a determination as to the day after Christmas. Commissioner Johnson moved to table items B, C, and D to tomorrow and amending item E as stated above. Commissioner Phillips seconded the motion. The vote was declared unanimous. Final Settlement, Kahn & Company Paul Gregg, Buildings & Grounds Supervisor, presented final settlement with Kahn and Company for replacement of carpet at the Eagle County Justice Center. He stated no claims have been received. Staff recommended approval. Mr. Gregg stated they are in the warranty period now. Commissioner. Phillips asked about the color and about any pieces large enough to use elsewhere. Commissioner Phillips moved to approve final settlement for Kahn and Company, as recommended by Staff. Commissioner Johnson seconded the motion. The vote was declared unanimous. Resolution 96-156, 1997 Proposed Budget Allen Sartin, Finance Director, presented Resolution 96-156, adopting the 1997 proposed Eagle County Budget. Staff recommended approval. Chairman Gates asked if all the changes have been considered. Mr. Sartin responded yes and the summary attachments explain those. He stated the only concern he has is the general fund balance of 1997 does not meet the minimum required. He stated he is anticipating a fund balance, however, it will make it more difficult in the spring to do supplementals. Fund balance may not then be available early in the year. Jim Fritze asked about the "required" and if it is an internal practice and not a statutory requirement. Commissioner Johnson moved to approve Resolution 96-156, adopting the proposed 1997 Eagle County Budget. Commissioner Phillips seconded the motion. The vote was declared unanimous. Resolution 96-157, Rules & Regs for Ground Transportation Jim Elwood, Airport Manager, presented Resolution 96-157, adopting the revised rules and regulations for ground transportation at the Eagle County Regional Airport. Mr. Elwood asked that section #3 be amended. He explained the amendment to the Board stating it would change the 6% to 14% ofthe rentals. Commissioner Phillips asked if the carriers are aware of this. Mr. Elwood stated they are. Commissioner Phillips moved to approve Resolution 96-157, Rules and Regulations for ground transportation at the Eagle County Regional Airport adopting #3 as set forth in the draft. Commissioner Johnson seconded the motion. The vote was declared unanimous. AFP-00009, Bachelor Gulch Kathy Eastley, Planner, presented file number AFP-00009, Amended Final Plat, Bachelor Gulch Village, Filing 1, Lot 30 at Beaver Creek. The applicant wishes to vacate the common lot line between Lots 29 and 30 to create one large lot, to be called lot 30, from the two smaller ones. Staff recommended approval. Commissioner Johnson asked if this is reducing the density. Ms. Eastley responded that at a later time the density will be shifted. Bob Loeffler, Asst. County Attorney, asked if these are single family. Commissioner Johnson clarified the floating density can then be anywhere within the PUD. Commissioner Johnson moved to approve file number AFP-00009, Amended Final Plat, Bachelor Gulch, Filing 1, Lot 30 at Beaver Creek. Commissioner Phillips seconded the motion.
