This being a scheduled Public Hearing the following items were presented
to the Board for their consideration:
Plat & Resolution Signing
Kathy Eastley, Planner, presented the following resolutions to be signed
by the Board:
Resolution 96-132, file number PD-139-96-A2, Arrowhead Village
Conceptual Plan. She stated this was a resolution for the approval of a
development area plan located in the Arrowhead at Vail Subdivision. This
application was heard by the Board on September 17, 1996.
Commissioner Johnson moved to approve Resolution 96-132, file number PD-
139-96-A2, Arrowhead Village Conceptual Plan.
Chairman Pro-tem Phillips seconded the motion. The vote was declared
unanimous.
PD-337-96-F1, Knudson Ranch
Kathy Eastley presented file number PD-337-96-F1, Knudson Ranch. She
stated this was a request for a final plat approval and associated
Subdivision Improvements Agreements. She stated the Board conditionally
approved the preliminary plan. Ms. Eastley stated the plat note has been
corrected. Staff recommended approval.
Rick Plyman, representing the applicant, addressed the collateralization
and school land dedication fees. He stated when this application was first
started it was decided this was not the place for single family lots. It was
decided to place duplexes on this property. Mr. Plyroan stated the school
district had related they needed almost twenty thousand dollars, but the
applicant determined this was multi-family housing and the school land
dedication fee should be the same.
Commissioner Johnson asked if anyone knew school district logic.
Mr. Plyman explained the changes in the process.
Jim Fritze, County Attorney, stated there was a study done by Jim
Collins, a consultant firm at that time, because of the second homes and the
ski bums, there was not much impact at that time. It is Staff's belief that
it is no longer true and are currently looking at re-writing the regulations.
Commissioner Johnson stated these are not being looked at as second

homes but rather family residences.
Sandy Treat, applicant, stated it is hard to see how the market will
perceive the development. They could be a nice primary residence for someone
but could also be used as second homes. He stated there are six purchases
that are not primary residences.
Commissioner Johnson questioned the difference in fees.
Mr. Plyman stated there is a $16,000 difference.
Mr. Treat stated with regards to collateralization, this type
development goes through the process but still has steps to go through before
the units can be sold to the owners. Essentially there are three more steps.
He stated to bond this entire development is over kill in this type of
project. It is not like land development where you convey lots rather than
houses. This development is unique and he plans to convey the
infrastructures in advance.
Mr. Plyman stated the County has a standard plat note, and this note
doesn't quite fit. He believes it would be to everyones benefit to change
the language in that note. He stated it makes sense to build the water
lines, roads and buildings all at once. He stated the applicant would still
have to come back through the Minor Type "B" Subdivision process before any
units are sold.
Kathy Eastley stated there are several methods in which the applicant
can provide collateral. She stated the options are open to all developers.
Mr. Treat stated Club Cottages were conveyed as lots then built upon.
Jim Fritze read from Colorado Revised Statutes indicating what items
shall take place before the plats are recorded.
Discussion continued on the collateralization of the property.
Jim Fritze continued to read from State Statutes for the Board. He
stated all items revolve around the worse case scenario. If there are public
improvements, those need to be collateralized to assure they are complete.
Mr. Plyman asked if the County was not already protected because the
applicant must come through another process before any property is conveyed.
Chairman Pro-tem Phillips stated she believes it is necessary for
collateral to be in place. She asked what would work better than a plat
note.
Mr. Fritze stated since the plat note is currently on the plat, the
Attorney's Office is willing to see if there is dialog that could be used
rather than cash collateral to see if there is a way to solve it. The
applicant could then renew any arguments they so choose.
Commissioner Johnson moved to approve file number PD-337-96-F, Knudson
Ranch, incorporating Staff findings.
Chairman Pro-tem Phillips seconded the motion. Of the two voting
Commissioners the vote was declared unanimous.
Commissioner Johnson moved to approve and authorize the Chairman Pro-tem
to sign the construction plans and the SIA.

LUR-021-96, Land Use Regulations
Kathy Eastley presented file number LUR-021-96, Land Use Regulations.
She stated this was a request to amend the definition of a Recreation
Facility, by adding "sales and service of motorized recreational vehicles."
She presented a request from Knight Planning requesting this matter be tabled
to October 29, 1996 to review the proposed changes.
Tom Boni, Knight Planning Services, stated they believe that although
this is a change to the Land Use Regulations, there are two applications
coming before the Board which this change will affect. He stated the
Planning Commission has been invited to the site of Nova Guides.
Commissioner Johnson stated this application is for a change in the Land
Use Regulations and not a specific file.
Mr. Boni stated the reason for the tabling request is to allow time to
review the possibilities of the proposal to allow everyone to fully
understand those changes.
Commissioner Johnson stated when the zone districts were developed they
did not come with a particular development in mind.
Chairman Pro-tem Phillips suggested this matter be tabled until all
three Board members can be present.
Commissioner Johnson moved to table file number LUR-021-96, Land Use
Regulations, to October 8, 1996.
Chairman Pro-tem Phillips seconded the motion. Of the two voting
Commissioners the vote was declared unanimous.
PD-353-96-S, Mountain Shadows Condominiums
Paul Clarkson, Planner, presented file number PD-353-96-S, Mountain
Shadows Condominiums. He stated this was a request for a PUD Sketch plan for
72 multi-family dwelling units in three buildings on 5.26 acres. Staff
recommended denial.
Steve Isom, representing applicant, showed the Board three different
placements of the three buildings. He gave the Board copies of the various
placements.
Jill Kovasovich, asked for a 15 minute recess to give her time to
receive the final terms of the agreement.
Chairman Pro-tem Phillips told Mr. Isom she liked the new layout.
Commissioner Johnson stated the new configuration allows for a
perception of open space.
Commissioner Johnson moved to table this item for 15 minutes until 5:30.
Chairman Pro-tem Phillips seconded the motion. Of the two voting
Commissioners the vote was declared unanimous.
Ms. Kovasovich presented the terms of the settlement agreement and asked
the Board for questions regarding the agreement.
Commissioner Johnson asked if the terms would have any effect on the
decision the Board will make.
Mary Jo Berenato, Deputy County Attorney, replied yes.
Ms. Kovasovich stated she has 11 point terms and can reduce it to an
agreement.
Chairman Pro-tem Phillips asked about the legality of the agreement.
Ms. Kovasovich commended the residents to see the pros and cons of the
application. She asked the Board to hear from the residents.
Chairman Pro-Tem Phillips asked for public comment from residents of the
mobile home park.
Monet Martin, resident, stated she just found about the settlement
immediately before the hearing. She stated she is happy they are working on
an agreement and are hashing out some further details. She spoke of concerns
regarding the vacation date. She had a prepared speech but declined to read
it.
G.W. Farrar, resident of the mobile home park, stated he has thoughts
logistically speaking and his thoughts about who the project is for and where

these people will go. He hopes the Commissioners can keep this all in
perspective. Mr. Farrar spoke to the details of the project in Gypsum and
the new trailer park as listed in the thirty five cent trailer park. It is
something to consider. Perhaps there will be influence by Vail Associates
who will encourage housing for the "worker bees". He hopes that
communication can continue. He stated he hates being compared to Avon
Station. They had a place to go to and now all the space is sucked up. Is
this a cart before the horse issue. Perhaps the new trailer park could have
been on line before this. It's all hindsight now. Whatever decision is
reached, he hopes it will be for the good of the valley, of the river. He's
still wondering, where will he go.
Jim Chamblis, council for the residents of Lone Pine, stated he is proud
of the steering committee and they pulled together on behalf of the
residents. All residents can be proud of those who took responsibility. It
is difficult for an attorney in a position such as this. He represents some
bright people, some assets to this community. There is a need for low income
housing and that is why this issue has been so trying. They have dealt with
it well but it does create a strain on all the residents. There is a need
here is what is on going. That need is a place for them to go. He hopes
they can work together as a community to make something available fore them.
Bill Williams, Riverwalk, stated this should bring to light there is a
great need for something like a trailer village. Respectable housing for
people who don't make as much money as others. They are caught up in a
situation before there were rules. He asked the planning staff how many
places they have set aside for housing such as this. There is a great need
for people who don't make as much money as others. This has brought to light
the problem as to where these people go.
Commissioner Johnson stated, "governments don't move rapidly.. .period,
and they don't move at all if you don't get active".
Commissioner Johnson discussed the need to do something more than
housing the worker bees. We as citizens of this county need to set aside a
little bit of time to ask ourselves, what do we want and what do we need to
do to take part. Each of us needs to give a damn and advocate for affordable
housing.
Monet Barton asked Commissioner Johnson how they propose to do that.
Chairman Pro-tem Phillips stated they met with the housing director
today and discussed areas that would be set aside for mobile home parks.
They are in the draft mode and face potential approval within the next year.
Ms. Barton asked what can be done for the people who live in Eagle River
Villas.
Commissioner Johnson stated they are updating the land use regulations
and there will be provisions within those that will require if you are going
to take away what is considered affordable housing you will be required to
provide affordable hosing elsewhere. She stated there are 380 homes there
including the Aspens. She said it could be in any developers best interest
to do so.
Chairman Pro-tem Phillips stated they have some food for thought and the
reason this is the last time to carry this on was that they did not ask for
it to be extended.
Commissioner Johnson clarified it was the last day for the applicant to
ask for any extension.
Jill Kovasovich summarized as an advocate of the county and of the
people reminding the board the mobile home park issue is not new. She thinks
we are in a good environment to look at quality projects that will allow for
some land ownership. These are long term people, not transient. To prevent
this from happening at Eagle River Village is to prepare for an alternative
place for people to obtain land ownership. If you look at the scale, the
middle portion is missing. We must take a concentrated look now combining
home ownership and landownership.
Chairman Pro-tem Phillips stated that is what she referred to and those
are some very good ideas that they as a Board need to look at.
Commissioner Johnson moved to approve file number PD-353-96-S, Mountain
Shadows Condominiums, incorporating Planning Commissions recommended
conditions as well as incorporating the applicable findings. He asked staff
for clarification.
Mr. Clarkson stated he will use the Planning Commission's findings.
Chairman Pro-tem Phillips seconded the motion. Of the two voting
Commissioners the vote was declared unanimous.
There being no further business to be brought before the Board the
meeting was adjourned until October 7, 1996.
