This being a scheduled Public Hearing the following items were presented
to the Board of County Commissioners for their consideration:
Plat & Resolution Signing
Kathy Eastley, Planning Technician, presented file SM-1060-96 Arrowhead
at Vail Filing No. 13, A Resubdivision of Lot 28. She stated this was a
Minor Type B Subdivision, a resubdivision of Lot 28 to create Lots 28 and 29.
Lot 28 is planned as a part of the Arrowhead Village core, and lot 29 is
being created for residential purposes. Staff recommended approval.
Commissioner Phillips moved to approve SM-I060-96 Arrowhead at Vail
Filing No. 13, A Resubdivision of Lot 28.
Commissioner Johnson seconded the motion. The vote was declared
unanimous.
Ms. Eastley presented file 5MB-00001 Terrace Ridge at the Homestead,
Phase III. She stated this was a Minor Type B Subdivision, a resubdivision
of Tract C to create 16 townhome units, common area and future development
area for the remainder of the units permitted to be built on this site.
Staff recommended approval.
Commissioner Johnson moved to approve 5MB-OOOOl Terrace Ridge at the
Homestead, Phase III.
Commissioner Phillips seconded the motion.
Chairman Gates questioned while doing this resubdivision if they would
be creating additional density.
Ms. Eastley responded no.
Chairman Gates called for the question on the motion. The vote was
declared unanimous.
PD-139-96-Fl, Arrowhead at Vail
Kathy Eastley presented file number PD-139-96-Fl, Arrowhead at Vail, Lot
22B, Filing 11. She stated this was a request for a final plat to
resubdivide Lot 22B to create 4 lots and an open space tract on 3.936 acres.
Staff recommended approval. She stated the applicant today is represented by
Jim Mandel and Pat Maher.
Chairman Gates asked about the noise being adjacent to the maintenance
shop.
Commissioner Johnson asked what type of maintenance facility it is.
Ms. Eastley responded it is where most of the equipment is kept.
Commissioner Phillips moved to approve file number PD-139-96-Fl,
Arrowhead at Vail, incorporating Staff findings.
Commissioner Johnson seconded the motion. The vote was declared
unanimous.

at Vail, Clubhouse. He stated this is a correction plat to correct an
address error. The access has been changed from Sawatch Drive to Wildflower
Place. There are twelve total units. He stated this was a request for an
amended final plat. Staff recommended approval.

Commissioner Phillips seconded the motion. The vote was declared

PD-139-96-AF2, Arrowhead at Vail
Paul Clarkson presented file number PD-139-96-AF2, Arrowhead at Vail,
Dakota. He stated this is a correction plat to correct address errors. In
this case, he stated the addressing was not well enough reviewed in 1994.
What they have done is change the street names and the addressing. They
created three different streets. He stated this was a request for an amended
final plat. Staff recommended approval.
Commissioner Phillips moved to approve file number PD-139-96-AF2,
Arrowhead at Vail, Dakota, incorporating Staff findings.
Commissioner Johnson seconded the motion. The vote was declared
unanimous.
SE-326-96, Bionaz Exemption
Paul Clarkson presented file number SE-326--96, Bionaz Exemption. He
stated this was a request for an exemption plat approval. John Bionaz was
present for the hearing. Mr. Clarkson stated the parcel was created in 1976
despite the regulations in place at the time. This parcel is about .4 acres.
The County Engineer noted if the County Road does not meet the standards,
perhaps the right-of-way should be obtained. This is not the proper venue to
create the additional right-of-way. Staff recommended approval.
Mary Jo Berenato, Deputy County Attorney, clarified the advice given to
the applicant during the exemption process that dedication for approval could
be restricted.
Chairman Gates asked about the location as being Chatfield Ditch. He
asked Mr. Bionaz if he understand the County may need to secure right-of-way
at some point in the future.
Mr. Bionaz responded yes.
Chairman Gates asked about the age of the house.
Mr. Bionaz stated the old cabin was there beforehand but Woods built the
new cabin in 1976. Mr. Bionaz stated he thinks it is the original spot where
the original owner had 100 acres.
Commissioner Johnson moved to approve file number SE-326-96, Bionaz
Exemption, incorporating Staff findings.
Commissioner Phillips seconded the motion. The vote was declared
unanimous.
Resolution 96-114, Submission of Electors, Property Tax Levy
A.J. Johnson, Eagle County Sheriff, presented Resolution 96-114,
providing for the submission to the registered qualified electors of Eagle
County, Colorado, of a question of authorizing the imposition of an
additional property tax mill levy. He explained the Resolution to the Board.
He explained two sites have the equipment in. Phase I is moving rapidly,
This taxing issue is dealing with Phase II and the five additional sites. He
stated there will be a full informational release available in the next few
days. He stated they have started doing public presentations already and
they are doing one in Red Cliff tonight. Mr. Johnson showed a video. He
stated they did the original filming and then Garton Productions put it all

together.
Commissioner Phillips questioned this being the only option.
Mr. Johnson responded it could be done otherwise, but the requirements
to do so would be more costly and less efficient. They certainly did a full
evaluation before making this decision. This allows for a lot of additional
growth. He explained the migration of other agencies to get on. He stated
they have an Inter-Governmental Agreement which the Board will review. It
clarifies the specifics and allows for migration without having to buy all
new equipment. The 800 technology provides them some other support that is
needed now.
Commissioner Johnson summed it up to say it's "better, faster and
cheaper". He stated cheaper, perhaps not up front, but in the long run
certainly.
Commissioner Phillips asked what the 1.5 mills will provide.
Mr. Johnson stated 1.4 million over three years. These monies will be
specifically for Phase II. It will total 29 repeaters. He stated will have
upwards of 90% coverage for the County. It buys all the upgrades of
equipment. He plans on having this done by 1999. There is still a lot of
work to do.
Commissioner Phillips questioned the up to 1.4 million.
Mr. Johnson stated they can only take up to 1.4. They are not gambling
on the valuation. It is all built in to cover the cost amount.
Chairman Gates questioned abatements and changes in assessment. He
questioned the spending of any other revenue or funds.
Mr. Johnson responded it would not stop anything else in the budget.
Commissioner Phillips moved to approve Resolution 96-114, providing for
the submission to the registered qualified electors of Eagle County of a
question of authorizing the imposition of an additional property tax mill
levy.
Commissioner Johnson seconded the motion. The vote was declared
unanimous.
The formulas for figuring out the cost per household comes out to being
approximately $29.00 per year.
Resolution 96-115 and Resolution 96-116, Conferring Power of Attorney
Mary Jo Berenato, County Attorney, presented Resolution 96-115, Power of
Attorney and conferring authority on the Attorney's Office to draw on Letter
of, Cordillera Valley Club Letter #3, Resolution 96-116 Cordillera Valley
Club Letter #4. Staff recommended approval.
Commissioner Johnson moved to approve Resolution 96-115 conferring power
of attorney for Letters of Credit for Cordillera Valley Club.
Commissioner Phillips seconded the motion. The vote was declared
unanimous.
License Agreement, Buchholz Property
Mary Jo Berenato presented a License Agreement between Eagle County and
The Buchholz', to permit use of an access road through their property.
Sheriff Johnson stated this is a site on Beacon Hill. There were some
problems with access to the site but they have come to agreements regarding
the site.
Ms. Berenato stated this is a five year agreement and explained the
amendment 1 issue.
Chairman Gates asked about road improvements.

Sheriff Johnson responded "he hopes not". He explained Holy Cross does
have access.
Staff recommended approval.
Commissioner Phillips moved to approve the License Agreement between
Eagle County and the Buchholz'.
Commissioner Johnson seconded the motion. The vote was declared

1041-00001, Completeness Hearing
Ray Merry, Environmental Health Officer, presented file number 1041-
00001, sewer extension service along Highway 6, completeness hearing. He
stated this was a request to accept the application as complete for sewer
line extension along Highway 6. He stated this is just to the west of the
Brett Ranch and east of Hillcrest Bridge. Staff recommended approval.
Commissioner Johnson moved to find the application complete for the
Eagle River Water and Sanitation District for a major extension of an
existing sewage treatment system as complete. The estimated fee to process
this application is $725.00, which may be increased to cover the actual cost
of review and public hearings.
Commissioner Phillips seconded the motion. The vote was declared
unanimous.
PD-108-96-AF3, Berry Creek
Patti Haefeli, Planning Technician, presented file number PD-108-96-AF3,
Berry Creek, Lot 11, Filing 4, Block 2. She stated this was a request for an
amended final plat for the reduction of Eagle County's road maintenance
easement to vacate seven and half feet of a road maintenance easement
located within on Lot 11, Block 2, Filing 4, Berry Creek Ranch Subdivision.
all owners of any property within 250 feet of the property for which this
vacation, have been notified. Eagle County Road and Bridge Division made a
site visit and agreed to the reduction of this easement. Staff recommended
approval.
Commissioner Johnson asked when this request was made.
Ms. Haefeli responded on some lots these easements are large in this
case, it is a pie shape configuration.
Chairman Johnson asked about the size of the original easement and if
there will be a 12 and 1/2 foot road maintenance set back.
Ms. Haefeli explained.
Commissioner Phillips moved to approve file number PD-108-96-AF3, Berry
Creek, Lot 11, Block 4, incorporating Staff findings.
Commissioner Johnson seconded the motion. The vote was declared

SE-328-96, Eagle County McCoy Shop Exemption
Patti Haefeli presented file number SE-328-96, Eagle County McCoy Shop
Exemption. She stated this was a request for an exemption plat for the Eagle
County Road & Bridge Facility. The applicant is requesting exemption
approval for an existing parcel created by the purchase of land from the BLM.
Eagle County had a special use for gravel extraction. In October 1995 the
County purchased this land from the BLM. Staff recommended approval.
Commissioner Johnson moved to approve file number SE-328-96, Eagle
County McCoy Shop Exemption, incorporating Staff findings.
Commissioner Phillips seconded the motion.
Chairman Gates stated there is a site concern.
John Althoff, Engineering Technician, stated he is not real familiar
with the area and maybe he can get together with Don Fessler and take a look.
Chairman Gates called for the question on the motion. The vote was
declared unanimous.
SM-807-92, Hat Creek Subdivision
Paul Clarkson presented file number SM-807-92, Hat Creek Subdivision.
He stated this was a request for the subdivision of three single family lots.
This Minor Type A Subdivision application proposes to develop three single
family parcels in conformance with the existing Rural Residential Zone
District. There are two 3-acre parcels and one 2-acre parcel. The 8.1 acre
parcel is adjacent to the East side of Highway 82 and the building sites are
on a bench above the Highway. Water will be provided by wells and sewage
disposal will be by way of septic systems (ISDS). While the proposed
subdivision is within the Mid-Valley Metro District, the District and the
applicant have signed an agreement restricting the development to 3 lots
since public water and sewer lines are more than 800' away. The applicant
has entered into an agreement with the Basalt Water Conservation District as
part of this water augmentation plan. Access is via an easement through the
Church of Christ parcel from the Highway 82 access road. The building sites
are separated from the Highway Right-of-Way by the Robinson Ditch and are
about 30 feet in elevation above it. Mr. Clarkson reviewed the history. Mr.
Clarkson responded to a memo just received from Stephen Quath, of the Bible
School. He addressed the concerns listed in the memo. He stated the
applicant is going to improve the width of the road. Mr. Clarkson stated the
property has been zoned RR for 12 years. Staff is not concerned with the
density. Mr. Clarkson stated notice was received several years ago and that
is all that is required. A Minor Type A does not require specific
notification. Mr. Clarkson stated he spoke often with the neighbors about
water rights. He has been talking with the Brownsons.
Chairman Gates asked about the construction of a forth unit.
Mr. Clarkson stated there is a 2 acre minimum lot size. There is no
other property on which that could happen.
Chairman Gates asked about the sufficiency of water and septic. He
questioned the verbiage about the expense.
Mr. Clarkson explained they have entertained several proposals on this
site and believe this is the best possible proposal to date. They do feel
this conforms with the master plan and the zoning. Staff recommended
approval. Staff has received the land dedication fee.
Commissioner Johnson stated he does not understand why they would have
their own water and sewer when a domestic system is available.
Mr. Clarkson stated that can be done by a written agreement.

Commissioner Johnson stated the services are available within the
district, and questions why the applicant can chose not to use them.
Mr. Clarkson stated the land use regulations do not mandate the use. If
a property is within 400 feet of a sewer or septic line, then they must. The
distance here is greater.
Ms. Berenato stated one would be encouraged to hook on but the expense
to do so would be inordinate.
Commissioner Phillips stated she is uncomfortable about the notice. She
questions the neighbors not knowing. She would like this to not be approved
today until the public are able to in attendance.
Commissioner Phillips moved to table file number SM-807-92, Hat Creek
Subdivision, to September 17, 1996.
Commissioner Johnson seconded the motion. The vote was declared

SM-1012-95, Grant Smith Subdivision
Paul Clarkson presented file number SM-1012-95, Grant Smith Subdivision.
He stated this was a request for a subdivision of two single family lots.
This Minor Type A Subdivision proposal is to subdivide the parcel into two
lots: one 10.4 acre parcel and one 0.7 acre parcel. A companion Zone
District Amendment Application was approved by the Board of County
Commissioners on April 30 of this year. The intent of the application is to
rezone and subdivide to fit the existing conditions on the site. That is to
say the site already contains two single family and accessory structures,
which have occupied the site since prior to the County's adoption of zoning.
The intensity, use and density of the site will not increase over and above
what is already there. Staff recommended approval.
Commissioner Johnson moved to approve file number SM-1012-95, Grant
Smith Subdivision, incorporating Staff findings.
Commissioner Phillips seconded the motion. The vote was declared
unanimous.
BLM Landfill Lease
Ron Rasnic, Road & Bridge, presented an application to amend the
existing BLM Landfill Lease COC-36803 to incorporate the new "Eagle County
Design, Operations, and Closure Plan: dated 12/5/95, revised 5/10/96. BLM
requests Eagle County amend the lease agreement once the new design has been
approved. Eagle County has been officially approved by the State of Colorado
in regards to the new Design & Operations plan. This new design stipulates a
new liner system and leach collection system be installed for future disposal
cell construction. In order to be in compliance with all solid waste
regulations, adherence to the new plan is required. Staff recommended
approval.
Commissioner Phillips moved to approve the application to amend the
existing BLM Landfill Lease, incorporating Staff findings.
Commissioner Johnson seconded the motion. The vote was declared
unanimous.

LUR-018-96, Land Use Regulations
sid Fox presented file number LUR-018-96, Land Use Regulation
Amendments. Mr. Montag stated on August 27, 1996, other issues were
discussed and approved. The extension of sketch plans was an item that was
tabled. The question is whether sketch plans should have a finite date, or
are they valid indefinitely? The current proposal is for a sketch plan being
good for two years and then having up to two years to extend the plan.
Chairman Gates suggested in the work session they talked about the
current two year plan with an extension up to two years.
Mr. Montag stated in the discussion he was involved in there were
questions around sketch plans changing from a six month extension to a two
year extension and that is the proposed language at this time.
Chairman Gates asked about the sunset provision.
Mr. Montag stated that is what this will do.
Commissioner Phillips stated she doesn't have a problem with the sunset.
Two years, she believes, is a length of time one could live with.
Commissioner Phillips stated she doesn't believe asking for preliminary
plan is a bad thing. She questioned the time limit they should put on an
extension?
Chairman Gates asked Ms. Berenato about the extension discussion.
Ms. Berenato stated she attended a work session where they discussed
extensions. She stated there may have been talk of others but she doesn't
recall any.
Commissioner Johnson stated the County Land Use Regulations already have
a sunset provision at two years. He stated what they are doing today is to
allow for an extension of the permit for up to two years.
Chairman Gates asked what happens if they shut it off.
Commissioner Johnson stated the Court can enjoin the County from
allowing or making the expiration of the sketch plan.
Ms. Berenato stated in the event the Board did not grant an extension
and appeal the decision, they could enjoin the County from keeping their
sketch plan from expiring.
Commissioner Phillips stated she doesn't understand why they are making
this so difficult.
Chairman Gates asked if this is the only issue to be brought up today.
He asked if there is a developer out there who could respond as to what would
happen if they were half way through the development?
Charlie Wick, Adams Rib, stated Mr. Cummer would have liked to have been
here today. He referred to the Board's having the discretion to allowing an
extension. He questions why they would not.
Commissioner Phillips commented there may be circumstances that warrant
an extension.
Mr. Wick stated as it is written today, it would not allow for an
extension. Development is like any other job and things don't always work
within set time lines. In large projects, time is needed to do it well. For
some projects, a sunset provision may be warranted. For projects that have
federal and state actions it is involved in, the Board should be able to
maintain at its discretion the ability to issue an extension. With work
being done and money being set forth, and efforts are being achieved, there
are many contingencies that are very practical and should be included in the
package.
Chairman Gates questioned a normal project.
Mr. Wick stated in a smaller project it may be realistic in a larger
project, it may not.

Discussion continued on the proposed amendment.
Mr. Wick reminded the Board some things can be dealt with at preliminary
plan.
Ms. Berenato asked if there have been sketch plan extensions on sketch
plans for other large developers.
Commissioner Phillips stated Blue Lake. She also suggested they have
not had the same mitigating circumstances.
Tom Boni, representing Knight Planning and as a professional planner,
stated it is not whether a sketch plan is extended but to what degree. By
allowing it to be extended, they must first look at the circumstances. If
there are circumstances out there that warrant an extension, it should be
granted. It should be done under merit, not an artificial deadline.
Dick Turgeon, area resident, stated he cannot see any reason to put a
sunset clause in. The Board has the ability to put in conditions and if the
conditions are not met it can be terminated.
Kathy Reicher, County Planning Commission, asked if Chairman Gates heard
the tape of the last planning commission meeting. She stated both the Eagle
County and the Roaring Fork Planning Commissions believe there to be a need.
Other developments are able to do it.
Chairman Gates asked about her recommendation.
Ms. Reicher stated two years with a two year extension, a four year
maximum.
Chairman Gates asked if they are part way through, would they have to
come back.
Commissioner Phillips stated any Board can say yes or no.

Ms. Berenato stated this extension is for up to two years, it is not a
mandatory two years.
Commissioner Johnson stated he agrees with Commissioner Phillips they
can be amended at any time. If in the future there are extenuating
circumstances, the Board can make that determination. In another proposal,
there was a grandfather provision. Re does not see why they would want to
extend the sketch plans for more than two years, because there are no plans
in front of them at this time.
Commissioner Phillips stated she agrees with two
possibility of an additional two years with an option

Commissioner Johnson suggested Commissioner Phillips would want to
substitute the word "one" for "an".
Commissioner Phillips moved to approve section 2.17.03 and section

of County Commissioners for a period not to exceed two years for good cause
shown."

be massaged so that the wording clearly states the intent of this Board.
Commissioner Phillips stated she would go with another number other than
one, but one is too limiting. Two years is very minimal.
Commissioner Johnson stated even if they were only allowed one two year
extension, they would have ten years to come in for preliminary plan.
Commissioner Phillips stated, we're talking sketch plan, not preliminary
plan.
Commissioner Johnson pointed out we don't have anything in the
regulations that govern the extensions and that is why we're here.
Chairman Gates called for the question on the motion. Commissioners
Phillips and Gates voting yes and Commissioner Johnson voting no.
Commissioner Johnson moved to adjourn into Executive Session to discuss
pending litigation, Board of Equalization, to get the Attorney's advice and
to discuss negotiations with the Jet Center.
Commissioner Phillips seconded the motion. The vote was declared
unanimous.
Commissioner Phillips moved to adjourn from Executive Session having had
discussions with the attorney's office.
Commissioner Johnson seconded the motion. The vote was declared
unanimous.
The Board returned from the executive session having discussed
negotiations with Vail Beaver Creek Jet Center.
ZS-389-96, Edwards Village Center
Chairman Gates stated this had been heard previously however after the
decision was final, the Board received some contradictory information which
brought up some matters of concern. He stated he would not sign the
resolution until the questions were discussed. He commented he listened to
the tapes. Chairman Gates listed some of the other concerns. The two
conditions, the truck size and the hours were still an issue. He reviewed
the hours and the changes to be made. He questioned why the two conditions
were eliminated at the end.
Commissioner Johnson stated the two items regarding the hours of
operation and the lengths of truck could be opened up to the public for
discussion. He stated he has gotten phone calls as well and questions the
decision made to erase them.
Chairman Gates asked if just those two issues could be opened up.
Mary Jo Berenato stated that is a decision for the Board.
Commissioner Phillips suggested those two concerns are an issue. She
questions whether a Special Use should have been in place prior to a grading
permit being issued. She questioned them using an older special use permit
since the use was not part of the special use initially. She agrees the last
two conditions are the only ones to be open for public discussion.
Commissioner Johnson and Commissioner Phillips agreed to hear public
comment on the last two issues.
Tom Walker, resident of Gold Dust Drive, stated after visiting with many
of the folks that live up in the area, he felt good having the restrictions
recommended regarding the hours of operation and the size of trucks. When
those were lifted at the last meeting he didn't understand why. He stated as
he did before, he was opposed to the development. Because of the proximity
to the residential neighborhood he thinks the size of the trucks and the

hours are a concern. He understands the performance standards should cover
this, but he is concerned how those will be enforced.
Mr. Walker asked about the amount of dirt that has been moved over to
the far east of the parcel.
Chairman Gates asked if the standards cover these two concerns.
Sid Fox stated with respect to the two recommended planning commission
recommendations, staff had some concern with the presentation and the
administration and enforcement. He stated they partially do and they
partially don't. He stated the standards are based on twenty four hours a
day. Mr. Fox suggested they could pass a performance standard rather than
control the hours. He stated he felt difficult carrying that forward as a
condition. Regarding safety issues, the site was designed to handle the
bigger trucks. Do the conditions further the compatibility with the project
and with the neighborhood. Staff felt performance standards are the
preferred way of regulating the impacts.
Commissioner Johnson asked about the specific conditions that made it
more palatable.
Mr. Walker stated the hours of operation are important. If the
standards are lifted, there can be traffic and trucks twenty-four hours a
day.
Commissioner Johnson asked about an accountant working there after hours
during tax time.
Mr. Walker stated that is not a problem necessarily, but what about a
tractor trailer there at any hour, day or night. He also questions the
ability for a larger truck to enter the project from the east end.
Chairman Gates asked if there was consideration given to the times the
deliveries are made in the area.
Mr. Walker stated there are restrictions placed during certain times.
Ross Jansen, resident above the proposed development, stated he came
forward to talk about hours of delivery, not hours of operation. It is the
trucks they want to have restricted. They main restriction they worked for
was that. He stated they are being reasonable and asking for reduced hours
during the night. If the trucks can make the turns, then so be it. He
questions them doing so, but leaves that it up to the professionals.
Commissioner Johnson asked then if they would like to see the hours of
delivery restricted.
Mr. Jansen responded yes, he does not want to see the trucks idling late
at night.
Terrill Knight, representing the applicant, stated they had suggested
they restrict truck traffic during the late night hours, from 12 to 6, for
any type of delivery. They had suggested a clarification and agreed to it.
The other issue, the trucks, is a concern. They have designed for 60 foot
trucks. They would rather see them in and unloaded rather than waiting to
enter or dropping deliveries elsewhere.
Chairman Gates asked George Roussos, County Engineer, to comment on the
truck size.
Mr. Roussos stated they have not seen the final drawings associated with
the building permit. They do have the standards and any approved site will
conform and be able to accommodate the 60 foot trucks.
Chairman Gates asked about the engineering designs.
Mr. Knight stated that is true and it is reflected on the plans.
Commissioner Phillips stated she is not sure that a fifty foot truck
makes more noise than a sixty foot truck. The design standards are the

concern. She stated they are then looking at changing some of the
conditions.
Chairman Gates stated the amended motion would be the only thing that
would be changed.
Commissioner Johnson stated as far as performance standards and the
trucks are concerned, it is difficult to mitigate.
Mr. Fox stated the County could measure the noise at the property line
if it is needed to do so.
Mr. Knight stated they have had numerous discussions with Sid and they
understand if it is violated, they must mitigate the concern. If it is
violated, it is their commitment to handle it promptly and to adhere to the
requirements.
Chairman Gates asked Mr. Knight if he feels the standards are being
mitigated.
Mr. Knight stated this will be the only place he is aware of that has
any such standard.
Charlie Baker, resident of the neighborhood, stated the noise has
certainly been a problem. The general use of the property is what is a
concern. In terms of trying to speak for others, the noise and the general
commercial are both objectionable. Anything that can be done to mitigate
would be helpful. He stated the entrance is questionable because of the
school busses and the kids that are in the area.
Commissioner Johnson stated the commercial general was already approved
for that land, it is the type of commercial general they will allow.
Commissioner Phillips stated she recognizes the developer has worked
hard to work with the citizens and the homeowners. She would like to see the
two conditions that were eliminated put back into the approval.
Commissioner Johnson asked about the hours of operation or the hours of
delivery.
Commissioner Phillips stated she has seen it both ways. A truck that is
delivering after 10:00 p.m. would cause some discomfort to the neighbors.
The delivery hours could be restricted from 10:00 p.m. to 6:00 a.m. Those
heard earlier were operation time not delivery.
Ms. Berenato stated if they are going to make specific findings for
time, those specifics need to be stated specifically. The desires of the
neighborhood are important, but they must be more applicable to the health,
safety and welfare.
Commissioner Phillips asked about what was approved earlier.
Mr. Fox stated an acceptable solution, having reviewed the minutes, the
applicant did agree to limit deliveries from midnight to six a.m. It was
discussed at the last hearing and it was part of the testimony given at the
last hearing.
Ms. Berenato stated specific findings will need to be made regarding the
size of the trucks. They do have noise standards in place. If the size of
the truck is going to be limited, they must have specific reasons that state
why they limit the length. She stated they have noise standards they can
enforce. If they are limiting the truck size, they must have specific
findings that explain why they are doing so.
Commissioner Phillips asked about the noise standards and what they
would do if they get a complaint.
Mr. Fox read the noise standards that are in place. He stated they
would respond like any other complaint. They would certainly work with the
applicant to avoid the situation in the future. Mr. Fox stated the standard
applies during any time of the day.
Ms. Berenato stated initially there was concern by the planning

commission about the size of the trucks based on design.
Chairman Gates stated there was a concern about the safety factor for
kids.
Commissioner Phillips stated she doesn't think that is a concern now.
Chairman Gates asked about the wishes of the Board.
Commissioner Johnson mentioned to Mr. Fox that even though it was
discussed in the last hearing the hours of delivery should be listed as a
condition enumerating the hours. He stated Mr. Roussos, as the Engineer,
will be able to make the determination as to what is safe.
Mr. Roussos stated the actual design will allow them to see if there is
ample room. If the trucks can't negotiate the turns, they will have to go
back and redesign. The design will have to accommodate a larger vehicle.
Ms. Berenato again asked for specific findings.
Commissioner Gates read from the land use regulations.
Commissioner Johnson moved to approve Resolution 96-117, file number ZS-
389-96, Edwards Village, incorporating Staff findings and the condition
prohibiting delivery from midnight to 6:00 a.m. on weekdays and between 8:00
p.m. and 8:00 a.m. on weekends. Commissioner Johnson added approval for the
Chairman to sign upon final draft.
Commissioner Phillips seconded the motion. The vote was declared
unanimous.
There being no further business to come before the Board, they adjourned
until the next scheduled meeting.
