The morning being spent paying bills the following items were presented
to the Board of County Commissioners for their consideration:
Consent Calendar
Chairman Gates stated the first item on the agenda is the consent
calendar as follows:
A) Approval of bill paying for August 5, 1996, subject to review by
County Administrator
B) Approval of bid award and purchase of an Oshkosh Model 02526
(SP) Snow Plow for the Eagle County Regional Airport
C) Approval of Contract renewal between Eagle County and the
Colorado Department of Public Health and Environment to provide EPSDT Case
Management Services
D) Resolution 96-107, ap~roving the 1996 Fiscal Year Budget for the
Office of the District Attorney, Flfth Judicial District, State of Colorado
E) Change Order No. 2 for Elam Construction, Inc. for the 1996
paving project on Brush Creek Road, Gypsum Creek Road, Cottonwood Pass Road
and Colorado River Road
F) Approval of the FAA Grant Application for Federal Assistance AIP
No 3-08-0020-23, to expand the aircraft parking apron at the Eagle County
Regional Airport.
Jim Fritze, County Attorney, questioned the Attorney's Office review
slot being marked N/A.
Jim Elwood, Airport Manager, responded in regards to purchase of
equipment, they would use the P.O. process because it details all the
pertinent information.
Mr. Fritze stated so it was in fact reviewed by the attorney's office.
Mr. Elwood responded yes.
Commissioner Phillips moved to approve the consent calendar as
presented.
Chairman Gates seconded the motion. Of the two voting commissioners,
the vote was declared unanimous. Chairman Gates stated Commissioner JOMson
was not present for the hearing.
Final Settlement, Stan Miller, Inc.
JOM Altoff, Engineering Department, presented Final Settlement for Stan
Miller, Inc. for site restoration of Lot 25, Highland Meadows, Filing 2. He
stated no claims have been received and recommended the Board approve final
settlement. Mr. Altoff explained the location.
Jim Fritze stated as of 1:41 no claims have been received including
today's mail.
Commissioner Phillips moved to approve final settlement for Stan Miller,
Inc. as recommended by Staff.
Chairman Gates seconded the motion. Of the two voting commissioners,
the vote was declared unanimous.
Plat & Resolution Signing
Kathy Eastley, Community Development, presented the following plat to
the Board for thelr consideration.
SM-1057-96 Red Tail Townhomes, Phase II. This is a minor type B
subdivision, a resubdivision of Tract A of Phase I, Red Tail Townhomes to
create 6 townhome units, common area and future development area.
Commissioner Phillips moved to approve SM-1057-96 Red Tail Townhomes,
Phase II.
Chairman Gates seconded the motion. Of the two voting commissioners,
the vote was declared unanimous.
Commissioner Phillips moved to adjourn as the Board of County
Commissioners and reconvene as the Board of Equalization.

Resolution 96-E-3, Abatement petitions
Connie Cantrell, Attorney's Office, presented Resolution 96-E-3
regarding the petitions submitted to the Eagle County Board of Equalization.
The petitions involved are #8907, #9007, #9477 and #40731. Mr. Schmale had
recommended denial and asked the Board to support that decision.
Commissioner Phillips moved to approve Resolution 96-E-3, regarding the
petitions submitted to the Eagle County Board of Equalization.
commissioner Gates seconded the motion. The vote was declared
unanimous.
Resolution 96-E-4, Equalization
Connie Cantrell, presented Resolution 96-E-4 consisting of twelve files
as presented on Exhibit A.
Commissioner Phillips asked Allen Black for a ~oint of clarification.
Commissioner Phillips moved to approve Resolutlon 96-E-4, regarding the
petitions submitted to the Eagle County Board of Equalization for
equalization and read the files into the record.
Chairman Gates seconded the motion. Of the two voting commissioners,
the vote was declared unanimous.
Resolution 96-E-S, Abatement Hearings
Connie Cantrell, presented Resolution 96-E-5, consisting of two files
including E96-84 and E96-86.
Jim Fritze stated he had asked that these items be tabled but he does
not have the research completed to finalize the files. He stated Mr. Schmale
had recommended the properties not be taxed. The two principle arguments
beinS lack o~ enabling legislation and secondly the petitioner's issuance of
grazlng pemts.
Allen Black stated he is unaware of any possessionary interest and does
not see grazing permits falling into that. He would like proof positive
there are other possessionary interests that do not show on the tax roll.
Chairman Gates asked if Mr. Black agrees with the referee.
Mr. Black stated he disagrees with the interpretation.
Commissioner Phillips asks where the ~etitioner stands.
Jim Fritze stated there have been indlcations that if the Board does not
follow the recommendation of the referee, there will be litigation.
Mr. Black indicated there may be anyway. He stated they have not heard
from surrmit County, but San Miguel and Gunnison are not going to tax.
Mark Chapin, Appraiser, stated based on some of the comments by the
petitioner to the referee, Mr. Chapin followed up with the other Counties
regarding the possessionary interest and they have done so. Mr. Chapin
stated the petitioner's comment is not fact. He questions whether some of
the weight given by Mr. Schmale considered the erroneous information.
Chairman Gates asked if today is the last day to make a decision
regarding BOE. He asked for legal advice.
Commissioner Phillips moved to go into executive session.
Chairman Gates seconded the motion. Of the two voting Commissioners the
vote was declared unanimous.
commissioner Phillips moved to continue the hearing regarding Resolution
96-E-5, regarding the petitions submitted to the Eagle County Board of
Equalization, #96-84 and #96-86 until Monday, August 12 at 3:30 p.m.
Chairman Gates seconded the motion. Of the two voting Commissioners the
vote was declared unanimous.
Commissioner Phillips moved to adjourn as the Board of Equalization and
reconvene and the Board of Health.
Commissioner Gates seconded. Of the two voting commissioners, the vote
was declared unanimous.
There being no further business to come before the Board the meeting was
adjourned until August 12, 1996.
