County Attorney, presented contract amendments with Isbill Associates for airport terminal complex planning design and field work, and for apron design and field work. He explained the amendments to the Board relating the amendments are numbered four (4) through eleven (11). He stated the terminal section is divided into several amendments. Jim Elwood, Airport Manager, reiterated part of the amendments are for design and part are for construction. He stated the contract for the apron area was defined quite some time ago, in the case of the parking, those were agreed to in principal last year. Mr. Loeffler stated an FAA Grant only pertains to the amendment to the apron area and not for bidding and construction. Commissioner Johnson stated the language in amendments six (6) through eleven (11) needs to be stuck out. Commissioner Johnson moved to approve the contract amendments with Isbill Associates for airport terminal complex planning design and field work, and for apron design and field work, correcting the language in amendments six through eleven, concerning the statement "upon receiving funds from the FAA". ,Commissioner Phillips seconded the motion. The vote was declared unanlffious . Isbill Associates, Assigmnent Bob Loeffler presented an assignment of Isbill Associates Amendment to Eagle County Airport Tenninal Corporation. He explained the assignment to the Board. Staff recommended the Board approve the assignment, amendments six through eleven, together with related construction documents. Commissioner Phillips moved to approve the assignment of Isbill Associates Amendment to Eagle County Airport Terminal Corporation. commissioner Johnson seconded the motion. The vote was declared unanimous. Craig Colby, Vail Beaver Creek Jet Center, asked for copies of all documents presented today. Lease, Tenninal Building Bob Loeffler presented a Terminal Building Lease between Eagle County Air Tenninal Corporation and American Airlines, Inc. Staff recommended approval. He stated the document provides for a ten year lease with a base rent of $750,000.00 per year. He stated this is a restated lease with a provision that was inadvertently omitted. Commissioner Johnson moved to approve the Terminal Buildin~ Lease between Eagle County Air Terminal Corporation and American Airllnes, Inc. Commissioner Phillips seconded the motion. The vote was declared unanimous. Option Agreement, American Airlines Bob Loeffler presented an Option Agreement between Eagle County and American Airlines, Inc. He ~lained the changes to the Board. He stated the entire function of the optlon is to protect American Airlines ten year lease. Commissioner Johnson questioned taking action today as in a previous hearing the Chairman was authorized to sign the document. Chairman Gates noted for the record, there were no changes and the Chairman will sign the document. Commissioner Johnson moved to approve an Option Agreement between Eagle County and American Airlines, Inc. Commissioner Phillips seconded the motion. The vote was declared unanimous. Ground Lease, Air Tenninal Corporation Bob Loeffler presented a restated Ground Lease between Eagle County and Eagle County Air Terminal Corporation. He stated a ground lease was entered into on June 10, 1996, in which the legal description was not correct. The legal description and technical errors have been corrected. Commissioner Phillips moved to ap~rove the restated Ground Lease between Eagle County and Eagle County Air Termlnal Corporation. Commissioner Johnson seconded the motion. The vote was declared unanimous. County Landfill Rate Increase Ron Rasnic, Solid Waste Coordinator, presented a request for approval of the Eagle County Landfill rate increase proposal for 1997. He explained the increases of 12% to the Board. He explained the increase is to help fund the insurance requirement for closure of the Landfill. The goal is for the landfill to pay its own way. Chairman Gates stated he has had a question from a member of the public , BOARD OF COUNTY COMMISSIONERS EAGLE, COLORADO RECORD OF PROCEEDINGS FORM 50 HOECKEL'S 387869 regarding rates for residential type trash. Mr. Rasnic stated construction trash and domestic trash is split 50%. He stated everyone generates trash and must pay their own way. He stated there are no options for construction waste. Commissioner Phillips asked how long it had been since the fees were raised. Mr. Rasnic stated January 1995. Commissioner Johnson stated the Landfill is an enterprise fund within the County budget. He related "We Recycle" has taken a large portion of the trash for the recycling project, but there has been no depletion of construction waste. He preferred to look into balancing a smaller increase for domestic waste and a higher fee for construction waste. commissioner Phillips asked about decomposing of the domestic trash rather than construction waste. Discussion continued on domestic trash, construction trash, rate increases and other possible solutions. commissioner Phillips stated the County must adhere to the new laws and regulations and a rate increase is inevitable. Commissioner Johnson moved to table the Eagle County Landfill rate increase proposal for 1997, to no later than October 1, 1996. Commissioner Phillips seconded the motion.
