Consent Calendar
Chairman Phillips opened the meeting with the first item on the agenda,
the consent calendar as follows:

02) Payroll for 11-10-94, subject to review by County Manager

04) Contract between Eagle County and Resource Center

commissioner Gates moved to approve the consent calendar as presented.
Commissioner Johnson seconded the motion. The vote was declared
unanimous.
State of Colorado, Change Order
Kathleen Fornash, Director of Social Services, presented Change Order
Letter number F951439 for Colorado Department of Public Health for the EPSDT
Program.
Commissioner Johnson moved to approve the Change Order Letter number
F951439, as ~resented.
Commissloner Gates seconded the motion. The vote was declared
unanimous.
Change Order, Eagle County Airport
Dan ReYnolds, Airport Manager, presented a change order for the MALSEF
installation at the Eagle County Airport. He stated there was a draina$"e
area not seen by the original survey, requirin$" a culvert, a wind cone lS
needed as a safety issue and a reduction in prlce for the asphalt. He
informed the Board the total project cost is still within the original grant
and within budget.
Commissioner Gates moved to approve Change Order Number One for the
Airport Improvement Project 3-08-0020-19.
commissioner Johnson seconded the motion. The vote was declared
unanimous.
Resolution 94-170
Dan ReYnolds presented Resolution 94-170, regarding landing fees at the
Eagle County Regional Airport. He stated the landing fees have been capped
through an agreement with the Vail Beaver Creek Jet Center since 1991 and
will terminate January 1995. Mr. ReYnolds stated the fees were set at 65
cents per thousand welght and will now be raised to $1.00 per thousand weight
for scheduled carriers and $1.50 per thousand weight for non scheduled
charters.
Jim Fritze, County Attorney, stated the Resolution is prepared for the
Board of County commissioners and will be effective December 1, 1994. He
stated the old fees will be revoked at a later date.
Jack Lewis, County Mana$"er, stated an agreement is needed from the Vail
Beaver Creek Jet Center waivlng the cap on the fees for December.
Mr. ReYnolds stated he has received a letter from the Jet Center but it
must be revlewed by County Attorney.
Corrmissioner Gates moved to aPI?rove Resolution 94-170 regarding landing
fees at the Eagle County Regional Airport.
Corrmissioner Johnson seconded the motion. The vote was declared
unanimous.
Resolution 94-171
Kathleen Fornash presented Resolution 94-171 designating members of the
Local Planning Committee for the Rural Resort Planning Area. She explained
the Resolution to the Board.
Commissioner Johnson moved to approve Resolution 94-171, designating

commissioner Gates seconded the motion. The vote was declared

Resolution, Adams Rib
Jim Fritze presented a Resolution regarding the matter of the
application for Adam's Rib Recreation Area. He stated this Resolution was
late due to a waiting period of a draft from the law firm representing Adam's
Rib. He stated the sketch plan was extended to August 23, 1997.
Commissioner Johnson questioned suggestions from the County Attorney to
be addressed at a later stage.
Mr. Fritze explained the suggestions from the Attorney's Office.
Corrmissioner Johnson questioned if Commissioner Gates intended to make
this the last extension.
Commissioner Gates stated he believes the County needs to place some
limits and believes this should be the last extension.
Mr. Fritze stated if the Board wishes to have that language in the
Resolution another Board of Commissioners can change that by another
Resolution.
Discussion continued on the proposed Resolution.
Commissioner Gates moved to table the Resolution for extension on the
Adam's Rib Sketch Plan.
Commissioner Johnson seconded the motion. The vote was declared
unanimous.
Ha:nestead, Filing 2, Blocks 13 - 16
Keith Montag, Director Corrrnunity Development, presented the expiration
of preliminary plan for Blocks 13 - 16, Filing 2, The Homestead.
Jim Fritze reminded the Board this is a show cause hearing to determine
why the proj ect is not expired. He asked if the Planning Department is
recommending this plan be expired.
Mr. Montag stated Staff has not completed an analysis comparing the
application to County Regulations today. He stated three items to be looked
at are as follows:
01) compatibility of land use with the surrounding and adjacent
property
02) density
03) lot sizes, open space.
Mr. Montag stated South Forty is to the North of this proposal with lot
sizes of one acre. He stated the current proposal allows for 160 units with
traffic concerns. He continued to discuss items to be looked at if this
application were to come before the Board today.
Bob Warner, aPI?licant, questioned if the one acre sites in South 40
Subdivision had indlvidual sewer.
Mr. Montag stated there is a one acre requirement for septic.
Mr. Warner questioned the traffic study done previously.
Phil Scott, Engineering Technician, stated he did not review the
proposals but a letter was submitted by an outside engineer who related the
road was sized to handle the traffic in the Homestead POD.
Mr. Warner continued to discuss traffic, open space, emergency access,
water tank and other items.
Kevin Lindahl, Attorney representing the applicant, stated according to
section 2.06.13 (10) page 67 of County Re$"Ulations permits for building
construction shall be issued only after flnal plat approval.
Chairman Phillips asked if there had been any action in filing 2.
Mr. Lindahl answered yes, the water tank and water line have been
installed and an easement lS in place.
Mr. Warner pointed out the water tank and stated it could have been
located elsewhere.
Discussion continued on what has taken place during the past year in
filing 2, blocks 13 - 16, the Homestead.
Commissioner Gates moved to adjourn into an "Executive Session"
Commissioner Johnson seconded the motion. The vote was declared
unanimous.

The Board reconvened from "Executive Session".
Jim Fritze stated on February 10, 1994, the County Attorney's Office
sent a copy of their opinion to the applicant with regards to which
provisions of the County Regulations apply to this application.
Chairman Phillips stated the County did receive a three page letter from
South 40 Homeowners Association, Tom Bennedict.
Commissioner Johnson moved, after hearing testimony, section 2.18.03 of
the County Land Use Regulations, County Staff did find correctly and believes
the Board of County Commissioners can grant an extension and do so grant an
extension for a one year period. This shall be the last extension allowed
for this POD. The Resolution shall be the final act. The extension will
expire November 7, 1995.
commissioner Gates seconded the motion.
Discussion followed on the extension for the Homestead, filing 2.
Chairman Phillips called for the question on the motion. The vote was
declared unanimous.
There being no further business to be brought before the Board the
meeting was adjourned until November 14, 1994.
