He referred to the existing open space plan for Eagle Connty. He discussed costs to be involved in the purchase of this open space. Bob Loeffler, Ass't. Connty Attorney, referred to the Resolution and the powers of the Board for emanate domain for acquiring property. Jay Peterson, Attorney representing Gary Bossow, referred to the Executive Session held !?reviously indicatin;J they did not want to sell this property. He stated thlS property was acqulred by Mr. Bossow for his personal residence. Mr. Peterson discussed possible mitigation measures for the property, including landscaping, no mirror glaze, stones blending into area, shielded lighting, use of colors to blend into the landscaping. Mr. Peterson stated the appraisers figures left out the architectural fees already expended and does not reflect the increase in value. He stated if this property is condemned the County will take possession but the Court will finalize the actual cost. Jay Peterson informed the Board the owner has the public's support as the general public does not believe the County should be purchasing this certain piece of property. He related the owner cannot buy another piece of comparable property at the price being offered by the Connty. He ask the Board not condemn the property. Mr. Loeffler questioned lf the owner was refusing to sell the property for the appraised value. Mr. Peterson answered absolutely. Mr. Loeffler asked if the owner would sell the property at any!?rice. . Mr. Peterson stated Mr. Bossow will sell the property lf the prlce is rlght. Gary Bossow, applicant, stated he has an offer of four, five and six times the amonnt offered by the County and he still does not want to sell the property. Mr. Peterson stated if the Board would have expressed interest six month~ a;Jo there would not have been a problem and there could have been negotlatlons. Mr. Loeffler reiterated to the Board their rights and there is an alternative to mitigate should the Board determine to do so. 10 BOARD OF COUNTY COMMISSIONERS EAGLE, COLORADO RECORD OF PROCEEDINGS FORM 50 HOECKEL'S 387869 Mr. Peterson stated if the Board chooses to delay their decision the owner will better negotiate the issues of concern. Chairman Phillips asked if everYthing was in place for the owner to receive a building permit. Mr. Peterson stated the owner is waiting for access permits from the Bureau of Land Management and from the Highway DeJ?artment. Discussion continued on the proposed Resolutlon. Mr. Peterson read a letter for the record from sid Fox, Planning Manager to Bob New, then owner of the property. Chairman Phillips expressed concerns of mitigation rather than purchase of the property, going through a long drawn out process. She informed the applicant the Board would need specifics on improvements to the property. Discussion followed on improvements and changes in the current plans for the property. Chairman Phillips stated she believes personal property rights are important and believes by approving this Resolution, it will allow the applicant and the Connty to move forward and mitigate the concerns with the proposed design of the structures. Commissioner Johnson agreed, passage of the Resolution would allow all interested parties to move forward with mitigation. Commissioner Johnson moved to approve Resolution 94-139, in the matter of the public needs for certain property for open space. Chairman Phillips seconded the motion. Of the two voting Comrrdssioners the vote was declared nnanimous. Commissioner Gates was not present at this hearing. Consent Calendar Chairman Phillips stated the next item on the agenda was the consent calendar as follows: 01) Bill paying, subject to review by Connty Manager 02) Resolution of appointments, Cedar Hill Cemetery Board. Resolution 94-148 Tom Girard, Weed and Pest Coordinator, presented Resolution 94-148, amending the Eagle Connty Weed Management Plan for unincorparated areas of Eagle County. He stated the current plan does not address how to proceed with enforcement measures. commissioner Johnson stated he would like to table this matter because of concerns with the notice to the landowner. Ms. Berenato stated she is concerned with ~anding the notice requirement.
