The morning being spent paying bills the following items were presented
to the Board of County commissioners in the afternoon for their
consideration:
ZS-317-94-A, Dowd Junction Camnunications
Ellie Caryl, Planner, presented file number ZS-317-94-A, Dowd Junc~ion
Communications Facility. She stated the applicant is Cellular One and lS
requesting a new user be added to the tower. Ms. Caryl stated the current
users are Cellular One, u.s. Forest Service and the Eagle County Sheriff.
The new proposed user would be Colorado Christian Radio. Staff recommended
approval with the followin$ conditions:
01) Compliance wlth all requirements of the approved Forest Service
Special Use Permit and process.
02) Tower lighting is not permitted.
03) Total tower height shall be limited to eighty (80) feet high
plus ten (10) foot whip antennas and painted to match existing facility color
or as otherwise recommended by the Forest Service. _
04) Satellite dishes attached to the tower shall be limited to six
(6) feet in diameter, antenna width shall be limited to four (4) feet.
05) Additional communications users shall be permitted on the High
Country Cellular, dba/Cellular One facility (tower and building) without
additional County approval if the additions comply with the above stipulated
height, width and color limitations and necessary approvals are obtained from
the Forest Service for facility expansion.
06) Acquisition of the appropriate permits (building, electrical,
etc) from Eagle County.
07) Compliance with Section 2.07.07:
a) All storage of materials shall be within a building or
obscured by a fence.
b) No dust, noise, odor, glare and vibration shall be
projected beyond the site.
The Eagle and Colorado Valley Planning Commission recommended approval
with the same conditions as Staff.
commissioner Gates moved to a~prove file number ZS-317-94-A, Dowd
Junction Communications Facility, lncorporating Staff findings and
recommendations.
Chai:rrnan Phillips seconded the motion. Of the two voting Commissioners
the vote was declared unanimous. Commissioner Jormson was not present as he
was out of town.
ZS-352-94, Alpine Christian Aca~
Ellie Caryl presented file number ZS-352-94, Alpine Christian Academy.
She stated this was a request for a special use permit to build a school.
She stated the school will be located next to the Basalt Bible Church. Ms.
Caryl stated Staff's major concerns were traffic impacts, adjacent property
impacts and the caretakers unit.
Staff recommended approval with the following conditions:
01) A State Highway Access Permit is required prior to the issuance
of a building permit.
02) The new highway and frontage road should be in place and
functional prior to the openlng of the school or a tempora~ traffic control
plan and approved by the Colorado Department of Trans~ortatlon.
03) The source (i.e. bulb) of any lighting lnstalled on the outside
of the building must be shielded to shine downward and away from any adjacent
residential structures.
04) Proposed signs require a sign permit. Off-site signs are not
permi tted.
05) If this specific special use is discontinued, any replacement
use must either be a use-by-right in the Resource Zone or receive special use
approval for a special use in the Resource Zone.
06) The proposed multi-purpose room shall not exceed the square
footage footprint of the existing Sunday School building, shall be one story
only, shall not provide additional classroom space so as to increase
enrollment above 150 students, and shall match the architectural theme of the
main school building. Classrooms shall be limited in number to those shown

on the floor plans for the main school building.
07) The existing driveway must be upgraded to a sixteen (16) foot
minimum width to accommodate two-way traffic and the increased volume. If a
second driveway is installed, it must include a culvert for drainage.
08) Revise the site ~lan prior to building permit issuance to
define the play area with fenclng or additional landscaping for noise
buffering. .
09) The parking lot will be kept in a compacted, dust free
condition and dust controlling agents applied as often as necessary.
Magnesium chloride is acceptable. Paving of the lot may be required if the
traffic level increases because of the majority of students are not riding
the bus but are being dropped off by private vehicle. This condition shall
be monitored by Staff.
10) Handicap ramp surfacing and construction subject to approval by
the Chief Building Official.
11) Side setbacks must be revised to reflect 1/2 the height of the
building on the site plan submitted with the building permit application.
12) Submit evidence (letter or signed lease) the parking for this
use that is on a separate, adjacent lot will remain available for use by the
school in the event the owner of the separate, adjacent lot (Basalt Bible
Church) sells or alters the use of said lot prior to issuance of building
permit.
Steve Isom, Isom and Associates, pointed out on a plat the location of
the proposal and adjacent property.
Bobbi Lucia, representing the applicant, stated the school will
accommodate Kindergarten through 9th Grade.
Chai:rrnan Phillips asked if there was enough play ground available.
Ms. Lucia answered yes.
Commissioner Gates moved to approve file number ZS-352-94, Alpine
Christian Acade!TIY' incorporating Staff findings and recommendations.

the vote was declared unanimous.
ZC-262-94, Eby Creek Mesa Subdivision
Keith Montag, Director Community Development, presented file number ZC-
2262-94, Eby Creek Mesa Subdivision, Filing #1. He stated this is a request
for a zone change from residential suburban low density to residential
suburban medium density. He stated the purpose of the request is to allow
for a larger building lot coverage of 20%' to 30%'. Mr. Montag stated the
current coverage allowed is 15%'. He reviewed prior hearings for the Board.
Brien O'Reilly, Attorney representing the developer, stated 15%' building
space is not enough on small lots. He stated the situation is a County
imposed hardship. Mr. O'Reilly suggested maybe a variance should be granted.
Mr. Montag stated he believes the applicant will withdraw the current
application and come back with a lot by lot variance.
Chairman Phillips asked which lot started this problem and how many lots
were impacted.
Wendy Sacks, developer, stated there are twenty-eight lots i~acted.
Timothy Sansell, owner of lot 82, stated he does not want fillng #1 to
be rezoned, but to allow the small lots to over build a bit.
Commissioner Gates moved to table a decision on Eby Creek Mesa
Subdivision, Filing #1 to Monday, August 8, 1994 at 8:30 a.m.

1041-027-94, Vail Associates, Inc.
Sid Fox, Planning Manager, presented file number 1041-027-94, Vail
Associates, Inc. He stated this is a request to consider connecting Patrol
Headquarters and wildwood Restaurant into the Upper Eagle Valley Sanitation
system, and connection of the Vail Mountain water supply to the Vail Valley
system.
Bob Weaver, Hydrosphere Resource Consultants, pointed out on a plat the
existing lines and the proposed new water lines. Mr. Weaver explained the
expansion proposal to the Board, including discussion on taps, fire
protection and sewer system.
Staff recommended approval with the following conditions:
01) The water tanks must be buried.
commissioner Gates moved to approve file number 1041-027-94, Vail
Associates, Inc., Vail Mountain Water and Sewer Facilities, incorparating
Staff findings and recommendations.

Mid-Valley Metropolitan District
Lee Leavenworth, Attorney representing Mid-Valley Metropolitan District,
appeared to ask the County to determine Arnold Meadows is not a material
inclusion into the District. Mr. Leavenworth stated a Resolution will be
presented for the Board's signature. He informed the Board the Garfield
County commissioners have determined Arnold Meadows was not a material
inclusion into the District. He stated he believes no purpose would be
served in requiring an updated service plan.
Bob Loeffler, Ass't. County Attorney, reminded the Board State Statute
states approval of modification of a service plan is required only with
regard to changes of an essential nature.
Paul Clarkson, Planner, asked about the additional area being 6%' and the
additional number of EQR' s being 120. He asked what percentage would be
considered to be substantial. He questioned the increase in debt.
Mr. Leavenworth stated there will be no increase in debt.
Commissioner Gates asked if this was a piece meal approach to
modifications in the future.
Mr. Leavenworth stated the District has expressed it would not expand
further to the West into Garfield County.
Discussion followed on the ability of the District to disclose the debt.
Chairman Phillips asked if the District was operating in the black or
the red.
Mr. Leavenworth stated the District is operating in the black.
Kelly Johnson, Administrator for the District stated the 1993 audit,
when completed, will show the District operating in the black.
Allen Sartin, Eagle County Finance Director, stated there has been no
material submitted to make a determination as to the financial capability of
the District. He stated he needs the 1993 audit.
Lewis Meyer, Smeeser, Board and Meyer, stated with the addition of the
~ond the plant capacity will be approximately 420,000 gallons per day which
lS 1,200 EQR' s. He stated the District has received a new discharge permit
from the State and installed a new flow measuring meter. He stated the
District is reaching the 80%' of capacity mark and will have to have a new
plant when they reach the 95%' of capacity mark.
Discussion continued on Mid-Valley Metropolitan District.
Chairman Philli~s asked why Staff was concerned with the financial
aspects of the Distrlct.
Mr. Loeffler stated the Board can only consider financial aspects on
inclusions into the District.
Commissioner Gates moved to approve the Resolution reflecting statements
made by the legal department.

1041-026-94, Mid-Valley Metropolitan District
Paul Clarkson presented file number 1041-026-94, Mid Valley Metro~litan
District. He stated this was a request to extend water and sewer servlce to
the Arnold Meadows development on both sides of the Eagle/Garfield County
line. Mr. Clarkson stated the proposal is for 120 EQR's. Staff originally
recommended approval with the followin$ conditions:
01) Upon approval, the Distrlct's waste water treatment facility
will be at 88%'. The State requires that expansion plans should be submitted
at 85%'. Those plans are very vague and uncertain. Additionally, it appears
the District is nearly three (3) million dollars in debt. It is not clear

what the impact of the new development will have on that debt and it is not
apparent just what the District intends to do to eliminate that debt. As the
District approaches capacity, it should be expected the indebtedness is
approaching retirement. This does not appear to be the case. A copy of the
financial audit has been referred to the County Finance Department for
comment.
02) The Tap/Purchase agreement is not reservin$ water capacity to
the new development. This would seem to mean that capaclty can be
transferred to another development within the District. Except to the extent
that Arnold Meadows owns 36 prepaid taps, the District does not guarantee
that an adequate number of EQR's of water service will be available on
demand. This leaves 84 EQR's of water service that is being specifically not
guaranteed to Arnold Meadows.
03) The District's Engineer reports the waste water treatment
facility is currently at 99%' of capacity based upon EQR's but 66%' actual
demand. It would be very helpful to know how capacity should be determined.
04) The District's Engineer also questions the District's ability
to get State site approval for a third treatment lagoon due to the close
proximity to the Arnold Meadows residential development. One may be able to
conclude that approval of Arnold Meadows will preclude the Distrlct's ability
to expand their waste water treatment facility.
05) There are numerous inconsistencles concerning total EQR's and
capacities throughout the application. Whatever the actual numbers are,
however, they appear to be pointing towards the capacity ceiling or beyond
it.
Mr. Clarkson informed the Board Staff is recommending this file be
tabled until all outstanding issues can be resolved.
Steve Isom, Isom & Associates, stated there is only one discrepancy, the
difference between 350 gallons per household per day, versus the amount going
into the sewer plant, which is only 2/3rds of that amount.
Lee Leavenworth asked the testimony presented during the Resolution
discussion be made a part of the record for this application. He stated the
District is approaching retirement of the debt. He stated taps are available
on a first come first serve basis.
Discussion followed on pre-payment of taps and capacity of the plant.
Commissioner Gates moved to table file number 1041-026-94, Mid-Valley
~etropolitan District until August 16, 1994, to settle all outstanding
lssues.
Chairman Phillips seconded the motion. Of the two voting Commissioners
the vote was declared unanimous.
PD-141-94-A, Homestead POD, Filing #1
Sid Fox presented file number PD-141-94-A, Homestead PUD, Filing #1. He
discussed access to the property. Mr. Fox stated in 1985 the Homeowners
Association, Developer and Eagle County determined the proposed drive from
Creamery Trail was not feasible due to steep grades. Culverts were installed
along Homestead Drive. He stated in 1991, Lot 19 received a building permit
with access onto Homestead Drive, however the PUD Guide was not amended. He
related Staff is concerned about setting a precedent by approving this
request.
Staff recommended approval with the following conditions:
01) The PUD Guide must be amended as follows:
a) Section 12, driveways, add at the end, after the Homestead,
Filing No.1, the following, with the following exception:
Lots 17 and 18, Block 7, Filing 1, may share a common driveway
onto Homestead Drive.
Lots 19 and 20, Block 7, Filing 1, may share a common driveway
onto Homestead Drive.
02) Each lot owner must provide a driveway turn around to prevent
backing onto Homestead Drive. The desi$D for the turn around must be
submitted with the building permit appllcation and approved by County
Engineer.
Jeannie Huff, representing the Homeowners Association, presented letters
to the Board regarding the proposal. She read a letter for the record.
Phil Scott, Engineering Technician, stated it is difficult to place a
driveway on a steep grade. He spoke of another lot with steep grades taking
access from Creamery Trail.

PUD, Filing 1, incorparating Staff findings and recommendations.

PD-322-94-A, Mid-Valley Business Center
Paul Clarkson presented file number PD-322-94-A, Mid Valley Business
Center. He stated this is a request to amend the PUD Control Document for
the commercial/industrial Mid Valley Business Center to include a
health/fitness facility as a use by right. Mr. Clarkson stated the proposal
will be entirely an indoor center. He stated the only concern is the hours
of operation, noise effecting the adjacent property. The applicant has
agreed to plant evergreen trees on the adjacent property, in order to screen
the residence from car headlights leaving the premises.
Staff and the Planning Commission recommended approval.
commissioner Gates moved to approve file number PD-322-94-A, Mid-Valley
Business Center, incorparating Staff findings and recommendations. The
letter of agreement between the applicant and adjacent property owner shall
be incorparated in the approval.

Plat & Resolution Signing
Patti Haefeli, Planner, presented final plat SM-914-94, Berry Creek
Subdivision, Lot 14 Block 4, Filing. 2. She stated this is a Minor Type B
plat, resubdivision of the aforementioned lot.

recommendations.

SU-325-94-S, Palmer Subdivision
Paul Clarkson presented file number SU-325-94-S, Palmer Subdivision. He
stated this as a request to create four ten acre lots for residential
development. Mr. Clarkson discussed access, surronnding zoning, wildlife
mitigation, water and reviewed plans for the project. Mr. Clarkson reviewed
the Eagle Connty Master Plan, Wolcott Commmity Plan and Wolcott Master Plan.
He read Connty Engineer'S concerns as follows:
01) Difficult access to all lots. will need detailed designs on
each access. May require !?lat note about steep grades.
02) Public vs prlvate roads.
03) Buried power lines.
04) Need for contract fire protection service and on-site
improvements.
05) Possible impacts to the structural capacity of Bellyache Ridge
Road. Off-site road impact fees.
06) No garbage trucks on Bellyache Rid;Je Road.
07) Draw down and recovery time for eXlsting wells.
08) Bore holes should be located on a map.
09) The leach field test holes are not on this site.
10) CUl-de-sac details are required in future submittals.
Staff recommended ap!?roval with the following conditions:
01) Adeguate eVldence of a water supply that is sufficient in terms
of quality, quantlty and de!?endability will be available. An analysis of the
cumulative impacts on existlng and potential future users. Ade~ate evidence
that the existing physical sup!?ly as well as the legal rights wlll not be
harmed. Conformance with Sectlon 30-28-133 (3) (d) and 30-26-136, C.R.S. 1973
and Section 2.18.01 (4) (m) (1) of the Eagle Connty Land Use Regulations.
Approval from the Water Court regarding the appllcation for water rights and
approval of augmentation plan.
02) Adeguate evidence that ISDS is or can be made suitable for each

specifically designed for each lot.
03) An adequate fire mitigation plan, both in home and wildfire.
04) Adequate restriction details concerning but not necessarily
limited to bear proof trash containers, dog and fence restrictions, building
envelopes and livestock. A rapture survey should be performed and it is
requested the a!?plicant partake in the wildlife miti;Jation trust fnnd as part
of a wildlife mtigation plan. This plan should be lncorparated into the
covenants.
05) School land dedication fees based upon the relevant Precinct at
final plat.
06) Appropriate off-site road impacts at final plat.
07) Connty Engineer concerns as outlined in a memo dated July 14,
1994 from Engineering to Planning.
Rick Plyman, Jamar & Associates, pointed out on a plat the location of
the property and location of the proposed access. He stated the ridgeline
will be the wildlife movement corridor. Mr. Plyman stated the applicant
agrees with all Staff's conditions.
Commissioner Gates asked about fire mitigation and if the applicant
would have a tanker truck on site and questioned the wildlife mitigation
trust fnnd.
Chairman Phillips stated water is a major concern.
Heide Jouflas, area resident, objected to the wildlife trust fnnd. She
stated she believes everyone should participate in the fnnd not just the new
development.
Paul Clarkson stated the wildlife mitigation fnnd is on a volnntary
basis only. He informed the Board the Wolcott Springs Road may in fact
become a gated commmity.
Mary Jo Berenato stated there has been no discussion as to whether or
not the Board will allow a gated access or not.

Subdivision, incorporating Staff flndin;Js and recommendations.

SU-316-94-P, Travis Creek Subdivision
Paul Clarkson presented file number Su-316-94-P, Travis Creek
Subdivision. He stated this was a request to create 16 single family lots on
163 acres in the Agricultural Residential Zone District four miles South of
Wolcott. He discussed Staff's concerns of the ISDS, wildlife, fire
protection, water, road, driveways, drainage & erosion control, subdivision
and off-site improvements and school land dedication fees.
Staff recommended approval with the following conditions:
01) Plat lan;JUage acceptable to Environmental Health Division
concerning non-conventlonal sewage disposal systems designed by a Registered
Professional Engineer. To assist the non-conventional sewage disposal
systems and reduce potential off-site impacts and low flow faucets,
showerheads and toilets shall be included in the covenants.
02) Conformance with the Travis Creek Subdivision, Filing 2,
Wildlife Mitigation Plan, dated July 11, 1994. The plan shall be signed by
both the develo!?er and the Colorado Division of wildlife. This mitigation
plan should be lncorparated into the subdivisions covenants. The one time
payment of $750.00 per residential nnit into the Bellyache Ridge Wildlife
Trust Fillld should be made at the time of Final Plat.
03) Plat note language concerning defensible space, individual
water storage and sprinkler system requirements. A fire protection service
contract shall be entered into with the Avon Fire Department.
04) Any gating of the subdivision intended to restrict access shall
be designed so that emergency ingress/egress can be easily facilitated.
05) Adequate demonstration of a fully approved plan for
augmentation and adjudication of the water supply by the Water Court for all
sixteen wells.
Ray Merry, Environmental Health Officer, stated it was his professional
opinion there will be places for individual sewage disposal sites on each
lot. He stated the blanket easement gives the flexibility to have alternate
combined sites if necessary.
Staff and the applicant discussed each concern and issue pertaining to
this project.
