HomeMy WebLinkAboutMinutes 07/27/94 BOARD OF COUNTY COMMISSIONERS EAGLE, COLORADO RECORD OF PROCEEDINGS FORM 50 HOECKEI.:S 387869 PUBLIC HEARING JULY 27, 1994 Present: Johrmette Phillips James Johnson, Jr. George "Bud" Gates Jim Fritze Earlene Roach Chai:rman Commissioner Commissioner County Attorney Deputy Clerk to the Board This being a scheduled Public Hearing the following items were presented to the Board of County commissioners for their consideration: SM-820-92, Delia Subdivision Paul Clarkson, Planner, stated the morning was spent on a site visit to Delia Subdivision to discuss access to three lots from Bellyache Ridge Road. He stated Staff still recommend the lots not be accessed off the collector road, when a secondary road is available. Mr. Clarkson stated there are remaining areas of concern as discussed in a previous hearing. Rich Delia, applicant, explained he was not partial to a gated community and explained his proposals for access. Chairman Phillips asked if the applicant was only looking at one access which will come off the secondary road. Mr. Delia stated that was correct. Mr. Clarkson stated if the applicant secure's access with Mr. Anderson that would meet the County requirements. Jim Fritze, County Attorney, stated before the applicant can sell lots there has to be a final plat filed. B.B. Anderson, adjacent property owner, discussed Mr. Delia and himself coming to an agreement on a road through the Anderson property to access Mr. Delia's three lots. Staff recommended approval with the followin$ conditions: 01) School cash in lieu of land dedicatlon fee of $2,150.00 02) Reduce building envelope size to 25%' of the lot size and cluster. Adjust the building envelope on lot 3 to eliminate the impact to the rapture nest 03) The execution of a fire protection service contract 04) Resolution of the point of access issue and subsequent resolution of the addressing and SIA issues 05) Off-site road impact fee of $3,600.00 06) The wildlife Mitigation Trust Fund for the Bellyache Area should be established and appropriately funded prior to Final Plat 07) The technical plat issues need to be resolved prior to signature by the Board. Bill Heicher, Division of Wildlife, stated the fund has not been established but will not take much to do. He stated the only monies that will be spent will be interest only and will be for the Bellyache Ridge area. Mr. Delia asked if the wildlife fees can be tied to building permits rather than creation of the lots. Mr. Clarkson stated Staff believes the fees should be submitted at final plat as there would be administrative problems if handled at building permit. Discussion followed on a wildlife Mitigation Plan. Doug Maxfield, Bellyache Ridge Homeowner, expressed concerns of the 1 water sup~ly, fire protection and wildlife. COrrmlssioner Gates suggested purchasing a fire truck with a tanker to keep on site. Discussion continued on the proposed subdivision. The Board concurred they conceptually agree with the plans presented today. commissioner Gates moved to table file number SM-820-92, Delia Subdivision to a time uncertain. Chai:rrnan Phillips seconded the motion. Of the two voting Commissioners the vote was declared unanimous. Commissioner Johnson was not present at this time. Attest: . ~ 2
