This being a scheduled Public Hearing the following items were presented
to the Board of County Commissioners for their consideration:
ZS-337-93, Eagle Sheriff's Department
Ellie Caryl, Planner, presented file number ZS-337-93, Eagle Sheriff's
Department Firearms/Training Facility. She stated the facility is located
approximately 2.5 miles North of I-70 on Highway 131. She stated the
application 1S for firearms training. There will be one modular structure to
be used for meeting, shelter and storage. Ms. Caryl stated there will be a
repelling tower and an additional building for lumber and tires. She stated
there will be a rifle ran~e, pistol range and sub-machine gun range,
separated by berms. She 1nformed the Board current vegetation will be left
on site. She discussed drainage and access.
A.J. Johnson, Eagle County Sheriff, stated the current range at Gypsum
no longer fits the Sheriff's Office needs. He discussed the plans for the
proposed firing range. He stated the firing range will be operated from
monies from confiscated funds.
Commissioner Phillips moved to approve file number ZS-337-93, Eagle
Sheriff's Department Firearms/Training Facility. Staff findings and
recommendations shall be included in the motion.
commissioner Johnson seconded the motion. The vote was declared
unanimous.
SE-290-92, Brgoch Ex~tian
Keith Montag, Director Community Development, presented file number SE-
290-92, Brgoch Exemption. He stated this was an application for exemption
located approximately 9 1/2 miles up Brush Creek Road, South of Eagle. He
stated the applicant proposes to legalize a 3.8 acre parcel. Mr. Montag
informed the Board the parcel was created prior to August 22, 1984, which
qualifies this piece of land for the exemption process. He stated there is
an existing well and septic system on site along with an existing residence.
Mr. Montag related the property is currently zoned resource and is for
residential ~urposes.
Staff f1nds that adequate access, water and sewer have been demonstrated
and recommend the Board approve the application.
Commissioner Johnson moved to a~prove file number SE-290-92, Brgoch
Exemption, including Staff findings 1n the motion.
Conmissioner Phillips seconded the motion. The vote was declared
unanimous.
PD-293-93-AF2, Lot 13, Cordillera
sid Fox, Planning Manager, ~resented file number PD-293-93-AF2, Lot 13,
Cordillera. He stated this appl1cation proposes to amend the building
envelope to provide better views and access. Staff finds the following:
a) The proposed amendment does not adversely affect adjacent property
owners.
b) The proposed amendment is not inconsistent with the intent of the
Final Plat.

c) The proposed amendment conforms to the Final Plat requirements and
conforms with other applicable regulations, policies and guidelines.
d) An iIT1I?rovements agreement is not applicable.
e) This 1S not an alteration of a restrictable plat note.
Staff recommended approval of this application.
conmissioner Johnson moved to approve file number PD-293-93-AF, Lot 13
Cordillera, includin~ Staff findings in the motion.
Corrrnissioner Ph1llips seconded the motion. The vote was declared
unanimous.
PD-139-93-A3, Arrowhead at Vail
Sid Fox presented file number PD-139-93-A3, Arrowhead at Vail, PUD
Amendment. He stated this was an application for transfer of density from
the core area into Bachelor Gulch. He explained the proposal to the Board.
Mr. Fox read Staff's major concerns and issues as follows:
a) Access, agreement with adjacent property owner and revised access
road alignment.
b) Geol~, additional study and recommended conditions.
c) Wildl1fe impacts, memorandum of agreement with the Division of
wildlife.
d) Visual impacts, Staff identified visual impacts as a concern early in
the review process. Subsequently, the applicant performed a visual
assessment and the plan, POD Guide and Design Guidelines have been modified
to minimize adverse visual impacts.
e) Affordable housing, the applicant has proposed an affordable housing
plan that will provide diversified types of housing assistance for 20~ of the
employees. The proposal provides a formula for projecting employment based
on land use. The employee housing requirements will be triggered as new
construction that is job inducing occurs. Required units must be available
~rior to the issuance of a temporary certificate of occupancy for the job
1nducing construction. The first 34 units of affordable housing required to
be developed by Arrowhead at Vail are offset by credits obtained through
participation 1n the Lake Creek Apartment Development. The affordable
housing proposal will be administered through the POD Guide.
f) Development area "J" formal adoption of the site planning and zoning
agreed to by Staff and applicant by readoption of the POD Guide and execution
of a Subdiv1sion of Construction Improvements Agreement, in conjunction with
the first Final Plat submittal for land within Development Area M, or within
two years from Preliminary Plan approval.
Mr. Fox discussed the Master Plan review.
Michael Sheldon, Attorney representing the applicant, appeared and
introduced James Thompson, president, Dave Klinger, planner and Chris Karis,
planner. He explained the application to the Board.
Dave Klinger spoke of slope analysis, geological analysis, wet land
studies, soil studies, revegetation, dependable land map, Master Plan and
access. He stated 90~ of the units will be ski in/ski out, 90~ will be
clustered and 80~ will be in the trees.
Rick Rosen, legal council for Beaver Creek Homeowners Association, read
a letter for the record from Ted ReYnolds, president, indicating they have no
objections to the proposal. He stated Arrowhead at Vail has gone above and
beyond to work with the homeowners in the area.
Chairman Gates stated the letter from Ted ReYnolds shall be admitted
into the record.
Conmissioner Johnson questioned the location of the property owned by
Mr. Shoton.
Mr. Sheldon described the location of the ~roperty.
Staff recommended approval with the follow1ng conditions:
1) The geologic stability within Development AreaM, shall be
further evaluated by the applicants geologic consultant and submitted to
Eagle County for review by the Colorado Geologic Survey. Prior to approval
of a Final Plat within Development Area M, the geologic analysis must
demonstrate the followin~:
a) The maJority of the mass of the old landslide has been
eroded away.
b) The existing natural drainage system is at or near the
elevation of the old failure plans and is effectively draining the residual

landslide deposits.
c) Presentation of an engineered grading and drainage plan
sufficient to handle the anticipated incident precipitation, and transport it
off of and away from the residual landslide deposits.
d) Slope stability analysis and factor of safety calculations
based upon the above conditions showing this area to be acceptably stable and
suitable for the proposed development.
If the geologic stability analysis is not satisfactory to Eagle County,
a preliminary Plan revision for Development Area M will be required in
accordance w1th the Preliminary Plan/POD Amendment review process.
2) Prior to the first final plat submittal for the Bachelor Gulch
Development Area, the applicant shall demonstrate deeded legal access via
Prater Road. Any alternate access proposed shall be reviewed through the
Preliminary Plan/POD Amendment review process.
3) Arrowhead shall construct a 10 foot wide paved trail through
their property, North of and parallel to Highway 6. There shall be an
associated spur trail constructed on Development Area J, which is in
substantial conformance with Exhibit B. The exact location and extent is
subject to further approval by the County prior to submittal of a Final Plat
for Development Area M. The trail shall be constructed or collateralized as
a public improvement in conjunction with the first Final Plat submittal for
land within Development Area M, or within 2 years from this Preliminary Plan
approval.
4) Arrowhead shall submit to Eagle County as part of its first
Final Plat for Bachelor Gulch, a fully executed wildlife a~reement between
Arrowhead and the Colorado Division of Wildlife, which is 1n substantial
conformance with the memo or understanding between the parties dated
September 14, 1993. The wildlife agreement shall be recorded with the first
Final Plat within Development Area M and a plat note shall refer to the
agreement.
5) Potential streets and emergency access routes, designated as
land use tracts allowing for open space and road rights-of-way, shall be
extended to the boundary lines of the land to be subdivided unless prevented
by topography or other physical conditions.
6) For a period of time, a potential lift corridor shall be
identified in Bachelor Gulch for a potential lift connection with Avon and
the Beaver Creek Ski Area, said corridor shall be free of any development
which would interfere with the potential lift connection. Arrowhead shall
not be obligated to provide any easement, dedication, reservation or other
grant of a lift corridor or lift connection except by mutual agreement with
Beaver Creek. The requirement of the identification of the potential lift
corridor shall expire at such time as the owner of Beaver Creek has requested
a replatting of resubdivision of any of it's ~roperty to the South of
Bachelor Gulch, such replatting or resubdivis10n has been a~proved and the
owner of Beaver Creek has not been required to identify a 11ft corridor for
the ~tential lift connection which is similar to and compatible with that
requ1red of Arrowhead.
7) The water and sewer line alignment will be further reviewed at
Final Plat and shall be located to avoid, to. the extent practical, sensitive
environmental areas, such as, wetlands, riparian corridors and critical
wildlife areas.
8) The water tank shall be as unobtrusive as possible. The tank
shall be constructed of neutral colors and must be landscaped or buried.
Compliance with this condition shall be illustrated as part of the building
permit application for the water tank.
9) Construction staging areas shall be designed to contain all
incidental or accidental fuel and lubricant spills.
10) An erosion control and revegetation plan for Bachelor Gulch,
including the access road through the Beaver Creek POD shall be submitted
prior to construction or with the initial Final Plat application, which ever
comes first and collateralized as a public improvement.
11) The final ~ublic improvement drawings shall show difficult
individual lot access dr1veways that do not comply with Eagle County
standards for residential driveways. Difficult individual lot access

driveways shall be further evaluated at Final Plat and may need to be
designed and constructed by the developer/applicant.
12) Arrowhead shall submit evidence, as part of its first Final
Plat application for Bachelor Gulch, that the developer/applicant has
obtained a Section 404 Permit for impacts to wetlands, if required.
13) The applicant shall submit an Entrance Road Mitigation Plan,
with the first final ~lat for Development Area M. The purpose of the
Entrance Road Mitigat10n Plan is to mitigate visual impacts and minimize
adverse i~acts on property owners within Tract L, First Amendment, Beaver
Creek Subd1vision, Second Filing. Said Entrance Road Mitigation Plan shall
be included with the public improvement drawings and collateralized as a
public improvement.
Jim Fritze, County Attorney, questioned the land use. He asked if it
was not open space where the lots were moved.
Dave Klinger stated the lots will be open space as they are open
hillside.
Mr. Fritze questioned the condition with regard to legal access.
Sid Fox stated normal refinement will occur between now and final plat.
Conmissioner Johnson stated if there were changes to the access it would
be delt with before final plat. He questioned access from the golf course.
Mr. Sheldon stated that issue has not been addressed.
Commissioner Phillips moved to approve file number PD-139-93-A3,
Arrowhead at Vail, POD Amendment. Incorporated in the motion are Staff's
findings and conditions one (1) through sixteen (16).
Commissioner Johnson seconded the motion. The vote was declared
unanimous.
Plat & Resolution Signing
Sid Fox presented file number SM-881-93, The Chateau, part of Lot 7, 6th
Amendment to the 5th Filing, Beaver Creek.
Conmissioner Phillips moved to approve file number SM-881-93, The
Chateau, ~art of Lot 7, 6th Amendment to the 5th Filing, Beaver Creek.
COmmlssioner Johnson seconded the motion. The vote was declared
unanimous.
sid Fox presented file number SM-883-93, Lot 16, Block 1, Eagle-Vail,
Filing #2. He stated this was a duplex split and does include the duplex
caveat.
Conmissioner Johnson moved to approve file number SM-883-93, Lot 16,
Block 1, Eagle-Vail, Filing #2, a duplex split including the duplex split
caveat.
Commissioner Phillips seconded the motion. The vote was declared
unanimous.
Sid Fox ~resented Resolution 93-126, approving file number T-018-93,
Mottillor Res1dence, a temporary housing permit.
conmissioner Phillips moved to approve Resolution 93-126, approving file
number T-018-93, Mottillor Residence.
Corrmissioner Johnson seconded the motion. The vote was declared
unanimous.
There being no further business to be brought before the Board the
meeting was adjourned until November 1, 1993.
