Commissioner Johnson requested payroll be added to the consent calendar.

Commissioner Johnson moved to approve ltems 1, 2, 4, 5, 6, 7, 8, 9, 10,
11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21 and 22 on the consent calendar.
Commissioner Phillips seconded the motion. The vote was declared
unanimous.
Jim Fritze recommended authorizing County Manager to sign the agreement
between Eagle County and Gyro Scope, subject to receipt of adequate
insurance, naming the County as other insured and by an insurance company
licensed to do business in Colorado. He stated the applicant would provlde
insurance naming the County as an insured, whereby their insurance pays first
prior to the County's insurance paying.
Commissioner Phillips moved to approve the agreement between Eagle
County and Gyro Scope Ride for entertainment at the Eagle County Fair and
Rodeo, after insurance has been checked and includes the County as
additionally insured. The County Manager shall be authorized to sign said
agreement after review and approval of insurance policy.
Commissioner Johnson seconded the motion. The vote was declared
unanimous.
Final Settlement With Francis Constructors, Inc.
Jim Fritze stated this settlement is for Eagle County Airport
improvement project number 3-08-0020-16. He informed the Board this matter
was duly advertised pursuant to State Statute. He stated two claims were
received from Rocky Mountain Air Coal Corrpany in the amount of $17, 364.32
and from Kearns Company in the amount of $2,791.53. He recommended these
amounts be retained pursuant to Statute, from any payment made to the
contractor for the statutory time period. If any action is filed in Court,
the County would then turn the claimed amount over to the Court or it will be
turned over to the contractor at the end of the Statutory time period.
Corrmissioner Johnson moved to authorize the Chairman to sign final
settlement, withholding collateral for claims received.

Findings for Consolidated Proposed Edwards Lake Creek Consolidated
Metropolitan District
Keith Montag, Director of Cormnmity Development, the County received an
a~plication for consolidation of two service districts, Edwards Metropolitan
Dlstrict and the Lake Creek Water District. He stated this proposal went to
the Planning commission on July 21, 1993 and the commission recorrmended
unanimous approval. Mr. Montag informed the Board he will be making a
presentation to the Board on August 24, 1993.
Jim Fritze presented Resolution 93-87, setting August 24, 1993 as the
hearing date for the Edwards Lake Creek Consolidated Metropolitan District.
commissioner Phillips moved to approve Resolution 93-87, authorizing the
hearin~ on August 24, 1993 to hear the evidence for the Edwards Lake Creek
Consolldated Metropolitan District.
Commissioner Johnson seconded the motion. 'TIle vote was declared
unanimous.
Abatements
Cherlyn Baker, Eagle County Assessor, presented a petition for
abatement, schedule number 0026362, Art Shack. She recorrmended this
abatement be denied as the sale of the property is out of the time frame.
She stated the unit is valued at $93,310.00.
commissioner Phillips moved to deny schedule number 0026362, Art Shack,
as recorrmended by the Assessor.
Commissioner Johnson seconded the motion. 'TIle vote was declared
unanimous.
Cherlyn Baker presented a blanket petition for abatement, schedule
numbers 0601850, 06292129, 0601850, 0601730, 0601240, 0628951, 0628952
regarding mining claims deeded to the united States of America. She stated
there was a J?Ortion of the year these claims should have been exempt.
Commissloner Johnson asked about the abatement amount.
Ms. Baker stated the amount of the abatement was $110.09.
Commissioner Johnson moved to approve the abatements schedule numbers
0601850, 0601730, 0601240, 0628951, 0628952, 062912 for a total amount of
$110.09, United States of America, for 1992.
Commissioner Phillips seconded the motion. The vote was declared
unanimous.
Audi t Acceptance
Allen Sartin, Finance Director, informed the Board this was the formal
document for the 1992 Eagle County Audit.
Bert Bondi, Bondi and Associates, stated the County is in better
financial condition at the end of 1992 than it was in 1991. He stated the
net equity and all of its funds increased by approximately 10% in 1992 and
the Statement of Revenues and Expenditures shows the County collected
approximately 1.3 million more in revenues than it spent.
Corrmissloner Phillips authorize and a~prove the 1992 Audit from Bondi
and Company. 'TIle Chairman shall be authorlzed to sign said audit.
Commissioner Johnson seconded the motion. 'TIle vote was declared
unanimous.
Open Meeting
Scott McGoodwin, area property owner, informed the Board he had
apparently missed the ~roperty tax protest period. He requested the Board
allow him the opportunlty to protest his property valuation.
Jim Fritze, County Attorney, asked if the petitioner filed an appeal but
did not file an appeal to the Assessor's decision.

Mr. McGoodwin answered he did file the protest but the valuation did not
change based on a decision of the Eagle County Assessor.
Mr. Fritze stated the Board of Equalizatlon reviews all properties in
Eagle County to assure they are equalized and stated the Board can direct the
Board of Equalization to look into this property to determine if the
valuation should be changed or left the same.
Mr. McGoodwin asked if the applicant does not receive the notice of
decision before the time period expires, how do they go to the next step ln
the process.
Jim Fritze recorrmended the Board, within their power, have the hearing
officer look into the valuation of the property.
Corrmissioner PhilliI?s moved to direct the hearing officer for the Board
of Equalization to look lnto the valuation of property, schedule number
21363, Scott McGoodwin and Tracy Cameron.
Corrmissioner Johnson seconded the motion. The vote was declared
unanimous.
