WHEREAS, on or about October 24, 2014, the County of Eagle, State of Colorado (the
"County"), accepted for filing an application (File Nos. PDS-5217, PDP-5218 and ZC-5219)
submitted by West Winds, Inc. (hereinafter "the Applicant") for approval of a Planned Unit
Development ("PUD") and zone change for the parcel designated as APN 2105-062-00-008, also
known as 32280 Highway 6, Edwards, Colorado (hereinafter"Hagedorn PUD"); and
WHEREAS, at a public hearing held on March 17, 2015, the Board of County
Commissioners of the County of Eagle, State of Colorado (the "Board") approved the proposed
Hagedorn PUD and zone change with conditions; and
WHEREAS, following approval of the Hagedorn PUD, the County accepted for filing an
application submitted by the Applicant for approval of a final plat for the Hagedorn PUD(the"Final
Plat"); and
WHEREAS, the application for Final Plat was accompanied by Subdivision and Off-Site
Improvements Agreement ("SIA"), binding the PUD to any conditions placed in the resolution
approving the Hagedorn PUD and establishing collateral for public improvements associated with
the PUD; and
WHEREAS, at a public hearing held on February 16, 2016, the Board considered the
proposed Final Plat for the Hagedorn PUD and the SIA,the statements of Eagle County Community
Development Staff, the Applicant and other interested parties. The Board voted unanimously to
approve the Final Plat and the SIA and authorized the Chair to sign on its behalf the foregoing
resolution evidencing such approval; and
NOW, THEREFORE, based on the evidence, submitted materials, testimony, exhibits,
comments of the Eagle County Community Development Department,comments of public officials,
and comments from all interested parties and the Staff Report, the Board finds as follows:
1. That proper publication and public notice was provided as required by law for the hearings
before the Board.
2. That all standards required for approval of the Final Plat for the Hagedorn PUD and the
associated SIA have been met as required by the Eagle County Land Use Regulations.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of the
County of Eagle, State of Colorado:
THAT,the Final Plat for the Hagedorn PUD described herein and in Eagle County File No.
PDF-5802,be and is hereby approved.
THAT, the Subdivision and Off-Site Improvements Agreement for the Hagedorn PUD be
and is hereby approved.
THAT,the Board directs the Department of Community Development to provide a copy of
this Resolution to the Applicant;
THAT,the Board hereby finds,determines and declares that this Resolution is necessary for
the health, safety and welfare of the citizens of Eagle County. •
ADOPTED by the Board of County Commissioners of the County of Eagle, State of
