TR., located on the southerly bank of the Eagle River, from which the SE Corner of said King Tract bears S24'55'03 "E 432.50 feet distant; thence S01'52'20 "W 312.02 feet to a Set 1.5" Aluminum Cap, on #5 Rebar, LS #38079, Located on the northerly right —of —way line of the Union Pacific Railroad; thence N61'16'20 "W 623.32 feet along the said northerly right —of —way line, to a Set 1.5" Aluminum Cap on #5 Rebar, LS # 38079, located on the northerly right —of —way line of the Union Pacific Railroad; thence leaving said right —of —way N28'18'30 "E 191.41 feet to the NW Corner of said Fleming Tract, a 10' Witness corner from true corner was set at the southerly bank of said Eagle River; thence from true corner S71'27'45W 491.52 feet, to the point of beginning. Containing 3.028 acres more or less. NOTES: 1) DATE OF SURVEY: October 12, 2015 2) STREET ADDRESS: 15433 Highway 6 (Posted) 3) Location of improvements and lot lines are based upon: the above— referenced Plat, Title Commitment provided by Land Title Guarantee Company Order No. 50042283, with an effective date of September 22, 2015, and Survey Monuments found at the time of this survey as shown hereon. 4) BASIS OF BEARINGS: Between a Found 2" Bronze Cap on 1" pipe, marked NW COR KING TRACT(Also being the NE CORNER OF THE FLEMING TRACT) and a Found 2" Bronze Cap set in concrete, marked SE COR KING TRACT, having a bearing between of S24'55'03 "E as shown hereon. 5) U.S Survey Feet was used for this Survey. 6) Notice; According to Colorado Law you must commence any legal action based upon any defect in this survey within three years after you first discover such defect, in no event, may any action based upon any defect in this survey be commenced more than ten years from the date of certification shown hereon. 7) Holding a 50' offset northerly from the Centerline of the existing Railroad Tracks, the SE and SW comer monuments found for the Fleming Tract, land within the Railroad Right of Way and are not accepted as the true corners of the Fleming Tract. The Railroad Right —of —Way Plans are not decipherable other than the Right —of —Way width of 100', 50' either side of centerline. The original FLEMING TRACT deed as shown hereon lands on the Northerly Railroad Right of Way when holding the shown Basis of Bearings. The SE AND SW corners of the said Fleming Tract where re —set with 1.5" Aluminum Caps, on #5 rebar, stamped LS #38079, on the Northerly Railroad Right —of —Way and at the original deed location which was the intent of the Original Surveyor. 8) Found 1.25" White Plastic Cap on #4 Rebar, LS #4551, laying on the ground at the approximate NW Deed Corner location. Re —set with a 1.5" Aluminum Cap on #5 Rebar, LS #38079, being a 10' Witness Corner. CERTIFICATION: I, Randall P.
