SUS -00006 WHEREAS, on or about October 19, 1999, the County of Eagle, State of Colorado, accepted for filing an application submitted by.Peter Fodor and Barbara Lowe (hereinafter "Applicant ") for approval of the Subdivision Sketch Plan for Castle Ridge, Eagle County File No. SUS - 00006; and, WHEREAS, the Applicant requested the approval of a Subdivision Sketch Plan which would allow for the development four residential lots ranging from 2.56 to 2.89 acres each, and two open space tracts on 18.22 acres; and, WHEREAS, notice of the Sketch Plan was given to all proper agencies and departments as required by the Eagle County Land Use Regulations, Section 5- 210.E., Notice of Public Hearings; and, WHEREAS, at its public hearing/hearings held December 2, 1999, the Roaring Fork Valley Regional Planning Commission, based upon its findings, recommended denial of the proposed Subdivision Sketch Plan; and WHEREAS, at its regular hearings of December 13, 1999, and January 18, 2000, the Eagle County Board of Commissioners (hereinafter "Board "), considered the Subdivision Sketch Plan, associated plans, and the statements and concerns of the Applicant, the Eagle County Community Development and Engineering staff, and other interested persons. Page 1 of 4 C - 1 C BASED ON THE EVIDENCE BEFORE IT, and with the modifications imposed by the conditions hereinafter described, THE BOARD FINDS AS FOLLOWS: 1. Consistency with the Master Plan The proposed subdivision IS consistent with the Eagle County Master Plan and the FLUM of the Master Plan; 2.. Consistent with Land Use Regulations The proposed subdivision DOES comply with all of the standards of this Section and all other provisions of these Land Use Regulations, including, but not limited to, the applicable standards of Article 3, Zone Districts and Article 4, Site Development Standards 3. Spatial Pattern Shall Be E cient The proposed subdivision IS located and designed to avoid creating spatial patterns that cause inefficiencies in the delivery of public services, or require duplication or premature extension of public facilities, or result in a "leapfrog" pattern of development. Specifically: (a) Utility and Road Extensions Proposed utility extensions ARE consistent with the utility's service plan or shall require prior County approval of an amendment to the service plan. Proposed road extensions ARE consistent with the Eagle County Road Capital Improvements Plan (b) Serve Ultimate Population The required finding that utility lines ARE or ARE NOT sized to serve the planned ultimate population of the service area to avoid future land disruption to upgrade under -sized lines IS NOT APPLICABLE. (c) Coordinate Utility Extensions The entire range of necessary facilities CAN be provided, rather than incrementally extending a single service into an otherwise un- served area. 4. Suitability, for Development The property proposed to be subdivided IS suitable for development, considering its topography,, environmental resources and natural or man- made hazards that may affect the potential development of the property, and existing and probable future public improvements to the area. 5. Compatible With Surrounding Use The proposed subdivision IS compatible with the character of existing land uses in the area and WILL NOT adversely affect the future development of the surrounding area. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMIVIISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the application for approval of the Subdivision Sketch Plan for Castle Ridge be and is hereby granted, subject to compliance with the following conditions: Page 2 of 4 C Road and right -of -way issues affect properties down -road of this approved development. In addressing these issues, applicant shall consult with those property owners. At the time of application for Preliminary Plan approval, the applicant shall report the results of its consultations and present solutions to the road and right -of -way problems, subject to approval by the Eagle County Engineer. The road and right -of -way problems include the following: a. The existing width of the right -of -way through Seven Castles Estates Subdivision of 40 feet vs. the Eagle County standard of 50 feet. b. The surface of the existing road through Seven Castles Estates Subdivision of gravel vs. the Eagle County standard pavement. C. The roadway width of the existing road through Seven Castles Estates Subdivision is approximately 14 feet vs. the Eagle County standard of 24 feet. d. The grade of the existing road through Seven Castles Estates Subdivision is 13 percent vs. the Eagle County standard of 8 percent with a maximum of 10 percent. e. The switchback radius on a portion of the existing road through Seven Castles Estates Subdivision is 30 feet vs. the Eagle County standard of 80 feet. 2. At the time of application for Preliminary Plan approval, the applicant shall present proposed mitigation to traffic impacts to Frying Pan Road which address the concerns of local residents. 3. At the time of application for Preliminary Plan approval, the applicant shall have answered questions regarding the central water supply and water storage to the satisfaction of Eagle County staff. 4. In consultation with the Basalt Fire Protection District, the Applicant shall propose at the time of application for Preliminary Plan approval measures to adequately mitigate wildfire hazard and provide adequate fire protection. At the time of application for Preliminary Plan approval, the applicant shall propose adequate measures to mitigate adverse impacts on wildlife. 6. At the time of application for Preliminary Plan approval, the applicant shall present proposed building envelopes which, following consultation with property owners in the area, reflect sensitivity to their concerns, and which minimize adverse impacts to wildlife and avoid adverse ridge line impacts. Page 3 of 4 C C THAT, the Sketch Plan submitted under this application and hereby approved, does not constitute a "site specific development plan" as that phrase is defined and used in C.R.S. Section 24 -68 -101, et seq. Sketch Plan approval is expressly conditioned on the County's authority to impose further restrictions or limitations on the. Subdivision which are necessitated by impacts which are not yet recognized or which are more severe than realized under the review given at the hearings on the Sketch Plan. THE BOARD further finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
