A RESOLUTION PROVIDING FOR THE ESTABLISHMENT OF THE EAGLE
COUNTY EARLY CHILDHOOD ADVISORY COUNCIL
WHEREAS, pursuant to C.R.S. §§ 29-1-101, et. seq. and 30-11-103, the Board of
County Commissioners (the "Board") is authorized to allocate, budget and appropriate county
funds for county purposes, including the funding of certain early childhood programs and
initiatives within Eagle County; and
WHEREAS, the Board desires to establish an Early Childhood Advisory Council to work
in conjunction and coordination with the Eagle County Department of Health and Human
Services to make funding recommendations to the Board for early childhood programs and
initiatives so as to ensure that children enter school healthy and ready to learn; families are able
to meet the need for quality care for their children; the community is able to retain a workforce of
families with children; and to assist in developing early childhood policies, programs and
initiatives in Eagle County; and
WHEREAS, for the purposes of ensuring sound funding decisions that will support early
childhood programs and projects in Eagle County, and for the benefit of present and future
generations, it is hereby determined appropriate and in the public interest to establish an Eagle
County Early Childhood Advisory Council.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, as set forth and described below, there is hereby established an Eagle County
Early Childhood Advisory Council.
A. Eagle County Early Childhood Advisory Council responsibilities:
The Eagle County Early Childhood Advisory Council (hereinafter referred to as the
"Council") is hereby established to recommend to the Board, early childhood policies, programs
and initiatives to be funded or otherwise supported by the County, at the Board's. discretion. The
Council shall be an advisory body to the Board. The Early Childhood Advisory Council's
responsibilities also include the following:
1. Within sixty (60) days after its appointment, the Council shall create, in
coordination with ECHHS, for the Board's approval, criteria to be used by the Council in making
recommendations related to the funding or support of potential early childhood programs,
projects or initiatives.
2. The development of specific early childhood strategic plans and the evaluation
criteria and standards and procedures for evaluating early childhood programs and initiatives, and
project funding requests as provided for in this resolution.

4. Recommendations for collaborating with federal, state and other governments,

B. A ointment of Members to the Council
l . Members shall be appointed to the Council by the Board within sixty (60) days
following the Board's adoption and approval of this resolution. The Council shall consist of a
maximum of twelve (12) members, and shall represent the interests of families with young
children living in Eagle County. At any time, sand in the absence of an appointed Chairperson, the
Board may designate an "Acting Chairperson until the Advisory Board holds elections to
designate a Chairperson.
a. Eagle County Health and Human Services (hereinafter referred to as
"ECHHS"} shall collaborate and compile a list of prospective candidates and then forward said
list to the Board. The Board shall select and appoint up to a maximum of twelve (12) members to
serve as a member on the Council.
b. The Board shall appoint no more than twelve (12) members, including the
Chairperson of each of the four (4) early childhood subcommittees, one (1) County
Commissioner or Designee, and one (1) Eagle County School District representative. The six (6)
remaining members shall represent the interests of families with young children living in Eagle
County.
2. Members shall serve staggered three-year terms. Dates in which the terms of the
members shall commence will be determined once the Board has made its appointments. When
a person is appointed to fill out the term of a departing member, that person's term shall end at

the time the departing member's term would have ended. The Board shall identify the term of
each member at the time of appointment and members maybe reappointed to successive terms.
Members shall serve at the pleasure of the Board of County Commissioners.
3. Members shall not be compensated for their services
4. Members of the Council shall be subject to state law relating to conflicts of
interest of public bodies. In addition, a member shall be prohibited from voting or making
recommendations on funding applications from or for any programs or initiatives for which a
potential conflict of interest exists. Said conflict of interest must be disclosed by the Council
member as soon as the member becomes aware of the potential conflict.
5. The Council shall convene eight times a year for the purpose of discussing
policies, projects, programs, funding to further the mission of the Council, educating members on
early childhood issues and initiatives, reviewing requests for funds, and in preparation of making
recommendations to the Board of concerning expenditures from early childhood-designated
funds and for performing its other functions under this resolution. The Board shall determine the
time schedule for submission of the written recommendations by the Council.
6. The Council shall comply with all requirements of the Open Public Meetings Act
(C.R.S. § 24-6-401 et seq.,) applicable to local public bodies as defined in that Act, as well as
any applicable resolutions of the Board.
7. Recommendations to the Board from the Council shall be in an advisory capacity
only and no such recommendation shall have any binding effect on any future Board decision.
8. All members appointed to the Council shall attend all committee meetings, unless
excused by the Council Chairperson. Unexcused absences from two or more meetings during a
calendar year may result in termination of the member's service on the Council.
C. Early Childhood Advisory Council Organization:
1. The Council shall elect a chairperson, vice chairperson and such other officers as
it may determine appropriate at the Council's first regular meeting of the year. The Council may
also establish sub-committees to assist the Counsel in performing its authorized duties and
responsibilities. Officers may serve not more than two consecutive one-year terms in the same
office.
2. The ECHHS Department shall provide administrative support and management
oversight to support the work of the Council.Administrative support will be provided by an Early
Childhood coordinator and management oversight will be provided by a Director or Manager
from the ECHHS Department at ECHHS discretion.
3. The Council shall keep minutes of all meetings that shall be promptly recorded in
a book maintained by ECHHS, and such records shall be open to public inspection. The minutes
of a meeting during which an executive session authorized under C.R.S. § 24-6-402(4) is held,
shall reflect the topic of the discussion at executive session. The minutes shall be prepared by a
representative from the staff of ECHHS and presented to the Council for approval. Approved
minutes shall be maintained as public records as the Board determines appropriate.
4. The Board shall adopt the by-laws concerning the operation of the Council
meetings that are attached hereto as Exhibit "A." Once appointed, the Council may change or
amend the by-laws as it deems appropriate concerning the operation of the Council meetings as
long as such policies remain consistent with the applicable State of Colorado and Eagle County
Government requirements. No official business of the Council can be conducted without a
quorum present. A quorum of the Council shall be at least 51% of members. If a committee
member is recused from consideration of any matter due to a conflict of interest, such member
shall nonetheless be considered present for the purposes of maintaining a quorum.
D. Dissolution of the Council
1. At any time, and in the Board's sole and exclusive discretion, the Council maybe
dissolved, in which case the obligations and duties of the Council and its members shall
terminate immediately.
THEREFORE, the Board of County Commissioners finds, determines and
declares that this Resolution is necessary'for the public health, safety and welfare of the citizens
of the County of Eagle, State of Colorado.

BYLAWS
I. Name
The name of this council shall be The Early Childhood Advisory Council (hereinafter
referred to as the "Council").
II. P ose
The purpose of the Council shall be to function as an advisory board to ensure that
children enter school healthy and ready to learn; families are able to meet the need for quality
care for their children, and our community is able to retain a workforce of families with children.
Accordingly, the Council will:
a. Make recommendations to the Eagle County Board of County Commissioners
(hereinafter referred to as the "Board") pertaining to policies governing early childhood programs
and initiatives.
b. Advocate for the needs of young children and their families throughout Eagle
County, and make recommendations for education or other efforts to foster public awareness and
understanding of the early childhood.
c. Develop of specific early childhood strategic plans and the evaluation criteria
and standards and procedures for evaluating early childhood programs and initiatives, and project
funding requests as provided for in this resolution.
d: Make recommendations for collaborating with federal, state and other
governments, non-profit or private organizations or individuals or corporations on early
childhood efforts.
e. Make recommendation to assist in the process of obtaining new council
members.
III. Council Members
The Board shall appoint the members of the Council. The Board shall appoint no more
than twelve (12) members, but at least six (6) members representing various community
agencies or disciplines described below. Appointments maybe based on recommendations from
Health and Human Services directors, members of the Council and any other sources the Board
deems appropriate. The six (6) required members shall include at least one representative from
each of the following agencies or disciplines:
a. Eagle County Commissioners or designee
b. Eagle County School District
c. A chairman from each of the four early childhood council subcommittees
including:
i. Early Care and Learning
ii. Early Intervention
iii. Family Supports and Social Emotional
iv. Health and Safety

The other six (6) appointed members, if appointed, shall be a representative from any of the
following agencies or disciplines:
a. County businesses
b. Civic clubs
c. Roaring Fork School District
d. Local Child Care Resource and Referral Agency
e. Local Head Start grantees
f. Public Health
g. Developmental disabilities or mental health
h. Guardian ad Litem or Child Advocate
i. Library or Recreation districts
j. Local foundations that fund early childhood activities
k. Licensed Eagle County child care centers and homes
1. Parents of children nine years of age or younger
m. Colorado Mountain College or other institute of higher education
n. Programs serving teen parents
IV. Terms
Members of the Council shall be appointed by the Board of County Commissioners.
Members of the Council shall serve staggered three-year terms. When a person is appointed to
complete the term of a departing member, that person's term shall end at the time the departing
member's term would have ended. Council members maybe reappointed. Members shall not be
compensated for services, but maybe reimbursed for expenses actually incurred in the
performance of their duties with prior approval of the County.
V. Officers
a. Chairperson: It shall be the responsibility of the Chairperson to preside at all
Council meetings and to coordinate with the Eagle County Department of Early Childhood
Services staff ("Staff ') on agendas for all regular meetings and work sessions of the Council:
b. Vice-Chairperson: In case of the absence or disability of the Chairperson, the
Vice- Chairperson shall perform the functions of the office of the Chairperson.
c. Other Officers: The committee may elect other officers as it determines
appropriate.
VI. Executive Committee
The Executive Committee shall be composed of the officers of the Council and members
of the Council as appointed by the Chairperson.
VII. Meetings
a. All Council meetings shall be open to the public and shall be conducted in
accordance with approved procedures and review processes.

b. All Council members shall attend all Council meetings, unless excused by the
Council Chairperson. Notwithstanding, an unexcused absence from three or more meetings
during a calendar year may result in termination of the member's service on the Council.
c. The regular meeting schedule shall be determined by the Council.
d. The minutes shall be prepared by a representative from the staff.
e. Special meetings maybe called by the Chairperson, a Health and Human
Services Director, by majority vote of the Board or by three Council members acting jointly with
a minimum of 24 hours notice to the Chairperson of the Council, and to Staff.
VIII. Votinu
a. No official business of the Council can be conducted without a quorum present.
A quorum of the Council shall be at least 51 % of voting members.
b. Each Council member shall be entitled to a vote. Formal proxy vote shall be
allowed.
c. Voting shall be either by voice, roll call vote, or other methods at the discretion
of the Chairperson. A roll call vote shall be conducted upon the request of a member of the
Council or at the discretion of the Chairperson.
d. All actions shall require a simple majority vote of the quorum. In the event of a
tie vote, the motion being voted on shall be deemed to have failed. The decision will be passed
on to the Board with a recommendation for denial.
IX. Conflict of Interest
a. As a matter of policy, the Council members shall strive to promote public
confidence in the Council by assuring the citizens of Eagle County of the impartibility and
integrity of the Council members. As such, all Council members will ensure that their actions
present neither a conflict of interest nor the appearance of impropriety or'of a conflict with the
public trust.
b. No committee member shall vote or otherwise participate in a decision making
process which affects any entity in which he/she has a financial interest. In the event of such a
conflict, or if for any other reason, the Council member believes a conflict of interest or the
appearance of impropriety or of a conflict with the public trust exists, the Council member shall
immediately disclose the interest to the Chairperson of the Council and immediately disqualify
himself or herself from making any decisions involving such business transactions or other
relationships.
X. Committee Recommendations
The Council shall be an advisory body to the Board. The Council shall review and make
recommendations to the Board, for the Board's adoption.
XI. Procedures

a. The Council shall conduct its business according to the agenda prepared by the
Chairperson and staff for each meeting. The agenda may be revised or amended at any time by
majority vote of the voting members present at the council meeting.
b. At any Council meeting, a presentation maybe made by an agency, or a party or
party's representative regarding a request for funds, so long as that agency or party has been
listed on the agenda in advance of the Council meeting.
c. The Council may consider and discuss the recommendations of staff prior to
taking any action on a proposal.
XII. General Policies
Nothing contained in these Bylaws shall limit the ultimate discretion and authority of the
Board on any early childhood matter and the Board may within its discretion waive any policy
and/or procedure contained herein.
XIII. Notice
Notice of regular and special meetings of the Council shall be posted on the Board of
County Commissioners Bulletin Board at least 24 hours in advance and follow all requirements of
the Open Public Meetings Act (C.R.S. § 24-6-401 et seq.,). Council members will be notified of
special meetings by email and/or telephone at least 24 hours in advance of the meeting.
XIV. Governin Rules
The rules contained in Robert's Rules of Order, newly revised, shall govern the Council
in all matters to which they are applicable and to which they are not inconsistent with these
bylaws, resolution and any special rules that the Council may recommend for adoption by the
Board.
