COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 2010 - ~
RESOLUTION VACATING AMENDED FINAL PLAT FOR FOX RUN MEADOWS
PUD, LOT 22, AT REQUEST AND WITH CONSENT OF CURRENT OWNER OF
SUCH PLAT SO AS TO RETURN SUCH LOT 22 TO ITS STATE IMMEDIATELY
PRIOR TO RECORDING OF SUCH AMENllED FINAL PLAT
WHEREAS, Zions First National Bank is the current owner of Fox Run Meadows PUD,
LOT 22; and
WHEREAS, such current owner has requested and consented to vacation of the
Amended Plat for such LOT 22, as recorded on October 28, 2008, as Reception No. 200823100,
so as to return such Lot to its status under the original Plat for such PUD, as recorded in the
public records of Eagle County as Reception no. 646687; and
WHEREAS, the Board of County Commissioners is willing to vacate such Amended
Final Plat.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Amended Final Plat for Fox Run Meadows PUD, Lot 22, is hereby vacated, and such
Lot shall be deemed returned to its status prior to recording of such Amended Final Plat, and
THAT, the Board hereby finds, determines and declares that this Resolution is necessary for the
public health, safety and welfare of the residents of the County of Eagle, State of Colorado.

REQUEST FOR AND CONSENT TO
PLAT VACATION
This REQUEST FOR AND CONSENT TO PLAT VACATION is executed by ZIONS FIRST NATIONAL
BANK, a banking subsidiary of Zions Bancorporation, aUtah corporation whose principal address is One
South Main Street, Salt Lake City, UT 84111 ("Zions Bank").
WITNESSETH:
WHEREAS, Zions Bank is the current owner of Lot 22, Fox Run Meadows PUD ("Lot 22"; also
known as 115 Fox Run Drive, Carbondale, Colorado 81623), as shown on the Final Planned Unit
Development Plan and Final Subdivision Plat recorded in the public records of Eagle County as Reception
No. 646687 and in the public records of Garfield County as Reception No. 520179 (the "Final Plat"); and
WHEREAS, Zions Bank acquired title to Lot 22 from its prior record owner, R.Kirk McDonald
("McDonald"), pursuant to Public Trustee's Foreclosure Sale No. 09-067, by Confirmation Deed dated
October 27, 2009, executed by the Eagle County Public Trustee; and
WHEREAS, on October 28, 2008, the Eagle County Board of County Commissioners ("BOCC")
approved an Amended Final Plat application for Lot 22 submitted by McDonald, which Amended Final
Plat is recorded as Reception No. 200823100 in the Office of the Eagle County Clerk and Recorder (the
"Lot 22 Amended Plat");and
WHEREAS, Zions Bank desires to vacate Lot 22 Amended Plat so as to return Lot 22 to its
condition immediately prior to recording of the Lot 22 Amended Plat; and
NOW, THEREFORE:
1. Zions Bank requests and consents to the vacation by the Eagle County board of
Commissioners of Lot 22 Amended Plat as set forth herein above.
2. Zions Bank hereby represents that the person signing this Request for and Consent to
Plat Vacation has the authority to do so on its behalf.
