HomeMy WebLinkAboutR10-032 Eagle Health Care Center Real Property Tax ExemptionCommissioner ~'~~'~ o ~- moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION N0.2010 - U~ v RESOLUTION IN SUPPORT OF THE REAL PROPERTY TAX EXEMPTION OF THE REAL PROPERTY OWNED AND OPERATED BY EAGLE HEALTH CARE CENTER, INC. WITHIN EAGLE COUNTY, COLORADO WHEREAS, Eagle Health Care Center, Inc. (hereinafter "EHCC") is a nonprofit corporation that is exempt from federal income tax as an organization described in Internal Revenue Code §501(c)(3), and is considered a hospital and is treated as a public charity under Internal Revenue Code § § 509(a)(1) and 170(b)(1)(A)(iii). WHEREAS, the members of EHCC are Vail Clinic, Inc., d/b/a Vail Valley Medical Center ("VVMC"), and Valley View Hospital ("VVH"), each of which is a Colorado nonprofit corporation that is considered a hospital and is treated as a public charity under Internal Revenue Code § § 509(a)(1) and 170(b)(1)(A)(iii); and WHEREAS, EHCC owns and operates a facility located at 377 Sylvan Lake Road, Eagle, Colorado (hereinafter the "Center"), at which VVMC and VVH provide community health care services through their respective employees; and WHEREAS, VVMC and VVH also sublease space in the Center to certain affiliated medical practices, each of which meets the requirements set forth in CRS § 39- 3-111.5 and provides medical care to patients at EHCC without regard to their ability to pay; and WHEREAS, together, the Center, VVMC's general acute care hospital located in Vail, Colorado, VVMC's regional cancer center located in Edwards, Colorado, and VVMC's community clinic located in Beaver Creek, Colorado, comprise the sole sources of institutional health care in Eagle County; and WHEREAS, as the sole sources of institutional healthcare in Eagle County, the Center and VVMC's facilities listed above (the "VVMC Facilities") comprise the health care safety-net for Eagle County, where residents in need may go for care without regard for their ability to pay; and WHEREAS, as the sole sources of institutional healthcare in Eagle County, the Center and the VVMC Facilities provide community benefits to the residents of Eagle County through programs and/or activities that offer treatment and/or promote health and healing as a response to identified community needs, including: - responding to the needs of special populations, such as minorities, older persons and other disenfranchised persons who are living in poverty, persons with chronic mental illness, persons who are medically underinsured or uninsured, and other disenfranchised persons; and - providing services or programs that would likely be discontinued - or would need to be provided by the County - if the decision were to be made on a purely financial basis; and - responding to public health needs; and WHEREAS, EHCC has filed an Application For Exemption of Property Owned and Used For Strictly Charitable or School Purposes, with the Colorado Division of Property Taxation (Application No. 08-579) (the "Application"); and WHEREAS, in support of EHCC's Application, the Colorado Division of Property Taxation has requested that EHCC provide it with a Resolution of the Board of County Commissioners of Eagle County, certifying that a need exists for the community health care services provided at EHCC's Center; and WHEREAS, the Board of County Commissioners of Eagle County has, as a matter of right, the power to oppose or support EHCC's Application; and WHEREAS, the Board of County Commissioners of Eagle County believes that the Center is a unique community resource, vital to the health and welfare of the residents of Eagle County; and WHEREAS, the Board of County Commissioners of Eagle County believes that the Center provides a substantial community benefit and thus relieves the County of an economic burden it would otherwise be forced to perform or fund. NOW, THEREFORE, BE IT RESOLVEll BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO THAT the Board of County Commissioners for Eagle County support the Application of EHCC, and the exemption of the Center from property tax to the fullest extent allowed by Colorado law, as such exemptions further the interests of the residents of Eagle County. THAT the Commissioners hereby certify that the need exists for the provision of all of the services offered by licensed physicians and other health care providers at the Center, that such services are necessary to the health and welfare of the residents of Eagle County in general, and are specifically necessary within the meaning of CRS §39-3- 111.5(1)(d). MOVED, READ AND ADOPTED by the Board of County Commissioners of the County of Eagle, State of Colorado at its regular meeting held the 23°d day of March, 2010.
