HomeMy WebLinkAboutR08-136 Land Use Regulations New Fee Schedule EAGLE COUNTY, 200826415 TEAK J 4 SIMONY • • REC: 2 02 01PM 12/16/2008 T EC' 50.00 D $ r fr - 111111 11111 III 11 rill 111111 Commissioner S L moved adoption of the following Resolution: I-j BOARD OF COUNTY COMMISSIONERS /� �COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 2008 - 1 LD IN THE MATTER OF ADOPTING A NEW FEE SCHEDULE APPLICABLE TO APPLICATIONS PURSUANT TO CHAPTER II OF THE EAGLE COUNTY LAND USE REGULATIONS, EFFECTIVE JANUARY 1, 2009 • WHEREAS, the Board of County Commissioners of Eagle, State of Colorado (hereinafter the "Board "), is authorized, pursuant to state enabling legislation including, but not limited to, C.R.S. 30 -28- 101, et seq., to plan for and regulate the use and development of land in the unincorporated territory of the County of Eagle, State of Colorado, for the purpose of promoting the health, safety, prosperity, and welfare of the present and future inhabitants of the County of Eagle; a na v enience, order, WHEREAS, pursuant thereto, and pursuant to the provisions of 30 -28 -116 and 113 of the Colorado State Statutes, the Board has adopted zoning and subdivision regulations, constituting Chapter II of the Eagle County Land Use Regulations (hereinafter "ECLURs "); and WHEREAS, pursuant to the provisions of Chapter II, Section 5 -210.B of the ECLURs the Board shall adopt a fee schedule for applications governed by the Chapter; and WHEREAS, in order to cover the increased cost of credit card process fees and other such costs, for Community Development Department customers, the Board desires to adopt a revised fee schedule for zoning and subdivision processes governed by Chapter II to become effective January 1, 2009; and WHEREAS, it is the Board's opinion that conditions require this action. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, pursuant to the authority granted by law and Chapter II, Section 5 -210.B of the Eagle County Land Use Regulations, the Board of County Commissioners herein adopts this amended, Chapter II Fee Schedule, attached hereto as Exhibit `A'. THAT, this Resolution is necessary for the public health, safety, and welfare of the County of Eagle, State of Colorado. THE FOLLOWING FEES ARE ALSO APPLICABLE: • Review fees charged by a state or federal agency (CGS/Forest Service/NWCCOG) shall be made payable to the reviewing agency based on current rates and paid at the time of application. • For any plat application, the applicant will be responsible for paying additional plat check fees that are in excess of 25% of the plat application fee. When applicable, this additional fee shall be paid upon submittal, when the flat rate is applicable. Please call (970) 328-8746 for potential amount. • A filing fee is required for the recording plats, Declarations and Covenants, Party Wall Agreements, etc. Checks should be made payable to the Eagle County Clerk & Recorder. • For all applications requiring legal descriptions fo be published in the newspaper, additional fees will be charged on a per cost basis, for publications that are in excess of $50.00. • When a Special Use Permit application accompanies a Sketch Plan or Zone Change, or 1041 Permit applications, the Special Use application fee shall be required unless waived by the Board of County Commissioners. 13. PLEASE ALSO NOTE: • Application fees shall be paid by cash or by a check made payable to the Eagle County Treasurer, and shall be submitted with the application to the Community Development Department. • Some applications require pre-application meetings prior to the acceptance of a submittal.
