UPHOLDING A FINDING OF NO SIGNIFICANT IMPACT [ FONSI]
FOR THE "MERTZ BERM"
FILE NO. FNZ -00006
WHEREAS, on August 15, 2007 during the Finding of No Significant Impact
administrative process, the Community Development Director made a FONSI for the berm on
property owned by ; and
WHEREAS, on July 28, 2008 the Board of County Commissioners (hereinafter the
"Board "), on its own initiative, called up for review the Finding of No Significant Impact; and
WHEREAS, a public hearing was held by the Board on October 28, 2008, at which time
the Board took evidence concerning the appropriateness of the FONSI.
NOW, THEREFORE, BE IT RESOLVED the Board, based on the evidence,
testimony, exhibits, and study of the FONSI request, comments of the Eagle County Department
of Community Development, comments of public officials and agencies, the recommendation of
the Community Development Director, and comments from all interested parties,
THAT, the Board upholds the Finding of No Significant Impact for the property,
described in Exhibit "A ", subject to compliance with the following conditions:
1. A detailed landscape plan that includes provision for and maintenance of regional native
species and irrigation be provided by the applicant and fully complied with thereafter.
2. A grading permit be obtained by the applicant and approved, including any collateral
and/or improvement agreements deemed necessary by the Eagle County Engineering
Department.
3. The CDOT Right of Way fence shall be returned to its original location as evidenced by
CDOT approval.
THAT the Board hereby finds, determines and declares that this Resolution is necessary for
the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners of the County
of Eagle, State of Colorado, at its regular meeting held the ~ day of _~1~, 2008.
